MERIDIAN, IDAHO FINDINGS OF FACT AND CONCLUSIONS The above entitled matter having come on for public hearing November 21, 1995, at approximately 7:30 o'clock p.m. on said date, at the Meridian City Hall, 33 East Idaho Street, Meridian, Idaho, tabled until December 5, 1995, and tabled again until December 19, 1995, the Petitioner appearing through his representative, Charlie Gongre, of Roylance Engineering, the Meridian City Council having heard and taken oral and .written testimony, and having duly considered the matter, the Meridian City Council makes the following: FINDINGS OF FACT 1. That notice of the public hearing on the vacation of the utility easement was published for two (2) consecutive weeks prior to the said public hearing scheduled for December 19, 1995, the first publication of which was fifteen (15) days prior to said hearing; that the matter was duly considered at the December 19, 1995, hearing; that the public was given full opportunity to COFFER INVESTMENTS, INC. Page 1 • • express comments and submit evidence; and that copies of all notices were available to newspaper, radio and television stations. 2. That this property is located East of Meridian Road and North of East Corporate Drive and is described as the Northerly 20 feet of Lot 6, Block 1 of Central Valley Corporate Park No. 1 (a recorded subdivision on file in Book 57 of plats at Pages 5332 and 5333, records of Ada County, Idaho.) and is owned by Applicant; that a note on the plat creates a 20' (twenty-foot) easement for drainage and utilities on the North and West of Lot 6 Block 1; that the Applicant proposes a vacation of the 20' utility and drainage easement situated on the North line of Lot 6 Block 1 and create a new fifteen-foot (15' ) easement along the North line of Lot 6 Block 1. 3. That the Applicant's submitted before the City Council an amended application showing the change from Central Valley Corporate Park No, 1 Lot 5 to Lot 6 in the vacation of the 20 foot easement and rededication of a 15 foot easement on the North by Coffer Investments, Inc. 4. That Idaho Power submitted partial release of easement; that the other utility companies, namely TCI Cable, U.S. West Communications, and Intermountain Gas Company and Nampa and Meridian Irrigation submitted no comments which objected to the vacation of the easements. 5. That the property is currently zoned C-G, General Retail & Service Commercial. 6. That Mr. Gongre testified before the Planning and Zoning COFFER INVESTMENTS, INC. Page 2 t • Commission public hearing, September 12, 1995, that as far as he is aware of the storm water drainage system at the site is an open ditch that is next to the service road that is on the same property as the canal, in which case it can be relocated if it needs to be, if the developer really feels like it is necessary to do so; that if it is found that the actual. location of the pipe is outside of the easement that the developer is proposing to relocate any piping and that would remain as an easement. 7. That Gary Smith, Meridian City Engineer, testified before the Planning and Zoning hearing, September 12, 1995, that the piping is in existence according to the design drawings; that it is the opinion of the Public Works Department of the City of Meridian that the easement needs to be maintained for the maintenance of the pipe; that it does drain a portion of the street to a catch basin and that pipe then runs to the east and then to the north along this easement then to the east continuing along the north side of this property to Nine Mile Drain; that if the easement is to be vacated then the pipe needs to be relocated in another easement. 8. That Larry Sale, of the Ada County Highway District, testified before the Planning and Zoning Commission, September 12, 1995, that the design plans for the storm drains indicate that it varies in depth from 8 feet in the street to about 10 feet deep along the property line; that the recommendation of the District is that the Applicant search for another means to reach their goals other than to vacate the easement and relocate the pipe. 9. That there was no public testimony objecting to the COFFER INVESTMENTS, INC. Page 3 . • vacation of the easements. 10. That the Assistant City Engineer, Bruce Freckleton submitted earlier comments to the Planning and Zoning Commission; that in his opinion, the existing 20 foot wide easement needs to remain in place; that the City of Meridian does not have jurisdiction on the operation and/or maintenance of the storm drain pipes; that consent for the easement relocation was not sought from the Ada County Highway District nor the Nampa and Meridian Irrigation District; that since the storm drain carries street runoff water directly to the Nine Mile Creek, that the consent of these two entities should be sought since the Ada County Highway District and possibly the Nampa and Meridian Irrigation District have jurisdiction over the operation and maintenance of this storm drain pipe; that if it is decided to approve this application, the easement along the westerly boundary should not be reduced in width to anything less than 10 feet. 11. That the Meridian Police Department, Meridian Fire Department, and Central District Health Department, submitted comments and such are incorporated herein as if set forth in full. 12. That the Nampa & Meridian Irrigation District submitted comments regarding Lot 6, Block 1; that the District has no facilities within the Lot 6, Block 1 of Central Valley Corporate Park #1, Drainage Easement and therefore, has no objection with the reduction in the width of this easement since it does not impact or encroach on any of the Irrigation District's facilities. 13. That approval was received by the Ada County Highway COFFER INVESTMENTS, INC. Page 4 .A • • District which considered this easement at their regularly scheduled meeting, November 8, 1995; that the release and dedication of the new storm drainage easement were approved. 14. That proper notice was given as required by law and all procedures before the Meridian City Council were given and followed. CONCLUSIONS 1. That all the procedural requirements of the Local Planning Act and of the Ordinances of the City of Meridian and of Idaho Code, Section 50-1306A have been met. 2. That the City of Meridian has authority to vacate easements pursuant to Idaho Code, Section 50-1306A and Section 11- 9-611A, Vacations and Dedications, of the Revised and Compiled Ordinances of the City of Meridian. 3. That since the Ada County Highway District recommended approval of the amended application to release the South 5 feet of an existing 20-foot wide drainage easement in a portion of Lot 6, Block 1 and since the Nampa and Meridian Irrigation District submitted a letter to the Assistant City Engineer, Bruce Freckleton, stating that the District has no facilities within the Lot 6, Block 1 of Central Valley Corporate Park #1, Drainage Easement and therefore, has no objection with the reduction in the width of this easement since it does not impact or encroach on any of the Irrigation District's facilities, the easement should be vacated. The variance request was for tiling of the ditch, the Eight .Mile Lateral. It was clearly spelled out that the size of pipe required for that is substantially greater than the 48 inch diameter that we use as a guideline. Therefore I would move that we adopt the findings of fact and conclusions as written. Corrie: Second Tolsma: It has been moved by Walt, second by Bob to approve the findings of fact and conclusions of law as written for the variance request by Kevin Howell and Dirk Marcum, roll call vote. I would move that it is decided that the application for a variance from 11-9-605 M is granted that the applicant shall not, let me start over. It is decided that the application or a variance from 11-9-605 M is granted that the applicant shall not the the Eight Mile Lateral, that the applicant shall place and construct landscaping along the Eight Mile Lateral as a condition of being granted the variance. MOTION CARRIED: All Yea ITEM #11: PUBLIC HEARING CONTINUED FROM DECEMBER 5, 1995: REQUEST FOR A VACATION OF AN EASEMENT BY JEFF COFFER: Tolsma: Is Mr. Coffer here? Dave Roylance, Roylance Engineering, was sworn by the City Attorney. Roylance: This is a request to vacate a 20 foot easement and replace it with a 15 foot • Meridian City Council December 19, 1995 Page 12 C~ easement along the north boundary of Lot 5, Central Valley Corporate Park. We have all the documents back from the appropriate utility companies and I have a list of those here. We have signed documents back and I believe Shari also has copies of these, we can ask in a minute. But we have signed documents back from TCt, US West, Idaho Power, Intermountain Gas, and City of Meridian Department of Public Works. We also notified all property owners within 300 feet and to my knowledge there was no negative concerns with this request. So with that we are asking that you approve this vacating of the 20 foot easement and creation of the 15 foot easement. Tolsma: Any questions of Council? Morrow. I have a question I guess to clear up some confusion. In my mind the findings as they come from P & Z are for Lot 5 Block 1 and the latest information is Lot 6, Block 1. Can you give me a hint as to what we are doing there? Roylance: I think what it was and I am not sure, another one of my associates is taking the lead on this and she could not be here tonight. Originally I believe we were pursuing an easement on Lot 5 and on Lot 6. As I understand it as I remember, ACRD did not approve it on Lot 5. Therefore we moved it to Lot 6. As I also understand it in discussions that I think my associate had with Shari that if we notified the property owners of the change from 5 to 6 that we would not have to go back to P & Z and we could come to City Council and conclude it here. So that is what we have done, we have a list of all property owners within 300 feet mailed out a notice of what we were doing and asked for responses be returned if there were any problems. Then we mailed out notices to all the utilities changing it from Lot 5 and 6 to just to 6. Morrow: I guess Dave the original application that I have before me dated July 19, essentially it says legal description of easement area to be vacated and the person or entity who is to receive the deed for the land and it is filled out that this is an easement for Lot 5, Block 1. So then, and that represents the western property line of Lot 5, 20 foot easement. According to the staff reports there was substantial objection by both ACHD and for storm drain purposes and I don't see anyplace in that application where it alluded to Block 6. The findings of fact and conclusions that came from P & Z are for Lot 5 and in tonights packet there is a reference to Lot 6 which is immediately east of Lot 5 and it is describing an easement on the north property line. So, I guess the confusion in my mind, I am not seeing any reference to Lot 5 and 6. I have seen a reference to Lot 5 on the original application, Lot 5 with respect to the findings and then we have a separate packet that is talking about Lot 6 block 1. Maybe Shari could give me some guidance as to where we are at. Stiles: Councilman Morrow and Council, this was originally noticed for Lot 5. It was denied • • Meridian City Council December 19, 1995 Page 13 by P & Z because of the objections of Ada County Highway District. Then they elected to go to Lot 6 and they were working out with the Highway District the particulars of this. It is not really a particular concern to the City except that these utility companies be notified. In talking with Wayne Crookston he agreed that it would be okay if they got waivers of notice from all of the property owners within 300 feet. Notifying them that a change has been made from Lot 5, to Lot 6. They did tum in those waivers and they also got letters of consent from all of the utilities that are involved with that vacation. That is where we are now. Tolsma: Mr. President, question for the Counselor, how do we get to where we need to be then? Obviously the findings are not correct. Crookston: That is correct, under our zoning ordinance for a change in the application the Zoning Administrator has the authority to determine if the change is significant and if she determines that it is significant then it should go back to Planning & Zoning. If she determines that it is not significant then it can go forward. So it is a decision by the Council to determine whether or not the change in the legal description is of sufficient difference than was initially started out with to decide whether or not the applicant has to go back to Planning and Zoning. Roylance: If I could interject, Wayne, isn't that also the purpose of those notices of waiver? So that those affected by this would have due process. By mailing out the notices I understand that solves that concern, at least that was my understanding of it. Crookston: That is why I suggested that be done it is still a Council decision as to whether or not they feel that it is enough of a significant change to require it to go back to Planning & Zoning. The problem when you change in essence the legal description the people that receive the mailing either initially or when they were sent out the second time changing the lot that is fine for those people (End of Tape) didn't care if it was Lot 5 but they may care if it is Lot 6. That is the only problem. Roylance: Well, if -you could support this we would appreciate it. I know our client is anxious to build on this lot. If we have to go back to P & Z so be it, but we would appreciate if it could be dealt with tonight. Tolsma: Any other questions for Mr. Roylance? This is a public hearing, is there anyone else from the public that wishes to offer testimony on this? Seeing none we can dose the public hearing. Corrie: Mr. President, again Shari do you find it significant enough that we should go back to Planning and Zoning. If I understand you right you said it was not. I think I am in agreement with that, this is not surrounded by anything residential, this is strictly a commercial project. It looks to me like at the very least we have to do new findings to clarify the issue because the findings we have don't apply to this at all. Crookston: That is correct. Morrow: I don't see any reason for it to go back to P & Z personally. Corrie: Nor do I. Morrow. So Mr. President, I move we instruct the City Attorney to prepare new findings of fact for Lot 6, Block 1. Collins: We have had some modifications to the original preliminary plat as submitted. Working in conjunction with Mr. Eddy to the west with his thinking on development proposals we changed a couple of the streets to continue through to the west. We have gone over the details with the staff and submitted a preliminary plat showing and reflecting those changes. All other details and comments in the staff report we have no problem with. We have worked with them on all points and they have been resubmitted. If there are any questions. I went around two weeks ago and I looked and I see that as we all have things are really starting to pop at the seams. It is getting exciting and it is getting stressful too for people. The excitement can be pretty overwhelming, I have a chance to make a development here now and I want to get it going. There is something to put a driving force into an individual or a firm to do a development. People are starting to do it all over town. I think that Meridian still has a great deal of zoned property available to be developed. Based on what I have seen and I would invite. you to go out and look around and look also and I am sure you have this is your community and you are here, you have vested interest in it and everything. That you please take a look at what is available and what has been sitting around, its locations and how the development is going. After you have done that I would like you to consider rejecting the rezoning at this time on this piece of property because of all the various disciplines of involvement from all different sources. You have got the Five Mile Creek, you have the cemetery adjacent to it. You have the property owners adjacent to it, irrigation. You have so many different things involved in it I think it takes a lot of consideration. To do justice to it I think you need to reject this request for rezoning and please review it again and maybe you will have a little bit better chance to make a very just recommendation. (Inaudible) certainly the map that I had was different as I look at the testimony and the process. Do we need to have new findings? Crookston: I believe that we do, not only because of the map but because we are actually dealing with in essence a new matter as an appeal. It still is a request for annexation and zoning which the first one was also. I think that there are maybe a need for the Council to think about it some so I would request that the findings be asked to be developed and bring it up at the next meeting. Rountree: Both letters indicate that the current easement contains storm water drainage system and the desire to be able to maintain that system. What is your position? Gongre: The storm water drainage system that I am aware from having visit the site is an open ditch that is next to the service road that is on the canals property. In which this case this can be relocated if it needs to be if the developer really feels like it is necessary to do that. We can relocate that thing. Johnson: Here is the letter for you from the City Engineer if you haven't had an opportunity to read that. That is another copy you can have. Gongre: In response to ACHD's letter, I would like to say we, that if we do find that the actual location of the pipe is outside of the easement that we are proposing to do then we understand that there is a cost to the developer to relocate any piping that is outside the area that would remain as an easement. Johnson: In effect you are saying that you would move it is that what you are saying? Gongre: Yes I am. Rountree: And with that moving there would be sufficient room in order to maintain the pipe? They indicated that (inaudible) 20 foot easement would be necessary to maintain the pipe. Gongre: I honestly have not looked at the depth of that pipe at this point so I honestly don't know the answer to that question. Johnson: Any further questions? Thank you very much, this is a public hearing is there anyone else from the public that vuould like to address the Commission on this application? Would the Public Works Department or ACRD wish to comment? Smith: Mr. Chairman, Commission members, we just went into the field to verify whether or not that pipe was in existence and according to the design drawings it was to be there and it is there. It does drain a portion of the street from the 1 think there is a catch basin at I am not sure the name of the street but it is the first street in from East 1st, there is a point of catch right there and that pipe runs to the east and then to the north along in this easement and then to the east continuing along the north side of this property to Nine Mile Drain. So if the easement is to be vacated then the pipe needs to be relocated in another easement I would assume. It is not our pipe, it belongs to, I guess it is the Highway District's storm drainage pipe.. I am not certain of that but Larry could speak to that. Johnson: Thank you Mr. Smith. Larry Sale, anything to add. Sale: Mr. Chairman, members of the Commission, for the record I am Larry Sale with ACHD. The design plans for the storm drains indicate that is varies in depth from S feet in the street to about 10 feet deep along the property line. Obviously anything can be relocated if you spend enough money I guess. We would recommend that the applicant search for another means to reach their goals other than to vacate the easement and relocate the pipe. So we would reaffirm our recommendation that the easement not be vacated. Certainly until the applicant provides the Highway District with an adequate plan for suitable relocation. According to the Central Valley Corporate Pazk No. 1, (Economic Development Grant Project ICDBG-88-111-29) Record Drawings prepared by James M. Montgomery, Consulting Engineers, there is an existing 15" diameter Storm Drain pipe that traverses north from E. Corporate Drive, 5 feet inside from the westerly line of Lot 5, Block 1. The pipe enters a manhole located 5 feet south and east of the northwest corner of the Lot, then the pipe traverses easterly across the back of the Lot, 5 feet inside from the northerly line and parallel with Corporate Drive. The existence of this pipe has been verified in the field by our staff. Please refer to the attached copy from the Record Drawings. In my opinion, the existing 20 foot wide easements need to remain in place. If for some reason that pipe needed to be dug up, the entire 20 feet would have to be utilized by equipment and personnel, however the City of Meridian doesn't have jurisdiction on the operation and\or maintenance of the Storm Drain pipes. My review packet contains a Relinquishment and Re-Dedication of Easement letter prepazed by Roylance & Associates, P.A., this letter doesn't indicate that consent was solicited from the Ada County Highway Dist. nor Nampa and Meridian brig. Dist. Since the Storm Drain pipe carries street runoff water directly to the Nine Mile Creek, I think that the consent of these two entities should be sought. The Ada County Highway Dist., and possibly the Nampa and Meridian brig. Dist., has jurisdiction over the operation and maintenance of this Storm Drain Pipe. If it is your desire to approve of this Vacation and Re-dedication, the easement along the westerly boundary should not be reduced in width to anything less than 10 feet. That Idaho Power submitted partial release of easement; that the other utility companies, namely TCI Cable, U.S. West Communications,___and Intermountain- Gas Company and Nampa and Meridian Irrigation submitted no comments which objected to the vacation of the easements. 4. That the property is currently zoned C-G, General Retail & Service Commercial. 5. That Larry Sale, of the Ada County Highway District, testified that the design plans for the storm drains indicate that it varies in depth from 8 feet in the street to about 10 feet deep -along the property- line; -that--~-he -recommendation of the District is that the Applicant search for another means to reach their goals other than to vacate the easement and relocate the pipe. 7. That there was no public testimony objecting to the vacation of the easements. 8. That the Assistant City Engineer, Bruce Freckelton submitted comments; that in his opinion, the existing 20 foot wide easement needs to remain in place; that the City of Meridian does not have jurisdiction on the operation and/or maintenance of the storm drain pipes; that consent for the easement relocation was not sought from. the P.~da County Highway District nor the Nampa and Meridian Irrigation District; that since the storm drain carries street runoff water directly to the Nine Mile Creek, that the COFFER INVESTMENTS, INC. That the Meridian Police Department, Meridian Fire Department, and Central District Health Department, submitted comments and such are incorporated herein as if set forth in full. 10. That proper notice was given as required by law and all procedures before the Planning and Zoning Commission were given and followed. CONCLUSIONS 1. That all the procedural requirements of the Local Planning Act and of the Ordinances of the City of Meridian and of Idaho Code, Section 50-1306A have been met. 2. That the City of Meridian has authority to vacate easements pursuant to Idaho Code, Section 50-1306A and Section 11- 9-611A, Vacations and Dedications, ~of the Revised and Compiled Ordinances of the City of Meridian. 3. That do to the comments of the Assistant to the City Engineer, Hruce Freckleton, that the existing 20' wide easement needs to remain i,m place, since the Ada County Highway District recommended that the Applicant search for another means to reach' their goals other than to vacate the easement and. relocate the COFFER INVESTMENTS, INC.
