City Engineer, Gary Smith recommended payment of $826.40 to C.I'rght Construction Co., Inc. for building an access roarfor the sewer treatment pant to facilitate getting samples for effluent in Five Mile Creek. Inspector: "Yes, it doesn't specify that the material has to be "better than" it can be common material - it's themini�r;v rQquirerent - anything better than that is up to the builder." Council -an Orton: "Fie has obviously met our percentage requirements and taken the pains to adjust the distribution of the homes to have less impact than it originally had - I don't see anything personally that would want to change on this distribution." Attorney Crookston: "You just have to approve, or dissapprove the amended plat to put those figures on the ammerided plat." Erik Gabrielsen: "I would like to read on that same Ordinance 383, Article 7 "prior to enactment of this Ordinance all residential developments approved by the City with minimum housing size of 1,350 square feet being contained in restrictive covenants of the subdivision, this section shall have an effect on removing the 1,350 sq. foot restriction. If an owner or owners of the subdivision desires to have this section apply to their subdivision they w471 cc -m.- before the City Council with an amended plat showing the lot, the minimum size house that they can build thereon clearly s�-wn. Said change of the Plat shall not be considered a new platting for purpose of platting procedure and only the City Council need act upon such request". So you can or you cannot act approving this request. "One hearing must be held upon such request 15 days prior to notice being published in the official City newspaper and a notice being forwarded to certified mail, registered receipt to individuals within 300 foot area". Custom Wood Products and Gem Fabricators - Progress Report (referred from 12.21.81) Building Inspector reported that he had gone to make an inspection on this day but there was no one around at Custom Wood Prooucvs. ' John Krishnek: "The reason the building inspector did not find anyone there is because we have been closed most of the time since this situat-on has risen. (Tape on file) ;Krishnek was reprimanded by the Council for c"osing his doors when they had specifically granted that f_ may stay open. Krishnek stated that the State Electrics' Inspec or's deadline for ':��inging up to Electrical Code had expired and did not care to operate under that circumstance. Brewer, yea Mayor Glaisyer; "Next on this Agenda is the progress report on Gem Fabricators" Aaron Burtzoff, part owner of Gem Fabricators: "My partner Dee DeMoss is hung pp with the snow. We have intiated some steps to correct the seven violations." Burtzoff stated that they had met with all inspectors, removed the Romex, oepn wires, disconnected the compressor that wasn't wired 'r ght, plan to relocate the gas furnace, compressor. The existing insulation se.ied to be the biggest and most costly problem. There was much discussion concerning +„e insulation. (Tape on file) BurtzoFf: "Von Brethorst,(State Electrica' Inspector) indicated to us that if we were to take an area under the existing balcony and build a spray booth out of it, and work closing with Vern and the Fire Marshal, abide with all the Codes, that we could possibly work something out as far as the State is concerned.” "We have taken care of five of the seven violations - we have removed our Acetone and limited to two gallons, picked up our housekeeping, ins -tilled exits signs, more "no smoking"signs. This brings it down to Violation Number 5 "A wall between the occupancy and the office and also t~ie business to the east, the outside wall.: next to the street be of block construction. It ;s not econom-scally feasible for our 'landlord or us to go ahead and try to _'t in a bloc,, wall or completely sheetrock." There was much discussion concerning the insulation or the block wall. These - people are in better shape than most ol them_ —__- Councilman Orton questioned the Fire Chief and wilding Inspector as to options concerning the Spray booth, insulation or Fire Wall and Councilman Williams pointed out that t'ie build;ng as insulated cannot be rented out for any shop use and that perhaps they could work something out with the Landlord. George Carey, representing the owners of the building, Viking Sprinkler Co., explained the uses of the building and stated that the only difference between the section Gem Fabricators use is the insulation. Carey was pessimistic that the owner would want to come in and re -insulate the building but was going to contact him. Burtzoff: " We can't afford to initiate any more dollars into it than we already have unless we know where we stand - we've put a lot of labor into it and now it's coming down to hard big bucks with the spray booth. If the owner d^ n't want to go with the insulation we will just have to 'ock it up and move." Your occupancy group in the building was (B-2) and presently you have (H-3) occupancy. "Group (H) occupancies are the most hazardous of all groups Section:307(a) 1979 Addition of U.B.C. "No building -or structure of any group shall be used or occupied, and no change in existing occupancy classification of a building or structure or portion thereof shall be made until the building official has issued a Certificate of Occupancy." Code". Many violations were noted and documented by pictures at the time of our inspection. Some of the violations are listed below: 1. Very poor housekeeping was noted. Sawdust and sanding dust on floors and on all flat surfaces. Shavings and sawdust piled against wall about four feet deep. Kindling type wood piled against outside of building. 2. Kerosene or fuel oil type blow torch heater not in use but appeared to have been used for heat or drying of lumber. 3. No sprinkler heads in office areas. 4. Some electric wiring without a permit and none of the wiring meets State Electric Code for the new (N) occupancy. 7. Legal exits for work area blocked and no exit signs (Overhead doors are not classified as exits). 10. Office area should be walled to ceiling of work area and not to be used for storage. With so many violations we feel the moulding business must be closed down until all violations are corrected. This will require four sets of plans by an Archetect or Engineer to show a'': remodeling, wiring and dust collecting systems that are needed to bring the building to all Code re- quirements. Pine, to "C" Commercial Limited Office, to have design review. Motion Carried: All yea. genda 2 Hearing - Kenneth Westby - Conditional Use for bicycle shop located at 234 E. 2nd. Elenita Westby was present, representing her husband, Kenneth, who was called out of town. Elenita stated that her husband would like to repair bicycles in their garage as a business. He has everything he needs for repairing, as he has wanted to do this for a long time. Westby has -beets unemployed- and-Treeds the income. Mrs. Westby stated that she had measured the parking area, (corner lots) 110 feet area along King St. and 80 ft. on 2nd St. There would not be that many people coming in at one time. The neighbors have given their approval for this use. Pipkin questioned if this would be used solely as a repair shop as opposed to sales. Mrs. Westby stated only the ones that her husband would have fixed up. As far as buying and selling new bicycles, she could not see at all. In answer to off-street parking, Mrs. Westby stated there could be three (3) spaces. This repair will not envolve welding or cutting. None of the tools are electric so there would be no noise. The Westbys have obtained approval of all neighbors within a two block radius and were encouraged to have a bicycle repair in Meridian. This would be kept at business hours. Spencer questioned off-street parking. Westby answered there was none. However, the Ada County Highway District had requested $7,000.00 deposit to the Public Road Trust Fund or improve Linder and Cherry with curb, gutter, pedestrian ramp, 5' sidewalk and paving, etc. Recommendations on file with these minutes. DiFelice stated that they do not thoroughly understand why the streets, curbs and gutters, but would comply if this was mandatory. There was no known date for improvement of Cherry Lane. The plat plan was displayed, the entrance from Cherry Lane, the exit onto Linder. The right-of-ways and easements were discussed. No one present knew what portion of this property would be involved in improvement, or widening of Cherry Lane, or what Ada County Highway District plans were for Linder. DiFelice stated they (Century 21) desire to locate in Meridian and would prefer to make the proper dedications for the streets, curbs and gutters and invest in the office improvement at this time. There was much discussion concerning the postponement of Ada County Highway District compliance until Cherry Lane improvement. There were no comments from the public regarding this hearing. It was the feeling of the commission that they did not want a commercial zoning, but a conditional use for limited office. Roy Johnson represented Phil Harper and displayed a concept plan of Sheri -Lynn Subdivision. Johnson stated, "the original plat consisted of 16 lots, basically 70 to 80 feet, filed covenants require a minimum of 1,350 sq. ft. Proposed changes are 0' lot lines, lots 40 to 50 feet wide, 26 lots, 1,100 sq. ft. homes higher density, but a_nicer�ome_for-the same dollars. There would be about a'50% increase in the tax base for the same subdivision." Johnson stated that they (Harper and Johnson) would like to get the commission's feelings on this concept. Density was discussed. Originally the subdivision was 4.11, now is 6 1/2 lots per acre. Streets are already dedicated. Minimum sq. ft. would be 1,100. Harper explained that the "Legend on the map does not apply. Johnson stated,. --."they are looking for 0' lot line concept, or 26 lots from 16. The new lots will be 45 X 100 feet. There would be a court yard effect. Usually the people that buy these do not have children or a lot of storage apparatus. Meridian Park Subdivision is to the south of Sheri -Lynn and construction has started on'the streets today. Their contract is to build the entire thing so they need to make the decision whether they are going to stop construction on Sheri -Lynn, separate it out and go back so that they can present a preliminary, go through the hearing and then come back and do this thing later. Sewer and water services have to be changed and added." Sharp explained the commission must keep in mind that there is a moritorium on replatting plats and the new ordinances are not completed. There was discussion concerning area for this type of development, the quality, aesthetics, covenant control,no adjoining stubs or shared walls. Pipkin stated the. term "highest and best use" is not necessarily the highest density or the most return for the dollar. Mr. Funkhouser will contact Mr. Nelson as soon as the Highway District counsel gives him an opinion. No official action taken until further information is available. SUBDIVISIONS - FINAL PLATS Cambria No. 1 and Cambria No. 2 - John.Joines explained that these subdivisions are re -subdivisions of Hic ory Grove Subdivision and the sub -division is recorded. Mr. Joines explained the proposed re -subdivision and recommended approval of the plat. After much discussion, Commissioner Fairbanks moved for the approval of the plats for Cambria No. 1 and Cambria No. 2 and to authorize the Chairman of the Commission to sign the plat. Commissioner Wardle seconded. Motion carried unanimously. SUBDIVISIONS - PRELIMINARY PLATS Swanson Townhouses - John Joines presented the plat and explained the proposed develop- ment and the requirements placed by staff. The Commission agreed with staff require- ments. Bluegrass Subdivision — John Joines presented the plat and the problem with the road- way that needs to be connected through for bike traffic. Discussion held. After much discussion the Commission agreed that the staff ask the developer to acquire the westerly portion of Valley Road and improve it as a condition to having the plat approved. CONDITIONAL USES AND RE -ZONES Robert Mitich Re -Zone - Commissioner Wardle asked about the right-of-way dedication. Discussion held as to who will improve the fairground side of Glenwood. ALDAPE PIT TOUR - The Commissioners agreed with staff suggestion that a tour of the subject pit be arranged to include the Highway District Commissioners, the Ada County Commissioners and representative from the Idaho Transportation Department. Niemann City Clerk Meridian City Hall October It 1979 Agenda 8 Duane Gress addressed the Council stating that his residence was at 2120 N. Linder and that this road was under construction. He stated he had repeatedly asked for help from the Ada County Highway District to control the traffic and dust, to no avail. He had tried to be polite, but has come to the point that he would take the matter to his own hand, backed by neighbors, also resent at this meeting. Brewer stated that the problem was supposedly taken care of some time ago, but will contact the Ada County Highway District and follow up on this problem. Motion Carried: Williams, yea; Bodine, yea; Brewer, yea. r. Meridian Planning and Zoning .3. August 13, 1979 The homeowners protested the need of a through street for fire protection. There was discussion on how Country Terrace was approved with the cul-de-sac and Meridian Greens approved with the connecting street. More discussion concerning how the problem came about. There are only four (4) vacant lots left in Country Terrace. Orton stated that the Commission should consider the Annexation question before them and after this is resolved to make a recommendation to the City Council to either have or not have the connecting street. Originally the Commission moved to have the street in there. If they were to make the same recommendation all over again, it would be in conformance with the City's Engineer recommendation, the Ordinances and the City Council. Again the need for the connecting street for fire protection was debated and opposed by Homeowners attending. James Kling,on behalf of Country Terrace homeowners asked for help from the Commission to solve this street problem. A Compromise Access was discussed to solve police, ambulance and fire department service. Hosac felt the problem would be resolved if the City Council would accept the pedestrian easement. Orton expressed opposition to annex any property south of the Interstate until service lines are extended. The Motion was made by Orton and seconded by Tewksbury that the Commission deny Country Terrace Annexation request. Motion Carried: All yea. Tewksbury stated that taking all in consideration, the homeowners opposition to street connection and access points that are available, he would be in favor of the City Council "back down" on street connection. Mitchell stated that the conflict has already started and that there was very little the Planning and Zoning Commission could do. This matter must be resolved with the City Council. He pointed out the original map had been approved and several errors have been made. The Motion was made by Mitchell and seconded by Orton to advance the connecting street -problem on to the City Council without recommendation. Motion Carried: All yea. Agenda 3 Hudson-Mitich Design Review - located West of Hudson Mitich Annexation on Linder and South of Pine. Glen Hudson was present with Design Review plans. Sharp stated that access points should be changed so that traffic would not come on to Linder anywhere they wanted. Hudson stated that they would be paving as they build. The Commission suggested an entry on each side and one in the middle off of Linder Road. Orton questioned adequate turn -around room for a fire truck. On June 1, 1979, I received another application for a building permit to build new walls, t�indows, and siding. I then checked to see what he was doing with the roof. It is a house -type roof over his mobile home instead of just re -roofing. I feel it isn't proper to construct a frame building around a mobile home. In the event of a fire, it would be impossible to fight the fire in the double wall and ceiling_ areas. The City of Meridian has an ordinance 112, June 5, 1961, which says, "No trailer coaches shall be used for dwelling or sleeping purposes except in a trailer court." For the above two reasons, T_ refused to issue a second permit. Upon annexation, he should have been asked to remove the two mobile homes from his industrial property, or been given a variance to allow them. Hudson stated - there would be a 50 ft. access road. The plan was for storage building but was now negotiating with Frito-Lay for a super_ delux building which would be next to the railroad tracks at the back. Williams stated that it is not the intent of the Council to allow Commercial establishments in an Industrial zone. Kingsford stated again that Annexation fees should be enacted. Item 1 Price, Rich, Fenstermaker Annexation Glenn Hudson was present representing the request. He stated they are residential homes on West Pine, North of Meridian Storage, and by request of the City they were asked to sell them on the idea of annexation. Annette Hinrichs inquired if this included all the property, leaving nothing out. Hudson answered yes, that no one was skipped, all the,homes in line with this request. Lee Mitchell inquired if provisions were made for sewer and water. Joy stated he thought they would have to connect to City lines when they became available. Rick Orton inquired if the property owners were aware they would have to connect to water and sewer when available. Hudson stated they were aware of that and the lines ran in front of the residences. The motion was made by Annette Hinrichs and seconded by Ken Tewksbury to recommend to the City Council that they annex the Price, Rich, Fenstermaker property, provided they connect to City services when available, and as "A" Residential. Motion pasted: All yea. Item 2 Hudson-Mitich Annexation No. 2 Glenn Hudson was present representing the request. He expalined the plan and stated it will more than double the storage facility. The Frito Lay Company has indicated they would like to locate a regional distribution center there. He described where they would be located. They have ten or twelve families living in the area and paying taxes. They would be brought in on a private track siding road. Annette Hinrichs stated traffic might be a problem because of a proposed residential subidvision to the South. Hudson stated if it was a problem they would bring them in their property. Zoning South of the tracks was outlined. Annette Hinrichs inquired what the Zoning should be. Don Sharp inquired how much truck traffic would be generated. Hudson stated about one truck a day increase. Meridian Planning & Zoning .2. December 11, 1978 Hudson stated it was all ready designed in. He was told in advance they could ask for a 50 foot access road and that has been designed in. The have increased the turn around area to 42 feet plus a 30 foot turn on the end where there was none previously. Don Sharp inquired from Bruce Stuart if access was adequate on the back to make a turn. Hudson expalined the distances. Stuart inquired if there would be parking on the end. Hudson stated there would not be parking on either end, and they will be open on the side for 5th wheel truck access. Stuart stated there shouldn't be any problem. Don Sharp inquired if Hudson would do some landscaping to buffer the area from the residential developments. Hudson outlined what has been done with Pine Trees. The front has been landscaped. They would be hoping to landscape the area to make it more attractive to the public. Don Sharp inquired if provisions had been made for fire hydrants. Hudson answered yes, and outlined what was in and what was stubbed off for.future development. The motion was made by Rick Orton and seconded by Lee Mitchell, to recommend to the City Council that the Hudson-Mitich Annexation, #2, be 'annexed as "D" light industrial, with a landscaping plan being submitted, with development plans for review, and they connect to City sewer and water. Motion passed: All yea. Item 3 Enclave Annexation Don Sharp stated the annexation A through I. He stated they will be considered one at a time with a seperate motion on each parcel. Parcel A: Giesler Annexation Don Sharp called for comment. George Davis stated there appeared to be a mistake in the legal description and felt it should be tabled and republished. ' Rick Orton inquired what the nature of the mistake was. Davis stated you go a certain distance one way, then a certain distance North, then back South, which leaves you nowhere. Rick Orton stated it appeared correct on the copy furnished Planning & Zoning, and therefore appeared to be typographical error and inquired what the correct procedure should be. Don Sharp inquired if anyone was present that objected to the annexation. Denise Giesler stated they owned the property it stated 340' North and South. She informed the Commission they were 120' North and South and that there are two _parcels of land that are not in the City. The other parcel is not shown on the notice. Rick Orton stated it is possible to have more than one parcel of ownership on an enclave. Giesler stated the other owner was not aware they were comming into the City. She also inquiredif they wanted to be rezoned commercial if it was possible. Rick Orton and Don Sharp stated they would considered when and if they came in. Sharp stated now they are being annexed as "A" Residential. On discussion of sever, some type of vehicle is needed and would work best but if developer brings lines out -later deveopers should not be able to hook-up at no expense. They would like to explore in the future various alternative ways for reimbursement if possible, from other developers at no expense to the City, possibly a sewer district or special ordinances. Mr. Hosac felt that from what he had heard at this meeting they do not have any absolute firm commitment on the phases but if their Preliminary plans match their concepts and if they live up to their commitment, then there should not be any problems with various phases going ahead on schedule. It was the feeling of the Mayor and Council that this project should not be concerned with the moratorium as all it does is stop new annexations, projects such as theirs could go ahead as planned after they go through normal procedures. Mayor Storey stated that Mr. Hosac had the commitment of the Council but a resolution is not appropriate at this time and this will be discussed with the City Attorney. Mr. Hosac pointed out that the funds for this development would have to come from borrowed development money, economic feasibility has a lot to do with how much money can be obtained for this project. If enough funds can be put together to bring utilities out on Phase I then it is his feeling that they should get the utilities out there — they cannot make that commitment at this time on the sewer line as they have on the water. He also stated that they plan to bring some proposals in for study for help in cost. Mr. Fuller stated that a possible vehicle is a sewer district for the purpose of extending the trunk lines. The district could work out extentions of lines. Mr. Kingsford pointed out, and would like to be on record as stating, the clarification thgt the City has not approved Preliminary Plats on secondary phases of this project - only on Phase I. Agenda 3' Mayor Storey reported that the Desert View Corporation were getting a contract ready for the City to review. Atterne{y's, Crookston and Fitzgerald are to review this. Agenda Gene Quintieri was present to discuss'ithe Meridian Bowling Lanes. He reported that they are anticipating eight new lanes but in order to add they need a variance on the set -back ordinance. They requested an additional four (4) feet and submitted drawings. There was some discussion by the Fire Chief as to the parking on the west side and it was thought all parking on the west side would have to be eliminated. July 23, 1973 believe in zoning and I.voted for it initially. For three years, I tried to get R-2 zoning without success. Finally, I concurred with the official thinking, after it became obvious that excessive mobile homes were pre- senting a problem to Meridian. In view of the fact that every available foot of railroad trackage between Meridian and -Boise has been bought up, it became apparent that the trackage close to Meridian on the West side should be commercial. At least two city officials have stated that everything between West Pine and the railroad should be commercial. West Pine extends two miles West from City:Center. My property is one mile West and 1/2 mile from the City limits. It will soon be 900 feet from the City limits, without moving my ground. Previously, the main issueconcerned water, sewer, and taxes. My plan for storage -buildings does not involve water or sewer. Regarding taxes, under my present zoning, each potential home would have to be of $75,000 value to match my planned investment. Two of my neighbors made application, with me for C-3 Com- mercial. One for a_small:neighborhood repair shop, and one for storage of electrical wiring material on a small scale. The office of "Chaos,.and Confusion? failed to men- tion it in the.letters.to our neighbors and it was omitted in all advertising. Approximately one year ago,, it was stated by one of the personnel connected with zoning... -..."And another thing we found out -- that a Mr. Mitich owns some of this ground". Thjis was one year and 3 months after Mr. Mitich and I made a'*45oint application. It was 3 months after we made a second joint application. Our request for Commercial C-3 zoning was denied !by a letter dated July 2, 1973, which stated as follows: "The Commission recommended to the Board of Ada County Commissioners that your requested zone change be denied for the following reasons: 1. This is a residential area 2. It is designated as residential by the Comprehensive Plan 3. There is no demonstrated.nsed forany commercial uses in this vicinity". -2 A year ago, the letter- tated hat it was too close to the railroad track. u� Now, I ask: "Who determines that there shall be no new businesses, or expansion of present industries -- the public,or will some theorists determine that there shall be no economic growth? Careful and detailed survey has shown a demand for inside storage for recreational vehicles. In fact, it is common knowledge that the industry is exploding and the numbers have doubled and redoubled in recent years. Presently, there is no known adequate public inside storage available in Treasure Valley. Currently, you will find a large var- iety of vehicles parked in alleys, streets and beside buildings. Many of them cannot be enclosed in a standard sized garage or covered by a standard sized carport, even if facilities were available. The size of some recreational vehicles prohibits such storage. I cannot think of any area more suitably located -Meridian for such a facility. Some of the mobile home trailer.courts.provide outside storage; however, many of these vehicles cost from $10,000 to $20,000, and the owners would prefer them to be protected by inside storage. In.._eantedting an official of the Ada County Sheriff's office, I learned that they have accepted the fact that these ve- hicles have to remain on the owner's property and the_,police department cannot do anything about that situation. However, it was explained by the official that their main problem con- cerned vandalism and burglary of parked vehicles, such as campers, horse trailers, boats, etc. I am hopeful that you gentlemen will consider my request for permission to erect structures to be used for storage of recreational vehicles. It is my plan to build them of such quality that this will enhance the appear-ance -of-the -- - - - --neighborhood. As I -presently own several thousand evergreens, the buildings will be surrounded by -trees, and the premises will be attractive and clean.
