SUMMARY DESCRIPTION OF REQUEST The Applicant, T.J. Brown, has submitted an application requesting modification to the recorded Development Agreement for Market Square, approved with the annexation (AZ-04-009) of the property. The reason for the modification is to update the overall site plan to reflect development that has already occurred on the site as well as proposed development. The applicant is also requesting approval to vacate a portion of a public domestic water and sewer easement depicted on the Smitchger Subdivision North plat. II. SUMMARY RECOMMENDATION Staff is recommending approval of the subject applications. III. PROPOSED MOTION (to be considered after the public hearing) Approval After considering all Staff, Applicant, and public testimony, I move to approve File Numbers MDA- 09-003 and VAC-09-001, as presented in Staff Report for the hearing date of November 24, 2009, with the following changes: (insert any changes here). I further move to direct Legal Department Staff to prepare an addendum to the recorded Development Agreement for this site that reflects the changes noted in the analysis in Section VIII. Denial After considering all Staff, Applicant, and public testimony, I move to deny File Numbers MDA-09- 003 and VAC-09-001, as presented during the hearing on November 24, 2009. APPLICATION AND PROPERTY FACTS A. Site Address/Location: The subject property is generally located on the northeast corner of N. Eagle Road and E. Ustick Road, in the southwest '/ of Section 33, Township 4 North, Range 1 East. B. Owner: Brighton Properties, LLC 12601 W. Explorer Drive, Ste. 200 Boise, ID 83713 Market Square MDA VAC Page 1 C. Applicant: T.J. Brown 9490 Fairview Avenue Boise, ID 83704 D. Representative: Jessica Aguilar, Engineered Structures Inc. 12400 W. Overland Road Boise, ID 83709 E. Applicant's Statement/Justification: Please see applicant's narrative for this information. V. PROCESS FACTS A. The subject application is a request for a development agreement modification. Per Meridian City Code, a public hearing is required before the City Council on this matter. B. Newspaper notifications published on: November 2, and 16, 2009 C. Radius notices mailed to properties within 300 feet on: October 29, 2009 D. Applicant posted notice on site by: November 2, 2009 VI. LAND USE A. Existing Land Use(s): The majority of this property has been developed commercially with retail and restaurant uses; the remainder is vacant land. B. Character of Surrounding Area and Adjacent Land Use and Zoning: 1. North: Vacant Land, zoned C-ID and A-1 in Boise City 2. East: Residential properties, zoned R1-C and R-IA in Boise City 3. South: Ustick Road and commercial property, zoned C-G 4. West: Eagle Road and commercial property, zoned C-G C. History of Previous Actions: • In 2004, the subject property (36.93 acres) was granted Annexation and Zoning (AZ-04-009) approval with a C-G zoning district. A Development Agreement was required as a provision of annexation and subsequently recorded (Instrument #104107404). • A preliminary plat (PP-04-037) was approved for the subject property as Smitchger Subdivision (aka Ustick Marketplace) in 2004 consisting of 11 commercial building lots and 2 common lots on 36.93 acres of land. • The final plat (FP-04-081) was approved for Smitchger Subdivision in 2005. • A short plat (SHP-07-002) was approved for a portion of the subject property as Smitchger Subdivision North in 2007 consisting of 4 commmercial lots on 11.07 acres. D. Utilities: 1. Public Works: a. Location of sewer and water: All conditions of prior approval will apply. Market Square MDA VAC Page 2 b. Issues or concerns: Location of the existing fire hydrant may be too close to the purposed new building, the applicant may be required to remove and relocate the fire hydrant. Please contact the Public Works Department for information. E. Physical Features: 1. Canals/Ditches Irrigation: NA 2. Hazards: Staff is not aware of any hazards that exist on this property. VII. AGENCY COMMENTS MEETING No comments were received by the Planning Department from other City departments for the subject application. Please see the public record for the MDA and VAC file for any written comments that may have been submitted by other agencies. VIII. ANALYSIS Analysis Leading to Staff Recommendation: A. MDA Application: When the development agreement (DA) was approved in 2004, a site plan was included to guide future development of the property. The site plan showed a detailed development plan for the southern portion of the property which included the Lowe's store and several pads for small service, commercial, and retail uses. A conceptual plan was shown for the northern portion of the site that showed small service commercial/retail uses along Eagle Road and a large commercial area to the east. Because a detailed plan is now proposed for the area that was previously shown as conceptual, the applicant is requesting approval to modify the DA to include a revised site plan that reflects existing development on the property as well as proposed development. The only proposed modification to the DA consists of an updated site plan; no changes to the text or provisions for development are requested. Staff supports the proposed plan as it reflects current site conditions and complies with the text of the DA for future development of this site. B. VAC Application: The applicant is requesting approval to vacate a 48.5' x 9.47' portion of a public sewer and water easement depicted on the recorded plat for Smitchger Subdivision North (see Exhibits A.4 & A.5). The reason for the proposed easement vacation is the applicant proposes to construct a building that would encroach into the subject easement area. Structures are not allowed to encroach into sewer and water easements. Approval of the proposed easement vacation would allow the applicant to construct a building as intended that would extend into this area. There are no existing utilities in the easement proposed to be vacated. Please refer to Section VLD of the staff report for more information. Staff is supports vacating a portion of the easement as proposed. Development of the site will need to comply with Public Works and Fire Department standards for location of services/fire hydrants.
