ORDER OF DENIAL
This matter coming before the City Council for City Council Review of the Planning
Director's decision on the request for an extension of the hours of operation of the Southridge
construction site for the purpose of extracting and transporting gravel for construction of the Ten
Mile Road interchange, pursuant to Unified Development Code 11-SA-6 on November 4, 2009. The
Applicant requested an extension of time for construction activities from the previously approved
7:00 am to 8:00 pm to 24 hours a day through December 23, 2009. After considering the request,
reviewing the original approval for the accessory use and public comments received by the City

during the I-84 widening project and at the public hearing for annexation of the Southridge 31
property, the Director denied the request.
IT IS HEREBY ORDERED THAT:
After consideration of all the evidence, the City Council determined that the applicant has not
met its burden to overturn the decision originally rendered by the Director. Therefore, construction
activities on the site shall remain limited to the hours between 7:00 am and 8:00 pm.
Please take notice that this is a final action of the governing body of the City of
Meridian, pursuant to Idaho Code § 67-6521.
