Broadway Avenue Meridian, Idaho 83642 CITY OFG4~f~ 1DU„N CITY CLERKS OFFICE Re: Cabella Creek (Rezone - RZ-09-004) Dear Mayor and Council: We believe the concerns outlined in the staff report could be addressed with specific provisions in a Development Agreement. We offer the following provisions: 1. The R-8 zone applies to (17) buildable lots and (3) common lots identified on the recorded Cabella Creek Subdivision as lots 1-19,block 2 and lot 1, block 9. 2. No more than seven homes smaller than 1,400 square feet shall be allowed within the block identified as lots 2- 18, block 2, and none of these homes shall be smaller than 1,270 square feet. 3. A Certificate of Zoning Compliance shall be submitted and approved prior to submittal of a building permit for any dwelling below 1,400 square feet. The application for CZC shall include a diagram of lots 2-18, block 2 reflecting the square footage of permitted homes within block 2 and an elevation of the proposed dwelling. 4. All homes under 1,400 square feet shall be substantially consistent with the elevations submitted with the rezone application. 5. No duplexes shall be allowed within lots 2-18, block 2. 6. This development agreement is applicable to lots 2-18, block 2. The original development agreement remains in effect for all other lots within the Cabella Creek Subdivision.
