HomeMy WebLinkAboutAgreement for Fee with Ringert Clark Chartered Legal Services - Water Rightss- FEE AGREEMENT AGREEMENT, made this 3 ©~ day of ~~'~!'2002, between the City of Meridian, hereinafter referred to as "Meridian" and Ringert Clark Chartered, a firm of lawyers in Boise, Idaho, hereinafter referred to as "Ringert Clark". Meridian retains and employs Ringert Clark to to represent Meridian in the Matter of Integrated Municipal Application Package (Consisting of 99 Applications for Transfers of Water Rights, and 13 Applications for Amendment of Permits) filed by United Water Idaho, Inc. with the Idaho Department of Water Resources. Meridian acknowledges that Ringert Clark has made no representations, guarantees or wan'anties regarding the results of their efforts. Ringert Clark is granted the power and authority to compromise or settle all claims arising from the aforementioned administrative proceedings should Meridian consent to such compromise or settlement. Meridian agrees to pay Ringert Clark for the above services as follows: (1) The minimum sum of $110.00 per hour shall be charged for Charles L. Honsinger's time,and $125.00 per hour shall be charged for Daniel V. Steenson's time through the end of 2002. Ringert Clark, Chartered may, at the beginning of 2003 or shortly thereafter, raise the hourly billing rates of its attomeys, but shall not raise the rates beyond $125.00 per hour for Charles L. Honsinger's time,and $140.00 per hour for Daniel V. Steenson's time; (2) Ringert Clark, Chartered shall charge any and all reasonable and necessary expenses it may pay out or incur in behalf of Meridian in connection with the above-stated matter, including payment of expenses and fees of any experts employed by Ringert Clark with the consent of Meridian; (3) Such attorneys fees and expenses shall be split evenly among the number of clients that FEE AGREEMENT -Page 1 RECEIVED S:\Charlies Does\WPDOCS\CLIENTSWMID\UIMIMAP\Cities\fee.meridian.wpd ~IOV 0 5 2002 City of Meridian Public Works Director r Ringert Clark, Chartered represents in the aforementioned matter.
