First, the requirement to extend Crosswind to Linder, through this parcel. ACHD provided us with two options,
stub to the north or extend to Linder. It appears the City will require the stub to be extended. Our contention
is the direct extension will encourage cut-thru traffic. We believe a better solution is to stub to the north. As
that parcel develops, Crosswind can ultimately tie into Windswept Way and then connect to Linder. This
alignment will discourage cut-thru, minimize vehicle speeds and place a Linder connection farther away from
Ustick.
The second issue is the non-conforming use the existing house (used as an office) creates. I agree it will clearly
be non-conforming as related to landscaping and parking. We disagree with a requirement to install (to any
extent) landscaping and a parking lot. Ultimately, the structure will come down. Any improvements installed
now will be temporary. The current use is not an intense use. Doug uses it randomly as a place to get on his
computer. A maintenance employee also uses it on occasion. Neither clients nor the public visits the office on
a regular, routine basis. JJA Land wants to continue this use without the improvements indicated in the staff
report.
If the above requirements are mandated, JJA Land will likely withdraw the application. As stated in the
application, the annexation request is a result of ACHD's roadway project. The old well was discovered during
ACHD's construction and it had to be removed. The house (it was used as an office) was then connected to the
City's water system. Hence, the annexation request.
IF I represented staff's position incorrectly, please let me know. I suspect staff must follow the ordinances,
regardless of the cause, hence your hands are tied. Can P&Z and ultimately the Council rule otherwise?
If the hearing should be postponed, please let me know.

Attached is the staff report for the proposed JJA Annexation (AZ-09-005). This item is scheduled to be on the
Planning and Zoning Commission agenda on October 1, 2009. The public hearing will be held at City Hall, 33 E.
Broadway Avenue, beginning at 7pm.
