Currently there is an old farmhouse and 2-3 outbuildings on .65 acres (95' x 300' deep). Until one week ago the farmhouse was occupied. We just purchased the home and ground and are interested in zoning it CG. We would like to zone CG so that in the future we won't be limited to strictly office use. At this time our plans are to have the home used as an office. This seems to be a desirable location for business, but doesn't seem feasible to continue having this property remain residential. The properties surrounding 2145 Fairview are primarily businesses, however at this time have remained as R-1 zoning. To the east is Green Thumb Greenhouses and a large, three story food storage warehouse. To the west is a fence company, and within .4 miles is D&B Supply, and Intermountain Arms. Across the street is the Shoshone office complex. Fred Meyers breaks ground with a store in May, and we've been told that Golden Rule Auto will locate duectly across the street. Our intent is to operate a short distance telephone company. US West has been contacted and plans to increase the phone line capacity immediately. We are anxious to meet the commercial requirements necessary for our new venture. Any help you could give will be appreciated. Fairview' Ave. Dear Mr. Longson: Thin letter is provided pursuant to preparation of a detailed drainage plan for the above referenced properL~. The front parking area for the property is proposed for an asphalt surface overlay. Consistent with Meridian zoning ordinance Section 2-414 (D.2,d), a drainage plan is required for all off-street parking areas to detail surface drainage pattorns and a disposal xaethod for stormwater runoff, The plan must then be approved by the City Engineer. The preferred method for disposal of atuface v~rater is outlined below. The detailed drainage plan Twill be subse- qucntlyprepared for city review. However, a preliminary drainago sketch is attached to outline the general plan for stormwater drainage. The final grade topography on the detailed drainage plan will match existing topography with minimal grading required for the aggregate base. The exiatirtg grade slopes from the north edge of tho private drive along Fairview Avo to the south and southeast comer of the private drive (see attached sketch). The water can then be diverted into the open space in the south portion of the property as discussed below. The proposed method for disposal of sto~mwater runoff is diversion into the open space located is the south end of the property. The attached sketch shows that the existing topography will fa cilitate drainage of water from the private drive into the open space, where the water will then infiltrate and evaporate, '1'he volutaae of water from the design atoxm (approximately 1 in) which must be handled from the private drive is approximately 400 cu ft, which amounts to an average 0.25 in of additional water which would spread over the roughly 100 x 200 ft open space area. In the long term, after the south portion of the property is developed, a drainage plan and stortn~ water disposal method will need to bo prepared for the new development and the front private dti~ve drainage can then be inwrpoxated into those pleas for the entire site. The probable storm- water disposal method for the long term development will be as oiUgrease trap and infiltration gallery. Lee Longson, 3497 Hull Drive, Eagle, was sworn by the City Attorney. Longson: Mayor and Council, I really have no comment as far as additional items or anything to discuss as far as the annexation. I think we have complied and are willing to comply with everything that is in the paper. We have studied it and looked at it and don't have any comment. Morrow. Since we have not had a presentation on this v~uld you make the presentation concerning what it is you are going to do and so forth for our benefit? Longson: We have been through the P & Z so I assume that they pass that information onto. Kingsford: They do the minutes, but sometimes that is not as clear as maybe the Council would like. Longson: Basically what we have done is we purchased a piece of property on Fairview which I am sure you are aware of. It is .65 acres and because in order to stay within the comprehensive plan of Meridian we wanted to annex that piece of property into Meridian. So we have been in the process of updating and remodelling the whole farmhouse which is on a piece of property. We have done so, actually at this particular point run the water across Fairview with the anticipation of maybe some day way down the line which we have not brought up at this particular point build an office building on that particular piece of property. We have run two different lines across Fairview at this particular time and put an 8 inch temporary in which we have capped off at both ends for the future. At this particular time there is an actual connection of an 1 1/2 inch line of which we are running the water into the hold farmhouse. We are at this particular point we are not sure exactly what we are going to do with that. We initially intended to operate our own business out of there which we are vuorking with different identities to accomplish that goal. If not we will rent it as a commercial establishment for some, whatever it may be, insurance or anything else. That is really our intent at this particular point. Kingsford: If my memory serves me correct sir this, at P & Z was your business the phone transfer thing? • • Meridian City Council July 18, 1995 Page 35 Longson: Yes sir, we are in the process right now with negotiating with US West for the proper lines of connection US West has actually put the lines in at this particular point. There is some question on the lines that we have and we are in negotiation at this particular point. Corrie: Are you on the north or south of Fairview? Longson: We are on the south side of Fairview about 2 homes down from the D & B Supply. Corrie: I have 2 different things here, one shows you on the north side and the other shows you on the south side. (Inaudible) Longson: We are right next to the fence company, Viking fence I believe, just straight across the street just diagonal a little bit to the Shoshoni building. We are on the other side of that about one home down if you were to go a little further east. Tolsma: (Inaudible) Longson: I don't know what properties border us there but the property itself that we purchased is 100 by 300 and I believe you have the annexation to go 300 feet back is my understanding so that is the extent of the piece of property. I know the report is based on 150. We will have no more impact on that area than it would be if it were rented as a home. We will not have any of what you would consider as consumer traffic of people coming in and out of the business because that is not the type of business that we intend on putting there. I would just Like to recommend that we be given some special consideration there I guess as far as what we can use with the property. If the existing well or septic tank for example were to fail I would then connect to the major utilities that are available. But until the time that we actually do something with the property whether it be another commercial building, that we knock down the existing farm house or whatever at that time we would comply with whatever the City has recommended for us to do so. Thank you. Johnson: Thank you, Mr. Crookston you might want to address the issue of being required to connect to City services. Crookston: Our ordinances require connection to City sewer and water if the property is within 300 feet, I have no idea where the 300 feet is but that is our ordinance. Johnson: 300 feet of existing sewer and water utilities then you have to connect there are no options. If you get annexed, otherwise we don't annex you. Leeann Longson, 2497 Hull Drive, Eagle, was sworn by the City Attorney. Longson: Initially we are in the impact area with Ada County. Initially I made I appealed to them so that we could be commercial. They said that we are far ahead of our time for them so we should hit Meridian. The only thing that I would say is that we are within the 90 feet of the water, I know, I don't know how far the sewer is. Actually we would have loved to have gone through the County but I don't know why they thought we were ahead of their time. So maybe you could shed a little light on that if you know. Johnson: Well, you are just in our impact area, so and you are requesting annexation and zoning to the City of Meridian. Longson: Yes, but initially we were not. Johnson: But since you did that is why you are here. Longson: Okay, so you want me to just pay the fee and sit down, okay. Johnson: No, you can sit down and then send the check. Is there anyone else that would like to address the Commission on this issue? Eddy: (Inaudible) As stated this property is generally located in the east 1/2 of Section 14, Township 3 North, Range 1 East, more specifically this parcel is south of West Franklin Road, west of South Linder Road and adjacent to the Landing Subdivisions and north of Primrose Subdivision. The existing zoning for this particular parcel is RT which allows for 5 acre lots. The developer requests that this property be annexed into the City of Meridian and rezoned to R-4 to allow for single family development. Currently property to the east is zoned R-4 and adjacent properties are zoned R-1 and RT. The rezoning of this parcel to R-4 would comply with the recommendations of the Comprehensive Plan which allows for single family residential development in this particular area. The existing utilities are near this property in (inaudible) right here and has been identified by us as able to continue on to serve this piece of property. The legal description submitted with the application appears to describe the subject pazcel, and meets the requirements of the City of Meridian, However one very minor change will need to be made to the legal description prior to the preparation of the Ordinance for Annexation and Zoning. The nature of the change will not affect the accuracy of the legal. 2. The City of Meridian owns and maintains a 10 inch diameter water main along the north side of Fairview Ave., approximately 90 from the subject pazcel. The pazcel is currently served from an existing well on site. The existing domestic well will have to be removed from it's domestic service per City Ordinance 622 (10/5!93). Wells may be used for non domestic purposes such as landscape irrigation. 4. All Off-Street Pazking, Landscaping, Drainage, Lighting, Paving, and Striping shall be in accordance with the standards set forth in 2-414 of the City of Meridian Zoning and Development Ordinance. 5. That notice of public hearing on the annexation and zoning was published for two (2) consecutive weeks prior to the said public hearing scheduled for May 9, 1995, the first publication of which was fifteen (15) days prior to said hearing; that the matter was duly considered at the May 9, 1995, hearing; that the public was given full opportunity to express comments and submit evidence; and that copies of all notices were made available to newspaper, radio and television stations; 2. That the property included in the application for FINDINGS OF FACT & CONCLUSIONS OF LAW Page 1 • • annexation and zoning is described in the application, and by this reference is incorporated herein; that the property is approximately .65 acres in size. 3. That the property is presently zoned by the county as R-T (Rural Transition); that the Applicant requests that the property be zoned General Retail and Service Commercial (C-G). 4. The general area surrounding the property is used mostly as residential property with some being used agriculturally and commercially; that the property to the north is the Shoshoni building; that the land to the immediate west is used as a fence company and farther west is D&B Supply and Intermountain Arms; that the property to the east is Green Thumb Greenhouse and a large three story food storage warehouse. 5. That the property is adjacent and abutting to the present City limits. 6. That Les S. and LeeAnn Longson are the Applicants and owners of the property and have requested this annexation and zoning and the application is not at the request of the City of Meridian. 7. That the Applicant's annexation and zoning application stated that the present use of the land is agricultural with the original house and out-buildings intact; that the proposed use is for a small business office using the house which has been lightly remodeled, to operate a short distance telephone service company. 8. That the Applicant, LeeAnn Longson testified that this would be used for a small business with very few employees; that FINDINGS OF FACT & CONCLUSIONS OF LAW Page 2 • • the type of business they intend will not have any considerable consumer traffic coming in or out of the business, probably ten (10) a day at the most. 9. That no other testimony was given. 10. That Bruce Freckleton, Assistant to the City Engineer, submitted comments; that the legal description submitted with the application appears to describe the subject parcel and meets the requirements of the City of Meridian, however one very minor change will need to be made to the legal description prior to the preparation of the Ordinance for Annexation and Zoning which will not affect the accuracy of the legal; that the existing domestic well will have to be removed in accordance with City Ordinance 622, except the well may be used for non-domestic purposes such as landscape irrigation and Applicant required to connect to City sewer and water; that all off-street parking, landscaping, drainage, lighting, paving and striping shall be in accordance with standards set forth in Section 11-2-414; all signage shall in accordance with the standards set forth in Section 11-2-415. 11. That the Central District Health Department, Meridian Fire Department, Meridian City Police Department and the Nampa Meridian Irrigation District submitted comments and they are hereby incorporated herein as if set forth in full. 12. That U. S. West submitted request for a ten (10) foot front lot line easement for future ultimate Fairview Avenue right- of-way. 13. That the Ada County Highway District (ACHD) submitted FINDINC~B OF FACT & CONCLUSIONS OF LAW Page 3 • • site specific requirements and they are incorporated herein as if set forth in full; that the Applicant's provide a site plan to the Ada County Highway District for review and approval of access to Fairview Avenue; dedicate 54 feet of right-of-way from the centerline of Fairview Avenue abutting parcel; deposit $800.00 to the Public Rights-of-Way Trust Fund for the required street improvements of the 95 feet of sidewalk on Fairview Avenue abutting parcel. 14. That the property included in the annexation and zoning application is within the Area of Impact of the City of Meridian. 15. That the parcel of ground requested to be annexed is presently included within the Meridian Urban Service Planning Area (U.S.P.A. ) as the Urban Service Planning Area is defined in the Meridian Comprehensive Plan. 16. That the property can be physically serviced with City water and sewer. 17. That the following pertinent statements are made in the Meridian Comprehensive Plan: A. Under ECONOMIC DEVELOPMENT, Economic Development Goal Statement Policies, 1.1 The City of Meridian shall make every effort to create a positive atmosphere which encourages industrial and commercial enterprises to locate in Meridian. 1.2 It is the policy of the City of Meridian to set aside areas where commercial and industrial interest and activities are to dominate. 1.3 The character, site improvements and type of new FINDINQ~S OF FACT & CONCLUSIONS OF LAW page ~ • commercial or industrial developments should be harmonized with the natural environment and respect the unique needs and features of each area. 1.5 Strip industrial and commercial uses are not in compliance with the Comprehensive Plan. 1.6 It is the policy of the City of Meridian to support shopping facilities which are effectively integrated into new or existing residential area, and plan for new shopping centers as growth and development warrant. B. Under LAND USE 1. EXISTING CONDITIONS, Commercial and retail area are established along major arterials, (East First Street, Cherry Lane, Fairview Avenue, Franklin and Meridian Roads) and include small commercial center and individual businesses. Uses include retail, wholesale, service, office, and limited manufacturing. 2. MIXED-PLANNED USE DEVELOPMENT, Mixed-use Area at Locust Grove Road and Fairview Avenue Plus Area North of Fairview Avenue These areas are within Ada County, but nearly surrounded by the City of Meridian. The area is characterized by large rural lots, and a sparse development pattern. In order to stimulate planned development in these areas, the following policies apply: a. 5.16U All development requests will be subject to development review and conditional use permit processing to ensure neighborhood compatibility. b. 5.17U A variety of coordinated, planned and compatible land uses are desirable for this area, including low-to-high density residential, office, light industrial and commercial land uses. c. 5.18U Existing residential properties will be protected from incompatible land use development in this area. Screening and buffers will be incorporated into all development requests in this area. FINDINGS OF FACT & CONCLUSIONS OF LAW Page 5 • • C. Under TRANSPORTATION, Page 42 1. Existing Conditions a. Special Community Design Areas Goal Statement - Policies. a. 2.1U Require businesses and government to install and maintain landscaping. b. 2.3U Encourage the beautification of streets, parking lots, public lands and state highways. E. Under COMMUNITY DESIGN, Page 69 1. Entrance Corridors Goal Statement - Promote, encourage, develop and maintain aesthetically pleasing approaches to the City of Meridian. 2. Policies, Page 71 a. 4.3U Use the Comprehensive Plan, subdivision regulations, and zoning to discourage strip development and encourage clustered, landscaped business development on entrance corridors. b. 4.4U Encourage 35-foot landscaped setbacks for new development on entrance corridors. The City shall require, as a condition of development approval, landscaping along all entrance corridors. 4. Neighborhood Identify Goal Policies, Page 72 a. 6.4U Limit the conversion of predominantly residential neighborhoods to nonresidential uses, and require effective buffers and mitigation measures through conditional use permits when appropriate nonresidential uses are proposed. 18. That in the Rural Area section of the Comprehensive Plan, Land Use, Rural Areas, page 28, it states as follows: FINDINGS OF FACT & CONCLUSIONS OF LAW Page 6 "Land covered by this policy section has characteristics which generally allow for agricultural and rural residential activity due to the existence of irrigation systems, soil characteristics and relative freedom from conflicting urban land uses. Where community growth creates pressure for new development, it must be recognized that agricultural land can no longer economically continue to be identified or used as agricultural land to the exclusion of orderly city growth and development." 19. That Section 6.3, of the LAND USE section of the Comprehensive Plan, states as follows: "Existing rural residential land uses and farms/ranches shall be buffered from urban development expanding into rural areas by innovative land use planning techniques." 20. That the property is included within an area designated on the Generalized Land Use Map in the Meridian Comprehensive Plan as a commercial area; that the commercial area is in an area that is listed as Mixed/Planed Use Development area. 21. That the requested zoning of General Retail and Service Commercial, (C-G) is defined in the Zoning Ordinance at 11-2-408 B. 11. as follows: (C-G1 General Retail and Service Commercial: The purpose of the (C-G) District is to provide for commercial uses which are customarily operated entirely or almost entirely within a building; to provide for a review of the impact of proposed commercial uses which are auto and service oriented and are located in close proximity to major highway or arterial streets; to fulfill the need of travel-related services as well as retail sales for the transient and permanent motoring public. All such districts shall be connected to the Municipal Water and Sewer systems of the City of Meridian, and shall not constitute strip commercial development and encourage clustering of commercial development. 22. That under 11-2-409, ZONING SCHEDULE OF USE CONTROL, B Commercial, Professional and Sales Offices are permitted uses in the C-G district. FINDINGS OF FACT & CONCLUSIONS OF LAW Page 7 • 23. That pursuant to the instruction, guidance, and direction of the Idaho State Legislature, the City may impose either a development fee or a transfer fee on the property, which if possible would be retroactive and apply to all land lots in the City, because of the imperilment to the health, welfare, and safety of the citizens of the City of Meridian. 24. That Section 11-9-605 C states as follows: "Right-of-way for pedestrian walkways in the middle of long blocks may be required where necessary to obtain convenient pedestrian circulation to schools, parks or shopping areas; the pedestrian easement shall be at least ten feet (10') wide." 25. That Section 11-9-605 G 1. states as follows: "Planting strips shall be required to be placed next to incompatible features such as highways, railroads, commercial or industrial uses to screen the view from residential properties. Such screening shall be a minimum of twenty feet (20') wide, and shall not be a part of the normal street right of way or utility easement." 26. That Section 11-9-605 H 2. states as follows: "Existing natural features which add value to residential development and enhance the attractiveness of the community (such as trees, watercourses, historic spots and similar irreplaceable amenities) shall be preserved in the design of the subdivision;" 27. That Section 11-9-605 K states as follows: "The extent and location of lands designed for linear open space corridors should be determined by natural features and, to lesser extent, by man-made features such as utility easements, transportation rights of way or water rights of way. Landscaping, screening or lineal open space corridors may be required for the protection of residential properties from adjacent arterial streets, waterways, railroad rights of way or other features. As improved areas (landscaped), semi- improved areas (a landscaped pathway only), or unimproved areas (left in a natural state), linear open space corridors serve: FINDINGS OF FACT & CONCLUSIONS OF LAW paq® $ • • 1. To preserve openness; 2. To interconnect park and open space systems within rights of way for trails, walkways, bicycle ways; 3. To play a major role in conserving area scenic and natural value, especially waterways, drainages and natural habitat; 4. To buffer more intensive adjacent urban land uses; 5. To enhance local identification within the area due to the internal linkages; and 6. To link residential neighborhoods, park areas and recreation facilities." 2$. That Section 11-9-605 L states as follows: Bicycle and pedestrian pathways shall be encouraged within new developments as part of the public right of way or as separate easements so that an alternate transportation system (which is distinct and separate from the automobile) can be provided throughout the City Urban Service Planning Area. The Commission and Planning and Zoning Commission shall consider the Bicycle-Pedestrian Desictn Manual for Ada County (as prepared by Ada County Highway District) when reviewing bicycle and pedestrian pathway provisions within developments. 29. That 11-9-607 F, of the Subdivision Ordinance, states in part as follows: 8.~~ Financial Guarantees - The developer shall post financial guarantees for all approved on-site improvements if required pursuant to 9-606 C." 30. That proper notice was given as required by law and all procedures before the Planning and Zoning Commission were given and followed. CONCLUSIONS 1. That all the procedural requirements of the Local Planning Act and of the Ordinances of the City of Meridian have been met; including the mailing of notice to owners of property FINDINGS OF FACT & CONCLUSIONS OF LAW Page 9 • within 300 feet of the external boundaries of the Applicant's property. 2. That the City of Meridian has authority to annex land pursuant to 50-222, Idaho Code, and Section 11-2-417 of the Revised and Compiled Ordinances of the City of Meridian; that exercise of the City's annexation authority is a Legislative function. 3. That the Planning and Zoning Commission has judged this annexation and zoning use application under Idaho Code, Section 50- 222, Title 67, Chapter 65, Idaho Code, the Meridian City Ordinances, Meridian Comprehensive Plan, as amended, and the record submitted to it and things of which it can take judicial notice. 4. That all notice and hearing requirements set forth in Title 67, Chapter 65, Idaho Code, and the Ordinances of the City of Meridian have been complied with. 5. That the Commission may take judicial notice of government ordinances, and policies, and of actual conditions existing within the City and State. 6. That the land within the proposed annexation is contiguous to the present City limits of the City of Meridian, and the annexation would not be a shoestring annexation. 7. That the annexation application has been initiated by the Applicant who is the property owner, and is not upon the initiation of the City of Meridian. 8. That since the annexation and zoning of land is a legislative function, the City has authority to place conditions upon the annexation of land. Burt vs. The City of Idaho Falls, 105 FINDINGS OF FACT & CONCLUSIONS OF LAW Page 10 • • Idaho 65, 665 P.D 1075 (1983). 9. That the development of annexed land must meet and comply with the Ordinances of the City of Meridian and in particular Section 11-9-616, which pertains to development time schedules and requirements, and Section 11-9-605 M., which pertains to the tiling of ditches and waterways and 11-9-606 14., which requires pressurized irrigation. 10. That the Applicant's proposed use of the property is in compliance with the Comprehensive Plan, and therefore the annexation and zoning Application is in conformance with the Comprehensive Plan. 11. That the City adopted the Comprehensive Plan at its meeting on January 4, 1994, and has not amended the Zoning Ordinance to reflect the changes made in the Comprehensive Plan; thus, uses may be called for or allowed in the Comprehensive Plan but the Zoning Ordinance may not address provisions for the use; it is concluded that upon annexation, as conditions of annexation, the City may impose restrictions that are not otherwise contained in the current Zoning and Subdivision and Development Ordinances. 12. The Applicant has stated and represented that their intention is to operate a short distance telephone company, and are requesting zoning of General Retail and Service Commercial (C-G). 13. Therefore, it is concluded that if the Applicant is agreeable to developing the property under the commercial planned development process, and having that as a condition of annexation and zoning, the property should be annexed and zoned General Retail FINDINt~S OF FACT & CONCLUSIONS OF LAW Page 11 ~ i and Service Commercial (C-G); that it is concluded that if the Applicant is not so agreeable, the City would not have sufficient control over the property and it should not be annexed. 14. That, also as a condition of annexation and the zoning of C-G, the Applicant shall be required to enter into a development agreement as authorized by 11-2-416 L and 11-2-417 D; that the development agreement shall address, among other things, the following: 1. Inclusion into the development of the requirements of 11- 9-605 a. C, Pedestrian Walkways. b. G 1, Planting Strips. c. H, Public Sites and Open Spaces. d. K, Lineal Open Space Corridors. e. L, Pedestrian and Bike Path Ways. 2. Payment by the Applicant, or if required, any assigns, heirs, executors or personal representatives, of any impact, development, or transfer fee, adopted by the City, as agreed to by the Applicant in statements by its representative during the public hearing. 3. Appropriate berming and landscaping. 4. Submission and approval of any required plats. 5. Submission and approval of individual building, drainage, lighting, parking, and other development plans under the Planned Development guidelines, including plans for the storage units. 6. Harmonizing and integrating the site improvements with the existing residential development. 7. Establishing the 35 foot landscaped setback under the Comprehensive Plan and landscaping the same. 8. The sewer and water requirements. 9. The Meridian Comprehensive Plan is applicable to the land and any development. 10. Traffic plans and access into and out of the development. 11. Meeting the representations made a part of the application process. 12. And any other items deemed necessary by the City Staff. 15. That it is concluded that the annexing and zoning of the property is in the best interests of the City of Meridian, and it is concluded that the annexation shall be conditioned on meeting FINDINa3 OF FACT & CONCLUSIONS OF LAW Page 12 • the requirements of these Findings of Fact and Conclusions of Law and if they are not met the land may be de-annexed. 16. That, if annexed, all ditches, canals, and waterways shall be tiled as a condition of annexation and if not so tiled, the property shall be subject to de-annexation. 17. That, if annexed, the Applicant will be required to connect to Meridian water and sewer and resolve how the water and sewer mains will serve the land; that the development of the property shall be subject to and controlled by the Subdivision and Development Ordinance and development agreement. 18. That proper and adequate access to the property is available and will have to be maintained. 19. That, if annexed, these conditions shall run with the land and bind the applicant and its assigns. 20. With compliance of the conditions contained herein, the annexation and zoning of General Retail and Service Commercial (C- G) would be in the best interest of the City of Meridian. 21. That if these conditions of approval are not met, the property shall not be annexed. As trite as it may sound sure we make a living doing this, but our sincere objective will be to create a use for that property, project on that property that will be in the best interest of the community. If it isn't it will fail and we've had some level of success I guess of doing this very thing of researching the market and deciding what is best suited for a piece of property. I am sorry to ramble but my bottom line is I really don't know at this time, but our direction will be towards a shopping center much smaller than the one you just heard. Lee Longson, 3497 Hull Drive, Eagle, was sworn by the City Attorney. Longson:. Mr. Chairman and Commissioners, I have reviewed the comments that were made by the Assistant City Engineer Mr. Bruce Freckleton, and we do not have any problem with complying with these at a future date. He has requested on different issues of that we connect to the sewer, water and make proper access into Fairview Avenue. I would like to clarify just for the records the actual use of the structure that we have there. It is an old farmhouse and we intend on doing very light remodeling which we have basically just kind of cleaned it up a little bit. We are going to use it for a small business, very few employees, there will be very few entrances and exits onto Fairivew, probably ~ • • Meridian Planning & Zoning Commission May 9, 1995 Page 32 maybe 10 a day at the most. I know the report is based on 150. We will have no more impact on that area than it would be if it were rented as a home. We will not have any of what you would consider as consumer traffic of people coming in and out of the business because that is not the type of business that we intend on putting there. I would just like to recommend that we be given some special consideration there I guess as far as what we can use with the property. If the existing well or septic tank for example were to fail I would then connect to the major utilities that are available. But until the time that we actually do something with the property whether it be another commercial building, that we knock down the existing farm house or whatever at that time we would comply with whatever the City has recommended for us to do so. Thank you. Johnson: Thank you, Mr. Crookston you might want to address the issue of being required to connect to City services. Crookston: Our ordinances require connection to City sewer and water if the property is within 300 feet, I have no idea where the 300 feet is but that is our ordinance. Johnson: 300 feet of existing sewer and water utilities then you have to connect there are no options. If you get annexed, otherwise we don't annex you. Leeann Longson, 2497 Hull Drive, Eagle, was sworn by the City Attorney. Longson: Initially we are in the impact area with Ada County. Initially I made I appealed to them so that we could be commercial. They said that we are far ahead of our time for them so we should hit Meridian. The only thing that I would say is that we are within the 90 feet of the water, I know, I don't know how far the sewer is. Actually we would have loved to have gone through the County but I don't know why they thought we were ahead of their time. So maybe you could shed a little light on that if you know. Johnson: Well, you are just in our impact area, so and you are requesting annexation and zoning to the City of Meridian. Longson: Yes, but initially we were not. Johnson: But since you did that is why you are here. Longson: Okay, so you want me to just pay the fee and sit down, okay. Johnson: No, you can sit down and then send the check. Is there anyone else that would like to address the Commission on this issue? ITEM #12: PUBLIC HEARING: REQUEST FOR ANNEXATION AND ZONING OF 42.02 ACRES TO R-4 FOR WHITESTONE ESTATES SUBDIVISION BY WHITESTONE PARTNERSHIP: Johnson: I will now open the public hearing and ask the Applicant or a representative to address the Commission and present their plan. Charles Eddy, 1345 South Timridge, Boise, was sworn by the City Attorney. Eddy: (Inaudible) As stated this property is generally located in the east 1/2 of Section 14, Township 3 North, Range 1 East, more specifically this parcel is south of West Franklin Road, west of South Linder Road and adjacent to the Landing Subdivisions and north of Primrose Subdivision. The existing zoning for this particular parcel is RT which allows for 5 acre lots. The developer requests that this property be annexed into the City of Meridian and rezoned to R-4 to allow for single family development. Currently property to the east is zoned R-4 and adjacent properties are zoned R-1 and RT. The rezoning of this parcel to R-4 would comply with the recommendations of the Comprehensive Plan which allows for single family residential development in this particular area. The existing utilities are near this property in (inaudible) right here and has been identified by us as able to continue on to serve this piece of property.
