Director, and in order to provide ainter-neighborhood connection/pedestrian path
without loosing a lot and having to undo and re-do utility work that is all ready
completed, it has been agreed to that awin-win situation for the City and the owner is
to affect only one lot on the approved final plat by requesting a reduction in the
minimum square footage requirement.
13. Minimum requirements needing to be reduced: Minimum square footage of a
residential lot (R-4 zone). Reduce it to allow the lot to have 7,393 square feet.
14- Difficulty or hardship compliance would cause- Sewer, water, storm drain,

19. electricity, and natural gas have all been installed. Completion of construction has
been postponed only due to weather. At the final plat hearing, no comments from
staff or Council were made regarding this issue. As the Council knows, the
commencing of utility construction for a subdivision is contingent on final plat
approval. When final plat approval was received, with no comments from the City
Planner, we proceeded with construction knowing that our layout and design was
acceptable to the Council.
20. Comprehensive plan: This request complies with the comprehensive plan by
providing for ainter-neighborhood connection/pathway while minimizing the impact
to the land owner, the existing neighborhood, and the lot.

ordinance? ACHD does not require a stub street to the south of this phase.
We have agreed to provide a stub street to the adjoining 40 acre parcel in one
of the next phases. To fit a pathway into the plat, without losing a lot and
having to undo and redo some utility work already completed, one lot needs to
be reduced in square footage: ~ .
4. What special conditions or circumstances exist that were not
a resul t of your actions? ~~ the final plat and construction plans
were approved by the City, utility construction began. That construction is
now substantially complete. The City Planner made~no comment on the final
plat at the hearing, nor shoztly thereafter. .The City Planner has recently
requested a pedestrian pathway for future inter-neighborhood connection.

Tn good fatith we obtained all the necessary approva]s for construction to
begin. Had we received more timely direction and/or input from the City abo~f

3. The ACIID Capital Improvement Plan indicates that Linder Road
is ,approved for use of Road Impact Fee funds to increase its
capacity; therefore, Road_Impact Fee. offsets may be given for
construction of the roadway improvements along Linder Road
and for right-of-way dedication in addition to what exists
now. If the developer wishes to be paid for the additional
right-of-way, he/she must submit an application to the impact
'fee administrator prior to breaking ground, in accordance. with
Section 15 of ACRD Ordinance X188.
4. Staff recommends that a stub street be provided to the north
side of this project .for future inter-neighborhood connection
when that parcel becomes redeveloped.. The parcel in the north-
west corner of this project is small enough so that it could
`be,.,allowed its own street connection to Linder Road without a
significant effect to the traffic. flow .
5. This application is scheduled for public hearing. by the Meridi-
an,Flanning & Zoning Commission on February 8', 1.994.
SITE SPECIFIC REQUIREMENTS:
1. Dedicate 30-feet of right-of-way from the centerline of Linder
Road abutting parcel (5 additional feet). The. owner will be
compensated for this additional right-of-way from available
impact fee revenues in this benefit zone.
2. Provide a deposit to the Public Rights-of-Way Trust Fund at
the District for the required. street improvements (5-foot
sidewalk) on Linder. Road abutting parcel.

Section 54-1215.
4. Provide written approval from the appropriate irriga-
tionfdrainage district authorizing storm runoff into their
system..
5. Locate obstructions (utility facilities, irrigation and drain-
age appurtenances, etc.} outside of the proposed street im-
provements. Authorization for relocations shall be obtained
from the appropriate entity.
6. Continue existing irrigation and drainage systems across par-
cel.
7. Submit three sets of street construction plans to the District
for review and. appropriate action.
_ 8. Submit site drainage plans and. calculations. for review and
appropriate action by ACRD. The .proposed. drainage system
shall conform to the requirements of the City of Meridian and
shall retain all storm water on-site.
Public street drainage facilities shall be located in the
public right-of-way or in a drainage easement set aside specif-
ically for that use. There shall. be no trees, fences, bushes.,
sheds, or other valuable amenities placed. in said easement.
Drainage easements. and their use restrictions shall be noted
on the plat.
9. Provide design data for proposed. access. to public streets for
review and agpropriate.action by ACRD.
10. Locate driveway curb cuts a minimum of 5-feet from the side
.lot property lines when the driveways are. not being shared
with the adjacent property.
11. .Developer shall provide the District with a copy of the record-
ed plat prior to the installation. of street name signs.
Street signs will not be ordered until all fees have been paid
and a copy of the. recorded plat. has been provided to ACRD
staff. The copy of the recorded plat shall. show the recording
information as inscribed by the Deputy County Recorder.
12. Install a stop sign on every unsignalized approach of a
.project street to an intersection involving a collector or
arterial. as the cross-street. The stop sign shall be in-

doing is changing from the number of occupancy in certain apartment housing, hotels,
motels, enacting a sprinkler ordinance to sprinkle buildings that are above a certain level
of occupancy, heights, and get protection to the public that is living in these rented
apartments. This transpired in Nampa, we are trying to following suit. I look forward to it
being adopted throughout the state.

FINDINGS OF FACT AND CONCLUSIONS
The above entitled variance request having come on for
consideration on February 21, 1995, at approximately 7:30 o'clock
p.m. on said date, at the Meridian City Hall, 33 East Idaho Street,
Meridian, Idaho, and the Applicant's representative, Tucker Johnson
appearing and the City Council having heard and taken oral and
written testimony, the City Council of the City of Meridian makes
the following:
FINDINGS OF FACT
1. That notice of the public hearing on the variance was
published for two consecutive weeks prior to the scheduled hearing
for February 21, 1995, the first publication of which was fifteen
(15) days prior to said hearing; that the matter was duly
considered at the February 21, 1995, hearing; that copies of all
notices were available to newspaper, radio and television stations.
2. That the notice of public hearing is required to be sent
to property owners within 300 feet of the external boundaries of
the land being considered pursuant to 11-2-416 E., 11-2-419 D., and
11-9-612 B. l.b. of the Revised and Compiled Ordinances of the City
of Meridian; that this requirement has been met.
3. That Tucker Johnson appeared on behalf of the Applicant,
Skyline Development Company; that Skyline Development is requesting

a variance to the minimum lot size in the R-4 Zone, which is 8,000
square feet, for Lot 12 Block 12 to provide a strip for a parkway,
greenbelt pathway on that lot so that the maximum block length of
1,000 feet is not exceeded; that the lot will be dedicated to the
homeowners association to be maintained as per the City's fire
department request to keep free of trash, weeds and so forth.
4. That Mr. Johnson testified that the net square footage of
the lot would be approximately 7,393; that this variance impacts
only one lot, making the backyard slightly smaller than the counter
part to the east; that the preliminary plat was approved without
any reference to or comments about block length; that in Mr. Wayne
Forrey's opinion, as he was the one who reviewed the preliminary
plat at that time, he didn't see any problem with it.
5. That Mr. Johnson also stated that the subdivision
preliminary was approved, as was the final plat, without any
comment on the block length in the block where this lot is located
and that the problem with the block length was only pointed out by
the City staff to him when the he came into to have the final plat
signed.
6. That in the application the representative states that in
cooperation with the City Planning Director, and in order to
provide an inter-neighborhood connection/pedestrian path without
loosing a lot and having to undo and re-do utility work that is all
ready complete, it has been agreed to that a win-win situation for
the City and the owner is to affect only one lot on the approved
final plat by requesting a reduction in the minimum square footage

requirement.
7. That the ZONING SCHEDULE OF BULK AND COVERAGE CONTROLS in
Section 11-2-410 A of the Zoning Ordinance, allows single family
dwellings in the R-4 District, requires that the lot size in the R-
4 Zone be 8,000 square feet; Section 11-9-605 E. of the Subdivision
and Development Ordinance states as follows:
"Every block shall be so designed as to provide two (2) tiers
of lots, except where lots back onto an arterial street,
natural feature or subdivision boundary; blocks shall not be
less than five Hundred feet (500') nor more than one thousand
feet (1,000') in length."
8. That the property is zoned R-4.
9. There was no testimony from the public, either opposing
or approving of the Application.
CONCLUSIONS
1. That all the procedural requirements of the Local
Planning Act and of the Ordinances of the City of Meridian have
been met including the mailing of notice to owners of property
within 300 feet of the external boundaries of the Applicant's
property.
2. That the City has authority to grant variances pursuant
to Section 11-2-419 of the Zoning Ordinance and pursuant to Section
11-9-612 of the Development Ordinances.
3. That the City Council has judged this application by the
guidelines, standards, criteria, and policies contained in the
Zoning Ordinance and upon the record submitted to it and the things
upon which it may take judicial notice.
4. That the Council may take judicial notice of its own

proceedings, those of the Commission, governmental statutes,
ordinances, and policies, and of actual conditions existing within
the City and the State.
5. That the following provision of Section 11-2-419 A, of
the Zoning Ordinance, are noted which are pertinent to the
Application:
11-2-419 A.
"The Council may authorize in specific cases a variance
from the terms of this Ordinance or from the Subdivision
and Development Ordinances as will not be contrary to the
public interest where, owing to special conditions, a
literal enforcement of the provisions of this Ordinance
would result in unnecessary hardship. No non-conforming
use of neighboring lands, structures or buildings in the
same district and no permitted or non-conforming use of
lands, structures or buildings in other districts shall
be considered grounds for issuance of a variance.
Variances shall be granted only where strict application
of the provisions of this Ordinance would result in
unnecessary hardship. A variance application does not go
to the Commission unless directed by the Council."
6. That the specific requirements regarding a variance
that must be evidenced and found by the City Council are as
follows:
11-2-419 C. FINDINGS
A variance shall nots be granted unless (as a result of a
public hearing) the Council makes a statement of
supportive reasons based directly on the evidence
presented to it which supports conclusions that the
mentioned standards and conditions of this Ordinance have
been met by the applicant and unless all of the following
exist:
1. That there are such special circumstances or
conditions affecting the property that the strict
application of the provisions of this Ordinance would
clearly be impracticable or unreasonable;
2. That strict compliance with the requirements of
this Ordinance would result in extraordinary

hardship to the owner, subdivider or developer
because of unusual topography, other physical
conditions or other conditions which are not self-
inflicted, or that these conditions will result in
inhibiting the achievements or the objectives of
this Ordinance;
3. That the granting of the specified variance
will not be detrimental to the public's welfare or
injurious to other property in the area in which
the property is situated;
4. That such variance will not have the effect of
altering the interest and purpose of this Ordinance
and the Meridian Comprehensive Plan.
7. That regarding Section 11-2-419 C it is specifically
concluded as follows:
a. That there are special circumstances or conditions
affecting the property that the strict application
of the provisions of the applicable ordinances
would clearly be unreasonable since the subdivision
plat was before the City in the preliminary and
final plat applications but the violation of the
block length was not discovered by the City and
brought to the Applicant's attention.
b. That strict compliance with the requirement that there
only be at least 8, 000 square foot single family dwelling
lots in the subdivision would result in extraordinary
hardship to the Applicant as a result of factors not
self-inflicted since the plat application were before the
City but the City did not bring the violation to the
attention of the Applicant.
c. That the granting of .the specified variance would
not be detrimental to the public's welfare or
injurious to other property in the area in which
the property is situated, in that the lot would be
approximately 7,400 square feet and the subdivision
would have pedestrian access to the property to the
south.
d. That such variance would not have the effect of
altering the interests and purposes of the required
maximum square footage in the R-8 zone.
8. That it is concluded the Application should be granted.

Kingsford: At this time I will open the public hearing and invite the owner or his designee
to speak first.
Tucker Johnson, 5635 North Eagle Road, was sworn by the City Attorney.
Johnson: This request comes after working with Shari Stiles on staff. From my
perspective this is the current events that transpired, back when we annexed this property
into the City and then we proceeded with the preliminary plat. The preliminary plat was
approved without any reference to or comments about block length. The preliminary plat
was approved essentially as you see it on the current plat. Then when the final plat came
through it was approved without any comments from staff regarding that issue. So we
proceeded forward and in the process of signing the plat that is where the issue came up
about block length. Wayne Forrey, who I have been in discussion with was the original

staff member who reviewed the preliminary plat. In his opinion the way he did it he didn't
see any problem with it. So it was frankly a little surprising to me to come back looking
forward to receiving the signed plat that it had become an issue. In cooperation with and
in the spirit of compromise Shari and I have talked over the issue and a win win situation
would be to provide a lot, a strip for the park~niay, a greenbelt pathway on that lot. 1 don't
know if you have a copy of the plat and kind of where that falls, in your packets that would
be visually, here it is in red on the plat. So it impacts one lot which vwuld make that lot very
similar to the lots right next to it on the east side, this side which are part of the preliminary
of another preliminary plat. Anyway the request is to grant the variance to the minimum
lot size because to put that pathway in there we need the space to put it. It was either take
out a complete lot or request a variance to impact just one lot. The lot still remains
buildable, the backyard would be slightly smaller than the counter parts to the east. Any
questions?
Morrow. I have a couple questions, what is the current lot size in terms of square footage?
Johnson: I know it is over 8,000 square feet, I don't have that, I left that sheet in my office.
I have the net.
Morrow. What would the new net be?
Johnson: 7,393, just about 600 feet is what we take out.
Morrow. My next question relates to the pathway, that pathway lot will be dedicated to the
homeowners association?
Johnson: That would be correct and they would have the responsibility to maintain it as
per the City's fire departments request to keep it free of trash and weeds and so forth.

Crookston: I am sorry Tucker, you mentioned a variance, at least as I heard it, a variance
to the block length.
Johnson: He is correct in a sense that is where it started, this solves from staffs
perspective and the ordinance perspective the block issue. There will be a break.

Stiles: The ordinance I believe requires a 5 foot paved pathway with landscaping on each
side.
Johnson: That is fine, may I ask the question then, would there be a problem with
eliminating the landscaping just have the full width be paved from fence to fence thus
decreasing the maintenance perhaps headache. Homeowners have a tendency to forget
something that is not in their yard. I through that out as a question, not a particular request.
Kingsford: The reason for the ordinance is to have it look kind of attractive and not just
paved.
Morrow. Well, if it is required by ordinance we would also have to have a variance on that.
