RE: Final Plat Application
Dear Ms. Stiles:
This is the final plat application for the Playground Subdivision. Accompanying this application
letter is the "Final Subdivision Plat Checklist". and the other required documents. This letter also
addresses the items on the checklist.
Regarding Item 1, thirty copies of the application form are attached to this letter. A copy of the
current deed showing ownership by The Playground, Incorporated is also attached (Item 2). The
final plat conforms with the approved preliminary plat, including conditions of approval (Item 3).
As required by City Ordinance, the final plat has been drafted in accordance with the provisions
outlined therein (Item 4), and with acceptable engineering and surveying practices (Item 5).
Attached is a copy of the Ada County Street Name Committee review sheet (Item 6). Regarding
Item 7, the sewer services for Lots 2 and 3 were approved and installed after the approval of the
Conditional Use Permit for the construction of the recreational vehicle park and the golf driving
range. Lot 1, the golf driving range, has no sewer service at this time. Physical connection of Lot
1 to municipal sewer must come from another source, east of the site (Item 7).
Item 8 requires thirty copies of the final plat at 1" = 300'. Those copies are attached. Thirty
copies of the final plat are also attached (Item 9). The copies contain the items on the checklist.
Also attached to this letter is the final plat application fee of $30.00 (Item 10).
As stated previously, the final plat was prepared in conformance with the approved preliminary
plat. No substantial change has occurred between the preliminary plat and the final plat. We ask
that this application before forwarded to the City Council with a positive recommendation.

days following the regular meeting of the Planning and Zoning Commission.

Mike Clarke related to me that the City of Meridian (the "City") wants to review
covenants applicable to the pending Playground subdivision.
I am enclosing with this letter a copy of a Easement Agreement and Restrictive Covenant
(collectively the "Agreement") that was negotiated between The Playground as original owner
of all lots and the purchaser the lot including the driving range. That Agreement deals with the

providing irrigation water to multiple lots. As provided in the Agreement, it is not contemplated
that use will continue indefuutely, but the Agreement provides for the use, operation and
maintenance of such facilities while joint use continues. Other than the facilities covered by the
enclosed Agreement, there are no other common facilities that I can identify. As you and I have
discussed before, this is an unusual subdivision in that it creates only three large commercial
"lots" lacking typical common features.
It is my conclusion that the enclosed matters are the only covenants that should apply to
the subdivision. If the City has standard requirements or other matters that you feel are
essential, please let me know immediately.

RESTRICTIVE COVENANT
This Restrictive Covenant is granted by Robert D. Nemec and Cynthia K. Nemec,
husband and wife ("Nemec") to The Playground, Inc., an Idaho corporation ("The
Playground") .
RECITALS
A. The Playground is the owner of that certain real property described as plat 2 and
3 of block 1 of The Playground Subdivision, as shown on the official plat thereof recorded on
at book of plats at page ("the Subdivision"). Nemec is the owner
of lot 1 of block 1 of the Subdivision.
B. Nemec desires to grant to The Playground and its successors and assigns a
Restrictive Covenant in the form set forth herein.
NOW, THEREFORE IT IS AGREED:
1. Nemec hereby agrees and covenants that lot 1 will not be used for the purpose
of (a) operating the recreational vehicle park, campground or similar facility providing overnight
or short term accommodation ("RV Park"), or (b) operating a convenience store selling a variety
of snack and convenience foods and beverages, which store is open to the general public ("a
convenience store").
2. This covenant shall continue for a period of ten (10) years, except it shall
terminate if lot 2 or lot 3 is not used for an RV Park for a period of one (1) year, and the
foregoing restriction on a convenience store shall terminate if lot 2 or lot 3 is not used for the
operation of a convenience store for a period of one (1) year.
3. This covenant shall be for the benefit of parcels 2 and 3, shall run with the land,
and shall bind Nemec, and Nemec's successors and assigns.
4. This covenant may be enforced during the term hereof by the fee owner of any
portion of lot 2 or lot 3.
5. In the event litigation is instituted to enforce the provisions of this Restrictive
Covenant, the prevailing party in such litigation shall be entitled to reasonable attorney's fees
and other court costs.

THIS EASEMENT AGREEMENT ("Agreement") is made and entered into this
day of February, 1996, by and between The Playground, Inc., an Idaho corporation
("Playground"), and Robert D. Nemec and Cynthia K. Nemec, husband and wife ("Nemec").
RECITALS
A. Playground is the owner of that certain real property described as Lot 3 ("Lot 3")
and Lot 2 ("Lot 2") of Block 1 of The Playground Subdivision, as recorded as Instrument No.
records of Ada County, Idaho (the "Subdivision"). Concurrently with the
execution of this Agreement, the Playground has conveyed that certain real property consisting
of Lot 1 of the Subdivision to Nemec. Lots 1, 2 and 3 are shown on Exhibit "A" attached
hereto and Lot 1 is described by a metes and bounds legal description attached hereto as
Schedule I, which description is intended to match and coincide with Lot 1 as shown on the
Subdivision plat. Playground, Nemec and their successors and assigns are sometimes referred
to as "Owner" .
B. Lot 1 is improved for use as and is now used as a golf driving range.
C. The golf driving range utilizes certain facilities located on Lots 2 and 3 consisting
of:
(1) A building used as a starter building (the "Starter Building")for storing
materials and supplies, for selling tickets to customers for the driving range, and for other
ancillary purposes for the driving range;
(2) Vehicular entry and parking areas shown on Exhibit "A"; and
(3) A pump, well and piping to deliver pressurized water for irrigating the
driving range on Lot 1.
D. A pylon sign located on Lot 1 and shown on Exhibit "A" advertises the business
conducted on Lots 1 and 3, and in the future may advertise the business to be conducted on Lot
2.
E. The parties desire to provide easements and agreements for continuation of each
of the facilities described above under certain terms and conditions.

AGREEMENT
NOW, THEREFORE, for valuable consideration, each party hereby creates, grants and
conveys the following easements, which easements shall be for the benefit of Lots 1, 2 and 3,
shall be permanent except as otherwise provided herein, shall run with the land, and shall bind
and benefit each of the parties hereto and their respective successors and assigns:
1. Playground hereby grants to Nemec an easement for vehicular and pedestrian
ingress and egress over and across that portion of Lot 1 now improved for use as a drive entry
way and parking lot as shown on Exhibit "A" attached hereto. Playground further grants to
Nemec an easement to use the existing Starter Building. The easements granted and obligations
undertaken in this Paragraph shall continue only for so long as Lot 1 is used as a golf driving
range. With respect to the Starter Building, such easement shall cease at such time as Nemec
is able to locate a Starter Building on Lot 1, and Nemec agrees it will use its best efforts to so
locate a Starter Building on Lot 1 within three (3) years. At the present time, the area
surrounding the drive, parking area and Starter Building is unimproved and is not used by
Playground, but the easements hereby granted with respect to the drive and parking areas are
non-exclusive and Playground may elect to use such undeveloped areas in the future and may
use the drive and parking areas in common with Nemec. Such drive and parking areas shall be
maintained by Playground unless otherwise mutually agreed by the parties, and Playground and
Nemec shall each pay fifty percent (50 %) of the cost of maintaining in good repair and condition
such drive and parking areas. For so long as Nemec makes use of the Starter Building, Nemec
shall maintain and repair the same at Nemec's sole cost and expense under certain terms and
conditions.
2. Playground hereby grants to Nemec an easement and right to use pressurized
irrigation water from the existing irrigation system. The easement granted and obligations
undertaken in this Paragraph shall continue only for so long as Lot 1 is used as a golf driving
range. Playground shall maintain and operate the irrigation system, including the well, pond,
pumps and underground and above-ground pipes located on Lots 2 and 3 so as to supply water
to I.ot 1, until Nemec elects to cease using I.ot 1 as a golf driving range. The cost of
maintaining and operating the irrigation system shall be divided between Playground and Nemec

based upon the relative quantities of water used on Lots 1, 2 and 3, which cost shall include all
costs of operating, maintaining, repairing or replacing such system and taxes on the system and
land used exclusively for such system.
3. Nemec hereby grants to Playground a permanent easement to operate, maintain
and use fifty percent (50 %) of the allowable signage area on that certain sign pylon shown on
Exhibit "A". Each Owner shall share one-half (1/2) of the cost of the existing lease for such
sign pylon, and future maintenance and repair costs. Each Owner shall have the right to use
fifty percent (50 %) of the sign area allowed on such sign pylon. In the event Nemec elects to
cease using Lot 1 as a golf driving range, then Nemec shall pay for the cost of relocating the
sign pylon to Lots 2 or 3 at a location designated by Playground, and Nemec shall, to the extent
reasonably possible, elevate the sign at Nemec's expense to the maximum elevation allowed by
appropriate governmental regulations, but no more than twenty (20) additional feet.
4. Each Owner agrees that it will in the future grant to the other party easements for
underground utilities at such locations as may reasonably be required for utility purposes. Each
Owner agrees that they will not unreasonably withhold their consent to and negotiate in good
faith to allow the relocation, adjustment or change in configuration of the easements hereby
granted so as to facilitate the development of Lots 1, 2 or 3 in the future.
5. Playground hereby grants to Nemec for the benefit of Lot 1 a permanent, non-
exclusive sewer easement over and across Lots 2 and 3 under the following terms and
conditions:
a. The easement shall be at the approximate location shown on Exhibit "A"
and which location is intended to reflect the approximate location of an existing underground
sewer line and the location of the easement leading from the termination of the existing sewer
line to the westerly boundary of Lot 1.
b. The owner of Lot 1, if it desires to utilize the easement herein granted,
shall, at its expense, extend the existing sewer line to the westerly boundary of Lot 1.
c. The owner of Lots 2 or 3 may, if it is necessary or convenient for the
development of Lots 2 or 3, relocate the sewer easement and the existing sewer line across Lots
2 or 3 to a reasonably convenient location. All costs of such relocation shall be paid by the

owner of the Lot relocating such sewer line, and such owner shall provide a survey description
of the relocated easement as it crosses such Lot or Lots. All work in connection with such
relocation shall be conducted so as to not cause an interruption in sewer service to Lot 1.
d. The sewer line may be used for one (1) user on Lot 1, one (1) user on Lot
2, and one (1) user on Lot 3, unless the approval of the City of Meridian is obtained to allow
use by more than one (1) user on either of said Lots. The Owner of each Lot shall pay for
sewer services required by the City of Meridian.
e. In the event any Owner desires to increase the size of the existing sewer
line, then the Owner requesting the increase shall provide written notice at least thirty (30) days
in advance to each Owner and may increase the sewer line at its sole cost and expense. In
increasing the size of such sewer line, the Owner performing such work shall not interrupt
service to the remaining Lots.
f. Any Owner utilizing the easement or the sewer line shall be responsible
for damage caused by such party. Any person performing work under the easement herein
granted shall repair all damage to surface improvements caused by such work. In the event
maintenance or replacement of the sewer line is required due to causes other than the fault or
neglect of any Owner utilizing such sewer line under the terms of this easement, such
maintenance or replacement costs shall be borne equally by each Owner utilizing such sewer
line.
6. The Ada County Highway District has indicated it may allow only one (1) entry
way from Overland Road onto Lots 1 and 2. At the present time, such entry way is located on
Lot 2. The parties agree that they will use their best efforts to obtain a separate and second
entry way onto Lot 1 and the Owners of Lots 2 and 3 shall not object to or attempt to restrict
or prevent the development of a new separate entry onto Lot 1. In the event an entry way
cannot be obtained into Lot 1, then the Owners agree that the existing entryway onto Lot 2 may
be relocated onto Lot 1, and the Owner of Lot 1 shall provide an easement for a suitable drive
from the entryway to a location designated by Playground on the boundary between Lots 1 and
2, which location shall be within one hundred feet (100') of Overland Road. The cost of
improving the entryway onto Lot 1 and of removing the existing entryway on Lot 2 shall be paid

by the Owner of Lot 1; the cost of extending the drive from the new entryway to Lot 2 shall be
paid by the Owner of Lot 2.
7. As used in this Agreement, maintenance costs shall include taxes reasonably
allocable to the area covered by the easement, including any taxes imposed on the area covered
by the easements hereby granted.
8. Nothing contained herein shall be deemed a gift or dedication of any portion of
Lots 1, 2 or 3 to the general public or any public purpose.
9. No breach of this Agreement shall entitle the owner of any Lot to terminate the
easements herein granted, except that an Owner who has failed to pay its respective share of the
costs of maintaining and operating easements granted herein may not utilize such easements until
such charges are paid.
10. In the event either party is required to initiate or defend litigation with respect to
the terms of this Agreement, the prevailing party in such litigation shall be entitled, in addition
to any other relief that may be granted, to reasonable attorney's fees and other costs incurred
in connection with such litigation.

Morrow: The reason for table was?
Corrie: Good question, I guess we will have the Playground people.
Hutchinson: Mr. Mayor, members of the Council, first of all, welcome to the new members
and congratulations Mr. Mayor. The issue that was for which this was tabled had to do with
the lighting and the conditions of approval. I have spoken with Dr. Clark regarding the
lighting on the driving range. Dr. Clark has been working with the neighbors that live on
the north side of the freeway in fact he visited their backyards and saw that there was a
problem with the lighting and those lights were previously adjusted to that public hearing
the lights haven't been on since about mid-October. They have been adjusted so that the
center of the cone of the light does not shine beyond the 150 yard marker so that those
have been adjusted and should no longer be a problem. Dr. Clark has also advised those

residents on that north side that if they have any problem at all to let him know and he will
certainly work with them to make sure this is not an ongoing problem with those lights. But
other than we have no problem with the other conditions.

Subdivision subject to all staff conditions and the resolution of the light problem.

Morrow: Mr. Butterfield, have you read the staff recommendations and the staff conditions
both from City Engineer Smith and City P & Z Director Stiles?
Butterfield: Yes, there were a couple of things I was concerned with. I thought we
probably better bring up. That parking lot was rebuilt in 1994 and here we are talking
about getting an engineering report and that is all said and done. So there is, but I do
have an as built of how it was built and it was put together but Rushman Sand and Gravel
and Capital Paving. We had come down for a building permit on the thing and we were
informed by somebody in the office that you don't do building permits on parking lots.
Which surprised us but we proceeded. So that is done. It hasn't been striped yet, I think
we would rather wait for some better weather. We talked a little bit about the inside
drainage for grease trap use and we have plugged off the inside floor drain so there is no
floor drain now. In lieu of using a grease trap at this point. That seemed to be acceptable
to the sewer people.

l have reviewed this submittal and offer the following comments, for your information and
consideration as conditions of the Applicant during the hearing process:
GENERAL COMMENTS
1. Any existing irrigation/drainage ditches crossing the property to be included in this project,
shall be tiled per City Ordinance I 1-9-605. M. The ditches to be piped are to be shown on
the Preliminary Plat. Plans will need to be approved by the appropriate imgation/Drainage
District, Lateral Users Association or Down Stream Users, with written confirmation of
said approval submitted to the Public Works Department. No variances have been
requested for tiling of any ditches crossing this project.
2. Any existing domestic wells and/or septic systems within this project will have to be
removed from their domestic service per City Ordinance Section 5-7-S17. Wells may be
used for non-domestic purposes such as landscape irrigation.
3. Determine the seasonal high groundwater elevation, and submit a profile of the subsurface
soil conditions, as prepared by a soil scientist, with the subdivision construction plans.
4. Submit copy of proposed restrictive covenants and/or deed restrictions for our review.
5. Provide 5 foot wide sidewalks in accordance with City Ordinance Section I 1-9-6(?6.B.
6. Water service to this development is contingent upon positive results from a hydraulic
analysis by our computer model.
7. Make any necessary mapping corrections to comply with the requirements of the Ada
County Street Name Committee prior to resubmittal to the City.

Superintendent.
9. Submit a master street drainage plan, including the method of disposal & approval from
the Ada County Highway District, and the affected irrigation/drainage district(s). The

SITE SPEC'iFI OMMENT~ PRELiMiNARY PLAT
1. Sanitary Sewer service to this site is divided between two different drainage areas. The
Hunter Lateral which traverses through Lot 3, Block 1 is more or less the dividing line.
Service for the drainage area west of the Hunter Lateral will be via existing sewer mains
installed as part of the development of the R.V. Park. Service for the drainage area east
of the Hunter Lateral will be via an extension of a future main line that is proposed as
Phase ii of the Five Mile Creek Sewer Trunk being constructed towards St. Lukes.
Subdivision designer to coordinate main sizing and routing with the Public Works
Department. Sewer manholes are to be provided to keep the sewer lines on the south and
west sides of the centerline.
2. Water service to this site will be via an extension of the existing ] 2 inch diameter main in
East Overland Rd. Applicant will be responsible to construct the water mains to and
through this proposed development. Subdivision designer to coordinate main sizing and
routing with the Public Works Department.
3. Revise the Preliminary Plat Map to show ~ adjacent land use and existing zoning of
properties surrounding the proposed development, including existing or approved proposed
streets and lots, and addressing all other comments contained herein. Resubmit the
Preliminary Plat with the revisions.
4. 10t3 watt high pressure sodium street lights will be required at locations designated by the
Meridian Public Works Department. All street lights shall be installed, at subdivider's
expense. Typical locations are at street intersections and/or fire hydrants.
5. Applicant shall provide a statement as to who the ownership, and operation and
maintenance of the pressurized irrigation system is to be with.

1. Please revise the Final Plat map to show the Nampa & Meridian Irrigation District
requested easement for the Hunter Lateral. The easement shall be 40 feet in width,
centered over the existing pipeline.

subdivision for the purpose of determining the availability of water for fire
protection. A calculated flow of 1700 GPM was recorded at the minimum mainline
residual pressure of 20 PSI. Fire flows for any proposed structures within this
development will be determined by the Meridian Fire Department during the building
plan review process.

STORMWATER MANAGEMENT RECOIVIlVIENDATIONS
We recommend that the first one half inch of stormwater be pretreated through a
grassy swale prior to discharge to the subsurface to prevent impact to groundwater
and surface water quality. The engineers and architects involved with the design
of this project should obtain current best management practices.. for stormwater
disposal and design a stormwater management system that is preventing
groundwater and surface water degradation. Manuals that could be used for

Nampa & Meridian Irrigation District's Hunter Lateral courses through the
middle of the project. The right-of-way of the Hunter Lateral is 40 feet: 20
feet from the center each way.
Nampa & Meridian Irrigation District's Cook Lateral courses along the south
boundary of the project. The right-of-way of the Cook Lateral is 30 feet: 15
feet from the center each way.
See Idaho Code 42-1208. RIGHTS-OF-WAY NOT SUBJECT TO ADVERSE POSSESSION. The
developer must contact John Anderson or Bill Henson at Nampa & Meridian
Irrigation District, 466-0663 or 345-2431, for approval before any encroachment
or change of right-of-way occurs.
Nampa & Meridian Irrigation District requires that a Land Use Change/Site
Development application be filed for review prior to final platting. Contact
Donna Moore at 343-1884 or 466-7861 for further information.
All laterals and waste ways must be protected. Municipal surface drainage
must be retained on site. If any surface drainage leaves the site, Nampa &
Meridian Irrigation District must review drainage plans. It is recommended
that irrigation water be made available to all developments with this District.
