Idaho Meridian, Idaho 83642 August 18, 1995 Re: Englewood Creek Estates Subdivision Dwelling minimum square footage Dear Mayor Kingsford; We respectfully request a Public Hearing for a reduction in dwelling minimum square footage from 1800 square feet to 1500 square feet. I have had several conversations with the City Planner and City Attorney regarding the proper procedures in which this request should be submitted to the City. Apparently there has not been any previous cases similar to this, however, Planning & Zoning and the City Council do have the authority to approve this request through public hearings. The Facts and Findings will have to be revised to reflect the change because the annexation included the minlmum home square footages specified in the proposed subdivision covenants rather than the 1400 square foot homes that the R-4 zoning BIIOWS. As mentioned at a previous City Council meeting, the current market for larger homes is not selling and development at the larger square footages would result in the development laying bare and the developers suffering financial hardships. Approval of this request would make the development more saleable in the current market. The reasons for this request are as follows: 1. Mortgage interest rates have increased since the preliminary plat was submitted for approval, causing a substantial decrease in the market that would qualify for the mortgage loans. - Candlelight Subdivision 1500 Square Feet - Parkwood Meadows 1400 - Saddle View 1400 - Firelight 1400 - Cherry Lane Meadows 1250 2. IDAHO AMENDED FINDINGS OF FACT AND CONCLUSIONS OF LAW The above entitled annexation and zoning application having come on for consideration on June 8, 1993, at the hour of 7:30 o'clock p.m. on said date and again on September 12, 1995, on Applicant's request to reduce the required minimum house size of 1,800 down to 1,500 square feet, at the Meridian City Hall, 33 East Idaho Street, Meridian, Idaho, and the Planning and Zoning Commission having heard and taken oral and written testimony and the Applicant not appearing in person but through Richard Jewell, and having duly considered the matter, the Planning and Zoning Commission makes the following: FINDINGS OF FACT 1. That notice of public hearing on the annexation and zoning was published for two (2) consecutive weeks prior to the said public hearing scheduled for June 8, 1993, the first publication of which was fifteen (15) days prior to said hearing; that the matter was duly considered at the June 8, 1993, hearing; that the public was given full opportunity to express comments and submit evidence; and that copies of all notices were available to newspaper, radio and television stations; FINDINGS OF FACT AND CONCLUSIONS OF LAW - PAGE 1 • 2. That the property included in the application for annexation and zoning is described in the application, and by this reference is incorporated herein; that the property is approximately 29.8 acres in size; it is in a portion of Government Lot 1, Section 3, Township 3 North, Range 1 West, Boise-Meridian, Ada County, Idaho. 3. That the property is presently zoned by the county as RT (Rural Transition) and the proposed use would be for R-4 Residential type development. 4. The general area surrounding the property is used agriculturally and residentially; that the residential property is zoned R-4, Residential; that the required minimum house size in the R-4 zone is 1,400 square feet; that Applicant stated in its preliminary plat application that the minimum house size was 1,800 square feet; that Applicant has come back to the City and requested that the minimum house size be decrease from the 1,800 square feet to 1,500 square feet. 5. That the property is adjacent and abutting to the present City limits. 6. The Applicant is not the owner of record of the property but the owner of record has requested the annexation and consented to the Application. 7. That the property included in the annexation and zoning application is within the Area of Impact of the City of Meridian. 8. That the entire parcel of ground is included within the Meridian Urban Service Planning Area as the Urban Service Planning FINDINGS OF FACT AND CONCLUSIONS OF LAW - PAGE 2 • Area is defined in the Meridian Comprehensive Plan. 9. That the Application requests that the parcel be annexed and zoned R-4 Residential; that the present use of the property is for agriculture; that the applicant indicated that the intended development of the property is for an R-4 type subdivision and in the Application stated the density would be approximately 3.1 dwelling units per acre. 10. That Richard Jewell testified at the hearing commenting that Applicant is in agreement with the development fee statute; that developer will provide what is needed to work with the school district; that the property borders Ten Mile Road for 37 feet; that the island between Ten Mile Road and the proposed Application is owned and maintained by the homeowners; that pressurized irrigation would be provided if there is sufficient water available; that they will meet the street light ordinance; that a small park will be provided; that Applicant favors a real estate transfer fee; that Applicant is in favor of a green belt; that Applicant will work with all the public services; that Applicant will re-submit a preliminary plat. 11. That the property is in the CHERRY LANE Neighborhood as set forth in Policy Diagram in the Meridian Comprehensive Plan; that under Housing Development on page 25 and 26 of the Comprehensive Plan property inside the Urban Service Planning Area may be developed at greater densities than one dwelling unit per acre and it is the policy that a density of greater than 1 dwelling FINDINGS OF FACT AND CONCLUSIONS OF LAW - PAGE 3 • • unit per 5 acres may not be exceeded outside of the Urban Service Planning Area. 12. That in the Rural Area section of the Comprehensive Plan it does state that land in agricultural activity should so remain in agricultural activity until it is no longer economical to exclude orderly growth and development to maintain agricultural pursuits. 13. That Meridian has, and is, experiencing a population increase; that there are pressures on land previously used for agricultural uses to be developed into residential subdivision lots. 14. That the property can be serviced with City water and sewer. 15. That the City Engineer, Meridian School District, Idaho Power, Bureau of Reclamation, and the Meridian Planning Director submitted comments and such are incorporated herein as if set forth in full. 16. The Meridian School District submitted comment and such is incorporated herein as if set forth in full; its comment was that there is no excess capacity in the schools of the District and that residents of the new subdivision could not be assured of attending the neighborhood schools; the School District asked for support for a development fee or a transfer fee to help offset the costs of building additional schools. 17. That in 1992 the Idaho State Legislature passed amendments to the Local Planning Act, which in 67-6513 Idaho Code, FINDINGS OF FACT AND CONCLUSIONS OF LAW - PAGE 4 • • relating to subdivision ordinances, stated as follows: "Each such ordinance may provide for mitigation of the effects of subdivision development on the ability of political subdivisions of the state, including school districts, to deliver services without compromising quality of service delivery to current residents or imposing substantial additional costs upon current residents to accommodate the proposed subdivision."; that the City of Meridian is concerned with the increase in population that is occurring and with its impact on the City being able to provide fire, police, emergency health care, water, sewer, parks and recreation services to its current residents and to those moving into the City; the City is also concerned that the increase in population is burdening the schools of the Meridian School District which provide school service to current and future residents of the City; that the City knows that the increase in population does. not sufficiently increase the tax base to offset the cost of providing fire, police, emergency health care, water, sewer, parks and recreation services; and the City knows that the increase in population does not provide sufficient tax base to provide for school services to current and future students. 18. That pursuant to the instruction, guidance, and direction of the Idaho State Legislature, the City may impose either a development fee or a transfer fee on residential property, which if possible would be retroactive and apply to all residential lots in the City, because of the imperilment to the health, welfare, and safety of the citizens of the City of Meridian. 19. That the R-4, Residential District is described in the Zoning Ordinance, 11-2-408 B. 1 as follows: FINDINGS OF FACT AND CONCLUSIONS OF LAW - PAGE 5 • (R-4) LOW DENSITY RESIDENTIAL DISTRICT: The purpose of the (R-4) District is to permit the establishment of low density single-family dwellings, and to delineate those areas where predominantly residential development has, or is likely to occur in accord with the Comprehensive Plan or the City, and to protect the integrity of residential areas by prohibiting the intrusion of incompatible non-residential uses. The (R-4) District allows for a maximum of four (4) dwellings units per acre and requires connection to the Municipal Water and Sewer systems of the City of Meridian. 20. That Section 11-9-605 C states as follows: "Right-of-way for pedestrian walkways in the middle of long blocks may be required where necessary to obtain convenient pedestrian circulation to schools, parks or shopping areas; the pedestrian easement shall be at least ten feet (10') wide." 21. That Section 11-9-605 G 1. states as follows: "Planting strips shall be required to be placed next to incompatible features such as highways, railroads, commercial or industrial uses to screen the view from residential properties. such screening shall be a minimum of twenty feet (20') wide, and shall not be a part of the normal street right of way or utility easement;" 22. That Section 11-9-605 H 2. states as follows: "Existing natural features which add value to residential development and enhance the attractiveness of the community (such as trees, watercourses, historic spots and similar irreplaceable amenities) shall be preserved in the design of the subdivision;" 23. That Section 11-9-605 K states as follows: "The extent and location of lands designed for linear open space corridors should be determined by natural features and, to lesser extent, by man-made features such as utility easements, transportation rights of way or water rights of way. Landscaping, screening or lineal open space corridors may be required for the protection of residential properties from adjacent arterial streets, waterways, railroad rights of way or other features. As improved areas (landscaped), semi- improved areas (a landscaped pathway only), or unimproved areas (left in a natural state), linear open space corridors serve: FINDINGS OF FACT AND CONCLUSIONS OF LAW - PAGE 6 • • 1. To preserve openness; 2. To interconnect park and open space systems within rights of way for trails, walkways, bicycle ways; 3. To play a major role in conserving area scenic and natural value, especially waterways, drainages and natural habitat; 4. To buffer more intensive adjacent urban land uses; 5. To enhance local identification within the area due to the internal; linkages; and 6. To link residential neighborhoods, park areas and recreation facilities. 24. That Section 11-9-605 L states as follows: Bicycle and pedestrian pathways shall be encouraged within new developments as part of the public right of way or as separate easements so that an alternate transportation system (which is distinct and separate from the automobile) can be provided throughout the City Urban Service Planning Area. The Commission and Council shall consider the Bicycle-Pedestrian Design Manual for Ada County (as prepared by Ada County Highway District) when reviewing bicycle and pedestrian pathway provisions within developments. 25. That the Applicant submitted an application for preliminary plat along with the application for annexation and zoning which application included a preliminary plat. 26. That proper notice was given as required by law and all procedures before the Planning and Zoning Commission were given and followed. CONCLUSIONS 1. That all the procedural requirements of the Local Planning Act and of the Ordinances of the City of Meridian have been met including the mailing of notice to owners of property within 300 feet of the external boundaries of the Applicant's property. FINDINGS OF FACT AND CONCLUSIONS OF LAW - PAGE 7 • • 2. That the City of Meridian has authority to annex land pursuant to 50-222, Idaho Code, and Section 11-2-417 of the Revised and Compiled Ordinances of the City of Meridian; that exercise of the City's annexation authority is a legislative function. 3. That the Planning and Zoning Commission has judged this annexation and zoning application under Section 50-222, Idaho Code, Title 67, Chapter 65, Idaho Code, the Meridian City Ordinances, the Meridian Comprehensive Plan, ~s amended, and the record submitted to it and things of which it can take judicial notice. 4. That all notice and hearing requirements set forth in Title 67, Chapter 65, Idaho Code, and the Ordinances of the City of Meridian have been complied with. 5. That the Commission may take judicial notice of government ordinances, and policies, and of actual conditions existing within the City and State. 6. That the land within the proposed annexation is contiguous to the present City limits of the City of Meridian, and the annexation would not be a shoestring annexation. 7. That the annexation application has been initiated by the Applicant, with the consent of the owner and the annexation is not upon the initiation of the City of Meridian. 8. That since the annexation and zoning of land is a legislative function, the City has authority to place conditions upon the annexation of land. 9. That the development of annexed land must meet and comply with the Ordinances of the City of Meridian and in particular FINDINGS OF FACT AND CONCLUSIONS OF LAW - PAGE 8 • Section 11-9-616 which pertains to development time schedules and requirements and 11-9-605 M, Piping of Ditches; that the Applicant will be required to connect to Meridian water and sewer; that the development of the property shall be subject to and controlled by the Subdivision and Development Ordinance; that, as a condition of annexation the Applicant shall be required to enter into a development agreement as authorized by 11-2-416 L and 11-2-417 D; that the development agreement shall address the inclusion into the subdivision of the requirements of 11-9-605 C, G., H 2, K, L and the comments of the Planning Director, Wayne Forrey, relating to the lack of adequate recreation facilities and that land set aside for a future park would be desirable, that the City is in need of land set-asides for future public service use, that a school site was not reserved and the subdivision, when developed totally, would contribute 125 children to the School District, a greenbelt along Nine Mile Creek and co-ordination was needed with the Pathway Plan; that the development agreement shall, as a condition of annexation, require that the Applicant, or if required, any assigns, heirs, executors or personal representatives, pay, when required, any development fee or transfer fee adopted by the City; that there shall be no annexation until the requirements of this paragraph are met or, if necessary, the property shall be subject to de- annexation and loss of City services, if the requirements of this paragraph are not met. 10. That proper and adequate access to the property is available and will have to be maintained. FINDINGS OF FACT AND CONCLUSIONS OF LAW - PAGE 9 11. That since the Applicant's property is in the CHERRY LANE NEIGHBORHOOD of the Comprehensive Plan, the annexation and zoning Application is in conformance with the Comprehensive Plan and does not conflict with the Rural Areas policies. 12. It is concluded that the development, with a density of 3.15 dwellings units per acre, is an R-4 type development and should be zoned in that fashion; that the minimum house size was initially listed as being 1,800 square feet and that was required by the City because that is what was requested by the Applicant; since the Applicant has requested that the minimum house size be decreased to 1,500 square feet and other subdivisions in the area have similar minimum house sizes, that the minimum house size should be 1,500. 13. Therefore, based on the Application, the Findings of Fact and Conclusions, and the Ordinances of the City of Meridian, it is ultimately concluded that Applicant's property should be annexed and zoned R-4; that the development of the property shall be at a density of not more than 3.15 dwelling units per acre with a minimum house size requirement of 1,500 square feet; that any representations of Applicant's representative shall be a restriction on the development and all representations shall be met; that the conditions should be those stated above and upon issuance of final platting and other conditions to be explored at the City Council level; that such annexation would be orderly development and reasonable if the conditions are met; that the property shall be subject to de-annexation if the R-4 density is FINDINGS OF FACT AND CONCLUSIONS OF LAW - PAGE 10 • • exceeded, the 1, 500 square foot minimum house size is not followed, or dwellings other than single family dwellings are allowed; and this restriction shall be noted on the plat of the subdivision. 14. That all ditches, canals, and waterways shall be tiled as a condition of annexation and if not so tiled the property shall be subject to de-annexation. 15. That any requirements from the Nampa Meridian and Settlers Irrigation Districts shall be met as well as any requirements of the Bureau Reclamation and the City Engineer. 16. With compliance of the conditions contained herein and the 1, 500 minimum house size followed, the annexation and zoning or R-4, Residential, would b,e in the best interest of the City of Meridian. 17. That if the conditions of approval are not met the property shall be subject to de-annexation. APPROVAL OF FINDINGS OF FACT AND CONCLUSIONS The Meridian Planning and Zoning Commission hereby adopts and approves these Findings of Fact and Conclusions. It does drain a portion of the street from the I think there is a catch basin at I am not sure the name of the street but it is the first street in from East 1st, there is a point of catch right there and that pipe runs to the east and then to the north along in this easement and then to the east continuing along the north side of this property to Nine Mile Drain. So if the easement is to be vacated then the pipe needs to be relocated in another easement I would assume. It is not our pipe, it belongs to, I guess it is the Highway District's storm drainage pipe.. I am not certain of that but Larry could speak to that. Johnson: Thank you Mr. Smith. Larry Sale, anything to add. Sale: Mr. Chairman, members of the Commission, for the record I am Larry Sale with ACRD. The design plans for the storm drains indicate that is varies in depth from 8 feet in the street to about 10 feet deep along the property line. Obviously anything can be relocated if you spend enough money I guess. We would recommend that the applicant search for another means to reach their goals other than to vacate the easement and relocate the pipe. So we would reaffirm our recommendation that the easement not be vacated. Certainly until the applicant provides the Highway District with an adequate plan for suitable relocation. ITEM #13: PUBLIC HEARING: REQUEST FOR A CONDITIONAL USE PERMIT FOR A CELLULAR COMMUNICATION FACILITY BY US WEST NEWVECTOR GROUP, INC.: Johnson: 1 will now open the public hearing, is the applicant or his representative ready to address the Commission. Timothy McFadden, 11201 Southeast 8th St, Bellevue, WA, 98004, was sworn by the City Attorney. McFadden: I am an acquisition and zoning consultant for US West, I am the person that prepared the package that you have before you. US West is requesting permission conditional use permit to construct a cellular phone facility at the mini storage located on Meridian. The facility ~nrould consist of interior, there is currently covered storage there. What US West is proposing to do is to enclose one of those units with the radio equipment inside that enclosed unit and then put the pole with the equipment next to it with the equipment on it next to the building. This is for lack of a better term a second generation cellular site. By that I mean the first generation of cellular is typically found on the highest points around, for instance Table Rock and some of the 300 or 400 foot towers that they put in. The only way that the company or any cellular company can increase capacity is to add more sites. Given the explosive growth of the industry this is one of 4 or 5 sites that is going to be going in around the perimeter of the Boise area, the core area to increase capacity. From the standpoint .of US West this is a fairly basic facility, there is nothing unusual about this one that you wouldn't find in any other cellular facility. The equipment room will contain 2 way radio equipment, and as I said the pole will have the antennas on top. We have entered into an option to lease from the gentleman that owns the storage pending the obtaining of all the necessary permits. We would hope that once the permits if and when the permits are granted we would be able to move into construction as soon as possible. It is really all we have in the way of a presentation. Johnson: Thank you very much, are there any questions of Mr. McFadden? Rountree: Are there any specific cellular requirements that makes this site particularly good for you (inaudible). McFadden: My job is I am the real estate guy that goes out and finds it and does the permitting. Richard Jewell, 1082 Arlington, Eagle, was sworn by the City Attorney. Jewell: Mr. Chairman and Commissioners, first of all I would like to apologize for getting • Meridian Planning & Zoning Commission September 12, 1995 Page 23 here late and I appreciate you holding it over. This request is for reduction in square footage of the dwellings for Englewood Subdivision from 1800 square feet to 1500 square feet. There are several reasons that we are requesting this. One of the major reasons those is due to the current market. The 1800 square foot homes are not really selling at this time, they have not been for the past year. Johnson: Enlighten me, what is the average sale price on an 1800 square foot home? Jewell: They range approximately between well right around $75 a square foot. Smith: $135,000 Jewell: We have another subdivision Running Brook Estates which had the minimum square footage of 1800 square feet, it is a different location or different area. However we have had some hardships in that particular subdivision because of the lack of lot sales. In addition to that the surrounding subdivisions that have been approved and are in the process of being developed are all in the neighbofiood of 1400 square feet. Originally we came to the City I guess it dates back to about April requesting the square footage reduction. There was some concern about how to proceed with this. So we decided to come back to Planning and Zoning as per the Mayor's recommendation. Do you have any questions? Johnson: Yes, why does the Mayor keep doing this? Jewell: Well in this particular case he was probably correct, the reason being is because in the preliminary plat process when we had the preliminary plat submitted along with the annexation request the City requested the preliminary covenants of which we submitted and they were generally what we intended however they were sketched from the last project we had at 1800 square feet and that is how it got sent through and the annexation tied the square footage of the dwelling units to the approval or the approval tied the square footage to the annexation which I believe is an incorrect thing but apparently that is how it's done. Johnson: The difference between that market, that $112,500 versus $135,000 I have no clue whether. that is a valid argument or not. I don't have any statistics on what is selling and what isn't. What you are telling us is there is a significant difference just to that 300 square foot range then as far as what people are able to afford at this point or that is what is selling. Jewell: Generally in the valley here, anything that is say up to $105,000 - $110,000 it is selling as fast as you can put them up generally speaking. You get up to $125,000 - • Meridian Planning & Zoning Commission September 12, 1995 Page 24 $150,000 on up to $250,000 somewhere in there and it is a very depressed market at least compared to what it was. Rountree: Second Johnson: I assume we need findings on this request for a reduction, is that correct or not? Crookston: Well, there were findings prepared when we did the annexation and zoning. The findings indicate that the request for the 1800 square feet was at the developers request as I remember it was included in their application either in their plat application or in their annexation application. I think that you do need to amend, if your desire is to proceed with the amendment I think that those findings need to be amended. I don't think we need new findings but you would need amended findings. Johnson: That was the reason for my question. So we do have a motion and a second. Crookston: You can make a recommendation you still need the findings but you can make a recommendation. Johnson: I was thinking, I am trying to find a way to speed this process up is what 1 trying to do. Crookston: It would still have to approve the amended findings. Alidjani: So no matter what we do it is going to wait until the October 10th meeting in order to approve the amended findings or a new finding. Crookston: That is correct.
