CHARACTERISTICS WHICH MAKE THIS CONDITIONAL USE DESIRABLE:
This"property is located on Eagle Road just north of Interstate I-84. The
proximity to the interstate makes it an ideal location for a travel center
which provides gas and food service.
There are currently no other facilities like this on Eagle Road.
I'~rmediately across Eagle Road from 'this property is the new St. Luke's Regional
Medical Center.

NOTICE OF HEARING
NOTICE IS HEREBY GIVEN pursuant to the Ordinances of the City of Meridian and
the Laws of the State of Idaho, that the Planning and Zoning Commission of the City of
Meridian will hold a public hearing at the Meridian City Hall, 33 East Idaho Street,
Meridian, Idaho, at the hour of 7:30 p.m., on October 10, 1995, for the purpose of
reviewing and considering the Application of Jackson Food Stores, Inc. for a Conditional
Use Permit of approximately 4.5 acres of land located in Lot 11 of the Amended Plat of
Magic View Subdivision, Meridian, Ada County, Idaho, and which property is generally
located at 625 Eagle Road, North of I-84. The Application requests a Conditional Use
Permit for a drive thru window for travel center providing gas and food service.
A more particular legal description of the above property is on file in the City Clerk's
office at Meridian City Hall, 33 East Idaho Street, and is available for inspection during
regular business hours.
A copy of the Application is available upon request. Any and all interested persons
shall be heard at said public hearing and the public is welcome and invited to submit
testimony.

As you know, this office represents Jacksons Food Stores, Inc. ("Jacksons"), which
is the applicant in the above-referenced application to move a traffic signal to Eagle Road (SH
55) and Magic View Drive. We are writing on behalf of Jacksons.
After having had a series of conversations over the course of spring and early.
summer with St. Luke's Regional Medical Center, our client, Jacksons, has regrettably been
compelled to the conclusion that moving forward with its application and transferring the traffic
light from St. Luke's driveway to Magic View Drive will not be economically feasible. We
have, therefore, been asked to request that the above-referenced application be deemed withdrawn
and that no further action be taken with respect to it. This request is in large part premised on
the understanding that the application previously filed by the Ada County Highway District
("ACHD") to convert the present three-way traffic signal at the intersection of St. Luke's entrance
drive and Eagle Road to a four-way traffic light to serve a future street extending to the west will
not proceed further once the Jacksons application has been withdrawn. If that fundamental
premise is incorrect we do not want to withdraw our application unless and until there has been
an appropriate disposition of the ACRD application. Please advise as to whether our
understanding on this critical fact is correct.

Dear Jerry:
l am writing this letter in response to your letter dated December 11th and signed by
Steve Jarsky. l do have some concerns in regard to this letter, i. e., the ability of the
drain to carry future flows. This drain is a subterranean drain, it has been a practice
of the District for several years to accept the predeve/opment flows based on the 25-
year storm. The District has not changed its policy providing we have a license
agreement and they are practicing good BMP's on the return f/ow of the water.
As far as the F. E.M.A. studies, / am not an expert in this field, but l do know the
physical facility itself and /don't believe that the projected flows that F. E. M.A. has
projected will ever reach this area, as it is necked down in the C/overda/e Road area
to a 30"pipe in several locations. This is not a major concern as far as future flows
go because of the minima/ amount that would come off of the Jackson Store area.
The District's operation and maintenance would be protected with a license
agreement. As of this time, we have not comp/eted a review and have only spoken
with the owners and their representatives. Theoretical/y speaking, l hesitate to make
any statements before the District's engineering staff has a chance to review the
project.
As far as your third concern becoming a precedence for similar proposals, /don't feel
a precedence wi// be set, as /mentioned ear/ier, we sti// accept pre-deve%ped flows
based on the 25-year storm with BMP's for design on the return flows along with a
license agreement to protect the District's interest.

Dear Ms. Higgins:
We have become aware of an application being made by Jackson Food Stores to move the
signal light on Eagle Road at the northwest corner of our property to a new location on Eagle
Road at the intersection of Eagle Road and Magic View Drive. As you know, St. Luke's owns
approximately 40 acres at the northeast corner of Interstate 84 and Highway 55. The existing
signal was installed and paid for by St. Luke's in connection with the construction of the St.
Luke's Meridian Medical Center following approval by the Idaho Transportation Department
and ACHD.
St. Luke's has met with Mr. Jackson and his counsel, the Chevron applicants, and spoken
with some of the neighbors to the north. We would support moving the signal so long as the
construction was done at no cost to St. Luke's and that St. Luke's be compensated for those
changes that would need to be made to the entrance of St. Luke's property to accommodate
the new location of the signal. While we are concerned about reimbursement of the costs,
and unless there are other issues of which we are not aware, we are willing to work with all
concerned parties as we do not find the signal relocation to be any disadvantage in the
foreseeable future.

Johnson: At this time I will open the public hearing, is the applicant or representative here
that would like to address the Commission, please come forward, you need to be sworn.
Dale Binning, 1590 Shenendoah Drive, Boise, was sworn by the City Attorney
Binning: This is a request to locate two very small satellite quick service restaurants within
an existing, or Jacksons travel center which is currently under construction. This was
previously, an application for annexation and rezone and a conditional use have already
gone through but we failed to include the drive thru window in any of the applications so
this is a follow up to that. I would be glad to answer any questions that you may have.
Johnson: Thank you, any questions of the applicant's representative?
Rountree: You indicated there would be two restaurants serviced by one drive thru
window?
Binning: Yes
Hepper: Where is the nearest residence from your property? I have a plat here for Magic
View Subdivision, is there. a house here? Mr. Moore I think was here last time and testified
and he had no objection to your thing.- Where is his house located from your property do
you know?
Binning: I got the impression it was across the street on the comer but I don't think there
is a house there so maybe it is the next (inaudible).

Hepper: I was thinking it was right in here someplace.
Binning: He may not have a residence he may just own a lot.
Hepper: But there is one directly the west of your property is that correct? Across the
street?
Binning: Yes (inaudible) I might add that these restaurants are kind of a new concept in
our area, they are very small, they are about 400 square feet, there is no food preparation,
everything is pre-cooked and brought in. They are just an extension of the typical service
counter that you would find at a Jacksons the hot dogs and coke and soft drinks and it
extends on around to pick up an additional service counter for in this case it looks like
Blimpies and Taco Bell.
Johnson: Any other questions? Thank you, this is a public hearing, is there anyone else
that would like to ask a question or address the Commission on this application? Seeing
no one then I will close the public hearing at this time.

The following are in addition to requirements of the Conditional Use Permit granted by the City
Council for a convenience store:
1. A Certificate of Occupancy is required prior to opening. Occupancy will be contingent
upon meeting all zoning, building code, public works, Fire Department and agency
regulations.
2. Illumination shall be designed to not cause glare or adversely impact neighboring
residential areas.
3. Perimeter fencing shall be provided along the southern and western project boundaries
to contain debris.. Temporary perimeter fencing should be installed to contain
construction debris.
4. Speaker location is not shown -system shall be designed to not be louder than 55 decibels
at neighboring property line.
5. Signs shall meet the Uniform Sign Code and City Ordinance.

FINDINGS OF FACT AND CONCLUSIONS
The above entitled matter having come on for public hearing
October 10, 1995, at the hour of 7:30 o'clock p.m., on said date,
at Meridian City Hall, 33 East Idaho Street, Meridian, Idaho, the
Applicant's representative, Dale Binning, appearing, the Planning
and Zoning Commission of the City of Meridian having duly
considered the evidence and the matter makes the following Findings
of Fact and Conclusions:
FINDINGS OF FACT
1. That a notice of a public hearing on the Conditional Use
Permit was published for two (2) consecutive weeks prior to the
said public hearing scheduled for October 10, 1995, the first
publication of which was fifteen (15) days prior to said hearing;
that the matter was duly considered at the October 10, 1995,
hearing; that the public was given full opportunity to express
comments and submit evidence; and that copies of all notices were
available to newspaper, radio and television stations.
2. That the property is located within the City of Meridian;
the property is described in the application which description is
incorporated herein; that the property is approximately 4.5 acres

in size.
3. That the property is zoned C-G, General Retail and
Service Commercial, which requires a conditional use permit for
drive through window.
4. That the General Retail and Service Commercial District
is described in the Zoning Ordinance, 11-2-408 B. 11. as follows:
(C-G ) General Retail and Service Commercial : The purpose
of the (C-G) District is to provide for commercial uses
which are customarily operated entirely or almost
entirely within a building; to provide for a review of
the impact of proposed commercial uses which are auto and
service oriented and are located in close proximity to
major highway or arterial streets; to fulfill the need of
travel-related services as well as retail sales for the
transient and permanent motoring public. All such
districts shall be connected to the Municipal Water and
Sewer systems of the City of Meridian, and shall not
constitute strip commercial development and encourage
clustering of commercial development.
5. That the use proposed by Applicant, a drive-in
establishment, is a specifically allowed conditional use in the
Zoning Schedule of Use Control, 11-2-409 B.
6. That the property is located on Eagle Road just North of
Interstate I-84; that immediately across Eagle Road is the new St.
Luke's Regional Medical Center.
7. That Jackson's Food Stores, Inc. is the record owner of
the above referenced property and has consented to the application
and has requested this conditional use and the application is not
at the request of the City of Meridian.
8. That the application is for locating two very small
satellite quick service restaurants within the existing Jackson's

travel center using a drive through window to service both
restaurants, which at this time looks to be like a Blimpies or Taco
Bell; that there is no food preparation and all the food is pre-
cooked and brought in; that this will extend the service counter
you find at Jackson's with the hot dogs and soft drinks.
9. That there was no public testimony given.
10. That the City Planning Director, City Police and Fire
Departments, Central District Health Department, Nampa-Meridian
Irrigation District and the Ada County Street Name Committee
submitted comments and they are incorporated herein as if set forth
in full.
11. That Planning and Zoning Administrator, Shari Stiles,
commented that a Certificate of Occupancy is required prior to
opening; that occupancy will be contingent upon meeting all zoning,
building code, public works, Fire Department and agency
regulations; that illumination shall be designed to not cause glare
or adversely impact neighboring residential areas; that perimeter
fencing shall be provided along the southern and western project
boundaries to contain debris and that temporary fencing should be
installed to contain construction debris; that speaker location is
not shown; that the system shall be designed to not be louder than
55 decibels at neighboring property line and that all signs shall
meet the Uniform Sign Code and City Ordinance.
12. That the Meridian City Fire Department commented that all
codes be met with water hydrants and water pressure requirements.

13. That proper notice has been given as required by law and
all procedures before the Planning and Zoning Commission have been
given and followed.
CONCLUSIONS
1. That all the .procedural requirements of the Local
Planning Act and of the Ordinances of the City of Meridian have
been met including the mailing of notice to owners of property
within 300 feet of the Applicant's property.
2. That the City of Meridian has authority to grant
conditional uses pursuant to 67-6512, Idaho Code, and, pursuant to
11-2-418 of the Revised and Compiled Ordinances of the City of
Meridian.
3. That the City of Meridian has authority to place
conditions on a conditional use permit and the use of the property
pursuant to 67-6512, Idaho Code, and pursuant to 11-2-418(D) of the
Revised and Compiled Ordinances of the City of Meridian, Idaho.
4. That 11-2-418 C) of the Revised and Compiled Ordinances
of the City of Meridian sets forth the standards under which the
Planning and Zoning Commission and the City Council shall review
applications for Conditional Use Permits; that upon a review of
those requirements and a review of the facts presented and the
conditions of the area, the Planning and Zoning Commission
concludes as follows:
a. The use, would in fact, constitute a conditional use
and a conditional use permit is required by ordinance.

b. The use should be harmonious with and in accordance
with the Comprehensive Plan but the Zoning Ordinance
requires a conditional use permit to allow the use.
c. The use apparently would be designed and
constructed, to be harmonious in appearance with the
intended character of the general vicinity.
d. That the use would not be hazardous nor should it be
disturbing to existing or future neighboring uses.
e. The property does not have sewer and water service
available at this time but it will have to be provided by
Applicant prior to opening.
f. The use would not create excessive additional
requirements at public cost for public facilities and
services and the use would not be detrimental to the
economic welfare of the community.
g. The use would not involve a use, activity, process,
material, equipment or conditions of operation that would
be detrimental to person, property or the general welfare
by reason of excessive production of traffic or noise.
h. That sufficient parking for the property and the
proposed use will be required.
i. The development and use will not result in the
destruction, loss or damage of a natural or scenic
feature of major importance.
5. That all Ordinances of the City of Meridian must be met,
including but not limited to the Sewer and Water Ordinances, the
Uniform Building Code, Uniform Fire Code, Uniform Plumbing Code,
Uniform Electrical Code, the Uniform Mechanical Code, the Fire and
Life Safety Code, all parking and landscaping requirements.
6. That the comments of the Planning and Zoning Director,
City Police and Fire Departments, Assistant to the City Engineer
and the Central District Health Department must be complied with.

STORMWATER MANAGEMENT RECONIl~NDATIONS
We recommend that the first one half inch of stormwater be pretreated through a grassy swale
prior to discharge to the subsurface to prevent impact to groundwater and surface water quality.
The engineers and architects involved with the design of this project should obtain current best
management practices for stormwater disposal and design a stormwater management system that
is preventing groundwater and surface water degradation. Manuals that could be used for
guidance are:

ITEM #10: PUBLIC HEARING: REQUEST FOR A CONDITIONAL USE PERMIT FOR A
DRIVE THRU WINDOW FOR TRAVEL CENTER BY JACKSONS FOOD STORES:
Johnson: At this time I will open the public hearing, is the applicant or representative here
that would like to address the Commission, please come forward, you need to be sworn.
Dale Binning, 1590 Shenendoah Drive, Boise, was sworn by the City Attorney.
Binning: This is a request to locate two very small satellite quids service restaurants within
an existing, or Jacksons travel center which is currently under construction. This was
previously, an application for annexation and rezone and a conditional use have already
gone through but we failed to include the drive thru window in any of the applications so
this is a follow up to that. 1 would be glad to answer any questions that you may have.
Johnson: Thank you, any questions of the applicant's representative?
Rountree: You indicated there would be two restaurants serviced by one drive thru
window?
Binning: Yes
Hepper: Where is the nearest residence from your property? I have a plat here for Magic
View Subdivision, is there a house here? Mr. Moore 1 think was here last time and testified
and he had no objection to your thing. Where is his house located from your property do
you know?
Binning: I got the impression it was across the street on the comer but I don't think there
is a house there so maybe it is the next (inaudible).

Hepper: I was thinking it was right in here someplace.
Binning: He may not have a residence he may just own a lot.
Hepper: But there is one directly the west of your property is that correct? Across the
street?
Binning: Yes (inaudible) I might add that these restaurants are kind of a new concept in
our area, they are very small, they are about 400 square feet, there is no food preparation,
everything is pre-cooked and brought in. They are just an extension of the typical service
counter that you would find at a Jacksons the hot dogs and coke and soft drinks and it
extends on around to pick up an additional service counter for in this case it looks like
Blimpies and Taco Bell.
Johnson: Any other questions? Thank you, this is a public hearing, is there anyone else
that would like to ask a question or address the Commission on this application? Seeing
no one then I will close the public hearing at this time.
Rountree: Mr. Chairman, I move that we have Council prepare findings of fact and
