SMITH – CUP-03-033 - Page 1 BEFORE THE PLANNING AND ZONING COMMISSION IN THE MATTER OF THE REQUEST FOR CONDITIONAL USE PERMIT FOR A DENTAL OFFICE IN A L-O ZONE Dr. Delmar Gray & Dr. Randall Smith, Applicants ) ) ) ) ) ) Case No. CUP-03-033 RECOMMENDATION TO CITY COUNCIL 1. The property is located within the Resolution Subdivision on Millenium Way. 2. The owners of record of the subject property are Dr. Delmar Gray and Dr. Randall Smith. 3. Applicant is Dr. Delmar Gray and Dr. Randall Smith. 4. The subject property is currently zoned L-O. This zoning district of is defined within the City of Meridian Zoning and Development Ordinance, Section 11-7-2. 5. The Applicant requests the Conditional Use Permit for a new dental office. The Resolution Business Park conceptual Planned Development requires a detailed Conditional Use Permit be obtained for all future uses at the time of development. 6. The Meridian Planning and Zoning Commission recognizes that the proposed application is in compliance with the Meridian Comprehensive Plan. 7. The use proposed which is the subject of this will, in fact, constitute a conditional use as determined by City policy and by the relevant Planned Development permit for the subdivision. RECOMMENDATION The Meridian Planning and Zoning Commission hereby recommends to the City Council of the City of Meridian that they approve the requested Conditional Use Permit as requested by the Applicant for the property described in the application, subject to the following: A. Adopt the Recommendations of the Planning and Zoning and Engineering staff as follows: 1. This conditional use permit shall be subject to the expiration provisions set forth in MCC RECOMMENDATION TO CITY COUNCIL OF APPROVAL OF CONDITIONAL USE PERMIT FOR MILLENIUM DENTAL BY DR. GRAY/DR. SMITH – CUP-03-033 - Page 2 11-17-4.B. 2. Applicant must comply with the conditions of the recorded plat for Resolution Subdivision. 3. Applicant shall be required to submit a conditional use permit for a planned development at the time the “future building” at the south-western corner of the property is developed. This request for approval does not include that building. 4. All parking stalls shall be designed per Ordinance 11-13-4. All two-way drive aisles adjacent to parking shall be at least 25 feet wide. 5. Applicant shall revise the Site/Landscape Plan to continue the sidewalk stub to the east property line and submit a copy of a recorded pedestrian cross-access easement with Lot 3, Block 1 of Resolution Subdivision prior to applying for a Certificate of Zoning Compliance. 6. The Landscape Plan (Sheet L1, dated April 28, 2003) shall be revised as follows: a. Per Ordinance 12-13-11-2.B. & C, add a minimum of three (3) new trees to the south landscape strip. (Applicant should note that some of the street trees on E. Gala or trees east of the building could be relocated to meet this requirement.) b. Revise the Plant Material Legend to include the street tree labeled as CH. c. Revise the Plant Material Legend to increase the size of the Emerald Gaiety (EG) to min. 2 gallon size. d. Revise the Plant Material Legend to include “arborvitae” (AR) under shrubs instead of trees. e. Landscape planter island on northern corner needs to be a minimum of five feet wide, measured inside curbs per MCC 12-13-11-3B. f. Per Ordinance 12-13-11-3E., each interior planter that serves a single row of parking spaces shall be landscaped with at least one (1) tree and shall be covered with low shrubs, lawn, or other vegetative groundcover. g. The five foot landscape strip along the south-eastern boundary of the property adjacent to the parking area needs to include 1 tree per 35’ (add 2 trees). h. Remove and landscape the two parking stalls along the eastern boundary of the property for turnaround. Applicant shall submit a revised Landscape Plan for review and approval with the Certificate of Zoning Compliance application. 7. All exterior lighting, whether attached to the building or located within the parking lot, shall be down-shielded or otherwise altered so that the light does not spill over onto adjacent properties or right-of-way. All parking lot lighting shall be in accordance with Ordinance 11-13-4C. 8. All signage shall be in accordance with the standards set forth in Section 11-14 of the RECOMMENDATION TO CITY COUNCIL OF APPROVAL OF CONDITIONAL USE PERMIT FOR MILLENIUM DENTAL BY DR. GRAY/DR. SMITH – CUP-03-033 - Page 3 City Zoning and Development Ordinance. All signage is subject to design review and shall require separate permits. Signs shall conform to the character of sign submitted with the application, with an 8’ maximum overall height. 9. All construction and site improvements shall conform to the requirements of the Americans with Disabilities Act and the adopted building and fire codes. 10. A drainage plan designed by a State of Idaho licensed architect or engineer is required and shall be submitted to the City Engineer (Ord. 557, 10-1-91) for all off-street parking areas. Storm water treatment and disposal must be designed in accordance with Department of Environmental Quality 1997 publication Catalog of Storm Water Best Management Practices for Idaho Cities and Counties and City of Meridian standards and policies. Off-site disposal into a surface water is prohibited unless the jurisdiction which has authority over the receiving stream provides written authorization prior to development plan approval. The applicant is responsible for filing all necessary applications with the Idaho Department of Water Resources regarding Shallow Injection Wells. 11. Certificate of Occupancy: All required improvements must be complete prior to obtaining a Certificate of Occupancy for the proposed development. A temporary Certificate of Occupancy may be obtained by providing surety to the City in the form of a letter of credit or cash in the amount of 110% of the cost of the required improvements (including paving, striping, landscaping, and irrigation). A bid must accompany any request for temporary occupancy. 12. Sanitary sewer and water service shall be via existing service lines. Applicant shall coordinate size and routing with the Public Works Department. B. Adopt the Recommendations of the Meridian Fire Department as follows: 1. That a fire-flow consistent with Appendix III-A of the Uniform Fire Code be provided to service the entire project. Fire hydrants shall be placed an average of 400’ apart. 1997 UFC Appendix III-A 2. Operational fire hydrants and temporary or permanent street signs are required before combustible construction begins. UFC 901.4.2 & 901.3 3. Acceptance of the water supply for fire protection will be by the Meridian Water Department. 4. Final approval of the fire hydrant locations shall be by the Meridian Fire Department thru the Public Works Department. 5. All radii shall be 28’ inside and 48’ outside radius for all entrances and internal roads. RECOMMENDATION TO CITY COUNCIL OF APPROVAL OF CONDITIONAL USE PERMIT FOR MILLENIUM DENTAL BY DR. GRAY/DR. SMITH – CUP-03-033 - Page 4 6. All fire lanes shall have an unobstructed width of 20’. UFC 902.2.1 7. The proposed project will have an undetermined transient population. Based on historical run analysis the Meridian Fire Department will respond to one call for service for every 24 people in the service area. This will generate an undetermined number of calls for service at build out. According to a report completed by Fire & Emergency Services Consulting Group in February of 2000 our requests for service are projected to reach 2800 in the year 2005 and 3800 by the year 2010, this is up from 2069 responses in the year 2000. C. Adopt the Recommendations of Central District Health Department as follows: 1. This proposal can be approved for central sewage & central water after written approval from appropriate entities is submitted. 2. The Applicant’s central sewage and central water plans must be submitted to and approved by the Idaho Department of Health & Welfare, Division of Environmental Quality. 3. Run-off is not to create a mosquito breeding problem. 4. Stormwater shall be pretreated through a grassy swale prior to discharge to the subsurface to prevent impact to groundwater and surface water quality. 5. The Engineers and architects involved with the design of the subject project shall obtain current best management practices for stormwater disposal and design a stormwater management system that prevents groundwater and surface water degradation. D. Adopt the conditions of Ada County Highway District, as outlined in their report dated June 25, 2003, by Joyce Newton.
