RE: Sunburst Subdivision
Gentlemen:
I write as acting City Attorney at the request of the Mayor
and City Council of Meridian, Idaho.
As the owners and developers of Simburst Subdivisions, your
property borders a piece of ground in the southwest corner
Section 2, Township 3 North, Range 1 West, Boise -Meridian,
Ada County, Idaho, otherwise located in the northeast corner
of the intersection of Cherry Lane and Ten Mile Road. There
is an existing irrigation ditch along the east and north
sides of this parcel of ground. I am enclosing a map of
this area which shows this existing irrigation ditch colored
-in yellow.
Section 9-605iM of the Subdivision and Development Ordinance
of the City of Meridian requires that this ditch be piped.
A copy of•this Ordinance is enclosed herewith.The piping
of this ditch must be designed in such a way as to provide
water to these adjacent properties. It is imperative that
this piping be commenced and completed promptly so as not to
be in violation of the Ordinance.
Before any piping is commenced, it is necessary that your
engineer provide a copy of his field notes together with a
written statement from the irrigation district involved as
to the required capacity'of the ditch involved to the city
engineer for his review.

I am also advised that it appears that said ditch or portions
thereof have been moved from its former location on the prop-
erty line which location must be restored.

9-605 M PIPING OF DITCHES
Tiling of irrigation ditches, laterals or canals. All waterways,
irrigation ditches, laterals or canals, exclusive of natural
waterways, intersecting, crossing or lying adjacent and
contiguous to an area being subdivided shall be covered and
enclosed with tiling or other equivalent covering which has the
same ability to detour access to said ditch, lateral or canal,.or
any part of said lads or areas being subdivided which abut
either or both sides of said ditch, lateral or canal. The City
may waive this requirement for covering such ditch, lateral or
canal, if it finds that the public purpose requiring such will
not be served in the individual case. Any covering program
involving the distribution system of any irrigation district
shall have the prior approval of that affected irrigation
district. Not subdivision plat shall be approved where the
subdivision is arbitrarily or artificially laid out to avoid
being adjacent to any waterway, irrigation ditch, lateral or
canal to which it would otherwise be naturally adjacent or which
it would otherwise naturally include.
9-606 IMPROVEMENT STANDARDS
9-606 A RESPONSIBILITY FOR PLANS
It shall be the responsibility and liability of every subdivider,
and the owner of the land being subdivided, to construct and
install every improvement shown on the plat of the subdivision or
represented to be included in the subdivision at any presentation
before the Planning and Zoning Commission or the City Council and
this responsibility and liability shall run with the land and
this responsibility and liability shall be shown on the plat of
the subdivision. (Ord. 557, 10-1-91)
9-606 B IMPROVEMENTS, PUBLIC
Every subdivider shall be required to install at his own expense
the following public and other improvements in accordance with
the conditions and specifications, as follows:
1. Monuments - Monuments shall be set in accordance with
section 50-1303, Idaho Code;
2. Streets and Alleys - All streets and alleys shall be
constructed in accordance with the standards and
specifications adopted by the City Council and Highway
District;

Crookston: I have a conflict and will be stepping down at this point.
Kingsford: Mr. Riddlemoser will step in for the attorney. At this time I will open
the Public Hearing. Is there a representative present,, please come forward and be sworn.
Russ Hunemiller,, 282 Parliment Court,, Boise,, was sworn in by the attorney.
Hunemiller: We want to get this annexed and zoning with preliminary plat.
Giesler: In the Findings it states that the Fire Department had some concern about the
accesses. Have these be adjusted to meet the necessary requirements?
Hunemiller: In all phases they do.
Tolsma: Is this going to be done in phases?
Hunemiller: yes it is.
Tolsma: Phase I will be out off Cherry Lane won't it?
Hunemiller: That is correct. Gave explanation of phases to Council.
Kingsford: What we are looking at is a plat map.
Myers: I notice the same concern about over crowding in the schools. Have you talked to
or done anything with the school board concerning this?
Hunemiller: No I haven't.
Kingsford: We would like to work with the schools so you might do some checking with
them. Anyone else from the Public who would like to offer testimony on this isse?
Seeing none I will close the Public Hearing.
The Motion was made by Tolsma and seconded by Yerrington to approve the Findings of Fact
and Conclusions of Law as prepared for Planning & Zoning.

ITEM #5: PUBLIC HEARING: REQUEST FOR ANNEXATION AND ZONING W/PRELIMINARY PLAT ON BENHAM
PARK SUBDIVISION BY B.W. INC.:
Kingsford: At this time I will open the Public Hearing. Is there a representative
present,I please come forward and be sworn.
Don Hubble, Hubble Engineering, was sworn by the attorney.
Hubble: I will briefly explain the project to you. This site consists of about 61 acres.
We have proposed 210 lots,, we've got a density there of about 3.4 lots to the acre. We
proposed a mixed use. The majority of the project is requested to be zoned R-8,, there
are two portions there,, two small lots that are requested to be LO and the one larger
parcel along Fairview is requested to be CG. The average lot size would be roughly
6600 sq. feet. We do have a proposed small park within the project. When we submitted
the aplication we said the minimum sq. feet would be 1200, since then we have discussed
with the developer of using the City's sliding scale home size and would like to
maintain that option if possible. We have reviewed the Findings of Fact and Conclusions
of Law and have a question with just one conclusion in that it says that all ditches
within the project shall be tiled. We would request you to approve this by saying that
all ditches, all private ditches, those not maintained by a public entity be piped.
We would like the flxibility,, we may pipe some of them anyway upon their approval, but
we would like that flexibility to not have to pipe the ditches that are maintained by
the public entities.
Giesler: How many small ditches are you talking in this project?
Hubble: I think just two that we would pipe for sure.
Myers: The Fire Department is a little bit concerned too. Did you talk to anybody
over there about the culdesacs down at the end with one way in and one way out.
Hubble: I haven't talked to anybody at the Fire Department,, I've talked to Jack.

Re: Sunburst Subdivision
To Whom It May Concern:
The Board of Directors of Settlers Irrigation District has
reviewed the preliminary plans for the above mentioned
proposed subdivision, and disapprove of the plan to relocate
the canal.
The Portion of the Settlers canal affected by this
development runs west along the southern boundary of the
subdivision parallel to Cherry Lane. According to Mr. Roy
Johnson of Johnson Engineering, Cherry Lane is to be widened
which will require either moving the ditch or piping it so
that it can continue on its present course. The developer
has informed Settlers that their plans call for relocating
the open ditch 20 feet north at the eastern boundary of the
subdivision then commencing west under the entrance to the
subdivision to the western boundary then turning south 20
feet then west again to its original course.
The Board finds three major Problems with that proposal.
Firstly, relocating the ditch would create increased flow
Problems in an area where sufficient flow is already
difficult to maintain. Secondly, an open ditch is an easy
dumping ground for grass clippings, leaves, garbage etc.
This would further restrict the flow of water. Thirdly, the
open ditch concept is an extremely poor one from a safety
standpoint --an open ditch is extremely hazardous. Settlers
is deluged with phone calls from homeowners in similar
situations pleading that something be done to insure the
safety of their children. A developer's lack of forethought
and/or concern for the safety of the homeowners is not
Settlers' responsibility --the canal was there long before
any subdivisions. The Cherry Lane Subdivision is a perfect
example of the ascetic and safety problems which exist due
to this type of Planning and development.

Therefore, it is the strong recommendation of the Board of
Directors of Settlers Irrigation District that the canal be
piped under the expansion of Cherry Lane and left on its
original course.

Subject: Review of Sunburst Subdivision Preliminary Plat Designed
by Johnson Engineering (Zoning Review)
Dear Meridian Planning & Zoning:
This subdivision's storm water will run off into Reclamation's Nine
Mile Drain operated and maintained under contract by the Nampa -
Meridian Irrigation District.
We request prompt Reclamation and Nampa -Meridian Irrigation Dis-
trict review of storm water drainage structure design. Assuming
BMP infiltration/detention and treatment satisfactory to Reclama-
tion and the Nampa -Meridian Irrigation District, we probably won't
require a permit for ACHD's increased storm water discharges to
these United States drains at existing points.
While we assume on -subdivision storm water detention and treatment,
another alternative would be downslope facilities nearer the
drain(s) treating and detenting ACHD flows from this and other
urban areas.

of any assistance.

Dear Mr. Niemann,
This planned residential development will accelerate the need
for Joint School District No. 2 to construct additional
classrooms and/or to adjust school attendance boundaries.
Meridian Schools does not have excess capacity. Nearly every
school in the district is beyond capacity.
The Meridian School District supports economic growth for Idaho
and specifically the district's area, but such growth produces a
need for additional school construction. We ask that planning
and zoning officials assist the district in obtaining support
for a development fee statute on new home construction to help
offset the costs of building additional school facilities. We
also ask that the same support for school bond issues be
required from developers and other interests seeking planning
and zoning approval for residential projects. If this support
is lacking then we ask that additional residential development
be denied.
School bus service may be restricted if adequate turnarounds and
loading areas are not provided.
Residents cannot be assured of attending the neighborhood school
as it may be necessary to bus students to available classrooms
across the district.
Developers are strongly encouraged to provide walkways, bike
paths and safe pedestrian access to schools.

On September 5, 1991, the Commissioners of the Ada County Highway Dis-
trict (hereafter called "District") approved the Preliminary Plat as stated
below:
FACTS & FINDINGS:
1. Sunburst is a 126 -lot single family residential subdivision located on the
north side of Cherry Lane and the east side of Ten Mile Road;
6,707 -feet of new public streets are planned.
2. Cherry Lane is designated a minor arterial street on the 2010 Urban
Functional Street Classification Map requiring a minimum 66 -foot right-
of-way and 52 -foot street section with 4 traffic lanes.
Cherry Lane has 50 -feet of right-of-way and is improved with 24 -feet
of paving. There is a large irrigation ditch along the north side which
will need to be relocated out of the public right-of-way.
�. Ten Mile Road is a section line road requiring 60 -feet of right-of-way.
The road has 50 -feet of right-of-way and is improved with 24 -feet of
paving.
SITE SPECIFIC CONDITIONS:
1. Dedicate 37 -feet of right-of-way from the centerline of Cherry Lane
abutting parcel.
2. Curb, gutter, 5 -foot sidewalk and match paving shall be constructed on
Cherry Lane abutting parcel. Improvements shall be constructed to a
52 -foot back-to-back street section.
3. Direct lot or parcel access to Cherry Lane is prohibited, in compliance
with District policy. Lot access restrictions shall be stated on the final
plat.

Engineering Services within 15 calendar days of the original Commission
action. The request shall include a statement explaining why such a
requirement would result in substantial hardship or inequity.
Should you have any questions or comments, please contact the Develop-
ment Services section at 345-7662.
In order that the Final Plat may be considered by the District for accep-
tance, the Developer shall cause the following applicable standard conditions
to be satisfied prior to District certification and endorsement:
1. Drainage plans shall be submitted and subject to review and approval
by the District.
2. If public street improvements are required: Prior to any construction
within the existing or proposed public right-ofway, the following shall
be submitted and subject to review and approval by the District:
a. Two complete sets of detailed street construction drawings pre-
pared by an Idaho Registered Professional Engineer, togrether with
payment of plan review fee.
b. Execute an Inspection Agreement between the Developer and the
District together with initial payment deposit for inspection and/or
testing services.
C. Complete all street improvements to the satisfaction of the District,
or execute Surety Agreement between the Developer and the Dis-
trict to guarantee the completion of construction of all street im-
provements.
3. Furnish copy of Final Plat showing street names as approved by the
Local Government Agency having such authority together with payment
of fee charged for the manufacturing and installation of all street
signs, as required.
4. If Public Road Trust Fund deposit is required, make deposit to the
District in the form of cash or cashier's check for the amount specified
by the District.
5. Furnish easements, agreements, and all other datum or documents as
required by the District.
6. Furnish Final Plat drawings for District acceptance, certifications, and
endorsement. The final plat must contain the signed endorsement of
the Owner's and Land Surveyor's certification.
7. Approval of the plat is valid for one year. An extension of one year
will be considered by the Commission if requested within 15 -days prior
to the expiration date.

The above entitled annexation and zoning application having
come on for consideration on August 13, 19919 at the hour of 7:30
o'clock p.m. on said date, at the Meridian Cit, Hell, 33 East
Idaho Street, Meridian, Idaho, and the Council having heard and
taken oral and written testimony and the Applicant Russ Hunemiller

appearing in person and through his engineer, Ron Johnson, and
having duly considered the matter, the Planning and Zoning
Commission makes the following:
FINDINGS OF FACT
i. That notice of public hearing on the annexation and zoning
has published for two (2) consecutive weeks prior to the Said
public hearing scheduled for August 13, 1991, the first
publication of which was fifteen (15) days prior to said hearing;
that the matter was duly considered at the Augus; 13, 1991,
hearing; that the public was given full opportunity to exrr::s
comments and submit evidence; and that copies of all notices werE
made available to newspaper, radio and television stations;
2. That the property included in the application for

annexation and zoning is described in the application, and by this
reference is incorporated herein; that th4E propErty
approximately 35 acres in size; it is in the northeast quadrant
of the intersection of Ten Mile Road and Cherry Lane.
3. That the property is presently zoned by the county AP -
1 (Agriculture) and the proposed use would be for R-4 Residential.
4. The general area surrounding the property is used
agriculturally and residentially; that the residential property
is zoned R-4, Residential.
5. That the property is adjacent and abutting to the
present City limits.
6. The Applicant's Bill Stuhr and Russ Hunemiller are not
the owners of record of the property but the owners of record,
Joan Pries and Glen William Davidson, have requested the
annexation and consented to the Application.
7. That the property included in the annexation and zoning
application is within the Area of Impact of the City o` Meridian.
8. That the entire parcel of ground is included within the
Meridian Urban Service Planning Area as the Urban Service Planning
Area is defined in the Meridian Comprehensive Plan.
9. That the Application requests that the parcel be annexed
and zoned R-4 Residential; that the present use of the property
is for agriculture; that the applicant indicated that the intendE-'
development of the property is for an R -Z subdivision.
10. There were no property owners in the immediate area that
testified objecting to the Application.

11. That the property is in the CHERRY LANE Neighborhood as
set forth in Policy Diagram in the Meridian Comprehensive Plan;
that under Housing Development on page 25 and 26 of the
Comprehensive Plan property inside the Urban Service Planning Area
may be developed at greater densities than one dwelling unit per
acre and it is the policy that a density of greater than 1
dwelling unit per 5 acres may not be exceeded outside of the Urban
Service Planning Area.
12. That in the Rural Area section of the Comprehensive Plan
it does state that land in agricultural a_tivity should so remair
in agricultural activity until it is no longer economical to
exclude orderly growth and development to maintain agricultural
pursuits.
13. That Meridian has, and is, experiencing a population
increase; that there are pressures on land previously used for
agricultural uses to be developed into residential subdivision
lots.
14. That the property can be serviced with City water and
sewer.
15. Ada County Highway District, the Department of Health,
the Nampa Meridian Irrigation District, Settlers Irrigation
District, City Engineer, Bureau of Reclamation and City Fire
Department submitted comments and such are incorporated herein as
if set forth in full.
16. That the R-4, Residential Dist-ict is described in the
Zoning Ordinance, 11-2-408 B. 1 as follows:

(R-4) LDW DENSITY RESIDENTIAL DISTRICT: The
purpose of the (R-4) District is to permit
the establishment of low c-- nsity single -
family dwellings, and to delineate those
areas where predominantly residential
development has, or is likely to occur in
accord with the Comprehensive Plan or the
City, and to protect the integrity of
residential areas by pronibiting the
intrusion of incompatible nurr-residential
uses. The (R-4) District allows for a
maximum of four (4) dwellings units per acre
and requires connection to the Municipal
Water and Sewer systems of the City of
Meridian.
17. That the Applicant's representative stated that
Applicants intend to tile all ditches included in the area to be
annexed as part of the development of the subdivision.
18. That proper notice was given as required by law and all
procedures before the Planning and Zoning Commission were given
and followed.
CONCLUSIONS
1. That all the procedural reeuirements of the Lal
Planning Act and of the Ordinances of the City of Meridian hav--
been met; including the mailing of notice to owners of property
within 300 feet of the external boundaries of the Applicant's
property.
2. That the City of Meridian has authority to annex land
pursuant to 50-222, Idaho Code, and Section 11-2-417 of the
Revised and Compiled Ordinances of the City of Meridian; that
exercise of the City's annexation authority is a Legislative
function.

3. That the Planning and Zoning Commission has judged this
annexation and zoning use application contained in Section 50-222;
Title 67, Chapter 65, Idaho Code, the Meridian City Ordinances,
Meridian Comprehensive Plan, as amended, and the record submitted
to it and things of which it can take judicial notice.
4. That all notice and hearing requirements set forth in
Title 67, Chapter 65, Idaho Code, and the Ordinances of the City
of Meridian have been complied with.
5. That the Commission may take judicial notice of
government ordinances, and policies, and of actual conditions
existing within the City and State.
6. That the land within the proposed annexation is
contiguous to the present City limits of the City of Meridian, and '•
the annexation would not be a shoestring annexation.
7. That the annexation application has been 'initiated by
the Applicant, with the consent of the owners, and the annexation
is not upon the initiation of the City cf Meridian.
8. That since the annexation and zoning of land is a
legislative function, the City has authority to place conditions
upon the annexation of land.
9. That the development of annexed land must meet and
comply with the Ordinances of the City of Meridian and in
particular Section 11-9-616 which pertains to development time
schedules and requirements; that the Applicant will be required
to connect to Meridian water and sewer; that the property will be
subject to Site Planning Review anlf the Subdivision and

J. Utley: The one I'm planning on is about 3400 sq. ft.. Presented picture to Commission.
Rountree: Any idea of what rental range you would be within?
J. Utley: Rental, I'm not sure. A friend has some which are not in Meridian and she
said between $450.00 and $500.00 a month.
Hepper: I see here they have single car garages, is there City Ordinances on residential
dwellings for a two car garage, does that apply to duplexes?
Clerk Niemann: As far as I know it does.
Hepper: So this would have to be changed to two car garages.
Utley: Yes I think it would accomodate it.
Hepper: It also shows a fence on just one place, are you going to fence any of the
other?
Utley: Yes. We are planning on chain link.

Roy Johnson, 9225 Chinden Blvd., was sworn by the attorney.
Johnson: I am here representing the applicant tonight. This subdivision that we are
proposing is a 352 acre parcel at the corner of Cherry Lane and Ten Mile. We have
126 lots and we are asking for a zoning of R-4, single family. We don't have any
problems with any of the comments made. Along Cherry Lane we have a twenty foot
landscape easement, and the proposal is to construct about a three foot burm with a
three to four foot fence on top of it. The pressurized irrigation system will run
along the rear lot lines.
Shearer: I was wondering about the irrigation comments -They are very concerned about
an open ditch and basically requested that it be tiled didn't they?
Johnson: Yes. There is an existing ditch that goes along parallel to Cherry Lane.
What we are going to do is move it to the north outside the right of way and leave it
as an open ditch. They don't feel this is a good idea so we will do whatever they
require.
Rountree: Questioned whether any comments were received from ACRD. You show a street
stubbed out in your preliminary plat and kind of a void between there and Sunnybrook
and the step street off of Rebecca, I suspect your going to get some indication that
that may want to be tied through that parcel at some point and time.
Johnson: That's what we anticipate.
Rountree: Is there enough distance there to provide adequate road curvature.
Johnson: Yes.
Rountree: I see some potential conflicts on Ten Mile with access in and out of that
subdivision as well as access in and out of Cherry Lane. Have you given any thought
of making that a four way intersection at that point or possibly moving that
intersection to the north?
Johnson: We are well above ACHD requirements. We have one thing that affects that and
that's the comments by the City Engineer. We have a sewer shown going through lot 16
from Ten Mile and coming over to Jubilee. The reason for that is by the time we get to
the east side of this property our sewer line is pretty shallow. By cutting accross
there we can save about a foot of drain. Explained further on sewer.
Rountree: Could you explain the type of residential area your proposing?
Johnson: Maybe Mr. Hunemiller could answer that.
Russ Hunemiller, 282 Parliment Court, Boise was sworn by the attorney.
Hunemiller: Prices of homes I'm looking at $75 on up to $100,000.00. Can you give
me a comparable neighborhood in Meridian?
Hunemiller: No I can't.

Hunemiller: I assuming right now that they will be 1200 sq. ft..
Hepper: Would that be something that you would stipulate on the plat, that they
be minimum of 1200 sq. ft., or would they be free to put in a 1,000 sq. ft. lot?
Hunemiller: No, I'd probably have nothing wrong with 1200 sq. ft..
Johnson: It would be an open subdivision, you wouldn't be the only builder right?
Hunemiller: No I won't.
Hepper: On the landscaping over on Ten Mile, what did you have in mind there?
Hunemiller: I'm not sure that on that side there will be burm. There may be an

Hepper: The property owners will be building fences right up the the sidewalk?
Hunemiller: No, we'll fence that, we've got a ten foot easement there for the
landscaping.
Hepper: Here on blk. 6, it looks like an irrigation ditch, will that all be tiled?
Hunemiller: No, I will if I have to but I'm going to try not to. We will work that
out with the irrigation.
Riddlemoser: Is there any drainage from any surrounding property that presently goes
through this property?
R. Johnson: Not that I know of.
Riddlemoser: So there's no drainage water that goes accross this property?
R. Johnson: Not that I'm aware of.
Riddlemoser: There will be no modifications of any kind will be made to any of these
irrigation facilities without the consent of Nampa Meridian or Settlers as it affects
them.
R. Johnson: That's right.
Riddlemoser: And that in the event that there is a ditch to be tiled that your plans
to tile it will be approved by Nampa Meridian or Settlers or the City Engineer of the

Rountree: What are you going to do with your storm water?
R. Johnson: There is the existing ditch and according to the comments that were
submitted by the Bureau of Reclamation we could have some water run into there
after we provided detention and both settling and skimming. A good part of it will
have to be done by drain fields.
Hepper: Do you have any lots designated for that?
R. Johnson: No, Ada County Highway District allows us to put drain fields either
adjacent to or within the right of way and we could do those every so often.
Chairman Johnson: Anyone else to testify from the public?
Clyde Brinegar, 5190 N. Locust Grove, was sworn by attorney.
Brinegar: Asked for a clarification of the Rutledge Lateral as to the impact on the
property that would be to the north. I generally support the idea.
Chairman Johnson: Explained procedures. Anyone else from the public?
Ernest Hepper, 1750 N. Ten Mile Rd., was sworn by the attorney.
Hepper: I have a couple of concerns. one is the traffic on Cherry Lane. Are there
any plans to handle the traffic?
Chairman Johnson: The Council does make recommendations when they see a traffic
problem but they have no control over the streets. We have no jurisdiction over
the streets.
Rountree: One point we might want to add is that these subdivisions on these arterial
roads are required to be a forty foot right of way from center on one side of the
road. That would be available for future expansion if needed.
Chairman Johnson: Anyone else to testify? Hearing and seeing none, I will close the
Public Hearing.

City of Meridian and the laws of the State of Idaho, that the
Planning & Zoning Commission of the City of Meridian will hold
