NOTICE IS HEREBY GIVEN pursuant to the Ordinances of the City of Meridian and
the Laws of the State of Idaho, that the Planning and Zoning Commission of the City of
Meridian will hold a public hearing at the Meridian City Hall, 33 East Idaho Street,
Meridian, Idaho, at the hour of 7:30 p. m., on October 10, 1995, for the purpose of
reviewing and considering the Application of Joe & Leslie Palmer, for a Conditional Use
Permit for land located in the S. 65' of the 200' of F.A. Nourse's Third Addition, Boise
Meridian, Ada County, Idaho, and which property is generally located 1 /2 block South of
Cherry Lane on Meridian Road. The application requests a Conditional Use Permit for
before and after school center, pre-school.
Amore particular legal description of the above property is on file in the City Clerk's
office at Meridian City Hall, 33 East Idaho Street, and is available for inspection during
regular business hours.
A copy of the Application is available upon request. Any and all interested persons
shall be heard at said public hearing and the public is welcome and invited to submit
testimony.

ITEM #24: CONDITIONAL USE PERMIT REQUEST TO OPERATE A BEFORE AND
AFTER SCHOOL BY JOE AND LESLIE PALMER.
Kingsford: Do you guys want to hear a presentation?
Palmer: I think everybody knows what it is, do you have some questions.
Kingsford: This is the property on Meridian Road?
Palmer: It is adjacent to a day care that we already have. It is next door to it on Meridian
Road.
Morrow: Is that where the Cherry Vacuum used to be?
Palmer: It is still there it is behind the two in between them.
Yerrington: How many students do you have in each one of them?
Palmer: The one that is now going is licensed for 43 and it is determined by the Fire
Marshall how many we can have. I have measured it out I believe it is going to be 30 to
34 right in there, it depends on which tape measure, there are a couple jogs in the wall,
I don't know how they are going to count that but it should be about 30.
Kingsford: Mr. Smith, what is the status with regard to the hook ups on those properties?
Smith: Can you give me just a minute to check my file.
Kingsford: Any questions for Joe while he is looking?
Smith: Mr. Mayor, item #7, when my assistant Bruce Freckleton commented in October,
on October 5 stated that the assessments will be reviewed during the building plan review
process. He asked for information from Mr. Palmer concerning his anticipated water
demand. I don't know whether he received that, did he receive that? He did.
Palmer: There was some concern whether or not the drainage system that we put in will
take all the water in the parking lot. Our engineer came by and re-checked everything and
said well according to the numbers it is not but we will do a test on it. So we will have a
water truck come over and dump 3600 gallons of water in and see if it will take it.

Kingsford: I think we are talking about different things here, we are talking about domestic
water for your facility.
Palmer: Nobody has said anything to me, we haven't had any problems with it.
Kingsford: Here we are talking about hook up charges Joe for (End of Tape)
Smith: I don't know, all I know is the question was asked and I don't know if he ever
received any input from you on what you expected as far as demand goes on the water
and sewer.
Kingsford: Do you know what we are talking about here Joe?
Palmer: How much water we are going to use?
Kingsford: What you are talking about here is to pay for your portion of the water tower and
wells so that you have water when you flush and that sort of thing.
Smith: We just need to look at that Joe and make sure that your assessments are in line
with the number of children that you are going to have.
Palmer: (Inaudible) Fire Marshall decides how many kids will be there and you assess it
off of that.
Smith: Right, correct, and those assessments will be made as part of that building review
plan, the building plan review process.
Palmer: So when does that take place then?
Kingsford: Well when you tell us how many you have got I guess. Normally we have an
assessment agreement that we review for a year.
Smith: Right
Kingsford: So that if you use more water than what our code calls for during that time we
would assess you additional hook ups.
Palmer: That is fine.
Kingsford: Any other questions of the Council? Is there a motion?

ITEM #13: PUBLIC HEARING: REQUEST FOR A CONDITIONAL USE PERMIT FOR A
BEFORE AND AFTER SCHOOL CENTER BY JOE & LESLIE PALMER:
Johnson: I will open the public hearing at this time and invite the Palmer's or their
representative to come forward.
Joe Palmer, 1620 Sportsman, was sworn by the City Attorney.
Palmer: What we are proposing is a before and after school center it is next door adjacent
to a building that we now own that we have a regular day care center that has children that
are under school age. They are on two different pieces of property, we are leasing the
one that we are proposing at this time we will be leasing that property. There is only one
building on the property some of the paperwork I came back there was some comments
about other buildings that are there on the property. There is no other buildings on the
property there is only one. There in the back corner of that building there will be two
people that rent just the one comer of it for doing a dental lab, I believe that was approved
in your last meeting. Is there any questions?
Johnson: Have you been operating this at this time before this meeting?
Palmer: No, we started to when school first opened and the building inspector said we
don't have an occupancy so not to operate so we haven't since then. That was about a
month and a half ago.
Johnson: You read the comments from the Assistant to the City Engineer and no questions
on those?

Palmer: Yes I have, no questions, we will comply with anything we need to.
Johnson: Same thing with Shari Stiles our Planning and Zoning Administrator?
Palmer: Yes, there is a little problem there, same old story the landscape. She requested
some trees there and right now there is a tree that is about 3 foot diameter and we have
had landscapers come through and they say. there is no way to put two more trees
underneath that tree and have them grow. I don't know what you want us to do, we have
one tree there that is big enough to cover the whole place. As far as putting other trees
there is no place to put them. They could put them behind the building in the back, there
is a gravel lot and if that is what is desirable we will do it.
Johnson: She is siting a City ordinance is what she is doing at this point.
Palmer: I understand that and if there is anythign we can do it.
Johnson: Landscaping by definition is more than trees too.
Palmer: Yes, we will landscape, there is not a lot of space that is not going to be sidwalked
through and maybe a few feet and we will landscape that accordingly. The Ada County,
they came out and we talked to them, they had their meeting last Friday, they told us
things we need to do we will comply with that. There was some sidewalk and gutter there
that has never been put in and we will put that in weather permitting in the next few weeks.
Johnson: Any of her other comments that she has addressed here, any other situations
that she has addressed here, any other situations that are addressed that you want to
comment on or have a problem with?
Palmer: Well, she wrote down children should not be permitted to walk across driveway
without an adult, that would never (inaudible) that is not something that would ever
happen. There is no reason from them to walk across it, the parents pull up and they drop,
they come in with them and they leave with them. So there is no problem with that.
Everything else the Department of Health and Welfare has already been done or will
happen as soon as we have permission to open.
Johnson: Well I think she is being particularly sensitive to the safety of the children, we
have to, that is what we should do.
Palmer: We are doing our best to do that also.
Johnson: Are there any other questions from the Commission of the applicant?

Hepper: There is a comment from Kenny Bowers the Fire Chief that says they also need
to get in compliance with other buildings at this address.
Palmer: There is no other building at that address.
Hepper: I was wondering if there, are there some concerns of the Fire Marshall, is there
some adjacent buildings?
Palmer: At the next property over, yes there is.
Johnson: What direction would that property be, is that to the south?
Palmer: Yes, that is where our other day care center is. Behind it we have two buildings,
one is my office which is Cherry's built in vacs and one of them is a 2000 foot shop that
we had leased out and it is going to be vacant within the next day, in fact it is probably
vacant tonight. There was, we had a gentleman there that was building cabinets and we
found out that he couldn't do that so we remedied that.
Hepper: So that would probably take care of the (inaudible).
Palmer: I am sure that has got to be what he is talking about on a different peke of
property.
Hepper: But it could potentially have an impact on this peke of property.
Palmer: Yes I guess it could.
Hepper: If it caught on fire it could.
Palmer: Well, any building caught on fire in the block could.
Hepper: But if they are all under your ownership.
Palmer: It is not under my ownership. The one that we are leasing, the new one we are
leasing, the other one is my ownership. But anyway we will, it is vacant as of tonight.
Johnson: Well I think our fire department is particularly sensitive to cabinet shops right
now.
Palmer: I understand, I have noticed that situation. It made me a tittle nervous when I seen
it too. (Inaudible) they didn't have any stain or lacquer or anything all they had was a

table saw, they cut their wood and take it out in the shop and put it together.
Johnson: Wayne, do you have anything?
Crookston: No I don't
Johnson: Thank you, this is a public hearing is there anyone else that would like to
address the Commission on this application? Seeing no one then I will close the public
hearing at this time.

ITEM #14: PUBLIC HEARING: REQUEST FOR ANNEXATION AND ZONING OF 28.49
ACRES TO C-G BY BILL HOWELL:
Johnson: I will now open the public hearing is the applicant of the representative here,
would you please address the Commission at this time.
Kristina Donner, 3363 Buckboard Way, Boise, was sworn by the City Attorney.
Donner: We are requesting annexation and zoning on a peice of property that is located
on Overland Road between Eagle Road and Locust Grove. I am not sure where the best
place to put this is, so you can all see it. I don't know if you all got a copy in your packet
but I know they were pretty large drawings.
Johnson: Welt there is an easel but I don't see it.
Donner: That is okay, I will just hold it.
Johnson: You can set it in those chairs there if you want to. Set it up by the projector or
whatever.
Donner: The site is 28.49 acres and the larger portion where we show the site plan now
is 20 acres the remainder is for future and that is the remaining 8.49 acres. There will be

Re; BEFORE AND AFTER SCHOOL CHILD CARE, DAYCARE CENTER
(Request for Conditional Use Permit - by Joe & Leslie Palmer)
I have reviewed this submittal and offer the following comments, for your information and
consideration as conditions of the Applicant during the hearing process:
1. Off-street parking shall be provided in accordance with Section 11-2-414 of the City of
Meridian Zoning and Development Ordinance.
2. Mr. and Mrs. Palmer submitted plans, 10/94, to the Public Works Dept. for paving the
parking lot of their business adjacent to this proposed facility. Their plans were reviewed
and approved 10/31/94. The plans did n~.l include any parking area for the proposed
facility, nor was there extra capacity designed into the sub-surface drainage sumps for the
additional parking. The parking lot for the proposed facility was paved at the same time
that the parking lot for the adjacent parcel (1524 N. Meridian Rd.) was paved, thereby
creating a situation where no plans were submitted and/or approved for the parking lot;
nor does the existing drainage sump have adequate capacity in its design to accommodate
the extra area. As per Meridian City Ordinance a drainage plan designed by an architect
or engineer, licensed by the State of Idaho, shall be required for all off-street parking
areas. The drainage plan shall be submitted for review and approval by the City Engineer
(Ord. 557, 10-1-91). Mr. Palmer stated to me during the construction of the parking lot,
that his engineer had looked at the drainage sumps, and had given his approval. I would
request that the Public Works Dept, receive a statement, prepared and certified by an
Idaho Licensed Professional Engineer, indicating the quantity of drainage water that is
generated on the proposed facilities parcel, and that the additional quantity of drainage
water will not adversely impact the functionality of the approved drainage facility
constructed in the parking lot at 1524 N. Meridian Rd.
3. Outside lighting shall be designed and placed so as to not direct illumination on any nearby
residential areas and in accordance with City Ordinance Section 11-2-414. D. 3

4. Paving and striping shall be in accordance with the standards set forth in Sections
11-2-414. D.4 and 11-2-414. D.5 of the City of Meridian Zoning and Development
Ordinance.
5. All Signage shall be in accordance with the standards set forth in 2-415 of the City of
Meridian Zoning and Development Ordinance.
6. All construction shall conform to the requirements of the Americans with Disabilities Act.
7. Sanitary Sewer and Water to this facility would be via. existing service lines. Assessments
for sewer and water service will be reviewed during the building plan review process.
Please provide any information that you may have with regards to your anticipated water
demand.

SUBJECT: Conditional Use Permit for a Before and After School by Joe and Leslie
Palmer at 1608 N. Meridian Road
This conditional use permit is for an expansion of the Almost Home Daycare at 1524 Meridian
Road. Mary Wilson applied for a conditional use permit on the property for the Joy School of
Meridian, which was granted in 1989; however, the conditions of that permit were never met
and the use has changed at least once since that time, most recently to a residential apartment
complex. Therefore, a transfer of the CUP was not possible.
The use of the rear portion of this building was recently approved by the City Council for a
dental studio (manufacture of dentures/orthodontic appliances). Following are my
recommendations for conditions of approval of this application:
1. Five-foot (5') sidewalks shall be installed per City Ordinance. ACHD approvals for work
within the public right-of--way shall be submitted to the Meridian Public Works
Department prior to commencement of work.
2. Any existing irrigation or drainage ditches crossing the property shall be piped.
3. Landscaping shall be provided in accordance with City Ordinance. One (1) three-inch
(3") caliper tree is required for every 1,500 square feet of paving. As Meridian Road is
an entrance corridor to the City, particular attention needs to be paid to landscaping along
this corridor.
4. A Certificate of Occupancy is required prior to opening. Occupancy will be contingent
upon meeting all zoning, building code, public works and Fire Department regulations.
5. Children should not be permitted to walk across driveway without an adult in attendance.
6. Applicant to submit a copy of facility license from Idaho Department of Health &
Welfare to the City Clerk's office prior to opening. In addition, valid operators' licenses
shall be available for inspection during all operating hours by City/State personnel.

7. Commission and Council should reserve right of yearly review of this conditional use
permit.
8. Parking and striping shall be per City Ordinance. One (1) parking space per ten (10)
children plus one (1) per employee is required. Children shall not be dropped off from
Meridian Road.
9. If a special meeting is to be held by the Commission later this month, I would ask that
Findings of Fact/Conclusions of Law for this project be acted upon at that meeting,
provided legal counsel has adequate time to prepare them.

FINDINGS OF FACT AND CONCLUSIONS OF LAW
The above entitled matter having come on for public hearing
October 10, 1995, at the hour of 7:30 o'clock p.m., the Petitioner,
Joe Palmer, appearing in person, the Planning and Zoning Commission
of the City of Meridian having duly considered the evidence and the
matter makes the following Findings of Fact and Conclusions:
FINDINGS OF FACT
1. That a notice of a public hearing on the Conditional Use
Permit was published for two (2) consecutive weeks prior to the
said public hearing scheduled for October 10, 1995, the first
publication of which was fifteen (15) days prior to said hearing;
that the matter was duly considered at the October 10, 1995,
hearing; that the public was given full opportunity to express
comments and submit evidence; and that copies of all notices were
available to newspaper, radio and television stations;
2. That this property is located within the City of Meridian
and the Applicant is not the owner of the property; that the owners
ad Chuck and Vella Palmer and they have given consent for this

3. That the intention of the Applicant is to operate a
before and after school center and child care facility; that the
center/facility will be for children ages 6-10 and pre-school for
younger children; that this will be a day care facility and not
used as a residence; that the Applicants are applying for a license
from the Department of Health and Welfare.
4. That the property is currently zoned C-C Community
Business District.
5. That the CC Community Business District is described in
the Zoning Ordinance, 11-2-408 B.9. as follows:
(C-C) Community Business District• The purpose of the (C-C)
is to permit the establishment of general business uses that
are of a larger scale than a neighborhood business, and to
encourage the development of modern shopping centers with
adequate off-street parking facilities, and associated site
amenities to serve area residents and employees; to prohibit
strip commercial development and encourage the clustering of
commercial enterprises. All such districts shall have direct
access to a transportation arterial and collector and be
connected to the Municipal Water and Sewer systems of the City
of Meridian.
6. The Applicants request that a conditional use be granted
for the operation of a Day Care Center.
7. That Mr. Palmer testified that this proposed facility,
the property which he is leasing, is for a before and after school
center; that the adjacent facility, which he owns, currently runs
a regular day care center for under school age children; that one
building exists in the back or to the east of this proposed
facility, which is currently being rented and doing business as a
dental lab; that the adjacent building, which is owned by Mr.

Palmer, has two detached buildings behind it, one used for Mr.
Palmer's office for his vacuum business and a 2000 foot shop, soon
to be vacated by the tenant, a cabinet maker; that Mr. Palmer is in
agreement with the staff comments except he has a problem with any
additional trees out in the front, but could put them behind the
building in the back and would comply with the sidewalk and gutter
out front with landscaping accordingly; that the children would be
dropped off, brought in and picked up the same way, using adult
supervision.
8. The Assistant to the City Engineer, Bruce Freckleton,
submitted comments which are incorporated herein as if set forth in
full; the comments address the off-street parking requirements,
outside lighting, paving and striping, and signage shall meet all
Meridian City Ordinances; that sewer and water are available but
the use may require additional charges or fees and that all
construction shall conform to the requirements of the Americans
with Disabilities Act. That the Applicant did not submit plans for
paving the parking lot of their business at this proposed facility;
that paving for the Applicant's business adjacent to this proposed
facility was submitted and was approved on October 31, 1994; that
since a letter sent by Shari Stiles, dated, August 9, 1995, to the
Applicant's regarding their non-compliance regarding the off-street
parking requirements at the 1524 N. Meridian Road address; that the
Applicant's have since had the paving completed at the 1524 N.

proposed facility but no plans were submitted and/or approved for
the parking lot for this application; nor does the existing
drainage sump at the adjacent facility, at 1524 N. Meridian Road,
have adequate capacity in its design to accommodate the extra area;
that as per City Ordinance, a drainage plan designed by an
architect or engineer, licensed by the State of Idaho, shall be
required for all off-street parking areas. The drainage plan shall
be submitted for review and approval by the City Engineer.
That Mr. Palmer stated to Mr. Freckleton during the
construction of the parking lot, that his engineer had looked at
the drainage sumps, and had given his approval; that it is
suggested that the Public Works Department receive a statement,
prepared and certified by an Idaho Licensed Professional Engineer,
indicating the quantity of drainage water that is generated on the
proposed facilities' property and that the additional quantity of
drainage water will not adversely impact the functionality of the
approved drainage facility constructed in the parking lot at 1524
N. Meridian Road.
8. That the City Planning and Zoning Administrator, Shari
Stiles submitted comments which are incorporated herein as if set
forth in full; five-foot (5' ) sidewalks shall be installed per City

corridor; that a Certificate of Occupancy is required prior to
opening and contingent upon meeting all zoning, building codes,
public works and Fire Department regulations; that children should
not be permitted to walk across the driveway without an adult in
attendance; that parking and striping shall meet City Ordinance;
one (1) parking space per ten (10) children plus one (1) per
employee is required; that the children shall not be dropped off
from Meridian Road; that the Applicant shall submit a copy of the
facility's license from the Idaho Department of Health and Welfare
to the City Clerk's office prior to opening, in addition valid
operators' licenses shall be available for inspection during all
operating hours by City and State personnel.
9. The Meridian City Police and Fire Departments, the City
Building Department, Nampa-Meridian Irrigation District, Central
District Health Department and Meridian Sewer Department submitted
comments and they are hereby incorporated herein.
10. That there was no public testimony given at the hearing.
CONCLUSIONS
1. That all the procedural requirements of the Local
Planning Act and of the Ordinances of the City of Meridian have
been met including the mailing of notice to owners of property

within 300 feet of the external boundaries of the Applicant's
property.
2. That the City of Meridian has authority to grant
conditional uses pursuant to 67-6512, Idaho Code, and, pursuant to
11-2-418 of the Revised and Compiled Ordinances of the City of
Meridian.
3. That the City has the authority to take judicial notice
of its own ordinances and proceedings, other governmental statues
and ordinances, and of actual conditions existing within the City
and state.
4. That the City of Meridian has authority to place
conditions on a conditional use permit and the use of the property
pursuant to 67-6512, Idaho Code, and pursuant to that section
conditions minimizing the adverse impact on other development,
controlling the duration of development, assuring the development
is maintained properly, and on-site or off-site facilities, may be
attached to the permit; that 11-2-418 (D) authorizes the City to
prescribe a set time period for which a conditional use may be in
existence.
5. That the City has judged this Application for a
conditional use upon the basis of guidelines contained in Section
11-2-418 of the Revised and Compiled Ordinances of the City of
Meridian and upon the basis of the Local Planning Act of 1975,
Title 67 Chapter 65, Idaho Code, the Comprehensive Plan of the City

of Meridian, and the record submitted to it and the things of which
it may take judicial notice.
6. That 11-2-418(C) of the Revised and Compiled Ordinances
of the City of Meridian sets forth the standards under which the
Planning and Zoning Commission and the City Council shall review
applications for Conditional Use Permits; that upon a review of
those requirements and a review of the facts presented and the
conditions of the area and assuming that the. above conditions or
similar ones thereto would be attached to the conditional use, the
Planning and Zoning Commission concludes as follows:
a. The use, would in fact, constitute a conditional use
and a conditional use permit would be required by
ordinance.
b. The use would be harmonious with and in accordance
with the Comprehensive Plan but the Zoning Ordinance
requires a conditional use permit to allow the use.
c. The use is designed and constructed to be
harmonious in appearance with the character of the
general vicinity; that if the conditions set forth herein
are complied with the use should be operated and
maintained to be harmonious with the intended character
of the general vicinity and should not change the
essential character of the area.
d. That the use would not be hazardous nor should it be
disturbing to existing or future neighboring uses if the
conditions are met; that traffic will increase, but due
to the drop-off and pick-up being off of Meridian Road it
should not be a problem.
e. The property has sewer and water service already
connected.
f. The use would not create excessive additional
requirements at public cost for public facilities and
services and"'the use would not be detrimental to the
economic welfare of the community.

Ordinances, Uniform Fire Code, Uniform Plumbing Code, Uniform
Electrical Code, the Uniform Fire and Life Safety Code, and all
parking and paving requirements.
8. The Conditional Use Permit, if granted, should be
reviewed periodically to see if the Applicant continues to meet the
requirements of the permit.
9. That the Applicant shall provide to the City copies of
all Health and Welfare child care licenses prior to opening for
business.
10. That the Applicant shall meet and comply with all of the
requirements and statements of City staff included or referenced in
these Findings of Fact and Conclusions of Law.

Collector street with no pathway designation (under consideration for upgrade to an arterial
street)
No traffic count available

70-feet existing right-of--way (40-feet e/o section line)
90-feet required right-of--way (45-feet from centerline)
Meridian Road is improved with an average 44-foot street section with curb, gutter and
sidewalk. Approximately 18-feet of curb, gutter and sidewalk is missing abutting this site.
Staff met the applicant on site and the applicant states that he will construct the missing
section of curb, gutter and sidewalk. An existing tree will require a portion of the sidewalk
to be constructed with pavers or other means due to the shallow root system of the tree.
B. There is an existing building located at the site. The applicant is not proposing any changes
to this site.
C. No new driveways are proposed. One narrow driveway exists which is not being used nor is
future use shown. Staff recommends that the applicant replace the existing curb cut driveway
with vertical curb, gutter and sidewalk to match the existing improvements.
D. The transportation system will be adequate to accommodate additional traffic generated by
this proposed development.
E. This application is scheduled for a public hearing by the City of Meridian Planning and
Zoning Commission on October 10, 1995.

The following requirements are provided to the City of Meridian as conditions for approval:
Site Specific Requirements:
Dedicate 45-feet of right-of--way from the centerline of Meridian Road abutting the parcel (5
additional feet) prior to issuance of building permit (or other required permits). The owner
will be compensated for this additional right-of-way from available impact fee revenues in
this benefit zone. If the owner wishes to be paid for the additional right-of--way, the owner
must submit a letter of application to the impact fee administrator prior to breaking ground,
in accordance, with Section 15 of ACHD Ordinance #188.
2. Construct the missing portion of curb, gutter and sidewalk to match existing improvements at
abutting the site. An existing tree will require a portion of the sidewalk to be constructed
with pavers or other means due to the shallow root system of the tree. Materials and design
of sidewalk improvements which will be affected by the root system of the tree shall be
reviewed and approved by ACHD Development Services Staff.
3. Replace the existing narrow curb cut driveway on Meridian Road with vertical curb, gutter
and sidewalk to match the existing improvements.
Standard Requirements:
A request for modification, variance or waiver of any requirement or policy outlined herein
shall be made in writing to the Development Services Supervisor. The request shall
specifically identi each requirement to be reconsidered and include a written explanation of
why such a requirement would result in a substantial hardship or inequity.
Requests received prior to the date scheduled for Commission action shall be rescheduled for
discussion with the Commission on the next available meeting agenda.
2. A request for an appeal of the Commission's action shall be made in writing to the
Development Services Supervisor within 15 calendar davs of the action and shall include a
minimum fee of $110.00. The appeal will be scheduled to be heard by the Commission
within 20 calendar days after receipt. The request for appeal shall specifically identify each
requirement to be reconsidered and include a written explanation of why such a requirement

3. Aright-of--way permit must be obtained from ACHD for any street or utility construction
within the public right-of--way. Utility cuts should be combined where practical to limit
pavement damage. Utility street cuts in roads Waved within the last five years will not be
allowed unless approved by the District Commission. Contact Construction Services at 345-

4. Submit site drainage plans and calculations for review and appropriate action by ACHD prior
to issuance of building permit (or other required permits). The proposed drainage system

shall retain all storm water on-site and shall conform to the requirements of City of
Meridian.
5. Locate driveway curb cuts a minimum of 5-feet from the side lot property lines when
driveways are not being shared with the adjacent property.
6. Provide written approval from the appropriate irrigation/drainage district authorizing storm
runoff into their system.
7. If street improvements are required, locate obstructions (utility facilities, irrigation and
drainage ditches and appurtenances, etc.) outside of the public right-of--way. Authorization
for relocations shall be obtained from the appropriate entity. If determined by the District,
existing irrigation facilities may remain in the right-of--way with District review and approval
of easements recorded for future relocation at a later date.
8. Submit three sets of street construction plans to the District for review and appropriate
action.
9. Provide design data for proposed access to public streets for review and appropriate action by
ACHD.
10. All public streets and drainage systems shall be designed and constructed in conformance
with District standards and policies.
11. Specifications, land surveys, reports, plats, drawings, plans, design information and
calculations presented to ACRD shall be sealed, signed and dated by a Registered
Professional Engineer or Professional Land Surveyor, in compliance with Idaho Code,
Section 54-1215.
12. The applicant shall submit revised plans for staff approval, prior to issuance of building
permit (or other required permits), which incorporates any required design changes.
13. Construction, use and property development shall be in conformance with all applicable
requirements of the Ada County Highway District prior to District approval for occupancy.

ITEM #13: PUBLIC HEARING: REQUEST FOR A CONDITIONAL USE PERMIT FOR A
BEFORE AND AFTER SCHOOL CENTER BY JOE & LESLIE PALMER:
Johnson: I will open the public hearing at this time and invite the Palmer's or their
representative to come forward.
Joe Palmer, 1620 Sportsman, was sworn by the City Attorney.
Palmer: What we are proposing is a before and after school center it is next door adjacent
to a building that we now own that we have a regular day care center that has children that
are under school age. They are on two different pieces of property, we are leasing the
one that we are proposing at this time we will be leasing that property. There is only one
building on the property some of the paperwork 1 came back there was some comments
about other buildings that are there on the property. There is no other buildings on the
property there is only one. There in the back corner of that building there will be two
people that rent just the one comer of it for doing a dental lab, I believe that was approved
in your last meeting. Is there any questions?
Johnson: Have you been operating this at this time before this meeting?
Palmer: No, we started to when school first opened and the building inspector said we
don't have an occupancy so not to operate so we haven't since then. That was about a
month and a half ago.
Johnson: You read the comments from the Assistant to the City Engineer and no questions
on those?

Palmer: Yes I have, no questions, we will comply with anything we need to.
Johnson: Same thing with Shari Stiles our Planning and Zoning Administrator?
Palmer: Yes, there is a little problem there, same old story the landscape. She requested
some trees there and right now there is a tree that is about 3 foot diameter and we have
had landscapers come through and they say. there is no way to put two more trees
underneath that tree and have them grow. I don't know what you want us to do, we have
one tree there that is big enough to cover the whole place. As far as putting other trees
there is no place to put them. They could put them behind the building in the back, there
is a gravel lot and if that is what is desirable we will do it.
Johnson: She is siting a City ordinance is what she is doing at this point.
Palmer: I understand that and if there is anythign we can do it.
Johnson: Landscaping by definition is more than trees too.
Palmer: Yes, we will landscape, there is not a lot of space that is not going to be sidwalked
through and maybe a few feet and we will landscape that accordingly. The Ada County,
they came out and we talked to them, they had their meeting last Friday, they told us
things we need to do we will comply with that. There was some sidewalk and gutter there
that has never been put in and we will put that in weather permitting in the next few weeks.
Johnson: Any of her other comments that she has addressed here, any other situations
that she has addressed here, any other situations that are addressed that you want to
comment on or have a problem with?
Palmer: Well, she wrote down children should not be permitted to walk across driveway
without an adult, that would never (inaudible) that is not something that would ever
happen. There is no reason from them to walk across it, the parents pull up and they drop,
they come in with them and they leave with them. So there is no problem with that.
Everything else the Department of Health and Welfare has already been done or will
happen as soon as we have permission to open.
Johnson: Wetl I think she is being particularly sensitive to the safety of the children, we
have to, that is what we should do.
Palmer: We are doing our best to do that also.
Johnson: Are there any other questions from the Commission of the applicant?

Hepper: There is a comment from Kenny Bowers the Fire Chief that says they also need
to get in compliance with other buildings at this address.
Palmer: There is no other building at that address.
Hepper: I was wondering if there, are there some concerns of the Fire Marshall, is there
some adjacent buildings?
Palmer: At the next property over, yes there is.
Johnson: What direction would that property be, is that to the south?
Palmer: Yes, that is where our other day care center is. Behind it we have two buildings,
one is my office which is Cherry's built in vacs and one of them is a 2000 foot shop that
we had leased out and it is going to be vacant within the next day, in fact it is probably
vacant tonight. There was, we had a gentleman there that was building cabinets and we
found out that he couldn't do that so we remedied that.
Hepper: So that would probably take care of the (inaudible).
Palmer: I am sure that has got to be what he is talking about on a different peke of
property.
Hepper: But it could potentially have an impact on this peke of property.
Palmer: Yes I guess it could.
Hepper: If it caught on fire it could.
Palmer: Well, any building caught on fire in the block could.
Hepper: But if they are all under your ownership.
Palmer: It is not under my ownership. The one that we are leasing, the new one we are
leasing, the other one is my ownership. But anyway we will, it is vacant as of tonight.
Johnson: Well I think our fire department is particularly sensitive to cabinet shops right
now.
Palmer: t understand, I have noticed that situation. It made me a little nervous when I seen
it too. (Inaudible) they didn't have any stain or lacquer or anything all they had was a

table saw, they cut their wood and take it out in the shop and put it together.

Johnson: I will now open the public hearing is the applicant of the representative here,
would you please address the Commission at -this time.
Kristina Donner, 3363 Buckboard Way, Boise, was sworn by the City Attorney.
Donner: We are requesting annexation and zoning on a peice of property that is located
on Overland Road between Eagle Road and Locust Grove. I am not sure where the best
place to put this is, so you can all see it. I don't know if you all got a copy in your packet
but I know they were pretty large drawings.
Johnson: Well there is an easel but I don't see it.
Donner: That is okay, I will just hold it.
Johnson: You can set it in those chairs there if you want to. Set it up by the projector or
whatever.
Donner: The site is 28.49 acres and the larger portion where we show the site plan now
is 20 acres the remainder is for future and that is the remaining 8.49 acres. There will be
