We are compiling this letter at the request of Mayor Tammy de Weerd asking the
counsel to reconsider our original request of conveying a small piece of property
that is now apart of the golf course and owned by the city. The property has an
area of 266 sq. ft (estimate) Please refer to our original documentation including::
maps, legal description and letter from the current lessee.
We are contesting the counsel denial for the following reasons.
The city concern about setting precedence or adding an unreasonable increase
of work load for the city staff is mediated by the lack of past request of kind and the
fact that the counsel and staff are there to help its citizens regardless of the work
involved.
I spoke with Nancy Link, director of Cherry Lane golf course concerning our
request. She responded that the board of directors is in full agreement with it as it
solves a nuisance problem in maintaining this property. I ask Ms. Link if they have
had any request of this nature in the past and her answer was no.. To confirm this
conversation please feel free to call Ms. Link..
The lot adjustment does not create a hinderance to other property owners nor
does it interfere with the play of golf.
It would however, allow us to add to our patio and house in conformance with all
city set back ordinance and Subdivion CC@Rs requirements . Additionally, we
could build a fence that would not have a disfigurement
It is our desire to met all of the requirements be it State or City and, are willing
to do whatever work that will help expedite this request..
We appreciate the counsels time given to this matter and hope they will responds
favorably.
We would greatly appreciate notification as to when the request be apart of the
counsel agenda so that we maybe present

De Weerd: Mr. Rountree.
Rountree: I move that we approve Item No. 9, 2004-20051'iscal year budget and instruct
counsel to prepare an ordinance.
Bird: Second.
De Weerd: It's been moved -and seconded to approve Item 9. Is there any further
discussion? Hearing none, Mr. Clerk.
Roll-Call: Bird, yea; Rountree, yea; Wardle, yea; Nary, absent.
MOTION CARRIED: THREE AYES. ONE ABSENT.
De Weerd: Thank you. I would like to remind you of the special joint workshop
tomorrow. The agenda and the publishing that the city clerk gave you, we did have an
item for park impact fees and the memorandum of understanding, so that we can collect
those impact fees. Also of discussion items. But that meeting is tomorrow at 1:30 at the
Ada County Courthouse. Will you all be able to make it? I know Mr. Wardle will not be
able to.
Wardle: Madam Mayor, I have a meeting, which I will be at. tf we can get a quorum
without me being tyre, it would help me out.
Rountree: Madam Mayor, at this point I plan on attending, but that could change.
De Weerd: Okay.
Bird: I will be there.
De Weerd: if that could change, we will -
Rountree: I'll let you know.
De Weerd: - give a desperate call to Mr. Wardle. Sound good?
Wardle: Yeah.

De Weerd: They usually validate. They give you little stickers. And so just bring your
tidce# in with you.
Rountree: ff there is a spot.
De Weerd: And I have given you a letter that was written by our Ptanning and Zoning
Department in reference to a piece of property they have been looking at for a campus
type of function, so, please, keep that in mind as we go in there tomorrow for
discussion. I also had a couple of items in front of you that I wanted feedback on. This
one from Ashford Greens Homeowners Association, 1 talked to Brad Watson about this
and in discussion with our city attorney, it does look tike there are three different
maintenance agreements that kind of say three different things and we just need some
clarity from the City Council to instruct the aty attorney to draw a clearer agreement that
will make it consistent of expectations that we have for our homeowners associations in
dealing with their drainage ponds. Did I summarize tha# okay? t don't know, maybe Gaty
hadn't been updated on this one, but - so we will put that on next week. I did have a
letter contesting the decision or -- about seAing a piece of property on the golf course.
They would like to come personally in front of City Counal and since this Mad an opinion
from Council, I wanted to know your feelings on if we should or not.
Rountree: Madam Mayor, I don't see any reason. i think the decision has been made. t
don't think we are in the position to want to hear people coming to the Council
establishing a forum for them to bargain with the city on the city's property. I mean the
next thing it's going to be auction property and old police cars and, you know, -- if our
policy is no, it's no.
De Weerd: Okay.
Bird: Madam Mayor?
De Weerd: Mr. Bird.
Bird: I would concur with that. We discussed it quite long when we denied it and we
would be setting a precedent, 1 believe, and I don't believe we are ready to do that.
De Weerd: Okay. Well, 1 will certainly let them know that the deasion is final by Council.
Mr. Wardle, I don't have quite a quorum on that decision.
Wardle: I agree, Madam Mayor.
De Weerd: Okay. Okay. ff there is no further business in front of Council, I would
entertain a motion.
