Re: Request for Transfer of Conditional Use Permit for the proposed
“Sunshine Academy” childcare center, currently called “Healthy Beginnings”
childcare center, located at 737 North Linder Road in an L-O (Limited Office)
Zone, by Debi Sheridan (File No. TCU-03-002).
We have reviewed this submittal and offer the following comments, as conditions of the
applicant. These conditions shall be considered in full, unless expressly modified or deleted by
motion of the Meridian City Council:
APPLICATION SUMMARY & BACKGROUND
The applicant, Debi Sheridan, is requesting a transfer of Conditional Use Permit for the existing
childcare center “Healthy Beginnings” located at 737 North Linder Road.
Conditional use permits, once they are approved, normally run with the land, and upon sale of
the property are transferred to the new owners without further application, however, home
occupations & childcare facilities are the exception to this. Transfer of conditional use permits
for childcare facilities for the same use for which the original conditional use was approved are
required to petition the City Council for approval (MCC 11-17-10).
The original conditional use permit (and concurrent rezone to L-O) was submitted by Wendell &
Kasha Lawrence and approved by City Council on November 21, 2000. The permit was
approved for the care of up to 48 children.
Staff recommends approval of the requested transfer of conditional use permit.
LOCATION
The subject parcel is located on the west side of Linder Road, approximately 130-feet south of
Pine Avenue. The current address is 737 N. Linder Road.
SURROUNDING PROPERTIES
North – Single family residential home, zoned L-O, separated from the subject site by a
6-foot, slatted chain link fence.
South – Multi-tenant industrial warehouse and storage business, zoned I-L. No fence
separation, but there is a landscape island.
East – Single-family residential (Westlawn Estates Subdivision), zoned R-4. (Screened
from Linder Road by a solid block wall)
West – One (1) acre residential lot, zoned R-4, with large garage/shop and open area.

SITE CONDITIONS
There are currently 9 paved parking stalls (1 handicap) on the site with one delineated access
point to Linder Road. There are some street trees and low-lying shrubs along Linder Road and
abutting the property to the south. There is a 6’ slatted chain link fence along the northern lot
line. There is a 6’ wood fence and 6’ chain link fence on the west side of the property. The
designated play area is fully fenced along the north side of the structure.
OWNERS OF RECORD
Steve and Linda Eisele are the current property owners and have provided a notarized consent
for the subject application.
CONDITIONS OF APPROVAL
1. The applicant shall meet all of the licensing requirements of the State of Idaho
prior to beginning operation. A copy of the State license shall be submitted to the
Clerks office for inclusion in the City’s records prior to occupancy.
RECOMMENDATION
Staff recommends approval of the proposed transfer of Conditional Use Permit for a
childcare center for up to 48 children, with no modification to the original conditions
approved with CUP00-046.
