Howell and Dirk Marcum we hereby submit the attached Conditional Use Permit application to be scheduled for the November 14, 1995, Planning & Zoning Commission meeting. This proposed Conditional Use Permit application is for the construction of a building on the easterly portion of approximately 4.21 acres of land zoned I-L in the City of Meridian. The building may contain an automobile/recreational vehicle repair shop and additional uses such as; window tinting, windshield repair and U-haul rental office.. Theses additional uses are allowed through the conditional use process as set forth in the Zoning Schedule Of Use Control in the Zoning and Development Ordinance. A 35' wide landscape strip along Franklin Road is being provided in conformance with the Comprehensive Plan and fencing will be constructed along the perimeter of the development. As mentioned previously the overall site contains approximately 4.21 acres. As shown on the site plan the easterly portion of this land is the Conditional Use Permit and the westerly portion is the future area of development for amini-storage facility as allowed by the Zoning Ordinance in an I- Lzone. The site plan shows the proposed conditional use and a conceptual layout for the future mini-storage facility. This proposed development is adjacent to similar commercial and light industrial uses and follows the trend of development along the North side of Franklin Road. • This development is in substantial conformance with the Meridian City Zoning and Development Ordinance and Comprehensive Plan. That is kind of a no brainer. A large part of his problem I think in terms of I think the man is his own worst enemy to some degree. This is not really the proper forum and the proper hour for you and I to be discussing this, maybe the three of us can discuss it at a future point. But I would hope that you vuould give the man some advice about being compatible with his neighbors, with his buyers already. I know that in our business your best advertising is from satisfied customers. Obviously to me it doesn't sound tike he has very many. That has got to cost him lot sales. So, maybe, you can use your powers of persuasion to begin turning the guy around and dealing with some of these fairly simple issues to start with and you can get into the more complex ones and he gets on down the road and makes a buck or two the people that buy are happy with the product they got and the City is happy because we have happy citizens and don't' have to deal with some of these kinds of issues that we shouldn't have to be dealing and that we by and large don't have to deal with other developers. Just a point of observation. McColl: I also recognize that this is probably not, procedurally the appropriate time but the substantively I have certainly had my eyes opened and I want to assure Mr. Luellen and Mr. Bell and Mr. Shipley that I have made notes of all the comments that they had and 1 will discuss them all with my client. I can be to a certain extent a point of contact with respect to some of the matters that are more in the area of legal issues. Your comments have not gone unnoticed certainly by me and all I can do is represent to you that I will visit with my client on these matters. Marcum: My name is Dirk Marcum, Mr. President and members of the Council so far on my project I have come up with my revised landscape plan that fully with all of the considerations- of the size and species that were required. So I have got that, I have a • Meridian City Council December 19, 1995 Page 75 preliminary elevation of the building which was asked for. So I have got all my paperwork done there. I was advised by Counsel to contact Elaine Schlekeway which I have on a few occasions got with her. So I guess I will let her speak and then I will go from there unless there are any questions from the Council? Scheleway: Elaine Williamson Schelekeway, my house sits fairly close to the property that Dirk Marcum is wanting to develop. We have had quite a few conversations between the two of us. I am mostly concerned about the closeness of the sheds that are on the east side of my house which is fairly close to the fence. He has said that he would be willing to set them back the ones that are closest to my house. So it vuould be easier for us to see out of our windows which I have five windows on the east side. But, we can't quite seem to come to an agreement on how far to set them back. He marked today where he thought they should be and I checked it out after he was gone and I think it should be another 30 foot setback. Because where he set them back it is still comes out even with my house as I sit at my kitchen table I would be staring right into a storage shed out that window. Also, I live on a farm, and on a farm you use your back door primarily like a front door, where he wants the shed the minute I step out the back door which is used like a front door for me I would be looking right straight into the shed So I am asking that he push those ones in that back row back another 30 feet and then I think we could get along. Thank you. Marcum: Last time I was at the meeting we brought the big plat so I will walk up and give you guys a close view of the plat here real quick. This is Elaine's house this is what we are talking about right here and I moved this building back, 1 told her another 30 feet so it is at the end of her house and then it would be a parallel line with the rest of it. So, see right here guys this building stuck out originally (inaudible) and I moved it back 30 foot, scribbled it out, I will have the new plat down that they all line up then all the way across the row. Before it did stick down to here they just drew it on here when they originally platted it because (inaudible) so here whole house, this is parallel with all the buildings show she can view clear down the whole row then. Morrow. Let me ask you this, I saw this for the first time and thought at 7:00 this evening so I am not real familiar with what we are long here. This portion up here is where the R.V. repair stuff is. What are these other buildings? Marcum: This here is mini-storage and it what should I say that area is, it is approved for that anyway. Here is the big one so you can see it, this is already zoned for this use, this use is what I am trying to get my conditional use permit for. Elaine is talking about her, see her house is here and I was going to cut this building off because she couldn't see past all the buildings anyway. Elaine is asking to drop this building back 30 more feet in size and I already reduced it 30 feet for her. Due to our landscaping and what not guys the four foot berm and the trees and everything eventually her view is going to be blocked anyway, • Meridian City Council December 19, 1995 Page 76 when the landscaping matures. I would also be willing on this corner building here we could maybe adjust the fence so that because of the fence due to ordinance and code there is, it would be a 6 foot high fence I would be willing to move it in and then down so that it wouldn't' block her view to the fence. You know you build down the property line it is required I would be willing to adjust the fence so it wouldn't. Because otherwise the fence is going to block your view. (Inaudible) Marcum: Well, okay but I am willing to adjust on the fence. I cut the building off 30 feet, I have moved back to the front of the building and had that little area landscaped that extra up your sideline instead of before it was going to be building or pavement. I can go ahead and landscape a little piece you guys like this up and over like at that little corner. So, but that, the meeting is actually for like Mr. Councilman Morrow says it is for the conditional use here but it all the same piece of property that we are working here. And that is an approved use at the other end we are just, I am just trying to work with Elaine to make it somewhat agreeable. So are there any other questions? Morrow. I have none. Marcum: Hillside Nursery did the landscaping (inaudible). Here is kind of an idea of what the building will look like, the front and the rear. It is designed, it is concrete tilt up and he had a recessed area to walk under the front here, you can't really tell by this, but it this is our tentative design (inaudible). So I guess that is all I have to say unless there are some other questions. Schelekeway: Could I add something, where I am asking him to allow another 30 feet for me by the house he still has I would say between 150 and 200 feet of a storage shed that is going to be right behind my house back to the canal that I am not complaining about. I am only asking about what is close to my house. If he doesn't move that shed back a little farther yet it is going to make a real dark comer on the back of my house and I have been broke into twice before so I am kind of concerned about that. Corrie: Mr. President, I guess my concern is, is that drawn to scale? If that is drawn to scale your building is not behind your house it is the edge of you house comes in there so am I assuming wrong? Marcum: It is to scale and where we have ended up now is the building comes, it is within a couple of feet of the corner of your house the back corner of your house now. Schelkeway: No, it is a lot more than that, because you marked it on the fence it is right • Meridian City Council December 19, 1995 Page 77 out there now I went out and looked. Marcum: It is pretty close if you look down that line, it is pretty close to the back of your house you have to be. We are 45 feet, 35 feet for landscape and 30 foot more back to where the building starts. Schelekeway: Yes but it is probably 8 feet from the back of the house already. Marcum: The building sets 10 foot off the property line too so that will help, it is not (inaudible) approximately down the back to the building anyway. Morrow: Mr. President if I might, kind of where we are at with this deal is we are dealing with a conditional use permit for the R.V. repair shop. The storage buildings which are under the same ownership in terms of the same lot, the same land are an approved use. The issue between Ms. Schelekeway and Mr. Marcum are such that I don't think there is anything that we can legally do with respell to the resolution of that. I think that is an agreement between the two of them that certainly I would support in terms of helping to preserve review and being a good neighbor. But I think the issue before us is the conditional use permit and that is really all we can do as a Council is rule on that. I would ask some advice from Counselor in terms of that observation. Tolsma: Well most of that is in the findings of fact and conclusions of law (inaudible). Morrow. And I understand that and I guess where my confusion is here is with respect to the storage facility. In other words I don't think that we can put a condition on this conditional use for the light automotive and R.V. repair that mandates a 30 foot setback or a 60 foot setback with respect to Mrs. Schelekeway's view. What f am asking is for some advice from the counselor concerning that. Tolsma: (Inaudible) Crookston: Let me ask a question first. Mr. Marcum, that portion of the storage sheds, do you own that land? Marcum: Yes Crookston: Is that part of the storage that has been there for a long time? Marcum: No, this is vacant land, that is back behind me now. See guys, my legal setbacks to be clear up here where we were and I am willing to move it back an extra 30 feet. • Meridian City Council December 19, 1995 Page 78 Crookston: Those storage sheds are part of this application for a conditional use? Marcum: No this is just my piece of property, our whole design for the City what we are going to do with the whole piece of property. The conditional use is only on the building but this is our whole design what we are doing. This is a legal use on this part which was fine. So that part hasn't' got anything to do with what we are trying to address, last time you told me to address the problem because she spoke out at the last public hearing because we are just going for our whole piece of property use. So Counsel instructed me for Elaine and I to get together which we have been and she knows plenty of times on the phone and as she said I have been out there and marked it off for her and everything. I am willing to do a little more landscaping in the corner like (inaudible) since I dropped it back 30 feet. Crookston: Mr. President, the City really has no jurisdiction over the storage sheds because they are not in front of you at this time. It is only the R.V. repair shop. Tolsma: (Inaudible) So what we are looking at is the findings of fact and conclusions of law heard at P & Z then. Crookston: That is correct. Morrow. We have already submitted a variance request for Eight Mile Lateral and that is scheduled for the City Council on December 5th. I am sure you guys have these lists. We just got that today so we, I hope they have all matched that up with (inaudible). Marcum: If you want me to run through them I sure can. Johnson: I think we can just ask the Commission if they have any questions of you at this point unless you want to elaborate more on your project? Marcum: It is fairly simple, if there are any questions, if the list is satisfactory otherwise I can go over any of the comments there. Johnson: Any questions of Mr. Marcum? Alidjani: Mr. Marcum, how do you define light automotive? Marcum: What he actually does is he just repairs motor homes and it will be done all inside. Camp trailers, beds, goes with the areas use there pretty much. He repairs the cabinets and interiors and metal sheeting on them. Just, he works for insurance companies and mainly repairs their mobile homes. Alidjani: (Inaudible) Marcum: No, none of that. If they bring them in, I guess the reason we kind of picked this area is because across the street there is an auto body shop right up the street about another 100 feet is a brake and alignment shop. All the uses, there is a mini storage right behind it there, and there is a mini storage right down the street. So all those uses right there kind of coincide that it would fit into the area. Also, the other tenant that we have got in the building lined up there, he does window tinting so it is a light use is what we have lined out. Alidjani: So it would be like a damaged interior or exterior but it would have nothing to do with the drive train of automobiles or R.V.'s? Marcum: I don't really know, he doesn't do brakes or doesn't do painting, auto body work so as far as I know it would just be something light. I guess they repack wheel bearings and stuff probably because I know that trailers that is a part of it. They do wiring, lights wiring and at this point I think he said that at most there would be possibly he figured for him around 6 employees would be the most. Which you can see we have excessive parking and the back is real secure and protected area back here. It is setback so it will be completely out of view, fenced and all paved. Meridian Planning & Zoning Commission November 14, 1995 Page 38 Hepper: Would he have a paint booth? Marcum: No, no painting. Rountree: You indicated there would be another use there and window tinting, how many other uses do you anticipate in that building? Marcum: At this point there might be, there is approximately maybe a 1000 square feet available but he thinks he will just take it anyway, that is what he is saying. They just (inaudible) it has big garage doors in the back. The front is a store look design, it has windows and doors, there are no garage doors in the front of the building. It is an office building looking front and back. So everything will be pulled around the back and come in, there are no garage doors in the front of it. They will just come around the back and they work on the vehicles on the inside. Rountree: What are the hours of operation? Marcum: It is alt interior work so the hours of operation on that kind of stuff people don't bring their vehicles into be repaired only from 8 normal store hours is when people come for repairs. It is not a 24 hour business or anything like that. Hepper: You don't have a front plat or anything of the building do you? Marcum: I think she sent it in the little package of the building, did you send the front look, no, it, to give you an idea it is a Van Auker, have you seen the Van Auker buildings, like as you get off the freeway on Broadway, have you seen how those buildings look with the windows across them and the doors. Well, it has a stucco, they are (inaudible) real nice Hepper: Would there be any over hangs or gable ends or features on (inaudible) Marcum: Pretty much rectangular, there is going to be paint designs around the middle part of it, the windows is all the dressing. There will be windows on the different, there are a couple of sets of windows. You would have to see the windows, we actually have the building designed but I thought it was shipped to you in the package but I didn't realize that it wasn't. So I can produce that. Hepper: We really don't have a plan review other than staff. There has been some concern in the past about some of the buildings put up that are just square rectangular boxes with no features. Where that is a main entryway, corridor coming into the town. Back in a subdivision some place that may be a little different, but I think where it is going to front right on Franklin Road there should have some features on Franklin Road to break it up • s Meridian Planning & Zoning Commission November 14, 1995 Page 39 rather than just a blank wall. Marcum: Well, as you can see on this we have landscaped clear around a huge area around this corner. So, there is a lot of landscaping, lots of parking and then, like I say everything is accessed to the rear. The front of the building is just office building look is what it is. It is not, it doesn't look like your typical mechanical shop. It is an office building look. Johnson: Has there been any discussion about the possibility of this being an impound area for anything? Marcum: No Johnson: Any other questions? Thank you Dirk, this is a public hearing, is there anyone else that would like to address the Commission on this application? Elaine Williams Schlekeway, 1200 West Franklin, was sworn by the City Attorney. Schlekeway: Gentlemen, I own and have for the past 42 years owned 33 acres of ground and buildings fronting on Franklin Road. The proposal the man before me just submitted would border my property and very close to my house. My house sits fairly close to the new proposal and frankly gentlemen t am not real enthused about it. Since my house is 50 feet long on that side and I have 5 windows which is the most I have on any side of my house and they would all be facing into these storage sheds. I don't have any idea how tall they would be because I went yesterday to the City Hall and looked at their map that they had submitted. It looked there are about 7 real long buildings on this small piece of ground. It looked like they were going to be pretty close to my fence line which isn't very far from my house. I noticed something else that was a 35 foot setback from Franklin Road, it said per ordinance. Does this take into consideration the widening of Franklin Road to 5 lanes by the Ada County Highway Department which is supposed to take place in the next few years. If so where do you measure from, the middle of the road or the edge of the proposed new 5 foot sidewalk on bads for that 35 feet. Also, is there any mention of a fence or lighting that would be shining in my windows on this new project. I don't mind storage sheds because I have already got some across from my property now. But they are farther bads, they are a long ways from the house. This would be just adjacent to the house. If they could be set back at least some so I could see out I would appreciate it. Johnson: Have you personally had any discussion with the applicant? Schlekeway: No, no one has come to see me. (Inaudible) Johnson: We need to get it on the record so if you could use the mic and move it up there, we have to type all of this and she won't be able to pick it up. Marcum: Okay, I was just showing her here, her house is located on here, so you can see here it shows this is they have their easement already set in there, we have our 35 foot ordinance for the landscaping so you can see where her house sits. Schlekeway: Well, I see where this building is, it comes right in the middle of my house. Johnson: What is the distance there where your finger is about there Dirk, do you have an idea? Marcum: If you were back to here it would be behind your house and that is 30 more feet, see how these are behind. Schlekeway: Yes, but not this one, this is very close to this. This is the fence line here, this is very close. Johnson: What is the setback for the property line there Dirk on the east side or the west side? Marcum: It is ten feet, there are ten feet there is no access or lighting back here it is landscaped and there will be (inaudible). Johnson: Where is the nearest lighting? Marcum: The nearest lighting would be on this face side dim low lighting. So this would be completely blocked. Johnson: Is there any free standing lighting anywhere in there? Marcum: No, nothing standing. Johnson: All come off the building. Schlekeway: Excuse me, there are storage sheds out in this area right now. And they have lighting back here, I can even get that shining up in my windows. I would like to know how high because on the map it didn't say or I couldn't see. Marcum: They are 8 foot 31 think. Schlekeay: This building here is only eight feet? Marcum: Yes, 8 feet 3, the 20 foot deep ones are only 8 feet 3, I guess the pitch of the roof is sloped up a little but but it is only 8 feet 3 to the back. Schlekeay: You mean the wall is just 8 feet but how high would it be including the roof? Marcum: I would have to look at the plan to tell you but I know 8 foot 3 Johnson: Well you have to have some pitch on the roof so you probably have another 2 feet. Marcum: (Inaudible) Schlekeway: And how high are these going to be? Marcum: Some of them will vary a little bit the pitch but these are so far away from you, you can see that you would never (inaudible), they are not, these are a long ways away from you, 30, 40, 60 feet more this building here. I can pull this back a little bit. Schlekeway: (Inaudible) Johnson: It looks to me like you guys can work something out, I know we are missing some of this on the tape. Schlekeway: (inaudible) that is my view of the mountains and the city and everything that I have been looking at. Johnson: I would certainly recommend that you two get together and I think it would probably work out. Marcum: This here that wouldn't be a problem you guys, you can just see that one building (inaudible) and that is just the way they drew them. Schlekeway: Where are you measuring your 35 feet. Steinbaugh: Okay, what I was just going to ask is if the access was going to be on the NW 10th and on Franklin and I was also concerned with the road widening just about the depth of his building off of Franklin Road. Howell and Dirk Marcum are the owners of the property; that the property is described in the application which description is incorporated herein. 3. That the property is zoned (I-L), Light Industrial FINDINGS OF FACT AND CONCLUSIONS OF LAW HOWELL/MARCUM PAGE 1 • District, which requires a conditional use permit for the operation of an automobile/recreational vehicle repair shop, window tinting, windshield repair and/or U-Haul rental business, which the application requests. 4. That the Light Industrial District is described in the Zoning Ordinance, 11-2-408 B. 11. as follows: (I-L) Light Industrial District: The purpose of the (I-L) District is to provide for light industrial development and opportunities for employment of Meridian citizens and area residents and reduce the need to commute to neighboring cities; to encourage the development of manufacturing and wholesale establishments which are clean, quiet and free of hazardous or objectionable elements, such as noise, odor, dust, smoke or glare and that are operated entirely or almost entirely within enclosed structures; to delineate areas best suited for industrial development because of location, topography, existing facilities and relationship to other land uses. This district must also be in such proximity to insure connection to the Municipal Water and Sewer systems of the City of Meridian. Uses incompatible with light industry are not permitted, and strip development is prohibited. 5. That the uses proposed by Applicant are specifically allowed conditional uses in the Zoning Schedule of Use Control, 11- 2-409. 6. That the Applicants stated that the property is currently vacant and undeveloped; that the proposed use by the Applicants are for an automotive and recreational vehicle repair shop and for additional uses such as window tinting, windshield repair and a U- Haul rental office; that the site contains approximately 4.21 acres; that the proposed site is adjacent to commercial and light industrial uses and follows the trend of development along the FINDINGS OF FACT AND CONCLUSIONS OF LAW HOWELL/MARCUM PAGE 2 • • North side of Franklin Road. 7. That sewer and water is serviceable to the property. 8. That Dirk Marcum testified before the Commission that the project he and Mr. Howell are proposing on Franklin Road and 10th Street is approximately 110 feet to the back of Franklin Road; that the building will be a rectangular shape, stucco, with paint designs around the middle part and a couple sets of windows is about all the dressing up the building will have to the outside; that it is very similar to Van Auker buildings off Broadway Avenue in Boise; that the repair work of the motor homes, all done indoors, is mainly done for insurance companies; repairing camp trailers, beds, cabinets and interiors and metal sheeting, some wiring and light automotive repair such as repacking wheel bearings; that painting and auto body work will not be done at this facility; that the other tenant in the building will do window tinting. Mr. Marcum further testified that the number of employees would be approximately six ( 6) ; that there is excessive parking and the back of the area is secure and protected; that the facility will be completely out of view, fenced and paved; that this location is ideal in that there is an auto body shop up the street and approximately another 100 feet there is a brake and alignment shop with a mini storage behind the proposed site and a mini storage down the street as well; that the proposed hours of operation will be normal eight (8) hours, not a 24 hour business; FINDINGS OF FACT AND CONCLUSIONS OF LAW HOWELL/MARCUM PAGE 3 • • that the front of the building will have an office building look and lots of landscaping and parking; that everything is accessed to the rear of the building; that it does not look like your typical mechanical shop; that access will be off Franklin Road, not 10th Street; that the one building will be approximately 110 feet off Franklin Road and the other buildings will have the 35 foot landscape setback plus the 45 foot adjusted easement for the new road, substantially back of Franklin Road. 9. Elaine Williams Schlekeway testified that she owns 33 acres of ground and buildings which border this proposal; that she is not enthusiastic about these storage sheds being that close to her property as well as the height of the buildings blocking her view as well as light shining in her windows; that Commissioner Johnson suggested Ms. Schlekeway and the Applicant's get together and that something could be worked out. 10. That Clyde Steinbaugh testified regarding the access to this proposal, either being from NW 10th Street and/or Franklin Road, and with the widening of Franklin Road in the future what this will do to the depth of this proposed building. 11. That the Ada County Highway District (ACHD) submitted site specific requirements and they are follows: a. That the dedication of 45 feet of right-of-way from the centerline of Franklin Road abutting the parcel (approximately 15 additional fee) prior to issuance of building permit or other required permits should be made; that the owner will be compensated for this additional right-of-way from available impact fee revenues in this benefit zone; that if the owner wishers to be paid for the additional right- of-way, the owner must submit a letter of application to the impact fee administrator prior to breaking ground, in accordance with Section 15 of ACHD Ordinance #188. b. That the Applicant provide a $5,372.00 deposit to the Public Rights-of-Way Trust Fund for required street improvements of 632-feet of 5-foot wide concrete sidewalk on Franklin Road prior to issuance of a building permit or construct a 5-foot wide sidewalk on Franklin Road abutting the parcel, prior to the ACHD roadway project scheduled for this portion of Franklin Road is started, if determined to be acceptable by ACHD Plans and Survey Staff. c. Construct curb, gutter, and 5-foot wide concrete sidewalk and match paving on 10th Street abutting parcel; that applicant shall provide a deposit to the Public Rights-of Way Trust Fund for the cost of construction of a portion of the sidewalk which would be required over the bridge at the north of this parcel; that improvements shall be constructed to one half of the 41 foot street section. d. Construct one 30-foot wide driveway with 15-foot radii pavement tapers on Franklin Road, located as proposed, approximately 250 feet west on 10th Street; that the driveway shall be paved 30 feet wide a minimum of 30 feet beyond the edge of pavement for Franklin Road; that no other access points to Franklin Road are approved. e. That the security gate for the storage facility shall be located as proposed; that any proposed FINDINGS OF FACT AND CONCLUSIONS OF LAW HOWELL/MARCUM PAGE 7 relocation of the gate shall be reviewed and approved by the District's Development Services Division. 14. That the Meridian City Police Department, Fire Department, Central District Health Department, the Nampa & Meridian Irrigation District, the Sewer Department and the Water Department submitted comments and they are hereby incorporated herein as if set forth in full. 14. There was no other testimony submitted. 15. That proper notice has been given as required by law and all procedures before the Planning and Zoning Commission have been given and followed. CONCLUSIONS 1. That all the procedural requirements of the Local Planning Act and of the Ordinances of the City of Meridian have been met including the mailing of notice to owners of property within 300 feet of the external boundaries of the Applicant's property. 2. That the City of Meridian has authority to grant conditional uses pursuant to 67-6512, Idaho Code, and, pursuant to 11-2-418 of the Revised and Compiled Ordinances of the City of Meridian. 3. That the City of Meridian has authority to place conditions on a conditional use permit and the use of the property pursuant to 67-6512, Idaho Code, and pursuant to 11-2-418 D of the Revised and Compiled Ordinances of the City of Meridian, Idaho. FINDINGS OF FACT AND CONCLUSIONS OF LAW HOWELL/MARCUM PAGE 8 ,~ • 4. That 11-2-418 C of the Revised and Compiled Ordinances of the City of Meridian sets forth the standards under which the Planning and Zoning Commission and the City Council shall review applications for Conditional Use Permits; that upon a review of those requirements and a review of the facts presented and the conditions of the area, the Planning and Zoning Commission concludes as follows: a. The use, would in fact, constitute a conditional use and a conditional use permit is required by ordinance. b. The use should be harmonious with and in accordance with the Comprehensive Plan but the Zoning Ordinance requires a conditional use permit to allow the use. c. The use apparently would be designed and constructed, to be harmonious in appearance with the intended character of the general vicinity. d. That the use would not be hazardous nor should it be disturbing to existing or future neighboring uses. e. The property has sewer and water service available. f. The use would not create excessive additional requirements at public cost for public facilities and services and the use would not be detrimental to the economic welfare of the community. g. The use would not involve a use, activity, process, material, equipment or conditions of operation that would be detrimental to person, property or the general welfare by reason of excessive production of traffic or noise. h. That sufficient parking for the property and the proposed use is required. i. The development and uses will not result in the destruction, loss or damage of a natural or scenic feature of major importance. FINDINGS OF FACT AND CONCLUSIONS OF LAW HOWELL/MARCUM PAGE 9 5. That the comments of the City Engineer's office and the Planning and Zoning Administrator must be met and complied with; that all Ordinances of the City shall be complied with, including the tiling of all ditches and waterways, except for the Eight Mile Lateral. 6. The requirements of the Ada County Highway District must be met. 7. That all ordinances of the City of Meridian must be met, including but not limited to, the Uniform Building Code, Uniform Fire Code, Uniform Plumbing Code, the Uniform Electrical Code, the Fire and Life Safety Code, all parking and landscaping requirements. 8. That the landscaping must be placed, the parking areas are to be paved and the building and operation are to comply with all Federal, State and local requirements prior to issuance of an occupancy permit. 9. That the structure must meet all codes prior to issuance of an occupancy permit; that the conditional use permit should be reviewed annually and may be revoked, after notice and hearing if the conditions hereof, or the Ordinances of the City, are not met. W. 10th Street Local street with no pathway designation No traffic count available 100-feet of frontage 60-feet existing right-of--way (30-feet from centerline) No additional required right-of--way W. 10th Street is improved with 44-feet of pavement with no curb, gutter or sidewalk. B. Franklin Road between Linder Road and Meridian Road is listed in the Five Year Work Program, scheduled for construction in 1998. Staff recommends that the applicant provided a deposit to the Public Rights-of--Way Trust Fund the cost of constructing 5-foot wide concrete sidewalk on Franklin Road abutting the parcel. These improvements are estimated to cost a total of $5,372.00. C. In accordance with District policy, staff recommends that the applicant be required to construct curb, gutter, 5-foot wide concrete sidewalk and pavement widening (to one half of a 41-foot street section) on 10th Street abutting the parcel. The applicant should provide a deposit to the Public Rights-of--Way Trust Fund for the cost of construction of a portion of the sidewalk which would be required over the bridge at the north of this parcel. Staff recommends that sidewalk be constructed on 10th Street per Section 7204.9.1 of the District's policy manual. MCU2395. WPD Page 2 • • D. No access to 10th Street is proposed. One 35-foot wide driveway is proposed from Franklin Road approximately 250-feet west of 10th Street. There are no driveways on the south side of Franklin Road to conflict with this driveway's location. Staff recommends that the driveway be a maximum of 30-feet wide. E. The gate to the storage facility is located sufficient distance from Franklin Road to not cause stacking to back up onto Franklin Road. F. The transportation system will be adequate to accommodate additional traffic generated by this proposed development. G. This application is scheduled for a public hearing by the Meridian Planning and Zoning Commission on November 14, 1995. The following requirements are provided to the City of Meridian as conditions for approval: Site Specific Requirements: 1. Dedicate 45-feet of right-of--way from the centerline of Franklin Road abutting the par- cel (approximately 15 additional feet) prior to issuance of building permit (or other required permits). The owner will be compensated for this additional right-of--way from available impact fee revenues in this benefit zone. If the owner wishes to be paid for the additional right-of--way, the owner must submit a letter of application to the impact fee administrator prior to breaking ground, in accordance with Section 15 of ACHD Ordinance #188. 2. Provide a $5,372.00 deposit to the Public Rights-of--Way Trust Fund at the District for the required street improvements of 632-feet of 5-foot wide concrete sidewalk on Franklin Road abutting the parcel prior to issuance of building permit (or other required permits). Or Construct 5-foot wide concrete sidewalk on Franklin Road abutting the parcel (approximately 632-feet) if construction, prior to the ACHD roadway project scheduled for this portion of Franklin Road is started, if determined to be acceptable by ACHD Plans and Survey Staff. 3. Construct curb, gutter, and 5-foot wide concrete sidewalk and match paving on 10th Street abutting the parcel. The applicant shall provide a deposit to the Public Rights- of-Way Trust Fund for the cost of construction of a portion of the sidewalk which would be required over the bridge at the north of this parcel. Improvements shall be constructed to one half of a 41-foot street section. 4. Construct one 30-foot wide driveway with 15-foot radii pavement tapers on Franklin Road, located as proposed approximately 250-feet west of 10th Street. The driveway MCU2395. WPD Page 3 • • shall be paved 30-feet wide a minimum of 30-feet beyond the edge of pavement for Franklin Road. No other access points to Franklin Road are approved. 5. The security gate for the storage facility shall be located as proposed. Any proposed relocation of the gate shall be reviewed and approved by the District's Development Services Division. Standard Requirements: 1. A request for modification, variance or waiver of any requirement or policy outlined herein shall be made in writing to the Development Services Supervisor. The request shall specifically identi each requirement to be reconsidered and include a written planation of why such a requirement would result in a substantial hardship or ~• Requests received prior to the date scheduled for Commission action shall be rescheduled for discussion with the Commission on the next available meeting agenda. 2. A request for an appeal of the Commission's action shall be made in writing to the Development Services Supervisor within 15 calendar days of the action and shall include a minimum fee of $110.00. The appeal will be scheduled to be heard by the Commission within 20 calendar days after receipt. The request for appeal shall specifically identify each req irement to be reconsidered and include a written ~ZCplanation of why such a requirement would result in a substantial hardship or inequity. A right-of--way permit must be obtained from ACRD for any street or utility construction within the public right-of--way. Utility cuts should be combined where practical to limit pavement damage. Utility street cuts in roads paved within the last five years will not be allowed unless azp~roved by the District Commission Contact Construction Services at 345-7667 (with file number) for details. 4. Submit site drainage plans and calculations for review and appropriate action by ACHD prior to issuance of building permit (or other required permits). The proposed drainage system shall retain all storm water on-site and shall conform to the requirements of Meridian. Public street drainage facilities shall be located in the public right-of--way or in a common lot owned by a homeowners association set aside specifically for that use. There shall be no trees, fences, bushes, sheds, or other valuable amenities placed in said easement. Drainage lots and their use restrictions shall be noted on the plat (when applicable). 5. Locate driveway curb cuts a minimum of 5-feet from the side lot property lines when driveways are not being shared with the adjacent property. MCU2395. WPD Page 4 # • 6. Construct pedestrian ramps on the corner of all street intersection in compliance with Idaho Code, Section 40-1335. 7. Dedicate up to a 20-foot x 20-foot right-of--way triangle (or appropriate curve) to keep street improvements within the public right-of--way at all intersections abutting and/or within the development prior to issuance of building permit (or other required permits). 8. Continue existing irrigation and drainage systems across parcel. 9. Continue borrow ditch drainage abutting parcel (culvert may be required). 10. Provide written approval from the appropriate irrigation drainage district authorizing storm runoff into their system. 11. If street improvements are required, locate obstructions (utility facilities, irrigation and drainage ditches and appurtenances, etc.) outside of the public right-of--way. Authorization for relocations shall be obtained from the appropriate entity. If determined by the District, existing irrigation facilities may remain in the right-of--way with District review and approval of easements recorded for future relocation at a later date. 12. Locate proposed sign(s) out of the public right-of--way and out of the clear-vision sight- triangle of all street and driveway intersections. 13. Install a stop sign on every unsignalized approach of a project street to an intersection involving a collector or arterial as the cross-street. The stop sign shall be installed when the project street is first accessible to the motoring public. 14. The developer is required to install street name signs at the locations approved by the Ada County Highway District. Purchase street name signs, sign poles, and mounting hardware from ACHD's Traffic Operations Department or an approved outside supplier. The District will not manufacture street signs until a copy of the recorded plat showing the recording data has been provided to Development Services staff. 15. Provide a clear vision sight triangle at all street intersections. Within this triangle no obstruction higher than 36-inches above the top of pavement will be allowed, including landscaping, berms, fences, walls or shrubs. The triangle shall be defined by the long leg measured down the centerline of any collector 350-feet; and the short leg measured down the centerline from the collector street curb line 20-feet. Provide notes on the plat and street construction plans of these restrictions. 16. Submit three sets of street construction plans to the District for review and appropriate action. 17. All public streets and drainage systems shall be designed and constructed in conformance with District standards and policies. 19. Rountree: Mr. Chairman, I make a motion we pass this preliminary plat onto the City Council with a favorable recommendation conditioned on resolving the issues of the City Engineer and potential issues that the Nampa Meridian Irrigation District may have pursuant to the utility easement. ITEM #8: PUBLIC HEARING: REQUEST FOR A CONDITIONAL USE PERMIT FOR A LIGHT AUTOMOTIVE AND R.V. REPAIR SHOP BY KEVIN HOWELL AND DIRK MARCUM: Johnson: At this time I will open the public hearing and ask that the representative or the applicant can address the Commission. Dirk Marcum, HC 33 Box 1080, Boise, was sworn by the City Attorney. Marcum: Okay, we are just, here is a look at our project over here that we are proposing on Franklin Road and 10th. We are asking for a conditional use permit for an R.V. repair service, light automotive and R.V. repair service. This building here which you can see is designed and it is approximately 110 foot back from Franklin. (End of Tape) We got this list here and f can start going over them. We have already submitted a variance request for Eight Mile Lateral and that is scheduled for the City Council. on December 5th. I am sure you guys have these lists. Johnson: We do and we also have your letter dated today or actually it is from Hubble Engineering that addresses specifically each request. I don't know if you have seen that • • Meridian Planning & Zoning Commission November 14, 1995 Page 37 or not. We just got that today so we, I hope they have all matched that up with (inaudible). Marcum: If you want me to run through them I sure can. Johnson: I think we can just ask the Commission if they have any questions of you at this point unless you want to elaborate more on your project? Marcum: It is fairly simple, if there are any questions, if the list is satisfactory otherwise 1 can go over any of the comments there. Johnson: Any questions of Mr. Marcum? Alidjani: Mr. Marcum, how do you define light automotive? Marcum: What he actually does is he just repairs motor homes and it will be done all inside. Camp trailers, beds, goes with the areas use there pretty much. He repairs the cabinets and interiors and metal sheeting on them. Just, he works for insurance companies and mainly repairs their mobile homes. Alidjani: (Inaudible) Marcum: No, none of that. If they bring them in, I guess the reason we kind of picked this area is because across the street there is an auto body shop right up the street about another 100 feet is a brake and alignment shop. All the uses, there is a mini storage right behind it there, and there is a mini storage right down the street. So all those uses right there kind of coincide that it would fit into the area. Also, the other tenant that we have got in the building tined up there, he does window tinting so it is a light use is what we have lined out. Alidjani: So it would be like a damaged interior or exterior but it would have nothing to do with the drive train of automobiles or R.V.'s? Marcum: I don't really know, he doesn't do brakes or doesn't do painting, auto body work so as far as I know it would just be something light. I guess they repack wheel bearings and stuff probably because I know that trailers that is a part of it. They do wiring, lights wiring and at this point I think he said that at most there would be possibly he figured for him around 6 employees would be the most. Which you can see we have excessive parking and the back is real secure and protected area back here. It is setback so it will be completely out of view, fenced and all paved. • Meridian Planning & Zoning Commission November 14, 1995 Page 38 Hepper: Would he have a paint booth? Marcum: No, no painting. Rountree: You indicated there would be another use there and window tinting, how many other uses do you anticipate in that building? Marcum: At this point there might be, there is approximately maybe a 1000 square feet available but he thinks he will just take it anyway, that is what he is saying. They just (inaudible) it has big garage doors in the back. The front is a store look design, it has windows and doors, there are no garage doors in the front of the building. It is an office building looking front and back. So everything will be pulled around the back and come in, there are no garage doors in the front of it. They will just come around the back and they work on the vehicles on the inside. Rountree: What are the hours of operation? Marcum: It is all interior work so the hours of operation on that kind of stuff people don't bring their vehicles into be repaired only from 8 normal store hours is when people come for repairs. It is not a 24 hour business or anything like that. Hepper: You don't have a front plat or anything of the building do you? Marcum: I think she sent it in the little package of the building, did you send the front look, no, it, to give you an idea it is a Van Auker, have you seen the Van Auker buildings, like as you get off the freeway on Broadway, have you seen how those buildings look with the windows across them and the doors. Well, it has a stucco, they are (inaudible) real nice Hepper: Would there be any over hangs or gable ends or features on (inaudible) Marcum: Pretty much rectangular, there is going to be paint designs around the middle part of it, the windows is all the dressing. There will be windows on the different, there are a couple of sets of windows. You would have to see the windows, we actually have the building designed but I thought it was shipped to you in the package but I didn't realize that it wasn't. So I can produce that. Hepper: We really don't have a plan review other than staff. There has been some concern in the past about some of the buildings put up that are just square rectangular boxes with no features. Where that is a main entryway, corridor coming into the town. Back in a subdivision some place that may be a little different, but I think where it is going to front right on Franklin Road there should have some features on Franklin Road to break it up • . Meridian Planning & Zoning Commission November 14, 1995 Page 39 rather than just a blank wall. Marcum: Well, as you can see on this we have landscaped clear around a huge area around this corner. So, there is a lot of landscaping, lots of parking and then, like I say everything is accessed to the rear. The front of the building is just office building look is what it is. It is not, it doesn't look like your typical mechanical shop. It is an office building look. Johnson: Has there been any discussion about the possibility of this being an impound area for anything? Marcum: No Johnson: Any other questions? Thank you Dirk, this is a public hearing, is there anyone else that would like to address the Commission on this application? Elaine Williams Schlekeway, 1200 West Franklin, was sworn by the City Attorney. Schlekeway: Gentlemen, I own and have for the past 42 years owned 33 acres of ground and buildings fronting on Franklin Road. The proposal the man before me just submitted would border my property and very close to my house. My house sits fairly close to the new proposal and frankly gentlemen I am not real enthused about it. Since my house is 50 feet long on that side and I have 5 windows which is the most I have on any side of my house and they would all be facing .into these storage sheds. I don't have any idea how tall they would be because I went yesterday to the City Hall and looked at their map that they had submitted. It looked there are about 7 real long buildings on this small piece of ground. It looked like they were going to be pretty close to my fence line which isn't very far from my house. I noticed something else that was a 35 foot setback from Franklin Road, it said per ordinance. Does this take into consideration the widening of Franklin Road to 5 lanes by the Ada County Highway Department which is supposed to take place in the next few years. If so where do you measure from, the middle of the road or the edge of the proposed new 5 foot sidewalk on bads for that 35 feet. Also, is there any mention of a fence or lighting that would be shining in my windows on this new project. I don't mind storage sheds because I have already got some across from my property now. But they are farther bads, they are a long ways from the house. This would be just adjacent to the house. If they could be set back at least some so I could see out I would appreciate it. Johnson: Have you personally had any discussion with the applicant? Schlekeway: No, no one has come to see me. I just got your letter and responded to that. • • Meridian Planning & Zoning Commission November 14, 1995 Page 40 Johnson: Where is your house on the map? (Inaudible) Johnson: We need to get it on the record so if you could use the mic and move it up there, we have to type all of this and she won't be able to pick it up. Marcum: Okay, I was just showing her here, her house is located on here, so you can see here it shows this is they have their easement already set in there, we have our 35 foot ordinance for the landscaping so you can see where her house sits. Schlekeway: Well, I see where this building is, it comes right in the middle of my house. Johnson: What is the distance there where your finger is about there Dirk, do you have an idea? Marcum: If you were back to here it would be behind your house and that is 30 more feet, see how these are behind. Schlekeway: Yes, but not this one, this is very close to this. This is the fence line here, this is very close. Johnson: What is the setback for the property line there Dirk on the east side or the west side? Marcum: It is ten feet, there are ten feet there is no access or lighting back here it is landscaped and there will be (inaudible). Johnson: Where is the nearest lighting? Marcum: The nearest lighting would be on this face side dim low lighting. So this would be completely blocked. Johnson: Is there any free standing lighting anywhere in there? Marcum: No, nothing standing. Johnson: All come off the building. Schlekeway: Excuse me, there are storage sheds out in this area right now. And they have lighting back here, I can even get that shining up in my windows. I would like to know how high because on the map it didn't say or I couldn't see. Marcum: They are 8 foot 31 think. Schlekeay: This building here is only eight feet? Marcum: Yes, 8 feet 3, the 20 foot deep ones are only 8 feet 3, I guess the pitch of the roof is sloped up a little but but it is only 8 feet 3 to the back. Schlekeay: You mean the wall is just 8 feet but how high would it be including the roof? Marcum: I would have to look at the plan to tell you but I know 8 foot 3 Johnson: Well you have to have some pitch on the roof so you probably have another 2 feet. Marcum: (Inaudible) Schlekeway: And how high are these going to be? Marcum: Some of them will vary a little bit the pitch but these are so far away from you, you can see that you would never (inaudible), they are not, these are a long ways away from you, 30, 40, 60 feet more this building here. I can pull this back a little bit. Schlekeway: (Inaudible) Johnson: It looks to me like you guys can work something out, I know we are missing some of this on the tape. Schlekeway: (inaudible) that is my view of the mountains and the city and everything that I have been looking at. Johnson: I would certainly recommend that you two get together and I think it would probably work out. Marcum: This here that wouldn't be a problem you guys, you can just see that one building (inaudible) and that is just the way they drew them. Do you have anything else to add Elaine? Schlekeway: No Johnson: Anyone else? Clyde Steinbaugh, 1905 East Paradise, was sworn by the City Attorney. Steinbaugh: I just wanted to ask is your access going to be on NW 10th or are you going to have access on Franklin also? Johnson: Clyde you have to address your questions to the Commission and we will get your answer otherwise (inaudible). Steinbaugh: Okay, what I was just going to ask is if the access was going to be on the NW 10th and on Franklin and I was also concerned with the road widening just about the depth of his building off of Franklin Road. Johnson: We will have him address that question when we line things up here. If you have another question let us know later, is that all you have right now? Steinbaugh: That is all I have. Johnson: Thank you, anyone else? Gary would you like to talk about this setback, are you familiar with the area. I assume we are talking about a 35 foot set back from the property line right? Stiles: Chairman Johnson, you are talking about a 35 foot landscape setback. Johnson: Right on the front of the property. Stiles: That would be from the required right of way from ACRD which is 45 feet from the centerline of the roadway. Johnson: 45 feet from the centerline Stiles: Of the existing roadway. Johnson: And then an additional 35 foot of landscaping. Meridian Planning & Zoning Commission November 14, 1995 Page 43 Stiles: Beyond that, the sidewalk would be within the 45 feet. Johnson: Thank you Shari, Dirk, did you want to comment on the access question? Marcum: Okay, the access is off of Franklin Road, there is no access off of 10th, it is all landscaped around that corner. Access if off Franklin Road. The setback on the project we actually, the buildings are another, our one building is going to be approximately 110 feet off Franklin Road and the other ones have the 35 foot plus the 30 foot plus the adjusted easement for the new road. So, I guess we have the 65 foot of our property plus the 45 feet I guess. So they are substantially back off of Franklin Road. Johnson: Okay, thank you. The design for the reconstruction of Franklin Road in this area is completed. The applicant should coordinate with the District's Plans and Survey Division to incorporate any approved driveway(s) in the street plans. W . 10th Street Local street with no pathway designation No traffic count available 100-feet of frontage 60-feet existing right-of--way (30-feet from centerline) No additional required right-of--way W. 10th Street is improved with 44-feet of pavement with no curb, gutter or sidewalk. B. Franklin Road between Linder Road and Meridian Road is listed in the Five Year Work Program, scheduled for construction in 1998. Staff recommends that the applicant provided a deposit to the Public Rights-of--Way Trust Fund the cost of constructing 5-foot wide concrete sidewalk on Franklin Road abutting the parcel. These improvements are estimated to cost a total of $5,372.00. C. In accordance with District policy, staff recommends that the applicant be required to construct curb, gutter, 5-foot wide concrete sidewalk and pavement widening (to one half of a 41-foot street section) on 10th Street abutting the parcel. The applicant should provide a deposit to the Public Rights-of--Way Trust Fund for the cost of construction of a portion of the sidewalk which would be required over the bridge at the north of this parcel. Staff recommends that sidewalk be constructed on 10th Street per Section 7204.9.1 of the District's policy manual. MCU2395. WPD Page 2 D. No access to 10th Street is proposed. One 35-foot wide riveway is proposed from Franklin Road approximately 250-feet west of 10th Street. There are no driveways on the south side of Franklin Road to conflict with this driveway's location. Staff recommends that the driveway be a maximum of 30-feet wide. E. The gate to the storage facility is located sufficient distance from Franklin Road to not cause stacking to back up onto Franklin Road. F. The transportation system will be adequate to accommodate additional traff c generated by this proposed development. G. This application is scheduled for a public hearing by the Meridian Planning and Zoning Commission on November 14, 1995. The following requirements are provided to the City of Meridian as conditions for approval: Site Specific Requirements: 1. Dedicate 45-feet of right-of--way from the centerline of Franklin Road abutting the par- cel (approximately 15 additional feet) prior to issuance of building permit (or other required permits). The owner will be compensated for this additional right-of--way from available impact fee revenues in this benefit zone. If the owner wishes to be paid for the additional right-of--way, the owner must submit a letter of application to the impact fee administrator prior to breaking ground, in accordance with Section 15 of ACHD Ordinance #188. 2. Provide a $5,372.00 deposit to the Public Rights-of--Way Trust Fund at the District for the required street improvements of 632-feet of 5-foot wide concrete sidewalk on Franklin Road abutting the parcel prior to issuance of building permit (or other required permits). Or Construct 5-foot wide concrete sidewalk on Franklin Road abutting the parcel (approximately 632-feet) if construction, prior to the ACRD roadway project scheduled for this portion of Franklin Road is started, if determined to be acceptable by ACRD Plans and Survey Staff. 3. Construct curb, gutter, and 5-foot wide concrete sidewalk and match paving on 10th Street abutting the parcel. The applicant shall provide a deposit to the Public Rights- of-Way Trust Fund for the cost of construction of a portion of the sidewalk which would be required over the bridge at the north of this parcel. Improvements shall be constructed to one half of a 41-foot street section. 4. Construct one 30-foot wide driveway with 15-foot radii pavement tapers on Franklin Road, located as proposed approximately 250-feet west of 10th Street. The driveway MCU2395. WPD Page 3 shall be paved feet wide a minimum of 30-feet beyond the edge of pavement for Franklin Road. No other access points to Franklin Road are approved. 5. The security gate for the storage facility shall be located as proposed. Any proposed relocation of the gate shall be reviewed and approved by the District's Development Services Division. Standard Requirements: 1. A request for modification, variance or waiver of any requirement or policy outlined herein shall be made in writing to the Development Services Supervisor. A request for an appeal of the Commission's action shall be made in writing to the Development Services Supervisor within 15 calendar days of the action and shall include a minimum fee of $110.00. The appeal will be scheduled to be heard by the Commission within 20 calendar days after receipt. The request for appeal shall specifically identify each requirement to be reconsidered nd include a written explanation of why such a requirement would result in a substantial hardship or ine4u~• 3. Aright-of--way permit must be obtained from ACHD for any street or utility construction within the public right-of--way. Utility cuts should be combined where practical to limit pavement damage. Utility street cuts in roads paved within the last five years will not be allowed unless approved by the District Commission Contact Construction Services at 345-7667 (with file number) for details. 4. Submit site drainage plans and calculations for review and appropriate action by ACHD prior to issuance of building permit (or other required permits). The proposed drainage system shall retain all storm water on-site and shall conform to the requirements of Meridian. Public street drainage facilities shall be located in the public right-of--way or in a common lot owned by a homeowners association set aside specifically for that use. There shall be no trees, fences, bushes, sheds, or other valuable amenities placed in said easement. Drainage lots and their use restrictions shall be noted on the plat (when applicable). 5. Locate driveway curb cuts a minimum of 5-feet from the side lot property lines when driveways are not being shared with the adjacent property. MCU2395. WPD Page 4 6. Construct pedes~n ramps on the corner of all street int~!`section in compliance with Idaho Code, Section 40-1335. 7. Dedicate up to a 20-foot x 20-foot right-of--way triangle (or appropriate curve) to keep street improvements within the public right-of--way at all intersections abutting and/or within the development prior to issuance of building permit (or other required permits). 8. Continue existing irrigation and drainage systems across parcel. 9. Continue borrow ditch drainage abutting parcel (culvert may be required). 10. Provide written approval from the appropriate irrigation/drainage district authorizing storm runoff into their system. 11. If street improvements are required, locate obstructions (utility facilities, irrigation and drainage ditches and appurtenances, etc.) outside of the public right-of--way. Authorization for relocations shall be obtained from the appropriate entity. If determined by the District, existing irrigation facilities may remain in the right-of--way with District review and approval of easements recorded for future relocation at a later date. 12. Locate proposed sign(s) out of the public right-of--way and out of the clear-vision sight- triangle of all street and driveway intersections. 13. Install a stop sign on every unsignalized approach of a project street to an intersection involving a collector or arterial as the cross-street. The stop sign shall be installed when the project street is first accessible to the motoring public. 14. The developer is required to install street name signs at the locations approved by the Ada County Highway District. Purchase street name signs, sign poles, and mounting hardware from ACHD's Traffic Operations Department or an approved outside supplier. The District will not manufacture street signs until a copy of the recorded plat showing the recording data has been provided to Development Services staff. 15. Provide a clear vision sight triangle at all street intersections. Within this triangle no obstruction higher than 36-inches above the top of pavement will be allowed, including landscaping, berms, fences, walls or shrubs. The triangle shall be defined by the long leg measured down the centerline of any collector 350-feet; and the short leg measured down the centerline from the collector street curb line 20-feet. Provide notes on the plat and street construction plans of these restrictions. 16. Submit three sets of street construction plans to the District for review and appropriate action. 17. Provide design data for proposed access to public streets for review and appropriate action by ACRD. MCU2395.WPD Page 5 18. All public street~nd drainage systems shall be designedd constructed in conformance with District standards and policies. 19. Specifications, land surveys, reports, plats, drawings, plans, design information and calculations presented to ACHD shall be sealed, signed and dated by a Registered Professional Engineer or Professional Land Surveyor, in compliance with Idaho Code, Section 54-1215. 20. The applicant shall submit revised plans for staff approval, prior to issuance of building permit (or other required permits), which incorporates any required design changes. 21. Construction, use and property development shall be in conformance with all applicable requirements of the Ada County Highway District prior to District approval for occupancy. Repair Shop By Kevin Howell and Dirk Marcum Dear Shari, I reviewed the Findings of Pact and Conclusions for the above mentioned Conditional Use Permit and find no reference of a time Limit on its. Condition number nine under the Conclusions section indicates a yearly review of the conditional use permit and that the permit may be revoked if the conditions hereof, ar the Ordinances of the City, are not met. It is my interpretation that this yeazly review is not a time limitation on the approval, but rather a tool for control of the development upon completion of construction. Please let me know if your research of the Findings of Fact and Conclusions indicates to you that a time extension on the approval of this conditional use permit needs to be filed. Franklin site would work very well for Nampa & Meridian Irrigation District. The full easement remains once the Eightmile Lateral goes behind the storage; area. We do burn these laterals and I feel that this type of facility would. have vehicles parked right up against the fence. This could make it very dangerous for the crews of Nampa & Meridian Irrigation District as they perform the necessary day-to- day maintenance. I would like to visit with you and/or the owners in regard to this project before I recommend a License Agreement to the District's Board of Directors. Please contact me at your convenience.
