Final Plat Modification for Challis Subdivision
Tealey's Land Surveying
STAFF RECOMMENDATION
Staff recommends approval of the Challis Subdivision Final Plat Modification (MFP-09-002)
with the stated comments and conditions. These conditions shall be considered in full, unless
expressly modified or deleted by motion of the Meridian City Council.
SUMMARY AND LOCATION
Challis Subdivision is located at 575 E. Franklin Road in the NW 1/4 of T. 3N., R.IE.,
Section 18. The City Council approved the short plat on June 6, 2009.
The applicant, Tealey's Land Surveying, has applied for a final plat modification to remove a
required short plat note per the approved Findings Facts and Conclusions of Law for Challis
Subdivision. Findings Facts and Conclusions of Law Condition 9 requires the applicant to
record across-access/cross-parking easement/agreement for all commercial lots within the
subdivision and that a copy of the subject agreement be submitted to the City prior to the City
Engineer's signature on the final plat. In the alternative, a note may be added to the face of
the short plat granting said cross-access/cross-parking. Staff assisted the applicant with a
blanket easement note on the face of the plat that meets this requirement and the City Engineer
was able to sign the plat, so the applicant was able to move forward with development of Lot
1, Block 1.
STAFF ANALYSIS
The applicant is requesting to remove the note from the face of the plat and to record a specific
easement agreement in lieu of the blanket easement. The easement agreement is for the purpose
of ingress and egress, but not parking, to and from the three lots within the subdivision (see
Exhibit B-1 for an illustration of the proposed ingress/egress easement). In addition, the
applicant states in their narrative that the modification to the condition is being requested
because of site topography and to reflect the site plan design as submitted with the application
(see Exhibit B-1 for the proposed concept plan). UDC 11-3A-3 requires cross-access/ingress-
egress easements to adjoining properties unless otherwise waived by City Council. In addition,
UDC 11-SA-2 requires City Council approval to modify a condition of an approved short plat.
Because the applicant is requesting to record an easement for ingress/egress only and to remove

the note from the face of the plat which requires cross-access/cross-parking, the applicant needs
to obtain approval from the City Council. Staff believes the proposed easement agreement
provides sufficient access to all lots in the subdivision, the site topography limits the way the
remaining two lots can be developed, and the attached concept plan (Exhibit B-1) provides
direction for future development. Therefore, staff supports the request to remove the note
from the face of the plat and to record an easement agreement in lieu of the blanket
easement.
