Operation..
Dear Mr, .Jewett:
kris letters in response to your request fax a Directors Determination asset farth:in.your e-
mail dated September 29, 2009 and the accompanying letter from Mr•. Ryan Russell dated
August 11, 2009. In those communications a request was made for a determination to allow the
expansion of'the hours of'operation for extracting and transporting gc~avei for the construction of
the Ien Mile Interchange.
On May 7, 2009, the City Council approved your request for annexation of the Southridge 31
project including a development agreement (DA) allowing the operation of'construction
activities related to the I-84 widening and construction of the Ten Mile Interchange. In addition,
the DA requires all future accessory uses on this site associated with the expansion of'the Ien
Mile Interchange project comply with all Department of'Environmental Quality, Idaho
Department of'Lands, Idaho Transportation Department, Federal Highway Administrai~on
environmental regulations, and Environmental Protection Agency air• quality and water quality
provisions and requirements.
With the approval of'the annexation request, the City Council directed that all accessory use
activities related to the construction of'the Ten Mile Interchange be reviewed and approved by
the Planning Director. On June 8, 2009, the Director issued a letter approving the following
activities for your property: extract gtaveUaggregate south and east of're-aligned Overland
Road, grade and borrow fill material in the area between Ien Mile Road and re-aligned Overland
Road and establish a concrete batch plant and asphalt mix plant area on the east of Ten Mile
Road and south of'I-84..
the approval ofthe request was subject to a number of'conditions. One of'the conditions was a
limitation of activities between 7:00 AM and 8:00 PM. Based on the information contained in
your email and the letter from Mr. Russell, it appears that you wish to amend the time limitation
to allow construction and related activities for atwenty-four hour period.

Section 11-SA-2 C. Unified Development Code (UDC) vests the Director with the authority to
administer, interpret and enforce the UDC . The proposed construction activities were reviewed
and approved as accessory uses in accordance with UDC 11-3E-6.
After considering your request, reviewing the original approval for the accessory use and public
comments received by office during both the I-84 widening project and at the public healing, we
are denying the request to extend the construction hours,
if you disagree with this decision you may seek City Council review. UDC1I-SA-6 provides for
City Council review of a decision of'the Director in the administration of the Code.. All requests
for z~eview must be filed in writing within. fifteen days after a decision is rendered • Please feel
free to contact our department on the necessary forms and checklists or obtain them on the
Department website.
