Who is going to maintain the tiled ditch and the storm run-off water? Gary Lee, JUH Engineers: Oakcrest, as was shown on the preliminary plat, there is a one acre in that southwest corner that is not under the ownership of either Monroe or Harker and at this time is not in the cantT^ol of the developer. At such time that that particular piece of land develops is when Oakcrest will continue through the subdivision. There was some concerns brought up about the access to the site and it was pointed out that there are three planned accesses all together. The storm water issue will be handled in much the same way that storm water has been handled through Kearney Subdivision. We will retain on site all that storm water above what's being dischat^ged now. Thet^e will be some water allowed to discharge into an existing storm water facility. The irrigation ditch along the south boundary will be tiled in accor^dance with City of Meridian requirements and as stipulated by Idaho Code, the property owners of which that ditch crosses will have the maintenance responsibility. Tolsma: The ditch will be tiled basically to Nampa Meridian Irrigation District's specifications? Lee: Yes. We size those pipes to handle the water as suggested by Nampa Meridian Irrigation Distt^ict. They give us a flow to use and then we accommodate any storm wate-^ run-off in addition to that. Tolsma: So if these pipes don't handle it then Nampa Meridian Irrigation District is at fault then. Lee: Well they'll give you the numbers that they know they have to deliver water and if we have an extremely wet year then there's always going to be same flooding problems. Giesler^: Dixie Lane once it gets into Wingate Subdivision - ACHD is -^equiring that street to be improved up to Wingate, the rest of Dixie Lane would be a part of the subdivision when you get into phase 4? ANNEXATION AND ZONING THE SOUTH 1/2, NORTHEAST 1/4, SOUTHWEST 1/4, SECTION 5, TOWNSHIP 3 NORTH, RANGE 1 EAST, BOISE-MERIDIAN ADA COUNTY, IDAHO MERIDIAN,-IDAHO FINDINGS OF FACT AND CONCLUSIONS OF LAW The above entitled annexation and zoning application having come on for consideration on April 13, 1993, at the hour of 7:30 o'clock p.m. on said date, at the Meridian City Hall, 33 East Idaho Street, Meridian, Idaho, and the Planning and Zoning Commission having heard and taken oral and written testimony, and the Applicant appearing in person and through Gary Lee, Applicant's Engineer, and the Planning and Zoning Commission having duly considered the matter, the Planning and Zoning Commission makes the following: FINDINGS OF FACT 1. That notice of public hearing on the annexation and zoning was published for two (2) consecutive weeks prior to the said public hearing scheduled for April 13, 1993, the first publication of which was fifteen (15) days prior to said hearing; that the matter was duly considered at the April 13, 1993, hearing; that the public was given full opportunity to express comments and submit evidence; and that copies of all notices were available to newspaper, radio and television stations; FINDINGS OF FACT AND CONCLUSIONS OF LAW - PAGE 1 • • 2. That the property included in the application for annexation and zoning is described in the application, and by this reference is incorporated herein; that the property is approximately 19 acres in size; it is located East of Mirage Meadows Subdivision and South of Kearney Place Subdivision and North of the proposed !:heri Meadows Subdivision. 3. That the property is presently zoned by Ada County as RT ( Rural Transition ) and the proposed use would be for a residential subdivision and the requested zoning is R-8 Residential. 4. The general area surrounding the property is used residentially or is proposed to be used residentially. 5. That the property is adjacent and abutting to the present City limits. 6. The Applicant, D.W., Inc., is not the owner of record but the owners of record have consented to annexation. 7. That the property included in the annexation and zoning application is within the Area of Impact of the City of Meridian. 8. That the parcel of ground is included within the Meridian Urban Service Planning Area as the Urban Service Planning Area is defined in the Meridian Comprehensive Plan. 9. That the Application requests that the parcel be annexed and zoned R-8; that the present use of the property is for a single family dwelling and one mobile home; that the applicant indicated that the intended development of the property would be for a residential subdivision and has submitted a proposed preliminary plat; that in the application for plat approval the FINDINGS OF FACT AND CONCLUSIONS OF LAW - PAGE 2 • Applicant stated that the minimum house size would be 1, 300 square feet and that only single family dwellings would be constructed. 10. There were two property owners in the immediate area that testified objecting to the Application because they wanted development to cease. 11. That the property is in the NORTH CURVE Neighborhood as set forth in Policy Diagram in the Meridian Comprehensive Plan. 12. That the property can be serviced with City water and sewer. 13. Ada County Highway District, Ada Planning Association, Central District Health Department, Nampa & Meridian Irrigation District, City Engineer, Meridian School District, and the City Police and Fire Department submitted comments and such are incorporated herein as if set forth in full. 14. That the Ada County Highway District recommended that land be dedicated for Dixie Lane to make it a public street; that the City Engineer, Gary Smith, commented that the twenty foot strip between the subject parcel and Chateau Meadows East No. 2 Subdivision should be included as part of this annexation; Meridian Fire Chief, Renny Bowers, commented that something needs to be done with Dixie Lane. 15. That the R-8 Residential District is described in the Zoning Ordinance, 11-2-408 B. 2 as follows: ~,R-8) MEDIUM DENSITY RESIDENTIAL DISTRICT: The purpose of the (R-8) District is to permit the establishment of single and two (2) family dwellings at a density not exceeding eight (8) dwelling units pre acre. This district delineates those areas where FINDINGS OF FACT AND CONCLUSIONS OF LAW - PAGE 3 • • such development has or is likely to occur in accord with the Comprehensive Plan of the City and is also designed to permit the conversion of large homes into two (2) family dwellings in well-established neighborhoods of comparable land use. Connection to the Municipal Water and Sewer systems of the City of Meridian is required. 16. That proper notice was given as required by law and all procedures before the Planning and Zoning Commission were given and followed. CONCLUSIONS 1. That all the procedural requirements of the Local Planning Act and of the Ordinances of the City of Meridian have been met; including the mailing of notice to owners of property within 300 feet of the external boundaries of the Applicant's property. 2. That the City of Meridian has authority to annex land pursuant to 50-222, Idaho Code, and Section 11-2-417 of the Revised and Compiled Ordinances of the City of Meridian; that exercise of the City's annexation authority is a Legislative function. 3. That the Planning and Zoning Commission has judged this annexation and zoning use application by the provisions contained in Section 50-222, Title 67, Chapter 65, Idaho Code, the Meridian City Ordinances, Meridian Comprehensive Plan, as amended, and the record submitted to it and things of which it can take judicial notice. FINDINGS OF FACT AND CONCLUSIONS OF LAW - PAGE 4 • 4. That all notice and hearing requirements set forth in Title 67, Chapter 65, Idaho Code, and the Ordinances of the City of Meridian have been met. 5. That the Commission may take judicial notice of government ordinances and policies, and of actual conditions existing within the City and State. 6. That the land within the proposed annexation is contiguous to the present City limits of the City of Meridian, and the annexation would not be a shoestring annexation. 7. That the annexation application has been initiated with the consent of the owners and the annexation is not upon the initiation of the City of Meridian. 8. That since the annexation and zoning of land is a legislative function the City has authority to place conditions upon the annexation of land. 9. That the development of annexed land must meet and comply with the Ordinances of the City of Meridian and in particular Section 11-9-616 which pertains to development time schedules and requirements; that the Applicant will be required to connect to Meridian water and sewer; that the property will be subject to the Subdivision and Development Ordinance. 10. That proper and adequate access to the property is available and will have to be maintained; that it is recommended to the City Council that Dixie Lane should be annexed and that if the owner, owners, or parties interested in Dixie Lane will not consent to annexation that the City annex the parcel FINDINGS OF FACT AND CONCLUSIONS OF LAW - PAGE 5 • • involuntarily; that Dixie Lane should be, if at all possible dedicated for a public street and Ada County Highway District, if necessary, should condemn the parcel for use as a public street and the abutting property owners should dedicate enough additional ground for a public street; this issue of Dixie Lane should be further addressed by the City Council and by the Ada County Highway District. 11. That since the Applicant's property is in the NORTH CURVE NEIGHBORHOOD of the Comprehensive Plan, the annexation and zoning Application is in conformance with the Comprehensive Plan. 12. Therefore, based on the Application, the testimony and evidence, these Findings of Fact and Conclusions, and the Ordinances of the City of Meridian, it is ultimately concluded that Applicant's property should be annexed and zoned as requested; that the conditions should be those stated above and other conditions to be explored at the City Council level; that such annexation would be orderly development and reasonable if the conditions are met. 13. That any ditches, canals, and waterways shall be tiled as a condition of annexation and if not so tiled the property shall be subject to de-annexation. 14. That any of the requirements of the Nampa Meridian Irrigation Districts and Ada County Highway District shall be met as well. 15. With compliance of the conditions contained herein, the annexation and zoning of R-8 Residential would be in the best FINDINGS OF FACT AND CONCLUSIONS OF LAW - PAGE 6 i • interest of the City .of Meridian; that construction of houses shall be limited to single family dwelling which have minimum size of 1, 300 square feet and there shall be no duplexes, townhouses or condominiums. Wingate Park is a 74-lot single family residential subdivision on 18.8 acres of property located on the east side of Dixie Lane approximately 1,300-feet north of Fairview Avenue. 3,350-feet of new public streets are planned. 2. Wingate Place (abutting parcel) is a local street that has 50-feet of right-of-way and is fully improved with a 36-foot street section. This is the only existing public street connection for subject parcel. There will be 69-lots (platted) through Kearney Place Subdivision from Cha- teau Drive east of Laughridge Avenue when the third phase (Kearney Place) is completed (currently under construction) . The addition of this project would bring the total to 143-lots which take access to a non-continuous local street. District policy requires a second street connection at 100-lots. 3. Cheri Meadows Subdivision is a single family subdivision that has been reviewed and approved by the District with a requirement for a traffic impact study (which has not been submitted yet) so the collector street connection is not available for subject parcel unless the District ap- proves the street as shown and the collector street is constructed from this area to Fairview . 4. Dixie Lane is a private street which connects the southwest corner of this property to Fairview Ave. Staff recommends that right-of-way be dedicated now to make Dixie a public street. 5. This planned development will accelerate the need for Joint School District No. 2 to construct additional classrooms and/or to adjust school attendance boundaries. Meridian Schools do not have excess capacity. Nearly every school in the district is beyond capacity. The Meridian School District supports economic growth for Idaho and specifically the district's area, but such growth produces a need for additional school construction. We ask your support for a development fee statute on new home construction or a real estate transfer fee to help offset the costs of building additional school facilities. If this support is lacking then we ask that additional residential development be denied. Residents of the new subdivision cannot be assured of attending the neighborhood school as it may be necessary to bus students to available classrooms across the district. Annexation: 1. The north boundary of this parcel is contiguous to the existing city limit boundary of Kearney Place Subd. 2. The annexation description-°-does n©t include an approximate>-one acre parcel at this parcels southwest corner nor does it include a 20 toot wide strip between this parcels west boundary and the east boundary of Chate~.u Meadows East No.2 Subd. and Mirage Meadows Subd. At the Teast it seems that the 20 foot wide strip should be included in the annex- ation. B. Preliminary Plat: 1. Access to this proposed subdivision is limited to one point near it northeast corner. Proposed future access connections near its southeast and southeaest corners will provide needed access. However, the southeast corner con- nection is contingent on developmenyt of Cheri Meadows Subd. and the southwest corner connection is presently blocked by a landowner who reportedly isn't interested in being a part of the development. 2. The status of Dixie Lane needs to be resolved. If this development goes forward does Dixie Lane, adjacent to this subdivision, need to exist? Can access to Gordon Woods be provided from Kearney Place Subd.? 3. The connection of proposed sewer and water lines to Oakcrest Dr. is not clear as to location. These facilities need to be in an always accessible position. What are the exact boundaries of the "Unplatted Future Development" parcel compared to the boundary of Mirage Meadows Subd.? It doesn"t appear there is room to position the lines through this area for connection. Because of the location of these tvao lines, Lot 1-Block 3 should not be considered a buildable lot until such time as the sewer and water lines can be moved into right of way D.W., Inc./Monroe/Barker Page 2 Annexation, Zoning, Preliminary Plat when the "Unplatted Future Development" is built. 4. What happens to the irrigation drainage water from the east that presently crosses this property and enters a pipe at the northeast corner of Mirage Meadows Subd.? 5. How will this proposed subdivision be developed? The sewer service needs to come from Mirage Meadows Subd. and the access from Kearney Place. Lot numbering indicates it will all be developed at once. 6. Some minor modifications to street light and fire hydrant locations appear to be needed. 7. DEVELOPMENT LOCATION The Monroe/Barker property is located in a portion of the S 1/2 of the NE 1/4 of the SW 1/4 of Section 5, Township 3 North, Range 1 East, B.M., Ada County, Idaho. The address of the site is 2170 Dixie Lane, Meridian, Idaho. More particularly, the project lies east of Mirage Meadows Subdivision, south of Kearney Place Subdivision and north of the proposed Cheri Meadows Subdivision (Dave Leader Property) II. SITE DESCRIPTION Currently, the site is comprised of approximately 19 acres of irrigated pasture with one single-family home and a mobile home. The land is generally flat with small irrigation ditches throughout that water the pasture by flood irrigation methods. At this time, the property is adjacent to the City of Meridian corporate limits to the north and west. The present zoning of the site is RT within Ada County. North Wingate Place provides access to the parcel at the northeast corner of the property and Dixie Lane (a private lane) provides access to the west boundary. A planned development known as Cheri Meadows Subdivision is situated along the south boundary line. PROPOSED DEVELOPMENT The developer plans to request a re-zone of the property to residential R-8. The project will consist of approximately 74 single-family residential lots resulting in a gross density of 3.9 lots per acre. The lots sizes will conform to the City of Meridian Zoning Ordinance for residential developments. This development and zoning (R-8) are desirable at this location. The property is situated next to R-8 zoning to the north and west. In addition, R-8 zoning is planned for the proposed Cheri Meadows Subdivision to the south. There are other residential developments in the area that make an R-8 zone desirable. This zoning request and annexation will comply with the Meridian Comprehensive Plan. IV. PROPOSED IMPROVEMENTS A. Sanitary Sewer System: There is an existing public sanitary s Wingate Place just to the north of the second sewer on East Oakcrest Drive to This system is operated and maintained Meridian. This development will exten sewer service into the site. B. C. Public Utilities: This subdivision will include public utilities such as electrical power from Idaho Power Company; natural gas from Intermountain Gas Company; telephone service from U.S. West Communications; and TV service from TCI Cablevision. Public Streets: All streets will be constructed to Ada County Highway District Standards and Specifications. All streets will be constructed to Local Street Standards. Storm water drainage for these public streets will be collected and retained on-site in accordance with A.C.H.D. standards. Disposal of storm water into the natural drainage will consist of only flows equal to the pre-development storm water discharge of the property (i.e., the amount of storm water discharged into this drainage will not exceed what is currently flowing into said drainage ditch in its present condition) . E. Irrigation and Drainage: An existing irrigation ditch that traverses this site along the southerly boundary will be tiled to continue delivery of irrigation water to neighboring properties. Other smaller irrigation and drainage ditches that deliver water to this parcel only will be abandoned. V. FIRE PROTECTION As mentioned earlier, the domestic water system will be maintained and operated by the City of Meridian. Part of their service will include the delivery of adequate fire protection.
