AnnVorcheN rs Canning, AICP Planning Director CITY OF MERIDIAN PLANNING DEPARTMENT STAFF REPORT DATE: March 17, 2008 TO: Anna Canning, Planning DirectorEC�IDIAN-_�— IDAHO FROM: Sarah Wheeler, City Planner SUBJECT: Ventana Subdivision No. 3 Time Extension Request for an 18 -month Time Extension to Obtain City Engineer's Signature on the Final Plat for Phase 3 of Ventana Subdivision Consisting of 70 Single -Family Residential Building Lots and 4 Common Lots on 18.21 Acres in an R-8 Zone by Ventana, LLC (File # TE -08-005) We have reviewed this submittal and offer the following comments: APPLICATION SUMMARY The applicant, Ventana, LLC, has requested approval of a time extension to obtain the City Engineer's signature on the final plat for Ventana Subdivision No. 3. The subject final plat consists of 70 single-family residential building lots and 4 common lots on 18.21 acres in an R-8 zoning district. The Applicant has been unable to meet the time requirements specified in Unified Development Code (UDC) 11-6B-7 and 11-5B-6. According to the Applicant the delay resulted because the current slump in the housing market hindered the developer's ability to continue platting Phase 3 (see Applicant's letter dated March 12, 2008). The annexation (AZ -04-019), preliminary plat (PP -04-026), and conditional use permit (CUP -04-028) for Ventana Subdivision was approved by the Meridian City Council on January 25, 2005. The final plat for Ventana Subdivision No. 3 (FP -06-055) was approved by City Council on January 16, 2007. The City Engineer signed the Ventana Subdivision #2 Final Plat on September 19, 2006. Per UDC 11 -6B -7B, Ventana Subdivision #3 would otherwise expire on March 15, 2008. The City of Meridian's Unified Development Code (UDC 11-6B-7) allows the Director to authorize one administrative time extension to record the final plat, not to exceed 18 -months, when the applicant files a written request for an extension prior to the expiration of the plat. The Applicant has filed a written request for an 18 - month time extension one day before the final plat expired, meeting the necessary deadline. Additional time extensions up to 18 -months as determined and approved by the City Council may be granted. With all extensions, the City may require compliance with the current provisions of the UDC as a condition for granting a time extension (UDC 11 -6B -7C). Staff believes that there are no additional conditions that should be added to those approved by the City Council with the final plat for this subdivision; the current conditions of approval shall remain in effect. LOCATION Ventana Subdivision No. 3 is located north of East McMillan Road and .east of North Meridian Road in a portion of the SW '/4 of T. 4N., R. 1 E., Section 30. STAFF RECOMMENDATION Staff recommends approval of an 18 -month time extension to obtain the engineer's signature on the final plat for Ventana Subdivision No. 3, to expire on September 15, 2009. Per Meridian City Ordinance 11 -6B -7B, the signature of the Meridian City Engineer must be obtained by 3/15/08 for Phase 3. The final plat for Ventana Subdivision No. 3 was submitted on 12/11/06, with City Council approval given on 1/16/07. Due to the current slump in the housing market, the developer is unable to continue platting of Phase 3 at this time. Per Meridian City Ordinance 11 -6B -7C, we respectfully request a time extension of 18 months to obtain the signature of the Meridian City Engineer (to 9/15/09).
