Opposed? MOTION CARRIED: AlI Yea Smith: The second item I have is a request from Roylance and Associates for an easement relinquishment in Central Valley Corporate Park No. 1, Lot 5 -Block 1, I will pass out their written request along with a little photo copy of the lot. Any time a request for a relinquishment is made it goes through the various utilities. They all have to sign off on the request. At the top of the written page you can see there are five utilities listed there one of which is the Meridian Department of Public Works. The area that I have highlighted on that sheet states that the document will relinquish the 20 foot easement on the north of Lot 5 -Block 1 and create a new 10 foot easement along the north line of Block 5 -Lot 1. This document will relinquish the 20 foot easement along the west line of Lot 5 -Block 1 and a-eate a new 5 foot easement along that west line of Lot 5 -Block 1. Public works department has no objection to this. Tolsma: Mr. Mayor, could we require the same thing we did on this prior easement to indemnify the City of all problems (inaudible) Smith: 1 think in that case I believe that gentleman already had a foundation constructed that was a problem. t don't know if that is appropriate but maybe Wayne could speak to that. Typically if all the utilities sign off on it as far as relinquishing it then everybody, someone along the line could say we can't relinquish this because we already have something there for example. I don't know I guess Wayne would have to address it. Tolsma: (Inaudible) Crookston: I have not seen this relinquishment idea done before, I think what this is its a vacation of a portion of the plat. Kingsford: Well, it is not a portion of the plat your are vacating an easemenf in the plat. The plat itself doesn't change except for the easement. Crookston: That is true but you actually vacate the easement portion of the plat. Kingsford: We have done that numerous times Wayne with regard to Fairview for example the portion where the car wash is and so forth. We have seen this a lot, it doesn't change i • Meridian City Council June 20, 1995 Page 31 the plat. Crookston: It does change the plat because the easement is removed from the plat. Morrow: A portion of the easement. Kingsford: It seems to me that the better approach would have been not to vacate 20 feet but to vacate 15 feet and put it in a more logical English language. Crookston: It is similar to where we vacated that irrigation easement for the property above over off of Overland above the rim it was not in the City it was in the County and he applied for a vacation of the easement, I think that is what these people want to do. Kingsford: There are no utilities built there and what is the disposition of that property, there is no building there either is that correct? Smith: I think that is where Zamzows built their, what do they call it, corporate office, 1 could be wrong. Crookston: If you don't vacate it from the plat and have the plat changed it will always show-this easement on there. Smith: I think the plat will always show the easement but it will have an attachment to it. I am not sure, they don't physically change the plat Wayne I don't believe they just attach a recorded document that says that this easement has been vacated or changed. Tolsma: The building is already built and paved and asphalted and everything on this property. Smith: If that is the lot that I am thinking of Ron, then yes. Tolsma: Our well sits on Lot 4 doesn't it? Smith: That is the Eight Mile Lateral/ Kingsford: That is the ditch itself, that would be true then that would be the building that they have already completed. Morrow: Isn't this handled just as a recorded addendum to the plat and there is a notation on the plat. Smith: Yes I believe so. I know it would be handled that way if it was a vacation I am t --j Meridian City Council June 20, 1995 Page 32 • • assuming that it would be recorded as a whatever the word relinquishment what significant that has technically. I guess if you relinquish something you give it up which is what, they are asking us to do is to give up that easement right since it is a public utilities and drainage easement. That is the way it is called out on the plat. . (Inaudible) Smith: It would have been a lot easier if they had said that you are right. Kingsford: Any other discussion? Is it the Council's desire to relinquish? I guess then to grant then to put that on the plat or record it, I think it has to be recorded with the plat unless you amend the plat it isn't going to change it. Crookston: There is a procedure that you have to follow to vacate any portion of the plat. This is shown, it is my understanding that this is shown on the plat as a utility easement. They need to follow that process, I think it may very well be that nobody cares, but I think they have to follow the process which is in the State code. Kingsford: Well, I would entertain a motion by Council to send it back to them and requesting them to do it that'way. Yerrington: So moved Corrie: Second Kingsford: Moved by Max, second by Bob to require the applicant to go through the proper procedure on that vacation and use better English as they do it, all those in favor? MOTION CARRIED: All Yea Smith: Thank you Mr. Mayor and Council, the last item I have is on our Well lot No. 16 we received a letter from Mr. Thomas Wright and he has requested that the appropriate signatures be attached to a donee acknowledgement by a charitable organization. I will pass out a copy of this document. Mr. Wright said in his cover letter please find enclosed the original IRS form 8283 non-cash charitable contributions. Gemtone Inc. would ask if you could secure the appropriate signature on part iv donee acknowledgement. MOTION CARRIED: All Yea Smith: Thank you Mr. Mayor and Council members, the last item I have is in Central Valley Corporate Park, Nahas' development there is a plat that was filed, No. 2 and No. 3 that the combination of the 2 involves a short culdesac street culdesac. They are wanting to re-plat that area into a different lot configuration. Part of the re,plat would be the request through the Highway District to vacate that roadway. In order for the Highway District to do this I have been advised by our legal counsel that we need to have a consent from the City Council so that the Highway District can proceed with the vacation of the roadway which would then be followed by vacation of the plat as I understand it. Let me pass this out so you can see (inaudible). The plat of Central Valley Corporate Park continues to be an evolving process. The yellowed portion is Headway Court which is the roadway in consideration for vacation. Presently there is no construction on Headway Court other than a stub off of South Progress Way which is that north-south street paralleling East First. Sewer and water were stubbed into that little I think the (inaudible) radius is on the curb and gutter were built and that is as far as it goes. It has been excavated slightly, the roadway was excavated but there were no improvements made. That was ancient, it could have very well done some contamination. I know that when they dug those tanks out the attitude was considerably different about ground contamination and I know they had leaked extensively. Figure 1 shows the site location. .~ • The purpose of this study is to make recommendations for the roadways in the . business park adjacent .intersections: • East 1st Street and Central Valley Drive, • Central Valley Drive and Progress Avenue, • Progress Avenue and, Corporate Drive, and • • East 1st Street and Corporate Drive. This analysis will provide a basis for a potential future traffic impact study. Existing Conditions Central Valley Corporate Park is accessible from East 1st Street via Central Valley Drive and Corporate Drive, and from Franklin Road via Stratford Drive (Figure 2). Central Valley Drive and. Corporate Drive, both east-west roadways with parking allowed on both sides, are, 60 feet and 40 feet wide respectively. Progress Avenue is a 40 feet wide north- . south roadway with parking allowed on both sides. Stratford Drive is a 40 feet wide north- south roadway connecting to Franklin Road. Traffic counts were taken in 1992 at the intersections of 1st Street/Corporate Drive, ..and 1st Street/Central Valley Drive. These counts were increased 2% per year to estimate . build-out (year .2015) turning movements. Trip Generation and Traffic Assignment Additional traffic from Central Valley Corporate Park was modelled assuming •. - ~ • + industrial and commercial uses as shown in Table 1. The building area is estimated to be 37% of the available land area. The table does not include existing developments in the Park ' such as Mc Donalds, Pizza Hut, etc., since traffic from existing uses is included in current ~. traffic volumes.. The trip generation shown for Computrol is for the proposed expansion only. The distribution of site traffic in Central Valley Corporate Park for the year 2015 is ~ ~ . shown on Figure 3. Traffic Circulation As shown in Figure 3, most of the traffic from the warehouse foodstore, the discount department store, and the wholesale sports store uses Progress Avenue and Central Valley Drive to access 1st Street. Traffic generated by light industrial/office complexes north and east of Computrol accesses 1st Street from Corporate Drive. Only 6 % of the site generated traffic uses Stratford Drive to access Franklin Road. Central Valley Drive and Corporate Drive carry the rest of the. traffic. Appendix A contains the build-out turning movements at the intersections of 1st Street/Central Valley Drive,1st Street/Corporate Drive, Progress Avenue/Corporate Drive, and Central Valley Drive/Progress Avenue. A capacity analysis, as described in the 1985 . Highway Capacity Manual, was performed for the four intersections. Results indicate that ..all the four intersections will perform at level-of-service "C" or better with recommended intersection configuration. The concept plan for Meridian (see Concept Report prepared by CH2M HILL for ACHD, May 1993) for the year 2014 proposes five alternatives. Alternative 4 proposes a'"T" (three leg) intersection for East 1st Street/Central Valley Drive with restricted movements to Meridian Road (right-in/right-out) from East 1st Street. ;The plan ~ also, proposes ~ a :.. .... .. i realignment of Meridian Road to Corporate Drive, forming a conventional four-leg ti ~ . ~ . intersection. This intersection of 1st Street, .Corporate Drive, and Meridian Road would be .~ .' signalized. ' Figure 4 and Figure 5 show the existing and recommended lane configurations at the four intersections with the proposed changes as described above. . •~ _ ~ ~ _ t.' ~~ ... .. , ;~ Conclusions and Recommendations ~ ~ • To ensure safe movement of traffic in the Central Valley Corporate Park area, the .following improvements are recommended: Central Valley Drive should accommodate. 4 lanes at 1st Street and 3 lanes , at Progress Avenue. Dual left-turn lanes should be provided at the 1st Street intersection.': • Progress Avenue should be widened to 3 lanes at Central Valley Drive and Corporate Drive. Left-turning and through traffic onto Progress Avenue from t Central Valley Drive should be controlled by a two-way stop sign. . • To avoid backing traffic from Central Valley Drive onto 1st Street due to the `` ~• j right turning traffic volumes (473 veh/hr) at Progress Avenue, afreeright-turn lane with a yield control is recommended for Central Valley Drive. • •Corporate Drive should accommodate 4 lanes at 1st Street and 3 lanes at Progress Avenue. At this time I will open the public hearing and invite the applicant or his representative to come forward and address the Commission. Crookston: Mr. Chairman, it was not opened. Charlie Gongre, Roylance and Associates, was sworn by the City Attorney. Gongre: I haven't been to one of these so you will have to instruct me. Do I need to review the project? Johnson: If you wish, just capsule form, explain the application. Gongre: This is a preliminary plat for phase 5 of CVCP, we are seeking approval of this. We have no objections to these conditions of approval, there may need to be clarification • • Meridian Planning & Zoning Commission August 8, 1995 Page 2 on a couple of items that I would like to address. Johnson: We have your written statement Charlie, is there anything there you would like to highlight or emphasize? I am speaking of your letter dated today. Gongre: On the site specific comments, page 2, number 3, Eight Mile Lateral is a 48 inch or larger main. It is our understanding that on the Eight Mile Lateral that we will need to the it and #hat we plan on requesting a variance and fencing and all of this. On the Nine Mile Creek it is designated woodlands and it is our understanding there is no need to file a variance but we will need to fence it. Johnson: You concur with that Gary that the Nine Mile Lateral also cannot be tiled? Smith: Mr. Chairman, 1 believe that Nine Mile is considered a drain and we haven't been tiling the drains. Gongre: We have tried to the it and it was with a 404 permit and we were not allowed to. Johnson: Why? Smith: We went through this exercise in Los Alamitos similar Corps of Engineers didn't want us tiling that drain. Gongre: That is really all of the comments that I have. Johnson: Are there any questions from the Commission to the applicant? Rountree: On the plat you have a (inaudible) that identifies a 35 foot common landscape area easement which borders the development in the Interstate, would you explain to me what is intended there? Gongre: The land will be owned by the individual property owners who purchase the property and it will be maintained by the subdivision. I believe that is why it is called a common easement. Rountree: Will the subdivision provide the landscaping? Gongre: That is the way that it has been done on the other phases and I have no reason to think it is going to be any different on this. Johnson: Any other questions? • Meridian Planning & Zoning Commission August 8, 1995 Page 3 Shearer: I do have a question, since we have already done this main subdivision and this Eight Mile Lateral has been in effect decisions made on how it would be handled is there any need for them to get a variance to do the other phase of the subdivision which is what we are talking about now? As I recall there was a variance before to not file Eight Mile through this. It vuould seem kind of strange to either the this portion and not the other portion or to have them have to come back for a variance for something that is already basically got a variance for, at least a portion of the subdivision. We can get bogged down enough with paperwork without. Johnson: Well, it is a new plat though is it not? What do you think Shari on that, have you been listening to the question? Stiles: Mr. Chairman, that was the only reason for the comment, this had originally come in as a PUD with no mention of tiling of ditches or anything like that. It is just the fact that it is a new plat that causes the compliance with all the ordinances in effect at the time of this subdivision. I suppose that would be a call the Council can also make since they are the ones that would act on the variance. Johnson: Thank you, any other questions? Any existing irrigation/drainage ditches crossing the property to be included in this project, shall be tiled per City Ordinance 11-9-605.M. If tiling is not proposed, a variance application will need to be submitted and approved and non-combustible fencing provided in lieu of tiling (unless otherwise determined by Council). Plans will need to be approved by the appropriate irrigation drainage district, or lateral users association, with written confirmation of said approval submitted to the Public Works Department. Also submit appropriate approvals for Nine Mile Creek plans (Bureau of Reclamation, Corps of Engineers, etc.) 2. Any existing domestic wells and/or septic systems within this project will have to be removed from their domestic service per City Ordinance Section 5-104A. Wells may be used for non-domestic purposes such as landscape irrigation. 3. Determine the seasonal high groundwater elevation, and profile the subsurface soil conditions. 4. The intersection of E. Eight Mile Court and E. Corporate Drive needs to be redesigned to facilitate through traffic as shown on the original preliminary plat. 2. What is the purpose of Lot 7, Block 4? No public road access has been provided to this lot. 3. Please submit, to the Public Works Department, a master street drainage plan including method of disposal and approval from the affected drainage district. 4. Streetlights will be required at locations designated by the Public Works Department. These will be installed at the subdivider's expense. 5. We have no objections to these conditions of approval, there may need to be clamcation • • Meridian Planning & Zoning Commission August 8, 1995 Page 2 on a couple of items that I would like to address. Johnson: We have your written statement Charlie, is there anything there you would like to highlight or emphasize? I am speaking of your letter dated today. Gongre: On the site speck comments, page 2, number 3, Eight Mile Lateral is a 48 inch or larger main. It is our understanding that on the Eight Mile Lateral that we wilt need to the it and that we plan on requesting a variance and fencing and all of this. On the Nine Mile Creek it is designated woodlands and it is our understanding there is no need to file a variance but we will need to fence it. Johnson: You concur with that Gary that the Nine Mile Lateral also cannot be tiled? Smith: Mr. Chairman, I believe that Nine Mile is considered a drain and we haven't been tiling the drains. Gongre: We have tried to the it and it was with a 404 permit and we were not allowed to. Johnson: Why? Smith: We went through this exercise in Los Alamitos similar Corps of Engineers didn't want us tiling that drain. Gongre: That is really all of the comments that I have. Johnson: Are there any questions from the Commission to the applicant? Rountree: On the plat you have a (inaudible) that identifies a 35 foot common landscape area easement which borders the development in the Interstate, would you explain to me what is intended there? Gongre: The land will be owned by the individual property owners who purchase the property and it will be maintained by the subdivision. I believe that is why it is called a common easement. Rountree: Will the subdivision provide the landscaping? Gongre: That is the way that it has been done on the other phases and I have no reason to think it is going to be any different on this. Johnson: Any .other questions? • • Meridian Planning & Zoning Commission August 8, 1995 Page 3 Shearer: I do have a question, since we have already done this main subdivision and this Eight Mile Lateral has been in effect decisions made on how it would be handled is there any need for them to get a variance to do the other phase of the subdivision which is what we are talking about now? As I recall there was a variance before to not file Eight Mile through this. It would seem kind of strange to either the this portion and not the other portion or to have them have to come back for a variance for something that is already basically got a variance for, at least a portion of the subdivision. We can get bogged down enough with paperwork without. Johnson: Well, it is a new plat though is it not? What do you think Shari on that, have you been listening to the question? Stiles: Mr. Chairman, that was the only reason for the comment, this had originally come in as a PUD with no mention of tiling of ditches or anything like that. It is just the fact that it is a new plat that causes the compliance with all the ordinances in effect at the time of this subdivision. I suppose that would be a call the Council can also make since they are the ones that would act on the variance. Johnson: Thank you, any other questions? Can you shed some light on that? Hutchinson: Yes, Mr. Chairman on I believe it was last week we had a meeting with Gary Smith and went over some of the concerns and in fact wrote him a letter that addressed those concems. We discussed the temporary lift station situation that will be involved with this particular subdivision, extension of water service and just a general review of the subdivision plan. I believe that, I came out of the meeting feeling that we had accomplished quite a bit. It is unfortunate that he isn't here because he does have that letter that we did send to him. Johnson: Do you have a copy of that letter with you this evening? Hutchinson: I believe I do, just a moment. Johnson: Do you we have your permission to make copies of this and enter it into the record? Hutchinson: Yes Johnson: Do you recall any areas of contention that still remain? Hutchinson: Mr. Chairman, I don't recall any that remained after that conversation. I don't know if Mr. Smith had any after receiving the letter and the copy of the plat. Johnson: Did you discuss the letter with him or had you just not heard back from him? Hutchinson: We had discussed each of the items in that list of conditions of approval and then we went through and answered those questions in a letter form. Johnson: So the meeting was prior to the letter? Hutchinson: Yes it was, in fact I believe the date of the letter is on there. Johnson: Yes, you met on the 6th and the letter is the 9th. General Information C-G -Zoning 23 -Lots 54.0 -Acres 281 -Traffic Analysis Zone (TAZ) West Ada -Impact Fee Benefit Zone Western Cities -Impact Fee Assessment District Progress Avenue Local commercial street with no pathway designation 60-feet existing right-of--way (30-feet from centerline) from previous plats 60-feet required right-of--way (30-feet from centerline) Progress Avenue is improved with 41-feet of pavement with curb, gutter and sidewalk on the west side. B. This phase will connect Progress Avenue to Corporate Drive and complete the loop. The existing turnaround at the south end of Progress Avenue can be eliminated after the construction of this phase. C. The preliminary plat proposes Corporate Drive "Tee"ing into Eight Mile Court. Staff recommends that this intersection be redesigned to "T" the culdesac road into Corporate Drive/Eight Mile Court as first proposed in the original preliminary plat. A larger number of vehicles will be driving on through on Corporate Drive/Eight Mile Court when compared to the culdesac road. D. Staff recommends that all internal streets be constructed as standard commercial roads with a 41-foot street section and 5-foot sidewalks in a 60-foot right-of--way. E. Lot 7, Block 4, has no public street frontage. Staff recommends that an access easement be provided for said lot. F. Interstate 84 is under the jurisdiction of Idaho Transportation Department (ITD). The developer is required to submit application materials to ITD for review and requirements of that Department. G. A traffic study has been submitted and reviewed for Central Valley Corporate Park. As a result of the traffic study, the applicant has been working with Traffic Services to redesign Preliminary Plat -Central Valley Corporate Park No. 5 Page 2 • • (widen) Corporate Drive between East 1st Street and Progress Avenue to accommodate the traffic generated. H. The street system will be adequate to accommodate any additional traffic generate by this proposed development. I. This application is scheduled for a public hearing by the Meridian Planning and Zoning Commission on April 11, 1995. The following requirements are provided to Meridian City as conditions for approval: Site Specific Requirements: Comply with requirements of ITD for Interstate 84 frontage. Submit to the District a letter from ITD regarding said requirements. 2. Construct all internal streets to a 41-foot back-to-back street section with 5-foot sidewalks and a 60-foot right-of--way. Standard culdesac shall be provided at the end of the Nine Mile Court and Eight Mile Court. 3. Resign Eight Mile Court to "T" the culdesac street into the through street of Corporate Drive and Eight Mile Court. 4. Provide an access easement to Lot 7, Block 4, to a public road. The easement shall be noted on the final plat. 5. Receive design approval from District Services Traffic Services Division for widening of Corporate Drive east of East 1st Street to approximately Progress Avenue. The approved street design shall be constructed prior to the fmal occupancy sign off by the District for any structure in this plat. Standard Requirements: 1. A request for modification, variance or waiver of any requirement or policy outlined herein shall be made, in writing, to the Manager of Engineering Services within 15 calendar davs of the original Commission action. The request shall include a statement explaining why such a requirement would result in substantial hardship or inequity and minimum fee of $110.00. 2. Locate driveway curb cuts a minimum of 5-feet from the side lot property lines when Preliminary Plat -Central Valley Corporate Park No. 5 Page 3 • • driveways are not being shared with the adjacent property. Locate obstructions (utility facilities, irrigation and drainage appurtenances, etc.) outside of the proposed street improvements. Authorization for relocations shall be obtained from the appropriate entity. 4. Aright-of--way permit must be obtained from ACHD for any street or utility construction within the public right-of--way. Utility cuts should be combined where practical to limit pavement damage. Contact Construction Services at 345-7667 (with zoning file number) for details. 5. Install a stop sign on every unsignalized approach of a project street to an intersection involving a collector or arterial as the cross-street. The stop sign shall be installed when the project street is first accessible to the motoring public. 6. The developer is required to install street name signs at the locations approved by the Ada County Highway District. Purchase street nave signs, sign poles, and mounting hardware from ACHD's Traffic Operations Department or an approved outside supplier. The District will not manufacture street signs until a copy of the recorded plat showing the recording data has been provided to Development Services staff. 7. Provide a clear vision sight triangle at all street intersections. Within this triangle no obstruction higher than 36-inches will be allowed, including landscaping, berms, fences, walls or shrubs. The triangle shall be defined by the long leg measured down the centerline of any collector 350-feet; and the short leg measured down the centerline from the collector street curb line 20-feet. Provide notes on the plat and street construction plans of these restrictions. 8. Submit site drainage plans and calculations for review and appropriate action by ACRD. The proposed drainage system shall conform to the requirements of Meridian and shall retain all storm water on-site. Public street drainage facilities shall be located in the public right-of--way or in a common lot owned by a homeowners association set aside specifically for that use. There shall be no trees, fences, bushes, sheds, or other valuable amenities placed in said easement. Drainage lots and their use restrictions shall be noted on the plat (when applicable). 9. Continue existing irrigation and drainage systems across parcel. 10. Continue borrow ditch drainage abutting parcel (culvert may be required). 11. Provide written approval from the appropriate irrigation/drainage district authorizing storm Preliminary Plat -Central Valley Corporate Park No. 5 Page 4 • • runoff into their system. 12. All public streets and drainage systems shall be designed and constructed in conformance with District standards and policies. 13. Specifications, land surveys, reports, plats, drawings, plans, design information and calculations presented to ACHD shall be sealed, signed and dated by a Registered Professional Engineer or Professional Land Surveyor, in compliance with Idaho Code, Section 54-1215. 14. Provide design data for proposed access to public streets for review and appropriate action by ACHD. 15. Submit three sets of street construction plans to the District for review and appropriate action.
