Dear Bill,
I received the Staff Report you sent me yesterday regarding the above-noted applications. Thank
you. Brighton Corporation sincerely appreciates the time and effort you and others in your
department have expended to meet with us and the applicant to discuss the project and chart a
practical and efficient course for entitlement. Brighton Corporation agrees with your findings of
fact and your overall recommendation for approval. Thank you.
Unfortunately, the Staff Report also includes a specific condition of approval that was a surprise
to us, especially in light of the fact that we and the Applicant had met with you, Pete Friedman,
ACHD and Mr. Silva in October to discuss the issue and. had come to an agreement on a specific
course of action that does not match your specific condition of approval.
In general, Brighton Corporation does not support your condition of approval referenced several
times throughout the report and, more specifically, in Exhibit B, Conditions of Approval, Section
1.3 that would require the platting of the entire. area north of the proposed Deer Crest Street and
the actual dedication and construction of the entire length of Deer Crest Street from Linder to the
eastern property boundary. We would support the condition that we had agreed to previously
with you that only the single remaining~arcel and only a~ of Deer Crest Street would be
platted, dedicated and constructed at this time.
As you will recall, in our meeting we discussed the fact that we did not want to plat, dedicate and
construct the entire length of the proposed Deer Crest Street extension all the way from Linder to
the eastern property boundary at this time. We felt that the only portion required at this time was
the extension of Deer Crest from Linder to the shared driveway of the two northern parcels.
Also, the property boundaries of the subject project parcel needed to be adjusted to conform to
the Applicant's site plan and future Deer Crest Street right-of--way. Please remember that this
northern parcel was existing_and~ All of us were in agreement that we could adjust the
property boundazies of the subject project parcel but that we would need to provide a dedicated
public right of way and access to the site via the Deer Crest Street extension, across the

remaining parcel (post-property boundary adjustment) and extended only to the shared driveway.
To do this, you and Peter said that we would need to plat the remaining single parcel and ACHD
right-of--way and then construct that portion of Deer Crest Street. We agreed, .and submitted an
application for the Property Boundary Adjustment, which Peter approved based on the
understanding that we would proceed with platting the remainir~ single parcel and a portion of
the Deer Crest extension.
Over the last two months, Brighton Corporation and it's Civil Engineer, have spent time and
significant resources to design the new Deer Crest Street section and prepare a Final Plat for the
remaining parcel and ACHD right-of--way. Brighton intends to submit this Final Plat in the next
several weeks, on schedule. Provided that the CUP, DES and ALT applications for Linder Self-
Storage are approved, Brighton Corporation will construct the improvements and portion of Deer
Crest Street to the shared driveway concurrently with the Applicant's improvements. In addition
to the portion of Deer Crest Street constructed to the shared driveway, Brighton Corporation will
also construct the northern sidewalk, curb and gutter along the entire length of the proposed Deer
Crest Street extension all the way to the eastern property boundary. Brighton Corporation will
also be placing public utilities in the proposed Deer Crest Street extension all the way to the
eastern boundary. The remaining portion of the Deer Crest Street extension to the eastern
boundary will be prepped in a 20ft-wide, dust-free, base to allow for emergency vehicle access to
the emergency entrance and turn-around at the southeast corner of the subject project.
Brighton Corporation has acted in good faith based upon our meeting and agreements and hopes
that you will alter your stated conditions of approval to reflect our collective agreements and
actions to date.
