(File # TE- OS-020) Staff has reviewed this submittal and offers the following comments: APPLICATION SUMMARY The applicant, B&H Development, Inc., has requested approval of a time extension to obtain the City Engineer's signature on the final plat for Crossfield Subdivision No. 3. The subject final plat consists of 53 single-family residential building lots and 6 common/other lots in an R-8 zone. The Applicant has been unable to meet the time requirements specified in Unified Development Code (UDC) 11-6B-7. The Applicant states the reason for the delay stems from the current slump in the housing market and the fmancing situation. The .project is currently at Ada County Highway District awaiting completion of their requirements and signature on the final plat mylars (see Applicant's letter dated September 25, 2008). The annexation (AZ-OS-015), preliminary plat (PP-OS-017) and conditional use permit (CUP-OS-022) for Crossfield Subdivision were approved by the Meridian City Council on October 18, 2005. The final plat for Crossfield Subdivision No. 3 (FP-06-034) was approved by City Council on August 8, 2006. The City Engineer signed the Crossfield Subdivision No. 2 Final Plat on March 28, 2007. Per UDC 11-6B-7B, Crossfield Subdivision No. 3 would otherwise expire on September 28, 2008. This is the final residential phase in the Crossfield development. The City of Meridian's Unified Development Code (UDC 11-6B-7) allows the Director to authorize one administrative time extension to record the final plat, not to exceed 18-months, when the applicant files a written request for an extension prior to the expiration of the plat. The Applicant has met the necessary deadline by filing a written request for an 18-month time extension before the final plat expires. Additional time extensions up to 18-months may be granted if determined and approved by the City Council. With all extensions, the City may require compliance with the current provisions of the UDC as a condition for granting a time extension (UDC 11-6B-7C). On August 5, 2008, the City Council provided staff with guidelines to use when evaluating time extension requests. These guidelines are meant for guidance and not as a mandate. Based on the direction given to staff, there are additional conditions for this project that Staff is recommending be added/updated to the previously approved set of conditions. Please see Staff Analysis and Site Specific Conditions below. LOCATION Crossfield Subdivision is located on the south side of W. Ustick Road, approximately 1/2 mile east of Linder Road, in the NW '/4 of Section 1, Township 3 North, Range 1 West. The applicant is to meet all terms of the approved annexation (AZ-OS-015), preliminary plat (PP-OS-017), conditional use permit (CUP-OS-022), and final plat (FP-06-034) for this development. 2. In direction given by City Council on August 5, 2008, staff was advised to deny time extensions that did not have a development agreement and elevations tied to the project. While Crossfield subdivision does not have a development agreement, the conditional use permit tied 17 specific elevations to the project. Construction within Crossfield Subdivision shall substantially comply with the 17 elevations submitted by the applicant. 3. Consistent with the recently adopted Meridian Pathways Master Plan, construct a 10-foot wide multi-use pathway on the north side of Lot 18, Block 11. Said pathway shall connect from the sidewalk on Sommersby Avenue and continue to the east property line. Coordinate the exact location and construction requirements of the pathway with the Parks Department. 4. The applicant shall have an additional 18-months, until March 28, 2010, to obtain the city engineer's signature on the final plat, satisfy the applicable requirements set forth in the conditions of approval, and begin the process of acquiring building permits and commencing construction of permanent footings or structures. STAFF RECOMMENDATION Staff is recommending approval of an 18-month time extension to obtain the City's Engineer's signature for Crossfield Subdivision No. 3 to expire on March 28, 2010.
