Sportsman point subdivision area. I have attached a letter from Paul Kunz. dated 31 December, 1992 which states that the flood plain will be retained within the banks of Nine. Mile. drain once the. new 48n culvert is in place. We are proceeding with the construction of this culvert as well as obtaining an official letter of map revision from FEMA. The relatively large floodplain is a result of an undersized oulvert cross3.ng under Overland Road with the predicted 1q0-year floodwaters overtopping the road. r have also rev~.ewed the Ada County Highway District's Overland Road Project (pra~ect No, 52033.0? in regards to the replacement of the existing culvert with a 46" diameter reinforced concrete pipe. The proposed pipe, 1~0 fast fang, was hydraulically modeled using the HEC2 computer backwater program in conjunction with the original FEMA model used in the Flaad Insurance Study. The resu~.ts of this investigation show that the 100-year floodplain would be contained within the channel area upstream of Overland Road with the sew 48" pipe. The computed 100-year water surface elevation approximately 15 fast upstream of the new culvert is 2627.4 versus the existing elevation of 2632.6, a decrease of a little over 5 feet. Witih the new 1.00-year elevation, the water surface would be about 2.5 feet below the banl: elevations used in the FEMA study. z will proceed with preparing the necessary documents and submittal to FEMA for a Letter of Map Revision (LOMB) Concerning the new culvert. As you indicated to ma today, construction of the new culvert will take place in the next week ar two. Fallowing ~'EMA`s review after the culvert has been installed, and assuming their concurrence in my analysis, they would then issue of LUMR which in affect would remove the property outside of the channel area from the floodplain maps. The calculations submitted show that all storm water will be retained on site. The problem that I have is that the drainage should be held off of the 60 foot easement which is 30 feet from the center both ways. The District maintains a maintenance road and the road must not be encroached upon. Please make these changes and resubmit the plans. If there are any encroachments within the easements, it will take a license agreement. Please contact Andy Harrington, 342-4591, for preparation of this license agreement. The Grantor is the owner of the real property hereinafter described, and the Grantor desires such property to be served by a sanitary sewer system. B. The Grantee has agreed to provide within of the date hereof sanitary sewer service to the Grantor's property and other property, and in order to do so, the Grantee requires the easements hereinafter granted. C. The Grantee has further agreed to waive any hook-up fee t~hhe Grantor would otherwise be obligated to pay in order to connect facilities on the Grantor's property to the proposed sanitary sewer system and sewer line. Now, therefore, for the sum of $ ~ •pO (~ivt MvNoREP Dollars) paid by the Grantee to the Grantor and in consideration of the foregoing premises, and the mutual terms, conditions and covenants hereof, and other good and valuable consideration, the parties hereby agree as follows: 1. Grant of Construction Eas t. The Grantor hereby grants to the Grantee an easement over a strip of land eet de g ad))'acent to and azallel with the north line of that parcel of land locate on of the SW 1/4 SE 1~ of Section 18, Township 3 North, Range 1 East, Boise Meridian, Meridian, Ada County, Idaho, said parcel being more particularly described as follows - Commencing at the South 1/4 corner of Section 18, T.3N., IL1E., B.M., Meridian, Ada County, Idaho; thence, i~T,O°28'14"E. 1094.Q~ £eet on the westerly boundary of said SE 1/4, Section 18 to a 5/8" diameter iron pin; thence leavutg said SE . 1 /4, Section 18, S.89'34'00"E. 361.00 feet to a 5/8" iron pin, said uon pin being the TRUE POINT OF BEGINNING; thence continuingg S.89°34'00"E. 301.80 feet to a 5/8'" iron pin; thence, S.0°28'32"W. 288.68 feet to a point of calculation; thence, N.89°34'00"W. 301.77 feet to a point of calculation; thence, N.0 °28'14"E. 288.68 feet to the TRUE POINT OF BEGINNING - for the sole purpose of constructing a twelve inch [specify material, eg., PVCI pipeline boned at least eight feet below current grade and. running pazallel to and a distance of approximately ten feet from the Northern boundary of the Grantor's properttyy described above. The construction of said sanitary sewer line shall be lanned, undertaken and completed in such a manner as to minimize disturbance of the ~rantor's property (including unprovements) and the Grantor's use of its property and improvements. The sanitary sewer lute will include within the boundaries of the. Grantor's property a stub or connection apparatus permitting the Grantor to connect facilities on its property to the sanitary sewer line and system. 2. Grant of Maintenance and Operation Easement. The Grantor hereby grants to the Grantee an easement over the Nor~tltern twenty feet ofthe thirty- SANITARY SEWER EASEMENTS -1 081192 0200 nu F_rn e_RC a n-.rFTic~R_F a cF~rn r • ' five foot strip described in section 1, above, for the sole purpose of maintaining and operating the constructed sanitary sewer line. It is understood and agreed that maintenance and repair includes repair and replacement of the sewer lme, which the Grantee, at its sole cost and expense, shall cause to be done as needed, consistent with prudent, usual and customary standards for the operation, maintenance, repair and replacement of sanitary sewer lines such as the one constructed, using materials of like or better grade than those used in original construction. The Grantee s use of the easement hereby granted shall be planned and undertaken in such a manner as to nunimize disturbance of the Grantor`s property (including improvements) and the Grantor's use of its property and improvements. In making future repairs or re lcements and in the p construction of the sewer lute, the Grantee, at its sole cost and expense, will expediently replace and restore the premises and improvements to a condition comparable to that existing prior to undertaking such construction, repairs or replacements. 3. Improvements. The Grantor hereby covenants and agrees not to place any permanent building structure in the area described for this maintenance and operation easement which would interfere with the use of said described easement for the purposes stated herein. It is expressly understood and agreed that the Grantor reserves the right to lace other improvements over or within the easement areas described above, including by way of illustration but not limitation, landscaping, fences, pavement, parking bumpers, signs, ditches, drains and other improvements. The Grantor further reserves the right, after the construction easement expires or the construction is completed, whichever occurs first, to place building structures within the southern fifteen feet of the construction easement right-of-way. 4. Duration of Easements. The construction easement granted above will expire six months from the date hereof. If the construction of the sewer line is not completed within said six month period, the operation and maintenance easement will also expire concurrently with the expiration of the construction easement. If the sewer line is so completed, the operation and maintenance easement will continue until the sanitary sewer system is completed and so long as the Grantee continuously utilizes the sanitary sewer line and maintains the same in good repair; provided, however, if the sanitary sewer system is not completed and in use by ,then the ma~.ntenance and operation easement hereby granted shall expire an that date, and the Grantee will immediately quitclaim and reconvey to the Grantor all rights and interests hereby created. 5. Indemnity. The Grantee hereby undertakes and agrees to indemnify, defend, reimb aeurs rid hold harmless the Grantor from and against any and all losses, damages, costs, claims or expenses (including but not limited to attorney fees and expenses, whether or not litigation or any other proceeding is commenced, and also on appeal, if any) arising. out of or m any way related to the sewer line (includin sewer or other material carried in it or that may escape or otherwise be released from it~, the construction, maintenance, operation, repau or replacement of the sewer line or the repair and replacement of the Grantor`s property or-any improvements to or upon it. d. Acce Lance and Recording. Upon the com letion of the sanitary sewer line as described v~thin the six month period, the Grant a shall be authorized, at the Grantee's sole cost and expense, to record this instrument in the records of Ada County, Idaho. Such recording shall constitute the Grantee's representation and warran#y that the construction of the sewer line has been completed on the terms hereof. Interpretation and General Matters. Time is of the essence of this r' agreement. This agreement shall be binding upon and inure to the benefit of the parties and their respective heirs, successors, and assigns, and the benefits and burdens hereof shall run with the land. This is the entire agreement among the parties, superceding all prior and other negotiations, understandings, and discussions, and it shall not be modified except in writing, signed by the party or parties to be bound.
