Request for an 18 -month Time Extension to Obtain City Engineer's Signature on the
Final Plat Consisting of 29 Townhouse Building Lots, 7 Commercial Building Lots, and
8 Common lots on 6.29 Acres in TN -R and C -C Zoning Districts by Franklin Centre,
LLC (File# TE -08-004)
We have reviewed this submittal and offer the following comments:
APPLICATION SUMMARY
The applicant, Franklin Centre, LLC, has requested approval of a time extension to obtain the City
Engineer's signature on the final plat for Harks Canyon Creek. The final plat consists of 29 townhouse
building lots, 7 commercial building lots, and 8 Common lots on 6.29 Acres in TN -R and C -C zoning
districts. The Applicant has been unable to meet the time requirements specified in Unified Development
Code (UDC) 11-6B-7 and 11-5B-6. The Applicant states the reason for the delay is because the relocation
of the lateral along the west property line is not complete (see Applicant's letter dated February 28, 2008).
The annexation (AZ -05-056), preliminary plat (PP -05-058), and conditional use permit (CUP -05-051) for
Harks Canyon Creek was approved by the Meridian City Council on April 25, 2006. The final plat for
Harks Canyon Creek (FP -07-017) was approved by City Council on July 3, 2007 and will expire on April
25, 2008.
The City of Meridian's Unified Development Code (UDC 11-6B-7) allows the Director to authorize a
single extension of time to record the final plat, not to exceed 18 -months, when the applicant files a
written request for an extension prior to the expiration of the plat, which the applicant has done. As
mentioned above, the applicant is only requesting an 18 -month time extension. Additional time
extensions up to 18 -months as determined and approved by the City council may be granted.
With all extensions, the City may require compliance with the current provisions of the UDC as a
condition for granting a time extension (UDC 11 -6B -7C). Staff believes that there are no additional
conditions that should be added to those approved by the City Council with the final plat for this
subdivision.
LOCATION
Harks Canyon Creek Subdivision is located west of Linder Road on Franklin Road in a portion of the NE
'/a of T. 3N., R. 1 W., Section 14.
STAFF RECOMMENDATION
Staff recommends approval of an 18 -month time extension to obtain the engineers signature on the final
plat for Harks Canyon Creek, to expire on October 25, 2010.

Dear Ms. Canning:
On behalf of my client, Franklin Centre, LLC, please accept this application for a Time
Extension for the final plat for the subject land development project. Harks Canyon
Creek Subdivision is located at 1845 W. Franklin Road, just west of the Harks Corner
commercial center at Linder Road and Franklin Road (also owned by Franklin Centre,
LLC).
The 6.29 acre site was approved for final plat on April 25, 2007 and that approval will
expire on April 25, 2008 if the plat is not recorded. The Subdivision can not be completed
by the expiration date because relocation of the lateral along the west property line is still
unfinished and will not be complete by the Irrigation Districts deadline of March 15,
2008. Therefore construction will be postponed until water is out of the lateral. We
expect construction to resume around October 15, 2008. Beginning construction again at
the date will postpone completion of the entire project until approximately April 2009.
