Maw's Additions # 1 and #21ay east of and next to this site. Although the original design of the Maw's Addition incha<ded this parcel, a preliminary plat was not submitted within the time-frame specified by the Meridian Subdivision Ordinance. Located at the northeast corner of Adkins Lane and Pine Avenue, the six (6) lots in this proposal all have frontage and access onto Adkins Lane. The preliminary plat has been designed to comply with the current zoning and subdivision regulations of the city of Meridian. Each lot is at least 6,500 square feet in size with at least sixty-five feet {b5') of street frontage. Maw's Addition #3 will be developed with single-family residential housing. As required by the Zoning Ordinance, each dwelling will contain a minimum of 1,301 square feet.. Municipal sewer and water services are available to the site. This is the final phase of the Maw's Additions. As stated previously, this phase was designed complying with the c~reirt subdivision and zoning regulations of the city of Meridian. Zoned R8, the lots meet or exceed the minimum lot size arul street frontage requirements. The density of this phase is 5.25 dwelling units per acre. B. Danbury Fair Subdivision No. 6 abuts the subject site on the north side. The following requirement was made of Danbury Fair Subdivision No. 6 with regazd to Atkins Lane. "Danbury Fair 6 proposes a single access to Locust Grove on its east property line. The developer proposes to vacate portions of Adkins Lane, located with and adjacent to Danbury Fair 6. Adkins Lane is a local public street with 18-feet of paving in 40- feet of right-of--way. If the vacation process is approved (for the section south of the proposed Roseburg Drive), a public cul-de-sac built to ACHD standards at the end of Adkins Lane will be required of the developer before the final plat is approved. The turnazound may not be located with the plat boundary. " Maw's Addition No.3 is not required to comply with the above stated condition, but is required to improve Atkin's Lane to the north property line abutting the parcel to half of a 37-foot street section with a 4-foot sidewalk plus 12-feet of paving. C. Drainage D. The street system will be adequate to accommodate any additional traffic generate by this proposed development. E. This application is scheduled for a public hearing by the Meridian Planning and Zoning Commission on April 11, 1995. Preliminary Plat -Maw's Addition #3 Page 2 The following requirements are provided to Meridian City as conditions for approval: Site Specific Requirements: Construct curb, gutter, 5-foot (Meridian minimum requirement) sidewalk on Atkin's Lane abutting parcel. Improvements shall be constructed to half of a 37-foot back-to-back street section, plus 12-feet of paving on the west side of centerline 2. Dedicate 25-feet of right-of--way from the centerline of Atkin's Lane abutting parcel (5 additional feet). The owner will n~,l be compensated for this additional right-of--way from available impact fee revenues in this benefit zone. Standard Requirements: 1. A request for modification, variance or waiver of any requirement or policy outlined herein shall be made, in writing, to the Manager of Engineering Services within ~ calendar daL of the original Commission action. The request shall include a statement explaining why such a requirement would result in substantial hardship or inequity and minimum fee of $110.00. 2. Locate driveway curb cuts a minimum of 5-feet from the side lot property lines when driveways are not being shared with the adjacent property. 3. Locate obstructions (utility facilities, irrigation and drainage appurtenances, etc.) outside of the proposed street improvements. Authorization for relocations shall be obtained from the appropriate entity. 4. Aright-of--way permit must be obtained from ACRD for any street or utility construction within the public right-of--way. Utility cuts should be combined where practical to limit pavement damage. Contact Construction Services at 345-7667 (with zoning file number) for details. 5. Install a stop sign on every unsignalized approach of a project street to an intersection involving a collector or arterial as the cross-street. The stop sign shall be installed when the project street is first accessible to the motoring public. 6. The developer is required to install street name signs at the locations approved by the Ada County Highway District. Purchase street name signs, sign poles, and mounting hardware from ACHD's Traffic Operations Department or an approved outside supplier. The District Preliminary Plat -Maw's Addition #3 Page 3 will not manufacture street signs until a copy of the recorded plat showing the recording data has been provided to Development Services staff. 7. Provide a clear vision sight triangle at all street intersections. Within this triangle no obstruction higher than 36-inches will be allowed, including landscaping, berms, fences, walls or shrubs. The triangle shall be defined by the long leg measured down the centerline of any collector 350-feet; and the short leg measured down the centerline from the collector street curb line 20-feet. Provide notes on the plat and street construction plans of these restrictions. 8. Submit site drainage plans and calculations for review and appropriate action by ACHD. The proposed drainage system shall conform to the requirements of Meridian and shall retain all storm water on-site. Public street drainage facilities shall be located in the public right-of--way or in a common lot owned by a homeowners association set aside specifically for that use. There shall be no trees, fences, bushes, sheds, or other valuable amenities placed in said easement. Drainage lots and their use restrictions shall be noted on the plat (when applicable). 9. Continue existing irrigation and drainage systems across parcel. 10. Continue borrow ditch drainage abutting parcel (culvert may be required). 11. Provide written approval from the appropriate irrigation drainage district authorizing storm runoff into their system. 12. All public streets and drainage systems shall be designed and constructed in conformance with District standards and policies. 13. Specifications, land surveys, reports, plats, drawings, plans, design information and calculations presented to ACRD shall be sealed, signed and dated by a Registered Professional Engineer or Professional Land Surveyor, in compliance with Idaho Code, Section 54-1215. 14. Provide design data for proposed access to public streets for review and appropriate action by ACRD. 15. Submit three sets of street construction plans to the District for review and appropriate action. We also find that this subdivision is located in census tract 103.12 and in the attendance zone for Chief Joseph Elementary, Meridian Middle School and Meridian High School. The School District may be required to transport elementary students from this subdivision to Ridgewood Elementary or another school that may have capacity, due to overcrowding at Chief Joseph Elementary. Using the above information we can predict that these homes, when completed, will house 2 elementary aged children, 1 middle school aged children, and 1 senior high aged students. At the present time Chief Joseph Elementary is at 119 of capacity, Meridian Middle School is at 139 of capacity and Meridian High School is at 122 of capacity. The Meridian School District is not opposed to growth in our district, however this subdivision will cause increased over- crowding in all three schools. There is little opportunity to shift attendance boundaries since the surrounding schools are also well over capacity. Before we could support this subdivision, we would need land dedicated to the district or at least made available at a minimum price for a school site in this area. The site would need water and sewer services available. In addition we would need to pass another bond issue for the construction of schools. The cost per student for newly constructed schools, excluding site purchase price and offsite improvements, exceeds $5,000 per elementary student and $10,000 per middle or high school student. We are in a difficult position and need your help in dealing with the impact of growth on schools. We also find that this subdivision is located in census tract 103.12 and in the attendance zone for Chief Joseph Elementary, Meridian Middle School and Meridian High School. The School District may be required to transport elementary students from this subdivision to Ridgewood Elementary or another school that may have capacity, due to overcrowding at Chief Joseph Elementary. Using the above information we can predict that these homes, when completed, will house 2 elementary aged children, 1 middle school aged children, and 1 senior high aged students. At the present time Chief Joseph Elementary is at 119 of capacity, Meridian Middle School is at 139 of capacity and Meridian High School is at 122 of capacity. The Meridian School District is not opposed to growth in our district, however this subdivision will cause increased over- crowding in all three schools. There is little opportunity to shift attendance boundaries since the surrounding schools are also well over capacity. Before we could support this subdivision, we would need land dedicated to the district or at least made available at a minimum price for a school site in this area. The site would need water and sewer services available. In addition we would need to pass another bond issue for the construction of schools. The cost per student for newly constructed schools, excluding site purchase price and offsite improvements, exceeds $5,000 per elementary student and $10,000 per middle or high school student. In order that the Final Plat may be considered by the District for acceptance, the Developer shall cause the following applicable standard conditions to be satisfied prior to District certification and endorsement: Drainage plans shall be submitted and subject to review and approval by the District. 2. B. Danbury Fair Subdivision No. 6 abuts the subject site on the north side. The following requirement was made of Danbury Fair Subdivision No. 6 with regard to Adkins Lane. "Danbury Fair 6 proposes a single access to Locust Grove on its east property line. The developer proposes to vacate portions of Adkins Lane, located with and adjacent to Danbury Fair 6. Adkins Lane is a local public street with 18-feet of paving in 40- feet of right-of--way. If the vacation process is approved (for the section south of the proposed Roseburg Drive), a public cul-de-sac built to ACHD standards at the end of Adkins Lane will be required of the developer before the final plat is approved. The turnaround may not be located with the plat boundary." Maw's Addition No.3 is not required to comply with the above stated condition, but is required to improve Adkin's Lane to the north property line abutting the parcel to half of a 37-foot street section with a 4-foot sidewalk plus 12-feet of paving. In addition, Adkin's Lane should be improved with 24-feet of pavement offsite from the site south to Pine Avenue. C. A drainage lot to be owned by ACHD is proposed on the preliminary plat. ACHD has not determined if this drainage lot desired. D. The street system will be adequate to accommodate any additional traffic generate by this proposed development. Preliminary Plat -Maw's Addition #3 Page 2 E. This application is scheduled for a public hearing by the Meridian Planning and Zoning Commission on April 11, 1995. The following requirements are provided to Meridian City as conditions for approval: Site Specific Requirements: Construct curb, gutter, 5-foot (Meridian minimum requirement) sidewalk on Adkin's Lane abutting parcel. Improvements shall be constructed to half of a 37-foot back-to-back street section, plus 12-feet of paving on the west side of centerline. 2. Pave Adkin's Lane from the south parcel boundary to Pine Avenue 24-feet wide. 3. Dedicate 25-feet of right-of--way from the centerline of Adkin's Lane abutting parcel (5 additional feet). The owner will no be compensated for this additional right-of--way. 4. Coordinate with the District's civil engineer to determine if ACRD will accept the proposed drainage lot. Standard Requirements: 1. A request for modification, variance or waiver of any requirement or policy outlined herein shall be made, in writing, to the Manager of Engineering Services within 15 calendar davs of the original Commission action. The request shall include a statement explaining why such a requirement would result in substantial hardship or inequity and minimum fee of $110.00. 2. Locate driveway curb cuts a minimum of 5-feet from the side lot property lines when driveways are not being shared with the adjacent property. 3. Locate obstructions (utility facilities, irrigation and drainage appurtenances, etc.) outside of the proposed street improvements. Authorization for relocations shall be obtained from the appropriate entity. 4. Aright-of--way permit must be obtained from ACHD for any street or utility construction within the public right-of--way. Utility cuts should be combined where practical to limit pavement damage. Contact Construction Services at 345-7667 (with zoning file number) for details. 5. Install a stop sign on every unsignalized approach of a project street to an intersection Preliminary Plat -Maw's Addition #3 Page 3 involving a collector or arterial as the cross-street. The stop sign shall be installed when the project street is first accessible to the motoring public. 6. The developer is required to install street name signs at the locations approved by the Ada County Highway District. Purchase street name signs, sign poles, and mounting hardware from ACHD's Traffic Operations Department or an approved outside supplier. The District will not manufacture street signs until a copy of the recorded plat showing the recording data has been provided to Development Services staff. 7. Provide a clear vision sight triangle at all street intersections. Within this triangle no obstruction higher than 36-inches will be allowed, including landscaping, berms, fences, walls or shrubs. The triangle shall be defined by the long leg measured down the centerline of any collector 350-feet; and the short leg measured down the centerline from the collector street curb line 20-feet. Provide notes on the plat and street construction plans of these restrictions. 8. Submit site drainage plans and calculations for review and appropriate action by ACHD. The proposed drainage system shall conform to the requirements of Meridian and shall retain all storm water on-site. Public street drainage facilities shall be located in the public right-of--way or in a common lot owned by a homeowners association set aside specifically for that use. There shall be no trees, fences, bushes, sheds, or other valuable amenities placed in said easement. Drainage lots and their use restrictions shall be noted on the plat (when applicable). 9. Continue existing irrigation and drainage systems across parcel. 10. Continue borrow ditch drainage abutting parcel (culvert may be required). 11. Provide written approval from the appropriate irrigation/drainage district authorizing storm runoff into their system. 12. All public streets and drainage systems shall be designed and constructed in conformance with District standards and policies. 13. Specifications, land surveys, reports, plats, drawings, plans, design information and calculations presented to ACHD shall be sealed, signed and dated by a Registered Professional Engineer or Professional Land Surveyor, in compliance with Idaho Code, Section 54-1215. 14. Maw's Additions # 1 and #2 lay east of and next to this site. Although the original design of the Maw's Addition included this parcel, a preliminary plat was not submitted within the time-frame specified by the Meridian Subdivision Ordinance. Located at the northeast corner of Adkins Lane and Pine Avenue, the six (6) lots in this proposal all have frontage and access onto Adkins Lane. The preliminary plat has been designed to comply with the current zoning and subdivision regulations of the city of Meridian. Each lot is at least 6,500 square feet in size with at least sixty-five feet (65') of street frontage. Maw's Addition #3 will be developed with single-family residential housing. As required by the Zoning Ordinance, each dwelling will contain a minimum of 1,301 square feet. Municipal sewer and water services are available to the site. This is the final phase of the Maw's Additions. As stated previously, this phase was designed complying with the current subdivision and zoning regulations of the city of Meridian. Zoned R8, the lots meet or exceed the minimum lot size and street frontage requirements. The density of this phase is 5.25 dwelling units per acre. MOTION CARRIED: All Yea FIVE MINUTE BREAK ITEM #7: PUBLIC HEARING: REQUEST FOR A PRELIMINARY PLAT FOR MAWS ADDITION NO. 3, 6 LOTS BY MAWS LIMITED PARTNERSHIP: Kingsford: At this time I will open the public hearing and invite the owner or his designee to speak first. Ted Hutchinson, 109 South 4th Street, Boise, was sworn by the City Attorney. Meridian City Council May 16, 1995 Page 40 Hutchinson: Thank you Mr. Mayor and members of the Council. I believe there is a typo this is a 7 lot subdivision with 7 residential lots plus one drainage lot. This is the final phase for Maws Addition. The prior approval for this particular site which expired for Maws 3 had lots which had 60 foot street frontages, we have re-designed this proposal to comply with the current regulations for R-8 development. This site is zoned R-8 and I believe that this now complies with the street frontage and lot size requirements. We do include a drainage lot on the north end of the development, we will be making improvements to Adkins Lane which will be improved to 1/2 of a 37 foot street section plus 12 feet of paving plus the sidewalk. It is our understanding that Danbury Fair will connect to Adkins Lane will will further the completion of Adkins to its full width. We have reviewed the comments and recommended conditions of approval, we agree with those comments and conditions. We just have one question about one of the conditions regarding perimeter fencing. It would be our understanding that the required fence would be along the northern boundary and the southern boundary because this is the completion of the Maws Addition project. Then we should also not at this time that the entire site for Maws Addition is excluded from the irrigation district in 1992. Basically this will comply with the requirements for development in the R-8 zone. Are there any questions from the Council at this time? Kingsford: Questions for Mr. Hutchinson? Morrow. I have a question with respect to the site specific comments. Obviously you have indicated in your testimony that at some point in time Adkins Lane will hook up or continue through Danbury Fair. There is nothing here that indicates when that will happen, there is a comment that some form of temporary turn around will be necessary. I guess 1 would solicit your comments on that as I see it temporary tum around would be mandatory for emergency vehicle folk until that hook up is made. Hutchinson: Mr. Mayor, Councilman Morrow, that has created an interesting problem, the issue was raised at the Highway District as well for a temporary turn around on Adkins Lane. There are additional properties that go on beyond the boundary line of our property between us and Danbury Fair. Those properties have access onto Adkins Lane. We don't know when Danbury Fair will make the connection into Adkins Lane. It was my understanding from the Zoning Administrators comments at the P & Z hearing that will connect to Adkins, Danbury will connect to Adkins. Then there is the issue of where would the temporary tum around be located we are not sure how that v~uld be facilitated on that ground given that there are additional properties that use Adkins north of this site. I am not sure how they are turning around at this point at the end of Danbury or Adkins excuse me. Any suggestions on how I could accomplish that? Morrow. (Inaudible) and Gary concerning that? Meridian City Council May 16, 1995 Page 41 Kingsford: Any other questions of the engineer? Anyone else from the public that would like to offer testimony on this issue? Seeing none I will close the public hearing. Morrow. I have a question for Gary, can you help us out here with respect to turn around information for our fire department? Smith: I am sorry Councilman Morrow I haven't been out to the site so I don't know what Adkins Lane is like. Morrow. In terms of the site speck comments that was from the Planning Department that was Shari's deal and is she gone for the evening or here? Smith: She is here I don't know where she is. Kingsford: Front and center Shari, comment on Maws Addition, Adkins Lane. Morrow: The turn around issue. The question is that we need some place for our fire tracks, large vehicles, paramedic vehicles to be able to turn around. Now Mr. Hutchinson has indicated that there are properties on down Adkins Lane at the current time and also the comments are that this will hook up to a street in Danbury Fair at such time that is developed and apparently that is not developed at this point in time. And there is no schedule. My concern here is how do we get stuff turned around and the site specific comments that you wrote you address the issue of some form of temporary turn around may be necessary. What did you have in mind for accomplishing that? Stiles: That the end lot there not be developed until such time as that access is available through there. So essentially it wouldn't be a buildable lot until the access goes through. Because there is no other way to accommodate a 50 foot radius tum around. Kingsford: Either that or get permission from the people to the west to allow for that tum around part of it on their land. Would that be a possibility? Stiles: 1 guess they could approach them about it, we did get a letter from one of the neighbors across the street that seemed to think that all of the right of way would be coming off of this property here and that none of the. additional right of way would come from their property. Morrow: That is Mrs. Farrington? Stiles: Yes Meridian City Council May 16, 1995 Page 42 Kingsford: Was she advised that wouldn't be the case if there would be, she would be required or whoever when that is developed that half street? Stiles: I don't know if she was here for the hearing. She thought because she had a survey which showed where her present pins are that any future road would just come off the other side of the street. Corrie: I guess Mr. Mayor what you are saying the people to the west doesn't give a turn around Lot 33 can't be built on until it goes through is that what you are saying? Does the developer know that? Stiles: I don't know. Kingsford: Well, perhaps that 34, Ted can you speak to that. Lot 34 is your water retainage is that correct, what would be wrong with making a ball turn around on that site? What is its depth I guess is the first question? Hutchinson: (Inaudible) Kingsford: Looks like 25 but I am not certain. Hutchinson: (Inaudible) I was just talking to the developer on this and he may have a possibility of speaking with another property owner about the development of a 50 foot tum around at the end of that. Like I say temporary in nature until Danbury is connected through to Pine. Kingsford: I think certainly an approval would have to be conditioned on either that taking place or designate either Lot 34 if you can get it all on or restrict Lot 33 for a temporary turn around. Hutchinson: We recognize that if that is the condition we will have to comply with it one or the other we will get a tum around. Kingsford: Any other questions of staff? What is the Council's pleasure? Morrow. Mr. Mayor, I would move that we approve the preliminary plat subject to the staff conditions subject to the Council condition that there be a turn around at this point on, my preference at this point would be to have it on Lot 33 because we know that it feets there. So I would make my motion that we approve the preliminary plat. Kingsford: I think you can just limit it to requiring a 50 foot tum radius and if that requires Meridian City Council May 16, 1995 Page 43 limitation on Lot 33 so be it. Morrow. I would move that we approve the preliminary plat with the requirement of an all weather 50 foot turning radius. Are they represented here this evening? Were they aware of this Mr. Berg? Anyone else from the public that vuould like to offer testimony on that issue then? Anyone familiar with the request? Shari are you familiar with the request by Dave and Denise Hall, variance to the setback requirement? They are not represented here this evening. Stiles: Is that for, they wanted a 4 foot 6 inch side setback instead of 5 feet? Corrie: (Inaudible) Kingsford: Will is saying that Daunt had some comments that didn't get into our packet. Morrow: If I understand their application correctly they purchased this home unknowing that it was in violation of the setback, under #4. Corrie: (Inaudible) Kingsford: Was it a spec home or what? Stiles: Mayor and Council this was John Bames submitted this application he is the one that dropped the application off. I don't really know what the association is there unless he is just trying to help them out because he feels partly responsible for it. Morrow: Mr. Mayor, I move that we table this to the first meeting in June. Meridian Planning & Zoning Commission April 11, 1995 Page 32 May 9th and then it will go for another public hearing to the City Council when it can be on their agenda which will probably either the last regular meeting in May or the first one in June. So you will have another opportunity to a public hearing and that is the purpose of me explaining that. FIVE MINUTE BREAK ITEM #11: PUBLIC HEARING: REQUEST FOR A PRELIMINARY PLAT FOR MAWS ADDITION NO. 3, 6 LOTS BY MAWS LIMITED PARTNERSHIP: Johnson: I will now open the public hearing and invite the applicant or his representative to address the Commission. Ted Hutchinson, 109 South Fourth Street, Boise, was sworn by the City Attorney. Hutchinson: Members of the Commission, this is an application fora 7 lot subdivision, I believe your staff report or something on the original application said 6 but there are 7 residential lots and one drainage lot. This is the final addition to Maws Addition subdivisions at Pine Avenue and Locust Grove Roads. This is going to be north of Pine with frontage on Adkins Lane. Each of these lots have been designed to comply with the zoning requirements of the R-8 zone. The lots are, when they were originally proposed as part of the master plan for the Maws Additions they were proposed at 60 foot wide lots, however the approval expired before the last phase could be submitted and we have redesigned these to comply with the current zoning standards. They are at least 65 feet in width and I believe they are about 6500 square feet, they are about 100 feet deep. This will be the final phase for Maws Addition, I think it is compatible with what has been approved and constructed in the area. We would ask that you recommend approval of this application to the City Council. With that are there any questions that I might answer for the Commission? Johnson: Thanks Ted, any questions for Mr. Hutchinson? Hepper: Does that street go on to the north, where does that street terminate at? Hutchinson: Mr. Hepper, Adkins Lane terminates up there, it simply dead ends I believe Danbury Fair, Shari said Danbury Fair is the subdivision to the north. They haven't quite worked out what they are going to do as far as access to Adkins Lane whether or not they are going to access it or not. The last conversation we had with the Highway District about Adkins Lane we'd be required to do improvements and possibly a temporary turn around but again the temporary tum around would be at the end of the current street. Whether or not that becomes a through street will depend on Danbury Fair's ultimate decision whether Meridian Planning & Zoning Commission April 11, 1995 Page 33 or not they are going to connect. Hepper: You will build a county approved road to the far side of the Maws addition? Hutchinson: From, the Highway District is requiring some off site improvements from the southwest corner of Maws to Pine Avenue. I believe they are requiring some widening and pavement in that area and then we would have to construct the street improvements in front of Maws Addition on Adkins. Johnson: Did you have any problems with any of the comments from our staff or agencies involved. Hutchinson: No, those were all okay. Alidjani: (Inaudible) all those 7 lots are going to have the improvement street wise on Adkins Lane? Hutchinson: Yes, they will have, right now it is just gravel, we will have to make the half street improvements. They will have curb, gutter and sidewalk on Adkins Lane and pavements widening out. Alidjani: I guess the next question I have you may not have the answer for it or not, but Danbury does not open up to go through, what is going to happen to that street. It is not 55 foot back to back, curb to gutters there are no curbs, no gutters, no sidewalks, so where are we going from there? Hutchinson: I would imagine the property to the west develops the Highway District will require they make improvements on the west side. If Danbury does not come through then 1 guess it would simply wait until that western property does develop. Alidjani: In your proposal how many feet (inaudible) black topped? Hutchinson: If you excuse me a moment I will have to look at the Highway District requirements I believe they specified what, half plus 10, so there is a considerable widening of the pavement. Johnson: Anyone else? Anyone from the public that would like to address this issue, this application? Seeing no one then I will close the public hearing. This would require findings of fact. Rountree: Technical question I guess, does this violate our requirement of a culdesac, the Meridian Planning & Zoning Commission April 11, 1995 Page 34 length and there is no way to turn around for emergency service, etc. I guess that is a question for Gary or Shari? Stiles: Danbury Fair will continue through to the south, that is a requirement of their preliminary plat. As it currently is it would exceed but it is not going to be a culdesac in the future, there will be a through street. Rountree: So in the interim we would consider this a culdesac street for the purposes of providing emergency services and a little bit of traffic around and through that. Stiles: One of my comments is they should have I thought that I had a comment they should have a temporary turn around that the Fire Department would likely require one until that was a through street. Johnson: Any other discussion? This does not require findings of fact and conclusions of law this is a preliminary plat. What would you like to do so we can move on? Rountree: Mr. Chairman, I make a motion that we pass a favorable recommendation onto the City Council provided that they meet all the conditions set forth by ACRD and City staff.
