We would provide the lot and require The Vineyards Homeowner's Association to maintain the landscaping. (Lot has been deeded to the city). 2. The City of Meridian would install the landscaping for the lot, and the well building. Jack had also indicated that we could credit the cost (not the sales price) of the lot to the $382. per lot well development fee, but I'm not sure this was firmed up. We expect The Vineyards Subdivision #3 to be complete and ready for marketing by approximately July 1. 1993. It would greatly enhance our marketing effort if the well building and landscaping could be completed by then. Therefore, I would rather have us do the landscaping since we can get it done quicker. It will cost $7000 to $8,000 to install the sprinkler system, sod, and landscaping on the lot. I would.-like to propose the following as to the well development fee: The Vineyards #3 fee - 45 lots @ 382. 17,190.00 Credit lot at average cost per lot (15,200.00) Landscaping credit if we provide ( 5.000.00) Excess Credit ($3,010.00) I would propose that the excess credit be applied to The Vineyards #4 fee. Boesiger has deeded the lot to the City of Meridian. 2. Boesiger will require in the CC&R's that The Vineyards Homeowner's Association will maintain the landscaping. 3. BOESIGER, INC., an Idaho corporation, or "Declarant," and shall be incorporated into and supplement that certain Declaration of Covenants, Conditions and Restrictions for The Vineyards Subdivision - Phase 1, recorded as Instrument No. 9240085, records of Ada County, as to the Phase 3 Property hereby covered as described below. ARTICLE I. GENERAL 1.1 Property Covered. Grantor/Declarant is the Owner of the real property in the County of Ada, State of Idaho, described as: The Vineyards Subdivision #3, a portion of the N. 1/2 of the N.E. 1/4, Sec. 11, T.3 N ., R.1 W. BM, Meridian, Ada County, Idaho, according to the official plat thereof recorded as Instrument No. records of Ada County, Idaho. ("Phase 3 Property" and "Phase 3 Lots" as to the lots therein). 1.2 Puryose. The purpose of this Supplemental Declaration is to annex the Phase 3 Property to the Property covered by the Declaration, and to include the Owners of Phase 3 Lots in the Association. 1.3 Annexation. Grantor, pursuant to the provisions of Article VIII of the Declaration, does hereby annex the Phase 3 Property to the Property covered by the Declaration and said Phase 3 Property hereby becomes subject to the Declaration and encompassed within the general plans and scheme of covenants, conditions, restrictions, and reservations of easements and equitable servitudes and other terms and conditions therein, except as otherwise specified herein. Unless otherwise provided, all defined terms as contained in the Declaration shall have the same meaning in this Supplement as are applicable to the Declaration. 1.5 Association Membershiy. Article IV in general and Section 4.2 specifically, is hereby supplemented to provide that each Owner of a Phase 3 Lot shall be a member of The Vineyards Homeowners Association. • ARTICLE II DECLARATION Grantor hereby declares that the Phase 3 property. and each Lot. parcel, or portion hereof. is and shall be held, sold, conveyed. encumbered. hypothecated. leased, used, occupied and improved subject to the Declaration. as supplemented hereunder. and the restrictions. covenants, limitations. conditions ad equitable servitudes contained therein. all of which are declared and agreed to be in furtherance of a general plan fo-r the protection, maintenance. subdivision, improvement and sale of the Phase 3 property, or any lot, parcel or portion thereof, and to enhance the value. desirability and attractiveness of the Property. The covenants, conditions and restrictions set forth in the Declaration. as supplemented hereunder. shall run with the land (described as the Property including the Phase 3 Property>, and each estate therein and shall be binding upon all persons having or acquiring any right, title or interest in the property, including the Phase 3 Property, or any Lot. parcel or portion hereof shall inure to the benefit of and be binding upon Grantor, its successors in interest and each Grantee and his respective successors in interest. and may be enforced by Grantor, by any Grantee or Owner or his successors in interest. or by the Association as described in the Declaration. ARTICLE III SUPPLEMENTS AND MODIFICATIONS 3.1 Plat Conditions. Article 1. Section 1.19 is hereby supplemented to provide that "Plat" as to the Phase 3 property shall refer to the recorded plat of The Vineyards Subdivision No. 3. All conditions of the Plat are hereby incorporated herein by reference and notice is hereby given of the same. 3.2 Duties of the Association. Article 4, Section 5.2 is hereby supplemented to provide that the Association shall maintain the landscaping on the well lot that is located at the entrance to the Properties on Linder Road (Lot 7, Block 1. Corner at the Vineyards Subdivision #2). and that is owned by the City of Meridian. The Association shall maintain the landscaped berm that runs adjacent to. and parallel to Linder Road. Idaho Meridian, Idaho 83642 Re: The Vineyards Subdivision No. 3 Dear Councilmen: I have reviewed the application for The Vineyards Subdivision No. 3. This planned development will accelerate the need for Joint School District No. 2 to construct additional classrooms and/or to adjust school attendance boundaries. Meridian Schools do not have excess capacity. Nearly every school in the district is beyond capacity. The Meridian School District supports economic growth for Idaho and specifically the district's area, but such growth produces a need for additional school construction. We ask your support for a development fee statute on new home construction or a real estate transfer fee to help offset the costs of building additional school facilities. If this support is lacking then we ask that additional residential development be denied. Residents of the new subdivision cannot be assured of attending the neighborhood school as it may be necessary to bus students to available classrooms across the district. title ask that you assure the developer will provide walkways, bike paths and safe pedestrian access. Giesler: I wasn't for certain whether Nine Mile is going to be tiled or not. Becky Bowcutt: No we will not be tiling Nine Mile, we will be putting a 6' cedar fence along the ditch and then we will be grating the ditch bank and then laying down some gravel road mix to improve it. Corrie: After it's all done, fenced, who is going to take care of that back there? Bowcutt: Nampa Meridian Irrigation District maintains that but it's under I believe the Bureau of Reclamation. Corrie: Does you property lines go iri the middle of that ditch or does it go to just your fence? Bowcutt: I believe the fence line would be on the property line. Corrie: Then we are possibly going to run into the same problem we're having the other places, it's the easement they are responsible for it but not the ditch company. Kingsford: Okay. Also we will be submitting some additional street names to the Street Name Committee because we have a couple that exceed the maximum length. That is the only issue that we need to resolve here. Kingsford: What is the status of the pressurized irrigation with Nampa Meridian? Have they been in contact with you any more on that? Bowcutt: Not this particular project.
