Dear Mr. Watson,
This letter is in regards to the subdivision plat for the Sparrowhawk Subdivision and the changes
made to the plat that required a new signature sheet to be produced.
We submitted the plat for review by the county engineer and received comments concerning the
plat. One of the comments, which facilitated the necessity for the new signature sheet, was a
question of the ownership of Nola Road. On the Quitclaim Deed, instrument number
100062159, a copy of which I have enclosed, there is a clause which reads "excepting there from
railroad rights of way, and also right, title, and interest of the public in and to those portions of
the above- described premises falling within the bounds of roads and highways". This clause
was also present in that Memorandum of Sale between the Curtis Parties and the Stutzman
Parties, instrument number 7737743 which I have also enclosed.
This type exception clause excepting out road rights of way is common in most Title Insurance
Policies and Commitments for Title Insurance and unfortunately have made their way into many
deeds that are used to transfer ownership in property. It is the opinion of the County Surveyors
Office that by including this type of exception clause in a deed that the ownership in the roads
and highways do not transfer to the new owner. In that case Dee. R. Lynn would not currently
own the existing 25 feet of right of way for Nola Road.
I have talked with Gary Inselman of the Ada County Highway District and he was in agreement
that Dee R. Lynn's ownership in the existing 25 feet of right of way for Nola Road was very
questionable and that ACHD would have no objection with the plat of Sparrowhawk Subdivision
only dedicating an additional 2 feet of right of way. With the existing 25 feet of right of way this
additional 2 feet would give ACHD the right of way width they have requested with this project.
Since it was the common consent with ACHD, the Ada County Surveyors Office and myself that
Dee R. Lynn is not the owner of the existing 25 feet of right-of--way for Nola Lane the property
description in the certificate of owners on the signature sheet of Sparrowhawk Subdivision has
been changed. The property description changed from including the 25 feet of right of way to
having the West boundary line of Sparrowhawk Subdivision being the East right-of--way line of
Nola Road.

This change in the property line does not affect any of the lat configurations, easements to be
granted by the plat or lot access locations. Its only affect is to lessen the amount of right of way
Dee R. Lynn will dedicate to ACRD.

This is to inform you of the changes that were made to the final plat for Sparrowhawk
Sub. These changes were made per Ada County Surveyor comments dated 8/5/03.
1. The legal description was changed in order to exclude the 25' of ROW on Nola
Rd. Appazently the deed from when the property was transferred to Dee R. Lynn
included a clause excepting any public Rights of Way, therefore she never
officially owned it and cannot show it on the plat.
2. An agreement for cross-access easements was recorded and the instrument
number is now referred to in the notes. Before it just stated that a blanket cross-
access easement was in effect. (See attached copy of agreement)
3. The sewer/water easements and irrigation easements were re-labeled to show to
whom they are being dedicated. (City of Meridian, NMID, etc.)
4. The note regazding the driveways was clarified in order to state where the main
driveway is to be located. Dave Couch originally asked for the locations to be
shown on the plat, but he settled for this clazification instead.
At this time, we need for you to re-sign the signature page so that we can submit it back
to Ada County. Please don't hesitate to call if you have questions or need additional
information.

SPARROWHAWK SUBDNISION, BLOCK 1, LOTS 1, 2 AND 3
Dee R. Lynn ("Owner") is the owner of certain real property located at 1960 E. Franklin
Road, Meridian, Idaho. The City of Meridian has approved and Owrier is submitting a
subdivision plat for the property known as Sparrowhawk Subdivision, comprising a legal
description of Block 1, Lots 1, 2 and 3, Sparrowhawk Subdivision, Meridian, Idaho.
Owner intends to grant cross access easements for Lots 1, 2 and 3, Sparrowhav/k
Subdivision as part of the approved subdivision plat. Owner agrees that, once construction has
been approved acid is underway in the Sparrowhawk Subdivision, the precise locations of the
cross access easements will be identified in the Sparrowhawk Subdivision plat and submitted to
the City of Meridian for approval. Prior to issuance of a building permit for Lots 1, 2 and 3,
Sparrowhawk Subdivision, a cross access easement agreement shall be recorded into Ada county
records.
