ITEM #3: PUBLIC HEARING: REQUEST FOR CONDITIONAL USE PERMIT BY FISCAL FUNDING
FOR APARTMENT COMPLEX:
Kingsford: At this time I will open the Public Hearing, is there anyone from the public
who would like to offer testimony on this issue.
Gary Lee, 1990 Turnberry Way, Meridian, was sworn by the attorney.
Lee: I am with JUB Engineers, we represent Fiscal Funding Company. They are the owners
of the property for which we are requesting the Conditional Use Permit for. We are
requesting a modification in the density of a portion of this property and also to
seek a Conditional Use for a new owner of the parcel. The density on the parcel
was modified and also the original concept plan was changed to better optimize the
open space. Before we had many more buildings planned for the same seven and a half
acres, two story units. This revised plan is based on two and a half story complex,
the half story being underground, which provided a much more open space to the
project. We are requesting 120 units, the maximum density is 135. We have met all the
requirements for the City. On site plan itsself we have 12,18 & 24 unit buildings,
all are two and a half story. There will be a mixture of different sizes, anywhere
from one to three bedroom or one to two bath. The square footage will vary from 700 to
1100 sq. ft. per unit. There will be a separate pressurized irrigation system. The Nine
Mile Drain contains a 100 ft. easement which we won't be able to build on, however
we are working with the U.S. Bureau of Reclamation to modify that drain, to bury a
pipeline to reconstruct the side slopes on the drain to landscape it. ACHD has reviewed
these plans and the only requirement they have is along Pine Street we'll be installing
a five foot sidewalk. (Drawings were shown to the Council)
Kingsford: Have you seem the Engineer's comments?
Lee: Yes we have and we have revised the parking.
Tolsma: They were going to put some kind of sodded road around the back side of this
for access.
Lee: What we've done on that is relocated a couple of our covered stalls to allow
access to that one side of the building. So now we do have the minimum distance required.
Giesler: How does the price range for these units compare to what was in the other
proposal?
Lee: About the same market, maybe a little less.
Kingsford: Anyone else to testify?
Gary Smith, 3917 Kootenai, Boise, was sworn by the attorney.
Smith: The maps presented to us during the Flood Plains Meeting did not include this
particular parcel of land. There have been some flood plains established and as I

understand it the establishment of the flood plains, the City has to adopt that, I
mean the City has to accept that or not. The primary causes of the flood plains are
culverts under roadways. The culvert that crosses the culvert that carries Nine Mile
Creek causes a back up. Based on what is shown on the southeast side of this development
on Nine Mile Creek, that your going to see some kind of a flood plain through this
project. They do have some restrictions that deal with heigth of floor levels concerning
that flood plain. I don't know how this will affect the project but I wanted you to
be aware of this.
Kingsford: Anyone else to offer testimony? Hearing no response, I will close the
Public Hearing.
Giesler: Regarding the pressurized irrigation, is that just going to be dry lines or
did you have a solution for when this comes on line it will be charged.
Lee: Right, it will be ready to go. I think we are going to go with a well on this
system. One thing I might say about the floor level, these particular buildings the
way they are designed, the actual floor in most cases is above natural ground, and
then we build a five foot high burm to raise the ground up artificially.

Conclusions of Law as prepared for the Planning and Zoning for Fiscal Funding for a
Conditional Use.

Roylance: Yes.
The Motion was made by Myers and seconded by Yerrington to approve the Final Plat for
Central Valley Corporate Park.

Nahas: We've sold a parcel to Pizza Hut and Chevron and McDonalds looking. We haven't
closed on it, we expect to be closing at the end of March. We are still waiting for a motel

The Special Meeting of the Meridian Planning & Zoning Commission was called to order
by Chairman Jim Johnson at 7:30 P.M.:

ITEM #1: PUBLIC HEARING: REQUEST FOR CONDITIONAL USE PERMIT FOR APARTMENT COMPLEX
BY FISCAL FUNDING, INC.:
Johnson: I will now open the Public Hearing, this is a request for a Conditional
Use Permit for apartment complex by Fiscal Funding, Inc.. Is there a representative
present who would like to come forward and address the Commission?
Gary Lee, 1990 Turnberry Way, Meridian was sworn by the Attorney.
Lee: I represent Fiscal Funding Company, the owner of the property with JUB Engineers.
Gave breif history of project. We requested a rezone to L -O (Limited Office Space)
with a PUD Concept with a Conditional Use Permit for different uses. Those uses included
Multi -family housing, child care facilities, nursing home, retirement center, mini
storage units with a planned unit development overlay. That of course was granted,
the zoning was changed annexation procedures were completed and accepted. Sometime
in September a portion of that was sold and that's what you see before you tonight.
You have the over-all site plan before you you can see where that is. The piece
that we are looking at tonight is the strip along the easterly border about 7.5 acres.
We were advised by the City Clerk that Conditional Use Permits weren't transferable
without authorization from the previous owner and a petition to the City Council.
Apparently the previous owner Equities International didn't want to grant a transfer,
so that is one of the reasons we are here before you tonight, to apply for a new
Conditional Use Permit under the new owner, Fiscal Funding and we've increased the
density on this site from 108 units to 120. The allowable on this particular use
multi -family in that zone I believe is about 135 on that 7.5 acres so we are shy of
that by quite a few units. In addition the new Concept here, the site plan before you,
was redesigned to make better use of the property. He's used a different concept in
building configuration, style, shape, and by doing so we've been able to maximize the
open space. As you can see we have quite a few more clusters of buildings than what
we show now.
Johnson: Were those original clusters one level or two?
Lee: I believe that these were two level. This particular plan is three level we
have six buildings on the site for apartments and one for recreational facility.
There will bza pool and a basketball court exterior. The building plans include one
twelve unit structure up on the Pine Street side. We have three twenty four unit
structures and two eighteens. These units will consist of one bedroom, one bath,
two bedroom, one and a quarter bath, two bedroom two bath and three bedroom two bath.
Johnson: How many three bedroom units are there?
Lee: I don't know for sure.

We'd planned to start construction this spring. We have originally planned to
start this month. We've taken bids on the site work. As soon as we get our
Conditional Use Permit straightened out we will probably start construction. The
improvements, as before we've got city water and sewer that'll traverse along the
Main road. We have two hundred forty one spaces for parking, these spaces will be
covered. I met with Ada County Highway District yesterday during their teck review
process, the only comments that they had was to have adequate separation from
our entry to 11th Street, and the addition of a five foot sidewalk on Pine Street.
We are going to provide a pressurized irrigation system for sprinklingthe entire site.
I met with US Bureau of Reclamation and the Nampa -Meridian Irrigation District on
the Nine Mile Drain and we are working on details to finish that particular design.
What we will end up with there is a piped crossing on the spine road and in addition
to that we will have smaller pipe in the open areas that we will cover and we will
develop a landscaped slope.
Johnson: What's the lighting for this project?
Lee: We are working on plans for that right now. I don't know how it's going to be.
Johnson: Was that just a minor alteration you had to make when you were a couple
parking spots short?
Lee: Yes it was.
Rountree: You show alot of common ground recreation areas, is that going to be a
responsibility of a rental association or is that going to be the owners responsibility?
Lee: There will be a Maintenance Manager on site to take care of the entire project.
Rountree: Will this be done in phases or is it going to under construction all at
once?
Lee: The original concept was to build the units north of Nine Mile Drain first.
With it scheduled they may just go ahead and build the whole thing at once, but we will
at least do the front three.
Rountree: Your concept and your illustrations show kind of an upscale kind of facility.
What kind of rental market are you looking at as far as who will be renting these.
Johnson: What's your minimum size unit?
Lee: I don't know.
Rountree: What kind of renter are you looking for?
Lee: From previous submittals they were looking at rental ranges from $350.00 to $550.00
I suppose. I don't know for sure what their market analysis shows. It will be an upscale
market.
Alidjani: Have you read what the City Engineer's comments were? One of those was that
it was two spaces short.
Lee: I talked to Eng. Smith and we have done some modifications on that plan to provide
for this. It was 241.

Alidjani: The second item listed in the comments states that the parking spaces shall be
9' wide and 19' long, for the 90 parking shall be 251,side parking lot do not have a 25'
foot one.
Lee: Right that's one of the items we corrected as well.
Alidjani: Do you have an idea of the height of the building?
Lee: I will let Don answer some of those questions.
Hepper: How about turn arounds for emergency vehicles, is there plenty of room?
Lee: Yes.
Don Gile, 2009 Rock Ridge Rd., Boise, was sworn by the attorney.
Gile: I am the architect on this project. There are three levels of units, it's
really classified as a two and a half story not a three story, with the lower level
classified as a basement although it's like a half basement. From entry level you go
down a half level and up a half level. The overall height of thebuilding is not to
different than a two story building, about 42 feet is the difference. The smallest
unit is 673 square feet and the largest is 1100 square feet. All units have outside
private decks, most of the units have walk in closets, most of them also have master
bath access. The lower units have ramp access, the corridors and the doors are sized
so that they are handicap adaptable.
Johnson: What about exterior lighting?
Gile: It will have some area lighting, like in the common area and the parking area,
it would be down lighting so it wouldn't affect any of the adjacent neighborhoods.
Johnson: How was Gary's estimate on the range of rent?
Gile: Pretty close.
Alidjani: What would be your estimation of the front elevation from the ground
to the roof?
Gile: About 20 to 23 ft..
Alidjani: Voiced concerns about fire fighting at that height. Have you spoke with
the Fire folks?
Gile: It just varily makes the 22 stories. That has already been considered.

Atty. Riddlemoser: Is there anything about the financing for this project that's going
to put any special conditions on it or the use of it?
Gile: It's just a normally financed conventional financing, not HUD subsidized or
anything like that.

Johnson: This is a Public Hearing is there anyone else that would like to address the
Commission tonight, if so please come forward. Hearing no response I will close the
Public Hearing.

the property be required to meet the water and sewer requirements, the fire and life
safety codes, and the Uniform Building Code, and other Ordinances of the City of Meridian.

FINDINGS OF FACT AND CONCLUSIONS
The above entitled matter having come on for public
hearing January 22, 1991, at the hour of 7:30 o'clock p.m., the
Petitioner appearing in person, the Planning and Zoning Commission
of the City of Meridian having duly considered the evidence and
the matter makes the following Findings of Fact and Conclusions:
FINDINGS OF FACT
1. That a notice of a public hearing on the Conditional
Use Permit was published for two (2) consecutive weeks prior to
the said public hearing scheduled for January 22, 1991, the
first publication of which was fifteen (15) days prior to said
hearing; that the matter was duly considered at the January 22,
1991, hearing; that the public was given full opportunity to
express comments and submit evidence; and that copies of all
notices were available to newspaper, radio and television stations;
2. That this property is located within the City of
Meridian and is owned by Petitioners Fiscal Funding, Inc_, and is
described in the application which description is incorporated
herein.
3. That the property is zoned Limited Office District
(L -O), which requires a conditional use permit for the construction

of Planned Unit Development, General Planned Residential which
is the use the application requests.
4. That the L -O District is described in the Zoning
Ordinance, 11-2-406 B. 5 as follows:
(L -O LIMITED OFFICE DISTRICT: The purpose of the (L -O)
District is to permit the establishment of groupings of
professional, research, executive, adminstrative, account-
ing, clerical, stenographic_, public service and similar
uses. Research uses shall not involve heavy testing
operations of any kind or product manufacturing of such
a nature to create noise, vibration or emissions of a
nature offensive to the overall purpose of this district.
The L -O District is designed to act as a buffer between
other more intense non-residential uses and high density
residential uses, and is thus a transitional use. Connec-
tion to the Municipal Water and Sewer System of the City
of Meridian is a requirement in this district.
5. That the Planned Unit Development, General Planned
Residential use proposed by Applicant is an allowed conditional
use in the L -O district.
6. That sewer and water is already available to the
property, but the use may require additional charges or fees.
7. That the Applicant did not need to submit petitions
signed by a least 750 of the people owning property within 300
feet of the property indicating their approval of the use of the
property as requested by Applicant since the property is not
zoned residential.
a. That there may be testimony submitted in opposition
to the application, and if so the Commission reserves the right
to amend these Findings.

CONCLUSIONS
1. That all the procedural requirements of the Local
Planning Act and of the Ordinances of the City of Meridian have
been met and complied with by Peitioner.
2. That the City of Meridian has authority to grant
conditional uses pursuant to 67-6512, Idaho Code, and, pursuant
to 11-2-418 of the Revised and Compiled Ordinances of the City
of Meridian; and
3. That the City of Meridian has authority to place
conditions on a conditional use permit and the use of the
property pursuant to 57-6512, Idaho Code, and pursuant to 11-2-
418(D) of the Revised and Compiled Ordinances of the City of
Meridian, Idaho;
4. That 11-2-418(C) of the Revised and Compiled
Ordinances of the City of Meridian sets forth the standards
under which the Planning and Zoning Commission and the City
Council shall review applications for Conditional Use Permits;
that upon a review of those requirements and a review of the
facts presented and the conditions of the area, the Planning and
Zoning Commission concludes as follows:
a. The use, would in fact, constitute a
conditional use and a conditional use permit
is required by ordinance.
b. The use would be harmonious with and in
accordance with the Comprehensive Plan but
the Zoning Ordinance requires a conditional
use permit to allow the use.

C. The use apparently would be designed
and constructed, to be harmonious in app-
earance with the intended character of the
general vicinity.
d. That the use would not be hazardous nor
should it be disturbing to existing or future
neighboring uses.
e. The property has sewer and water service
available.
f. The use would not create excessive addi-
tional requirements at public cost for public
facilities and services and the use would not
be detrimental to the economic welfare of the
community.
g. That sufficient parking for the property
and the proposed use will be required.
h. The use would not involve a use, activity,
process, material, equipment or conditions of
operation that would be detrimental to person,
property or the general welfare by reason of
excessive production of traffic or noise.
i. The development and uses will not result
in the destruction, loss or damage of a
natural or scenic feature of major importance.
APPROVAL OF FINDINGS OF FACT AND CONCLUSIONS
The Meridian Planning and Zoning Commission hereby adopts
and approves these Findings of Fact and Conclusions.

the property be required to meet the water and sewer requirements,

Sewer/Water Plans
Dear Gary:
The City of Meridian Public Works Department has reviewed the
plan submitted for this project and we have the following
comments:
A. Sewer
1. Provide an 8 inch diameter sewer stub to the east
property line from M.H. A-7 and plug with a marker
to ground surface.
2. Provide a recorded sanitary sewer line easement, 16
feet in width for the length of the 8" dia. sewer line.
This easement shall be recorded in favor of Meridian
City.
B. Water:
1. The existing 8" dia. water line, stubbed in from Pine
Ave., has not been flushed, pressure tested or
disinfected. It should be flushed prior to connection
with the proposed line.
2. The water valves at this entrance and at the westerly
entrance shall be raised to asphalt surface and a
concrete collar constructed around each one.
3. The fire hydrant at this projects northeast corner is
only 4" diameter, therefore, a hydrant needs to be
located just inside the Pine Street entrance.
4. By note provide that the water line shall be constructed
with a minimum 5 foot cover. This will enhance sewer
service and main line crossings.

FACTS & FINDINGS:
1. J -U -B Engineers, Inc. requests conditional use approval to construct
120 apartment units within the LO (Limited Office) zone.
2. Pine Avenue has 60 -feet of right-of-way (which is adequate), and is
improved with a 41 -foot street section without sidewalks. The street
• has new pavement. ACHD Resolution 263, Section 11, states: "Where
street surfacing has been in service five years or less, the permittee
must bore utility services. Street cuts parallel to centerline must be
approved by the District Engineer."
3. The entrance drive appears to have adequate offset from West 11th
Street intersection with Pine Avenue, but should be relocated to meet
District standards if not aligned or offset properly.
Requirements are provided to Meridian Planning & Zoning as conditions for
compliance.
SITE SPECIFIC REQUIREMENTS:
1. Provide 5 -foot wide sidewalk along Pine abutting parcel.
2. Maintain minimum required intersection offset per District Policy.
STANDARD REQUIREMENTS:
1. Site drainage plans showing that storm runoff will not flow into public
right-of-way shall be submitted for review and appropriate action by
ACRD, in compliance with Boise City Code 11-3-54 and ACHD policy.
• 2. A right-of-way permit must be obtained from ACHD for all street and
utility construction within the public right-of-way. Combine utility
cuts where practical to limit the number of pavement cuts. Contact
Quality Control at 345-7667 (with zoning file number) for details.

Dear Mr. Niemann:
Pursuant to the procedures outlined in the City of Meridian, Idaho Zoning
Ordinance, FISCAL FUNDING CO., Inc., hereby requests that a certain parcel of
land as described in the attached Conditional Use Permit Application be given
consideration for the use as requested therein.
The 7.48 acre parcel of land is situated south of West Pine Street and east of
Linder Road and is bound to the south by a Railroad Right -of -Way and is bisected
by the Nine Mile Drainage Ditch. The land is currently vacant and within the
City of Meridian LO (Limited Office) Zone. The applicant wishes to construct a
120 -unit multi -family apartment complex similar to a previously approved 108 -unit
site plan. The new 120 -unit site plan uses the parcel in a more efficient
manner. It provides for more open space and better aesthetics to result in a
more acceptable and compatible use of the parcel. In addition, the construction
of 120 units on this parcel results in a density of 2715 square feet per unit,
which is greater than the 2400 square foot minimum.
Currently, the property is not in use, and the existing buildings are vacant.
It is the intent of the owner to develop the site as shown on the enclosed Site
Plan Map. The proposed use does not violate any subdivision covenants or
restrictions, deed restrictions, or City of Meridian Zoning Ordinances.
The owners state that payment of all costs incurred by the City in processing
this Conditional Use Permit request including engineering, publication and
attorneys fees will be paid in full by FISCAL FUNDING CO., INC. In addition, the
owners will post said property one week before the scheduled hearing date in
accordance with the City of Meridian Zoning Ordinance requirements.
Included for your use and processing are the following:
1. Twenty-seven copies of the City of Meridian Application for a

DEVELOPMENT Multi -Family Apartment Complex on West Pine Street
Dear Mr. Niemann:
Pursuant to the procedures outlined in the City of Meridian, Idaho Zoning
Ordinance, FISCAL FUNDING CO., Inc., hereby requests that a certain parcel of
land, as described in the attached Conditional Use Permit Application, be given
consideration for the Amended Use as requested therein.
The 7.48 acre parcel of land is situated south of West Pine Street and east of
Linder Road and is bound to the south by a Railroad Right -of -Way and is bisected
by the Nine Mile Drainage Ditch. The land is currently vacant and within the
City of Meridian LO Zone with a General Planned Unit Development designation.
The applicant wishes to modify the multi -family apartment site plan to
accommodate a better use of the parcel. In addition, the applicant wishes to
construct 120 units on this parcel, resulting in a density of 2715 square feet
per unit.
Currently the property is not in use, and the existing buildings are vacant. It
is the intent of the owner to develop the site as shown on the enclosed Site Plan
Map. The proposed use does not violate any subdivision covenants or restric-
tions, deed restrictions, or City of Meridian Zoning Ordinances.
The owners state that payment of all costs incurred by the City in processing the
Conditional Use Permit request including engineering, publication and attorneys
fees will be paid in full by FISCAL FUNDING CO., INC. In addition, the owners
will post said property one week before the scheduled hearing date in accordance
with the City of Meridian Zoning Ordinance.
Included for your use and processing are the following:
1. Fifteen copies of the City of Meridian Application for a Conditional
Use Permit.
2. Warranty Deed & Legal Description of the Property.
3. Fifteen copies of a Vicinity Map, 1" = 300'
4. A listing of adjacent property owners within 300 feet.

CONTENTS OF CONDITIONAL USE APPLICATION
An application for a Conditional Use Permit shall be filed
with the Administrator by at least one (1) owner or lessee
of property for which such conditional use is proposed. At
a minimum, the application shall contain the following information
where applicable. (Application available from Administrator):
1. Name, address and phone number of applicant;
2. Name, address and phone number of owner of subject property;
3. Legal description of property;
4. Proof of ownership of subject property;
5. Description of existing use;
6. Present use of subject property;
7. Proposed use of the subject property;
8. Twenty-five (25) copies of a vicinity map of a scale of
one (1) inch equals three hundred (300) feet;
9. Characteristics of subject property which make a conditional
use desirable;
10. A listing of the mailing addresses of all property owners
(from authentic tax records of Ada County) who are within
three hundred (300) feet of the external boundaries of
the land being considered, and a list of all owners within
the area being considered for a Conditional Use;
11. In Residential Zoning a petition signed by three-fourths
(3/4) or seventy-five percent (75%) of all those persons
owning property within said three hundred (300) feet approving
of the Conditional Use, and a petition signed by one hundred
percent (100%) of all landowners within the area being
considered showing their approval of the proposed Conditional
Use; Does not apply to Old Town Zoning,Commercial or Industrial
Zoning.
12. A fee established by the Council; (See 2-422 A) $160.00
13. A statement that the owner grants a lien against said property
for payment of all costs incurred by the City including engineer-
ing, publication and attorney fees.
14. A statement that the proposed use does or does not violate any
subdivision covenants or restrictions or deed restrictions.
15. The property will be posted 1 week before hearing stating they
have applied for a Conditional Use Permit or Zoning. There must
be a signed affidavit that this has been done as part of the
application.
HEARING PROCEDURES FOR CONDITIONAL USE PERMIT
1. The Applicant shall:
a. Give notice of the hearing, at least fifteen (15) days prior to the
hearing, be certified mail to property owners within the land being
considered and to owners within 300 feet of the external boundaries
of the land being considered. Said notice of certified mail must be
deposited with the United States Post Office at least 15 days prior
to the hearing. Said notice shall contain a vincinity map of the
property, a brief statement of the nature of the application, the
name and address of the applicant.
b. Provide the City Clerk with the names and addresses of property owners
notified, a notarized statement of compliance and a copy of the
notification.
2. The Commission Shall:
a. Conduct at least one public hearing at which interested persons will
have the opportunity to be heard. At least 15 days prior to hearing
notice of the time and place shall be published in newspaper.
b. Within 45 days after hearing the Commission, shall transmit its
recommendation to the Council with supporative reasons, the Commend
shall recommend the application be approved, approved with conditions
or denied. The Commission shall insure that any approval is in
accordance with the Comp. Plan, this Ordinance and State Law.
3. The Council:
a. The Council shall conduct one public hearing after notice requirements
as above.
b. After hearing the Council shall approve, approve with conditions or
deny, with supportive reasons.
c. A Conditional Use Permit in the old town district only requires a public
hearing before the P & Z Commission and then is passed on to the Council
with the recommendation at which time the Council may approve, deny or
modify the recommendation of the Commission.
4. FOR APPLICAN'T'S INFORMATION:
Additional water and sewer hookup fees could be required as part of the
approval of the conditional use permit.
PETITION REQUIREMENTS:
1. Petitioner must supply a comprehensive list of ALL residences within 300 feet
from the proposed Conditional Use property line to include Name, Address,
Telephone and Date.
2. Supply 20 copies of all required materials.
3. Three-fourths (75%) of those persons owning property within 300 feet must
agree to this Conditional Use before the proposed use will be considered.

Pursuant to the procedures outlined in the City of Meridian, Idaho Zoning
Ordinance, Section 2-418, paragraph J, and on behalf of the new property
owner, we do hereby petition the City Council to transfer said conditional use
permit from EQUITIES INTERNATIONAL, Inc., to FISCAL FUNDING CO., INC.
As discussed during the Dec. 18, 1990 City Council meeting, the new owners
would proceed with the development next spring when the transfer is granted.
It is anticipated that construction on site improvements could commence as
soon as mid-January, 1991.
For your use, and distribution to the Council for their use, during the public
hearing is the following information:
1. A letter dated December 6, 1990, from the new property owner, Fiscal
Funding Co., Inc., requesting the City to hear the petition.
2. A 1 "= 300' Vicinity Map showing the proposed development.
3. A list of surrounding property owners within 300 feet of the proposed
development.
4. A copy of a warranty deed dated September 12, 1990, transferring owner-

housing as part of an overall mixed use development. The parcel which I am requesting name
change is for the 7.5 acres of Lot 3. The plan for developing these 7.5 acres is consistent with
the previously approved use and is intended to be connected with the remaining 21 acres when
developed by others.

You have been previously notified by the City Clerk, of the
City of Meridian, that the property you own in the City of Meridian
on Pine Street has a weed problem and that that will be cleaned up
by the City since you have not done so. Also, the City Clerk
informed you that you have a house on the property which is
dilapidate and a fire hazard. The City Clerk has previously
informed you that the City will either remove the house, or burn
Oit, to remove it since it is a nuisance and an unsafe structure.
The Ordinances of the City of Meridian provide as follows:
"6-105 REMOVAL OF, OR REPAIR OF UNSAFE BUILDINGS: A building
or structure or part thereof that may, or shall at any time
become dangerous or unsafe, shall, unless made safe and secure
be taken and removed."
Pursuant to the above section unless the structure is removed
the City of Meridian will remove it which may entail the burning
of the structure, since it is in a dilapidate condition and is
unsafe. If response to this letter is not made within ten (10)
days of the receipt thereof the City of Meridian will take action
to remove the structure or burn it.
As previously stated in correspondence from the City Clerk the
costs of this removal or burning will be assessed to your real
property taxes.

now where we proceed from here. They did pay for cleaning the
weeds up. We are going to have to have a environmental deal done
before we can tear it down or burn it or anything else.
Corrie: Can't we condemn that?
Niemann: We wrote them a letter but they haven't answered.
Kingsford: Can we have our Fire Marshal condemn it.
Corrie: It has to be done by the Building Inspector.

and is opposed by Leon Swaggart for that board seat.

FACTS & FINDINGS:
1. J -U -B Engineers, Inc. requests conditional use approval to construct
120 apartment units within the LO (Limited Office) zone.
2. Pine Avenue has 60 -feet of right-of-way (which is adequate), and is
improved with a 41 -foot street section without sidewalks. The street
has new pavement. ACHD Resolution 263, Section 11, states: "Where

3. The entrance drive appears to have adequate offset from West 11th

utility construction within the public right-of-way. Combine utility

RE: REQUEST FOR TRANSFER OF CONDITIONAL USE PERMIT TO
EQUITIES INTERNATIONAL, INC.
Dear Mayor and Council:
r I have been requested for an opinion as to the validity of the
request for transfer of a Conditional Use Permit to Equities
International, Inc., of a permit..issued on August 21, 1990, to
New Concept Developers, Inc., covering a portion of lot 3 of
West ;awn Subdivision to Meridian.
The facts stated to me are as follows:
The property was formerly owned by Roger E. Jeppesen and Ray M.
Jeppesen, husband and wife, who also do business in the corpor-
ate name of Equities International, Inc. An application for
Conditional Use Permit covering said property was applied for
by New Concept Developers, Inc., and after the necessary hearings,
a Conditional Use Permit was issued in the name of New Concept
Developers, Inc., covering the subject property. In September,
1990, the property was sold to Fiscal Funding Co.., Inc., and an
application for transfer of said Conditional Use Permit to Fiscal
Funding Co., Inc., has been filed with the Council.
A Conditional Use Permit does not transfer with a change in
ownership of the property. Section 2-418(2) of the Zoning
Ordinance sets forth the requirements for transfer of the permit.
This provides, in effect, that the permit can be transferred to
the new owner only by petitioning the City Council who shall hold
a public hearing after the required notice therein has been given.

I have also been advised that there has been no consent to the
transfer of this permit•by.New Concept Developers, Inc., the
party to which the permit was issued.' New Concept Developers,
Inc., is obviously a corporate party working with the original
owner on the property. Basic law dictates that the permit
holder must give its consent to the transfer. Therefore, until
the consent of the permit holder has been filed with the Council,
this matter is not properly before the Council for any further
action regarding this transfer.
In this case, the issuance of.the Conditional Use Permit to a
party other than the owner gives me a little concern as to such
practice. Section 2-403 of the Zoning Ordinance defines owner
as the person or entity having the ownership of record in the
property. Section 2-418 of the Zoning Ordinance is discussing
transfers of the permits, transfers from old owners to new owners
or old occupants to new occupants. Since both sections refer
to owners, it is my opinion that,the conditional use permit should
be issued to the owners of.the property even though applied for
by some agent.,

buildings if we find we don't have that reach we would be thinking in terms of
concrete blocks that the grass grows through, I really believe that we accomplish
that reach alright.

Tolsma: That was a concern that the Chief had, the fact that if they did move the
garages away from there or put the driveway back in there just to make sure that we
get the 150 ft..
Gile: We could do that, no problem.
Giesler: I just would comment that it looks like a very nice project, and I
compliment the individuals that are trying to put this together.
Lee: There is two parts to the request, one is transfer of ownership of the
property on the Conditional Use Permit, the second is to increase from 108 units to
120.
Kingsford: As I look at the Ordinance I think it would be out of place to look
at doing those jointly. We need to look at the transfer then grant an increase,
it could be in the same meeting of course.
Crookston: We really don't have_a procedure short of going through the whole
process again. I think -we need to have one but --we don't have one now. To change
the Conditional Use is would have to go back to the P & Z and start again. To do
the transfer the Council can vote.
Kingsford: What's your time frame?
Gile: Early Spring.
Kingsford: We did have some criticism of having that high:of a density.originally
in that approval.
Gile: As we have stated t*e._road configuration is going to stay the same.
It wouldn't change with either the 108 or the 120. My question would be do we rpn
any risk of loosing the 108 Conditional Use if its reheard?
Crookston: We don't really have a procedure for amending the Conditions for a
Conditional Use. I'd hate to see the Council go ahead without taking any
precautions and then one of the people that had concerns in the first place
come back and say well your in violation of your own Conditional Use because
you exceeded the allowed density. As I forsee it to change the density you would
have to go back to the start.
Kingsford: So if I read you right your recommending that the City have three
Public Hearings. The next step would be for you to contact Jack to schedule those
Hearings.

Bowman: It's life span is pretty well exhausted.
Pete Michaelson: We are in the process of setting up an advisory board of
mechanics and station owners. The Board is going to go through some.�changes4
those of us that are staying are sure that we will not institute a change
without working it out with the advisory board.

ITEM #3: GARY LEE, JUB ENGINEERS: REPRESENTING FISCAL FUNDING CO., INC., ON
PINE BLUFFS APARTMENT PROJECT.
Gary Lee: As you are aware we delivered a letter to the Council last week concerning
a couple items on the Pine Bluffs Apartment Complex. As the project started out
New Concepts Developers was the developer and the owner of the project site. A
portion of it was designated as Multi Family, since that time and since the
Conditional Use Permit was issued and the zoning was approved there was a transfer
of ownership on a portion of the property. That is the first part of the request,
and that request being a transfer of ownership on the Conditional Use Permit for that
Multi Family Apartment Complex. The second part is to increase the density on that
particular project site from 108 units to 120. We are here tonight to present the
situation to you and ask for your cooperation. I do have with me tonight,. Don Gile
who is the Architect on the project, he has a few drawings to show.
