A meeting of the Meridian City Council was called to order at 7:14 p.m., Tuesday, ~ `
September 1, 2009, by`Mayor Tammy de Weerd. •

De Weerd: I'd like to welcome everyone to our City Council meeting and apologize for
our late start, but we appreciate you being here this evening. ,For the record, it is
Tuesday, September 1st, 2009. It's 7:14. I will ask for roll call attendance, Madam

De Weerd: Item No. 3 is our community invocation. Tonight we will be led by retired
pastor Burton Roberts with the Meridian Gospel Tabernacle. If you will all join us in the
community invocation or take this as an opportunity for a moment of reflection. Pastor,
thank you for being here with us.
Roberts: And thank you, Madam Mayor. We are always, pleased to be here. I was
sitting here a moment ago thinking about how proud my father would be of this building.
He was such. a long time resident of this city and always was so much a part of it, that
just found myself thinking back and going, wow, dad, you should be able to see where
we are now. So, with -that kind of thankfulness in my heart, let us pray. Our most
gracious and kind Heavenly Father, we are, indeed, thankful for your many blessings. ,
In times like these we need to remember and realize how far you. have led your people
and how much we still need your constant guidance in our lives. Tonight, Father, we,

Item 9: Public Hearing: ZOA 09-002 Request to amend the standards for
temporary signs listed in UDC 11-3D=6A.6 to allow an increase in the
amount of time a temporary sign may be displayed from 90 days to a
maximum of 180 days for UDC Text Amendment -Temporary Signs by
City of Meridian Planning~Department:
De Weerd: So, we are at Item 9, the public hearing for ZOA 09-002. I will open this
public hearing with staff comments. ~ ~ ,
Canning: Thank you, Madam Mayor. This ~is our code amendment for temporary signs
and it would apply citywide. The Planning Department has initiated'the text amendment
to increase the display time of temporary signs from 90 days~to 180 days and as you.
may recall, we spoke to Council. before we initiated this text amendment. The new
standards are on an interim basis, as city staff is in the process of rewriting the entire
sign code and. the ~ temporary sign standards will be reviewed in a `future zoning
ordinance amendment later this year. We hope to adopt that new sign ordinance before
the beginning of the year. The Commission has recommended denial at their August 6,
2009, public hearing. The Planning Department spoke in .favor of the text amendment,
but there was no one in opposition, commenting, or providing written testimony. The
key issues of discussion by the Commission were the time frames for the adoption of
the new sign ordinance, anticipating, again, a late December adoption date. The
temporary sign requirements proposed in the new sign ordinance and the current
temporary sign standards -- and by that we are looking at allowing more permanent
signs to reduce the need for temporary signs in the new ordinance. And the impact
from the community and the business if the display times are increased. And there was
also discussion -about the effectiveness of temporary:. signs with regard to.-- if they are
up too long they lose their effectiveness is what the- Commission stated -- or one
member of the Commission. So, the key Commission changes to staff;,recommendation
-- they did recommend denial of the zoning ordinance amendment. So, that is the -- the
outstanding issue before Council. As I said before, there was no one at the.. Planning
and Zoning Commission hearing. We have tried to get the word out a little better and I
think you will find that there are some folks here to testify tonight in support of the text
amendment. And with that I will answer any questions that Mayor or Council may have.

De Weerd: Okay. This is a public hearing. Is there anyone who would like to provide
testimony on this .item? Please come forward. If you will, please, state your name and

Reitz: My name is Kathy Reitz. ~I live at 12374 West Goldenrod is Boise and I own
Renewed Expressions Consignment Boutique in Meridian.
De Weerd: Thank you.
Reitz: Okay. My business is located at the intersection of Cherry Lane and Linder,
across the street from Pizza Hut. I would like to state that it's been a rough year and' a
half. M'y business is four years old next .month and I have advertised via the Money
Mailer Mag -- mailers. The Book of Good Deals. Radio. Cable television. And
consistently for the last year in the Hometown Values.. This ad -- this half page ad right
here cost me approximately 600 dollars every time I run it and it reaches about 50,000
people. I generally get about 15 to 20 new customers every time it's run. I found out
about the Marquee signs with the fluorescent letters about a year and a half ago and
have utilized it my three months out the year for the past two years. It's hands down my
number one advertising avenue. I get probably five to ten new customers a week off of
it and, basically, what it does is it gives me the ability to change out what I say omit.
Because I'm consignment I'm always advertising to get new consigners, as well as new
customers. ft's also important in that when we publish this kind of thing, when we do
radio, television, sometimes signage will just cause people to connect. all the dots and
they will realize, oh, that's the place that I heard the ad on or whatever. I ask my
customers how they find me and most of them tell me it's either via a friend
recommending them to.my store or off of my signage and I would say that one of the
cha{fenges for the businesses, especially on the west side of Meridian, is that a lot of
people are coming down the main corridors, like Linder, Meridian Road, Locust Grove,
and they are taking a left and they are headed east to do their business rather than
west. So, I'm sitting on the west side, which is a challenge. I'm sitting, basically, a mile
between the two Albertson's, so .it's been an advantage for me in that I'm right ~on the
edge of a subdivision and people will spot that sign before they will see the'sign on my
building. So, I am requesting that you would change the sign ordinances from three
months to six months. It would absolutely help my business no question. Any

Thomas: Good evening. I'm Rick Thomas. I live in Meridian off of Black Cat on,2463
North O'Conner and I own a business on 950 East Fairview. We have been open about
four month's now and we have taken advantage of the Marquee signs that Kathy was
just speaking of. Unfortunately, we don't own the building that we currently occupy. We
are right next to Hastings and if everybodyRhas driven by Hastings, they have a nice big
road .Marquee sign that says Hastings on it. They have the ability to put different
promotions and whatnot on that sign. The owner of our building has said at some point
when he has enough tenants in that building he would be willing to do something similar
,
to 'the Hastings building, but at the current economy I don't see that happening anytime
`' in the near future. We poll, since we are a new business, almost every single person
that comes in our doors and radio'-- haven't done any TV, but flyers, word of mouth,
hands down -- seven out of ten people that we poll say the sign that is on Fairview that
we put up and change weekly, bi-weekly, that the fluorescent letters is virhat~pulls them
into our store. We sit back from Fairview. We cannot afford ourselves to put up a
'permanent fixture sign, which is allowed to do, like Banner Bank has right in our same
parking lot and at Smoky Mountain. So, changing the ordinance to extend the -- from
the 90 days to 180 days would benefit a business like ours. Not only that,~the city's
getting money for the signage that we put out there as far as permits and whatnot, 'so I
know the city could use the extra revenue. I see more of a problem with yard sales and
garage sale signage than respectable, nice signs that are changed out from time to time
and I'd really appreciate it if somebody would really think long and hard about doing
`something -- maybe for just a temporary period, but it really benefit's small businesses
like ours and we don't want to go out- of business and if we stay in business more
revenue for the city. So, that's about all I got, if anybody has any questions.

De Weerd: Jonathan Seal signed up for. Good evening:
Seal: Good evening, Mayor and Council Members. ?My name is Jonathan Seal. I'work
for the W.H. Moore Company, 1940 Bonito. I'm here on behalf of, obviously, the W:H.
Moore. Company and so many of her tenants. I think, .you .know, recently you waived

the fire and the ,police impact fees and I think there is a recognition on the part; I would
assume, of the Council and the Mayor that developers out there are. struggling, that was
to encourage them to bring business to the community. We are seeing the same thing
with retailers out there. I think that several of these individuals have already spoke. It's
a real struggle out there for them. We see them on a fairly consistent basis coming,in,.
asking that the rent be reduced, that there be some forgiveness for things. A lot of them
are really struggling out there and some of them are hanging only by their fingertips. I
know that temporary signs are not an attractive thing. l personally don't like to see them
either. I know we have them in Centre Point, for example, and, personally,,they are not°~
attractive, but I would point out that I think they are less -- or they are not as unattractive
is driving by and seeing empty buildings and that's what you're going to be faced with.
There is a real struggle out here. So, I understand it's on a temporary basis and I would
strongly encourage you to do it, because I think it's critical to these. Whether--- how
long it's=,effective -- I heard a comment about -- with P&Z how effective it is. I can't
speRak to that. ~ But I do know that it is very effective; it's very. important, they need- that,
and~it may be the difference between staying in business and closing down. So; I think
it becomes the lesser of two evils. So, I would .encourage you, I -think it's -- I appreciate
the fact that you have been able to take this. into consideration and pass this tonight;-
because it is highly important, I think, to many of the .tenants and, obviously, the
businesses. in the community. Thank you. ,,

Long: And originally I signed up .just because i thought it was asign-in sheet. But,
actually, we are here with our scout LLtroop and -- but after listening to the business
owners I come before you as a consumer of products and services and seeing signage
going down~the road, I believe that the longer, you know,~the signage is out there -=
have seen a lot" of these neon signs, they have drawn me into businesses, small
businesses especially. I like -- I like to -- I'm always kind of a -- I'm an entrepreneur at
heart, so I understand how these businesses struggle in an economy like this, so seeing
something like this, you know, -from 90 to 180 days, especially in an economy like this,
as a consumer I think it's beneficial for the small business of Meridian and' this
community and I believe that if you pass this it will help the small businesses, not only
for them, but also the community`and the city. So, that's all I have.

Hull: Hi. I'm Eric Hull. I° live at 7280 Hidden Valley Drive, Boise. I own Sam's Toybox.
De Weerd: Thank you.
Hull: And, you know, we -- we did the 90 day sign thing' during Christmas, obviously,
because we were brand new, and so we were waiting until this. next season to do it
again. But at that time what we saw is -- you know, we spent a ton. of money on
advertising, radio, we had some T,V, we had a lot of print, and we got more people off of
q our signs that were going to Winco, because we are. located in the Central Park
Shopping Center over there by Winco. So, you got the Panda Express on one end, but,
° then, you can't see us down at the other end, because of the angle of the building. And
so when we had our signs out -- we are small enough and we are -- you know, we are
slow enough that I talk to everybody that comes through and I have charted it, where
everybody hears about us, and even when ~we were spending all the money on
advertising, even during. the Christmas season back then, eight,out of every ten people'
-- it was 81 percent. So, basically, eight out of ten, came in because of the signs and
.because we are set back a little way,and so it was really helpful. for us to get people in.
I know for us it would be a great help to be able to have the signs up longer and maybe
through different parts of tFie year. So, I -- I really-- any.questions?

Rountree: Just a comment. You have go`t great toys.
De Weerd: And you do .good advertising. I know about you, not because of your sign,
so --
Hull: Trying to get people in.

Boothe: Todd Boothe. I live at 13924 West Daimler Court in Boise. With RC Willeys.
And we definitely buy a lot of permits for signage from you guys. So, totally in favor of
adding -- get it to 180 days ~ For what we do, we have a lot of advertising, as you guys
know, and things change quite a bit. When we do print advertising we put it in three
months before, sometimes two months, and by the time things change. Our mattress
prices adjust, they go down, and what we do is we have -- they keep coming to our
°' entrance. We have ..pillars there that we hang a banner on and we alert people with

special deals that we are going that weren't -- we can't let them know with a TV ad we
did three months before, because it could be that 300 dollar reduction on something.
And so we had tracked it and we have had mattress,sales jump 200,000, you know;=in a
week because of that type of a sign. I feel like they are very professional. We are not,
you know, running up and down the street with things. One -thing is our events are
usually a week long and so with the permits right now you have to give them in two
week inter -- you know, intervals. So, really, we get six opportunities a year to do signs
and this would help us quite a bit, take us to 13, and it does help businesses. I know
that I'm° not a small business, but we still are local, we have 235 local employees and it
does affect our business and it keeps, you know, money in people's pockets and Helps
the economy. So~, as long as it's professional, I feel like the sign is professional,l think it
-- it's okay. {think there is some ratty signs out there. I think that's something we .need
to be concerned with, but -- anyway, I think it's a good thing. Also, I -- when they had
further hearings on this I Piave some other great ideas for this and I don't mind paying
the fees. I think it's a great sign. But, again, I think the main thing is keeping if
professional and keep people in' business, so --
De Weerd: Well, great. Well, we will look for your comments as we move forward with
permanent sign changes. So, thank you for being here. ,, „

De Weerd: You piqued her interest with your further comments. Those are the names
that have signed up. Is there anyone else who would like to provide testimony on this

Zaremba: Not really a question, just a comment: May take away from what I believe
the Planning andZoning Commission was saying is they -- they didn't feel the necessity
to change a rule that was going to change in less than six months anyhow. And I
understand that. I will also have to say as a former small business owner many, many
years ago in another city -- the on-site signage is the biggest draw of all the things that
you could`spend money on and at a time when our economy is suffering, I'd be very

happy to cut some of our businesses some slack and make this change, even if we are
~ going to revise the whole ordinance sequence.

Hoaglun: Madam Mayor?
De Weerd: Mr. Hoaglun.
Hoaglun: Just a quick" comment. I read the Planning and Zoning minutes on this
hearing and the comments -- one commissioner talked about, you know, if the signs are
up too long, temporary signs, they lose their effectiveness and from a marketing
standpoint there is some validity to that where they put a "sign up there and they expect
to drive their traffic and they don't change the sign. That's true. But at.,the same time,
.when you`-hear business people like -- I think it was Kathy mentioned, hers is part of a
marketing program or strategy. She does advertising in some publications, she uses her
sign to draw attention to her business, she changes the sign out, that's -- that changes
the dynamics quite a bit and it's not just something that's thrown up there, never
changed, and the visual element is lost,. because it's always there and people don't see
it. So, I think there is a difference to using signs as a marketing tool and smart business
owners do that and that's what they need to do and especially in this economy. You-
" know, the comment about ratty signs, yes, I hope our sign ordinance looks at that.
When we do-the permanent one we don't want to have wars, we want to have standards
that look nice; they are professional, that they can be used and; you know, I don't want
to get into the wars where someone has afour-by-eight, well, you have afour-by-eight,
I'm going to go eight-by-ten and off we go and -- because that doesn't do anybody any
good. But I think there is a place for signage in our city to drive business; drive traffic to
businesses and I think something like this will certainly help.

Rountree: Madam.Mayor, I do support this and I appreciate the comments we have
heard tonight. "A lot of them ring true to things that are both a concern about temporary
signage, as well as concerns about the importance of temporary signage. My only
hesitancy is that we are in the process of doing our signing ordinances, so, hopefully,
this doesn't build some sense of false expectation. I don't know where it's going to go,
but itmight go someplace different. But I do support it and I appreciate the folks-that
came out and talked this evening and your points did resonate.

Church, Incorporated, for annexation of a parcel of land in the northeast one quarter of
the northeast one quarter of Section 30, Township 4 North, ,Range 1 East, Boise
Meridian, Ada County, Idaho, as described in Attachment A_ and annexing certain lands
and territory situated in Ada County, Idaho, and- adjacent and contiguous, to the
corporate limits of the `City of Meridian, as requested by the City_ of Meridian,
establishing and determining the land use zoning classification of said lands from RUT,
Ada County, to R-8, Medium Density Residential District, in the Meridian City Code,
providing that copies of this ordinance shall be filed with the Ada County assessor, the

'This Task Order is issued. by City and accepted by the Consultant pursuant to the
mutual promises, covenants and conditions contained in the Master Services
Agreement between the above named parties, dated January 24,x2007.

The City of Meridian has been allocated $608,800 by the Department of Energy
(DOE) through the Energy Efficiency and Conservation Block Grant (EECBG) '
. and is determined to step forth as a leader in, improved energy efficiency and
conservation measures at the local government level. This effort will~enhance the .
City's position through:
^ The more efficient use of fiscal and physical resources related to the
provision of City. services and operation and maintenance of facilities.
^ Energy conservation strategies and renewable energy programs:
• Incentives to attract. the right type of businesses and emerging technology
employers that_produce living wage~jobs.and to reduce local carbon ,
emissions. °~
In order to address these goals and comply with the DOE requirements for #~
., creating an Energy Efficiency and Conservation Strategy that outlines the City's x
plans for an energy efficient future, the City of Meridian desires to contract with
HDR Engineering, Inc to perform the following tasks:
(Note these tasks will not be initiated until Grant funding is received by the City
~' as allowed under the EECBG formula grant program) ,

Identification of policy objectives and potential projects.to comprise a~-City
of Meridian Energy.Strategy.
' HDR will assist city staff in,indentifying`objectives for an ongoing energy strategy
that would assist city co_uricil in project and program prioritization. HDR will
facilitate a brainstorming session with city staff and key stakeholders to identify a ,
wide array of potential projects for high level assessment.

The City of Meridian will coordinate brainstorming session and invite appropriate
stakeholders. The session will last 3 hours and up to 3~ HDR staff will. attend.

Preliminary=high level assessment of potential projects.
HDR will conduct a preliminary assessment of the potential projects and
programs based on the main criteria developed by the US.Department of Energy
and the objectives identified by the City in task 1.
Deliverables
Draft and Final Projects Matrix (excel) with High -Medium -Low scoring
Assumptions
Up to 25 potential projects will be assessed.
One 2 hour meeting (3 HDR staff) will be conducted for matrix review.
Two draft submittals will be sent to the City for review before final matrix is
created. The City will compile all comments from different departments and
stakeholders and send to HDR for revisions.
Task 3
Presentation of objectives and potential projects and programs to-City
Council for inclusion in the Energy Efficiency and Conservation Strategy
(EEGs).

RE: Temporary Signs -UDC Text Amendment
In response to several requests from city business owners who are having difficulties in the
current economic climate, the City of Meridian Planning Department is requesting an amendment
to the standards for temporary signs listed in UDC 11-3D-6A.6. The amendment proposes an
increase in the amount of time a temporary sign may be displayed from 90 days to a maximum of
180 days as follows: (proposed changes shown in strikeout and underline format)
6. The following additional standards shall apply to temporary signs that require a permit as
set forth in subsection C of this section:
a. A temporary sign permit may be obtained through the planning department for fifteen
(15), thirty (30), sixty (60), or ninety (90) day time periods.
(1) In no instance shall a temporary sign requiring a permit be displayed for more
than rrirtet~(99-} one hundred eighty (1801 days per year per business.
(2) A permit must be obtained for every new temporary sign to be displayed.
(3) If a permitted sign is removed for any portion of the permitted time period, the
time shall be forfeited and shall not accrue or be added to the allowable display
period for a temporary sign. , '

b. The temporary sign permit shall be attached to the approved'sign so that it is visible
from the nearest public right of way.
c. All signs to be placed on private property shall obtain the written consent of the
property owner and file that consent with the planning department prior to issuance
of a permit.

Moe: Next item on the agenda is the public hearing of ZOA 09-002 for the UDC Text
Amendment For Temporary Signage by the City of Meridian Planning Department.
And, please, go forward.
Friedman: Thank you, Mr. Chair, Commissioners. As `Mr. Chairman indicated, this is a
zoning text amendment by the Planning Department to amend the UDC to extend the
* time that temporary signs maybe erected. As you know, we have a limitation right now
on 90 days per year., The proposal is to increase that to 180 days per year. But,
however, this is ,seen as an interim measure. By way of background, the whole
temporary sign timing thing has been creating a number of challenges for code`
enforcement given the current economic atmosphere. Some of "our -- more than one or
two of our business owners -- many business owners are feeling that they really are
feeling constrained by the 90 day time limit -.and we have had an increase in code
enforcement activity. Those concerns have been communicated to the city at all levels.
We met with the City Council to discuss a couple options. One being, you know,

eliminate the time period all together, although we indicated that would be -- kind of a
tough Genie to get back in the bottle once we eliminated it. Another one was to just
x. double' the time that they could be allowed. Staff and the .city, attorney's office have
been working on an entire new sign code. They have completed or. almost have
completed -the draft. Right now the thought, is that they are. going to get that draft
completed, assemble an advisory committee. That draft code -- and hopefully have it to
you for your consideration -- I believe the time line would probably be around October or
November, with the goal of getting it to City Council in November -= December, with
adoption at the end of the year. All signs would be discussed and reviewed in that code
and Idon't know'--,I can't answer what thoughts have gone into,temporary signs and so
forth, but they will be addressed in one manner or another.T So, really, this is seen as an
interim measure. that would probabJly stay in effect until the new. sign code is adopted`at
the end of the year. So, with that staff is recommending approval of this text
amendment and I'd be happy to answer any questions. ,°

Marshall: Mr. Chair? Pete, I assume, #hough, then --.:.and I think I have this correct --'is
that the new sign. amendment that would. be seen in October, November would
supercede what we are talking about tonight?

in effect -- this amendment, if adopted by the City Council, would stay in effect until
some- other code provision replaces it. r
Marshall: Got you. - .
Friedman: So -- and our anticipation is that -- or at least our goal is to have Council
action on a new code by the end of this year. By the end of December.

Moe: You've still got the floor, sir:
Marshall: Having a degree in business management I fully understand the power of
advertising. When economic times are difficult, as they as now, `the need to advertise is
even more important.. All of us are impacted by this economic down turn°and wanting to
see. our local businesses succeed. I want to do everything in my power to help them.
That being said, I want to consider what the city can do to help local businesses attract
customers. Where. the main goals of the Planning and Zoning Commission is to help
guide development in a manner that provides a safe and attractive environment that
people want to frequent, temporary signs are, temporary for a reason. They do not
replace permanent signage. I have never met anyone that has called them attractive.
In fact, I have met -many people who called them a blight or an eye sore. They are
intended to draw attention. If they ..did not, no one would use them. Rather than
banning therrm, I feel the city has correctly allowed their use~on a temporary basis. This

allows special sales, advertisements, and one-time offerings to catch people's attention
a's they drive past an establishment. They ;alert potential customers that some --
something special is coming or currently underway. These limits also keep the eye sore
.or blight in check, creating a more attractive streetscape that consumers want to
frequent. Having taken numerous classes in advertising, I am aware that humans tend
to take notice of the new and unusual. Our brains are-hard wired to evaluate everything
in front'of us and anything that is common or common place or seen again and again, is
given'_ a lower priority for our brain to evaluate. Therefore, things that are new and
changing go to the forefront and a higher priority in the brain. `It is this fact that helps
make temporary signage useful. It is not always there. We take notice when it is:
Increasing the time limit for temporary signage decreases its effectiveness. If every
single business were to take advantage of the 180 day limit for temporary signs, we
would have a temporary sign in front of every other business on 'the street. Maybe I'm a
slow reader, but'while driving I cannot read that many signs and.. still. be able to drive. If
there is an occasional sign that catches my attention, I will read it. When there are a
whole bunch of signs close together, I get information overload and I do not read any of
them. 1f I even try, I know I'm going to run into something. I worry about the person

behind .me trying to read them all. Personally, I believe increasing the time limit on
temporary signs on the surface seems like a good thing for business, which I want to
'support any way I can. When looking at it holistically, I believe it decreases their
effectiveness, creates a less attractive streetscape, which, , in turn, decreases --
decreases the propensity for consumers to visit the area and the decreases traffic
safety. It is for these reasons I'm against increasing the time limits on temporary signs.
`On.the whole I do not think it's a good idea for businesses°or the~city.

O'Brien: Mr. Chair?

O'Brien: ~ My thought was, in looking- at this situation, is that I -- I agree that 180 days is
u ' too long. I -- if it would. make any sense to have a business renew or have it previewed
as an extension past 90 days to 1.80, I think it would be -- it would serve best if -- if that
business would review it again with the Planning Department and whoever .and get an
extension pass for 90 days, instead of just automatically putting it out a 180. I'm againsf
that overall number.
Marshall: If I -- if I understand this correct, a business can come in and apply for five
day, ten day, 15 day, 30 day permits, up for a maximum of 90 days for the entire year:
If I were a business owner I would only want to put temporary ~ ignage out five to ten
days,at maximum, take it down for longer than that and, then, put' it back up. Otherwise,
people see it on a daily basis and they stop reading it. Their brain just puts it at a lower
priority. But they can go up to a maximum of 90 days over~the entire course of the year.
One, fiundred~ and eighty days is every other day or half the year and if every business
took advantage of it and in these times I think everybody should take advantage of

.temporary signage when they can,=need every opportunity to advertise that you can. If
they do than much, every other business- would have~'something out all the time.

Friedman: Mr. Chairman; Commissioners; just a point of clarification and I'think you hit
on it already, Commissioner Marshall. Right now the code allows for -- even with a 90
day limitation -- annual limitation for allowing temporary signs to be'up for intervals of
15, 30, 60 or 80 days. Now, those businesses that avail -- we have had' some that
come in and just take, out one permit for the 90_days. And, then, the 90 days elapses
-and that's it. We have others that will .come in and take them out for ~15 days or 30 days
and; then,,they will go fallow for awhile and, then, they will come back and get in it, but
.it's a new permit every time. And,. yeah, it's been interesting, because Ihave- had calls
from people who have taken their 90 days permit,. used it; yet a neighboring business
getssmtaltiple permits throughout the next year and they call up and they are not happy.
r Granted, it could'be every -other day, but businesses don't have to take them all out in

alternative or compromise between 180 or just leave it at 90?
Marshall: That's. one quarter of the year for me. If I were a business owner I would
want one out there every day of ..the year, but I think it -- once you open that to
everybody,, I think it -- it diminishes the effectiveness and I think one quarter of the year
is very reasonable. '

Rohm: I guess I do have one question of staff. If -- how encumbering would it be to
leave it at the .180 -- or, excuse me, at the 90, with one 90 day extension if -- if needed?
' Would that make it difficult for staff to execute?
Friedman:. Well, we -- Mr. Chairman, Commission Members, we would still -- I mean
one 90 day extension, again, we.would still have the people who-would have the option
under the existing code language of taking them out in intervals adding up to 90 days:
Now, the one thing Ididn't-clarify was for the people who have obtained the 90 day
permits now, they couldn't come in and get a 180 day permit. So, in essence, if the
recommendations were to go forward.. with 180 total, if you already have obtained your
90 day permit and you come in for.another sign permit, temporary sign permit, it won't
be for 180 days, it will only be for 90 days. So, it's probably more -- I don't know that it
would be„that much=of a burden on staff, I mean we process the permits and we track
them. So, if you came in fora 90 day permit and, then, if I heard the question correctly,
wanted to come in for a one time extension of 90 days,,it would be another sign permit.
Rohm: With an application fee associated with it?
Friedman: That's correct.
Rohm: Oh. Okay. All right.
Friedman: And, again,-for those folks, as the code currently allows them to take them
out in intervals less than 90 days, each one of,those intervals is,a new sign permit with
a new~fee, so they are tracked.
O'Brien: Mr. Chair.- Mr. Friedman, what effect will this resolution tonight have on the
changes that are- planned for the new signage amendments in -the next couple of

months? Will it -- will this become part of that new UDC? Is it going to change or,just
be obsoleted and, then, we start'all over again? ,
Friedman: Mr. Chairman, Commissioners; that's a good question, to which I don't have
an answer. However -= because I have not been a part of the drafting process of the
new code. However, this was -- when staff proposed if, did propose it as an interim
measure. So, I don't believe that this is going to findits way into the new code. I don't
know exactly how they are looking,at temporary signs. There maybe an entirely new
focus, but I don't know.what that, is.
Newton-Huckabay: But it would give you the data if there is a run, on the Planning
Department to get a temporary sign permit.
Friedman: Yeah.
Marshall: Pete, can task -- how much is the fee that they are paying?
Friedman: Twenty-three or twenty-seven dollars per permit.
Marshall: See, I'd almost recommend in the new -- it just -- having .some background in
advertising, if 1 were a business owner, I'd only want it out the"re maximum, you know,
five, ten days at a time over and over again. I would almost want to be able to come in
and fill out one permit for the year and say I'm going to ,have it the first ten days of this
month and these days -- so, I can get my 90 days or, if it passes, 180 days in one fell
swoop and have that al{ in one single permit, but --
Friedman: Mr. Chairman, Commissioners, that -- that, Commissioner Marshall, does
present a tracking problem °for us. That's why we have`t.had businesses avail
themselves of this ---sort of the intervals and -- because they know theirs highs and
lows better than anybody else and'=they are willing to spend that 27 dollars over again.
Because, otherwise, if you take out your permit for 90 days and; then, you take it down
and, then, it goes back up again, code has a tough time -- I mean we have stickers on
them, but it's a very difficult time for tracking that sort of thing.k If you take it-out, you
know, for Joe's place for 15 days and, then, you come back in and take out another one
for 30`days, we still, you know, have the ability at least to track the number of permits
that you have taken out for the number -- for the period of time that you have taken it
out for.

can put it out five days this week and four days that next week-and two days the
following week and stretch it over a period of a year, I think it's; just 90 days from the
date that it's taken out period.

transportation needs in the City of Meridian. The specific objectives and actions that support the
proposed amendment are listed below:

business owners in the community.

The Planning Department has initiated the proposed Zoning Ordinance Amendment in response to
comments from the business community and is meant as an inte~im measure. Currently, City Staff is in
the process of re-writing the entire sign code and temporary sign standards`will be reviewed in a future
ZOA: slated for later this year.
The section proposed for amending includes the standards that govern temporary signs. More
specifically the display times for temporary signs are proposed to increase from 90 days to 180 days.
The Planning Department Staff is recommending to amend UDC 11-3D-6A.6 as follows:
The following additional standards shall apply to tempor'ary' signs that require a permit as set
forth in subsection C of this section:
a. A temporary sign permit maybe obtained through the planning department for fifteen (15),
thirty (30), sixty (60), or ninety (90) day time periods.
(1) In no instance shall a temporary sign requiring a permit be displayed for more than n~et}~
(~ one hundred eight~(180) days per year per business.
(2) A permit must be obtained for every new temporary's sign to be displayed.
(3) If a permitted sign is removed for any portion of thel permitted time period, the time shall
be forfeited and shall not accrue or be added to the allowable display period for a

OF MERIDIAN, COUNTY OF ADA, STATE OF IDAHO:
SECTION 1. That the following described land as e ~'denced by attached Legal Description
herein incorporated by reference as Exhibit "A" is within the corporate limits of the City of
Meridian, Idaho, and that the City of Meridian has received a,written request for annexation and re-
zoning by the owner of said property, to-wit: Valley Life Community Church, Inc.
SECTION 2. That the above-described real property is hereby annexed and re-zoned from
RUT (Ada County) to R-8 (Medium Density Residential Disinct), in the Meridian City Code.
SECTION 3. That the City has authority pursuant to ~e laws of the State of Idaho, and the
Ordinances of the City of Meridian to annex and zone said property.
SECTION 4. That the City has complied with all the~noticing requirements pursuant to the
laws of the State of Idaho, and the Ordinances of the City of Meridian to annex and re-zone said
property.
SECTION 5. That the City Engineer is hereby directed to alter all use and area maps as well
as the official zoning maps, and all official maps depicting the boundaries and the zoning districts of
the City of Meridian in accordance with this ordinance.

SECTION 6. All ordinances, resolutions, orders or parts thereof in conflict herewith are

SECTION 8. The Clerk of the City of Meridian shall, within ten (10) days following the
effective date of this ordinance, duly file a certified copy of this ordinance and a map prepared in a
draftsman manner, including the lands herein rezoned, with the following officials of the County of
Ada, State of Idaho, to-wit: the Recorder, Auditor, Treasurer and Assessor and shall also file
simultaneously a certified copy of this ordinance and map with the State Tax Commission of the
State of Idaho.
SECTION. 9. That pursuant to the affirmative vote of one-half (1/2) plus one (1) of the
Members of the full Council, the rule requiring two (2) sepazate readings by title and one (1) reading
in full be, and the same is hereby, dispensed with, and accordingly, this Ordinance shall be in full
force and effect upon its passage, approval and publication.
