Services Center, Meridian, Idaho We have recently received an application for mortgage insurance under HUD's Section 232 Mortgage Insurance Program for Nursing Homes, Intermediate Care Facilities, and Board and Care Homes. The application is for a 152 bed facility containing 50 units of assisted living, 52 skilled nursing beds, 25 Alzheimer beds, and 25 beds of long term specialized care, located on West Pine Avenue in the City of Meridian. We have enclosed a copy of the application and site map for your review. As Idaho does not have a Single Point of Contact (SPOC) for the intergovernmental review of applications for Federal assistance, we are asking for your comments on the proposed project (see Code of Federal Regulations, 24 CFR Part 52). We will make every effort to accommodate any concerns you may have relating to the proposed project; however, we must receive your comments within 30 days of the date of this letter. Please be aware that this is not a low income public housing project. The applicant is not asking for a Federal subsidy, but for mortgage insurance on a loan made by a private lending institution. This is similar to the FHA insurance we provide for single family homes. This letter is also not intended to circumvent your normal building permit/inspection process. Lee: It was discussed at the meeting and brieflyI visited with ACRD about the intersection of Linder & Pine and they have done traffic counts on that and at this time the traffic count is much less than what the collector is designed to carry, those collector streets are designed to carry 4000 vehicle trips per day and their traffic- count is less than 1000. That the City of Meridian has authority to annex land pursuant to 50-222, Idaho Code of the Revised and Compiled Ordinances of the City of Meridian; that exercise of the City's annexation authority is a Legislative function. 3. That the Planning and Zoning Commission has judged this annexation and zoning use application by the standards contained in Section 50-222, Title 67, Chapter 65, Idaho Code, the Meridian City Ordinances, Meridian Comprehensive Plan and the record submitted to it and things of which it can take judicial notice. 4. That since the annexation and zoning of land is a legislative function the City has authority to place conditions upon the annexation of land pursuant to 67-6512, Idaho Code, and Section 11-2-418(D) of the City Zoning Ordinances. 9, That the development of annexed land must meet and comply with the Ordinances of the City of Meridian and in particular Section 11-9-616 which pertains to development time schedules and requirements; that the Applicant will be required to connect to Meridian water and sewer; that the property will be subject to Site Planning Review; that the property will be subject to the requirements of the Ada County Highway District, the Central District Health Department requirements, the Nampa & Meridian Irrigation District, and the comments of the City Engineer. 10. That proper and adequate access to the property is available and will have to be maintained. 11. That there has been an increase in population and a reduction in residential lots capable of being built in which warrants conversion of land previously used agriculturally to residential uses. 12. Gary Lee, JUB Engineers, 1990 Turnberry Way, Meridian, was sworn by the Attorney. Lee: I will give you a brief overview of the project. This request is for annexation and zone to an L-O Limited Office District with general planned unit development. Along with that is a Conditional Use request for the different uses identified in the planned unit development preliminary plat. Included in that Conditional Use is the multi-family housing district, the daycare facility, a nursing home - retirement center and a mini storage warehouse facility. There are eleven lots one of which we are planning along the eastern border of the project to include 108 multi family apartment complex. The improvements for the site at this point will include public sanitary sewer system, that we intend to extend from W. Pine Street from an existing facility, there has been some concern expressed by the City Engineer about the depth of cover requirement on the project, we did a preliminary concept engineering plan which was submitted to your City Engineer, indicating that there would be some areas requiring additional fill over the natural ground. It will require about one to two feet of additional fill. The domestic water system will again be an extension of the public facility on Pine Street. The project will also have private streets within the facility. The streets will be maintained by the Homeowners Association. The development will include a pressurized irrigation facility. We are contimplating on reworking that floodway through there to incorporate it as a greenbelt and also to maintain its integrity as a floodway. Johnson: Does anyone have any questions? Dennis Marshall, 1921 Incline Way, Meridian, was sworn by the attorney. Marshall: Showed Members of the Commission a Plan of the facility. We have 60 cony. units, 30 intermediate care units and 40 retirement units. The building is an exact duplicate on the outside as Capital Care Center. Marshall: Yes, there is a pool and lots of area for park area. Johnson: Any fencing involved? Marshall: No sir not at this point. Johnson: Have you contemplated this in stages? Marshall: At this point, this is all of one project. Johnson: What kind of office buildings? Marshall: Western Health Care Management and part owner of this project will have their main offices located here. The Day Care Center we will be leasing to a National Franchise. Johnson: How would you maintain land that you have set aside for future development? Marshall: We will keep it looking nice or it would mess up the whole project. Johnson: What consideration, if any, have you given with regard to access to Linder? Marshall: We tried to purchase this ground on the west side from Nadine Miller, we had made several offers and she had rejected them, the last offer I was told that it already had been sold. Rountree: Have you precluded the possibility of working with the irrigation district to use that maintenance easement on the southern edge to get access. Marshall: We have not tried that. We are not opposed to that. Johnson: It's a nice looking project. Gary Lee: That subdivision west of the project, they have planned to replat that southern portion of that WestLawn and preclude that access to the boundary. Johnson: If this is approved this will be the single largest dollar project in Meridian in forever maybe. We're talking eleven million. Lee: I had some concerns about the intersection at Linder & Pine. I contacted ACRD and they have done studies on this intersection. The traffic would beat 60~ of capacity. Lee: That access along the Rutledge easement, I don't know how that would be with Nampa-Meridian. Rountree: Between the office space and the apartment units do you have any type of buffer or barrier? Marshall: Yes; Rountree: How about the back easmeent along Rutledge canal? Again do the homeowners accept maintenance of that area. Marshall: It is important to us that it is well maintained. There will belittle traffic for the convelescent center, the same goes with the intermediate care. We will provide parking for the retirement center, and we will provide a van for them also. Rountree: Have you notified people on Pine Street that this project is going to happen. Marshall: I gave a list of all the owners to the City Clerk. Hepper: Would any of the lots on the apartment areas or any of the lots be sold? Marshall: Our intention is to maintain it ourselves. The apartments are all in one spot, if they wanted to buy they would have to buy the whole thing. Hepper: When you talk about the homeowners association maintaining the common areas, there really wouldn't be any other homeowners other than the developers themselves. City of Meridian Ordinance #542 annexed lots 3, 4, and 5 of West Lawn Subdivision on August 21, 1990. 2. This property was zoned Limited Office (L-O). 3. Subsequent to this property's annexation and zoning, 7.48 acres of lot 3 were sold, presumably to Fiscal Funding Company. 4. Fiscal Funding Company was required to obtain a Conditional Use Permit for the construction of 120 unit apartment complex. A Conditional Use Permit was applied for by and granted to Fiscal Funding Company on February 19, 1991. 5. On July 19, 1994, JUB Engineers petitioned Meridian City Council for an extension of the Conditional Use Permit which was granted in 1991. Council approved a one year extension. Since a year has passed since this extension was approved, the Conditional Use Permit which was issued in 1991 is no longer valid. Unless information arises to the contrary, that the property in question is located in zoning district. An apartment complex district with a Conditional Use Permit. Si'. Lee: My name is Gary Lee with JUB Engineers in Boise. This project called Pine Bluff Apartments was a development that was proposed and approved by the City of Meridian in the early part of 1991 for a piece of property on Pine Street to develop 120 units apartment complex. The conditional use was granted for this particular project, it is currently situated in a L-O zone. Which this particular use is an allowed use with a conditional use. The sewer and water plans were submitted and approved by both the City Engineer and the State Health Department. Site plans were completed and submitted and approved. License agreements are in the works with Nampa Meridian Irrigation District and U.S. Bureau of Reclamation for the Nine Mile Drain which traverses the property. Ada County Highway District had approved all of the plans and got to a point in development where it was being bid and ready to go to construction. The only short come at that particular time was submitting for building and actually starting construction. The project was put on hold by the owner who is still currently the same owner. At this .point in time they would like to proceed and start the construction of the apartment complex We have reviewed the conditional use process and the city ordinance with the City Planner Shari Stiles. And in the specific section on conditional uses it doesn't speak to any particular time element involved in commencing construction after the conditional use is approved. There are sections of the subdivision ordinance that address time elements for subdivision projects, final plats, preliminary plats and alike. We would like to at this point I guess ask the Council's opinion and request their approval to proceed with this apartment complex under the current conditional use permit. Will, did you have a chance to hand out those documents on the plan? Berg: Yes Lee: If you have any questions, I would be glad to entertain those at this point. Tolsma: Is this the same complex that was proposed? Lee: Same thing, same set of plans. Tolsma: The storage facilities. Lee: The storage facilities were part of a separate piece of property. That was under a planned unit development that was put together by a different person, a different property owner. This 7 1 /2 acres where this Pine bluff sites stands alone is owned by a separate Meridian City Council July 19, 1994 Page 10 entity and it was a separate application process. But it sits next door to it. Yerrington: I have a question, how much of an extension of time are you asking for? Lee: They are in the process right now of putting together the plans to resubmit for building permit. And the last I heard they want to start construction this fall. Corrie: Mr. President, Mr. Lee, I have 3 questions, 1 to Gary Smith and 2 to you. You say nothing has changed it is still going to be 2 1/2 story complex, half a story being underground. Open space, you are still requesting 120 units, separate pressurized irrigation system and how about the well? Lee: There will be an irrigation well for pressurized irrigation. Corrie: You are going to continue with the well site. I guess Gary, my question to you is has anything changed as far as sewer and water, that has been 4 years ago we weren't as ambitious as we are now with all the subdivisions. Smith: I haven't looked at the plans again since they-were approved at that time, I assume in talking to Gary Lee that everything is the same as it was. We did have some minimum grade on sewer there but that had to do with the depth of the sewer in Pine. It was the only way it could be sewered. Come: You seem satisfied as far as water capability and sewer and all of that to be able to facilitate that big of complex. Smith: Well, we would want to make sure that we looked at that again based on the number of units that we have here and water supply. Corrie: I guess I have one other question to the Counselor, is there enough changes here that this needs to go back to a public hearing. Crookston: No Lee: Can I make a comment about the water and sewer, Gary and I worked on the sewer and water easement at the time and that was about the last thing we got accomplished in our interaction on the project. We did get the last minute things changed and the sewer and water easements were assigned by the owner. We have those in hand but they haven't been recorded. So, I guess there is a chance there that we could look at those one more time too if there is any need to change. We do want to ourselves rereview our own set of plans and I .believe Gary's staff wants to take another look at the water and Meridian City Council July 19, 1994 Page 11 sewer as well. State Health Department will require it be reviewed again, they do have a one year requirement on construction. So we will go through at least those steps. In addition there are probably some uniform building codes that will have to be looked at on the structures themselves. Morrow: I have a question for Gary, if the project is built now then it does not have a grandfather right in terms of water and sewer type of construction. It would be built to today's requirements, is that correct? Smith: Right Morrow: And Wayne where does the issue come from with time on conditional use permits? Do we have anything that covers time? Crookston: -The Council has on various occasions set limitations on how long a conditional use will be allowed. I don't see that it is in the findings, I don't agree with Gary Lee that probably the subdivision and development ordinance does have time restrictions for development. I am not sure that they apply to conditional use permit. Morrow: The next question would be then is by virtue of the conditional use it does not give it grandfather rights with respect to building permits because they were never applied for. Crookston: That is correct. Morrow: So they would be current codes both for the sewer and water and building permit standpoint, Uniform building code standpoint. Crookston: That is correct. Morrow: And you are in agreement with those things? Lee: Yes Tolsma: I think we need a motion to approve or disapprove the extension. We had talked about a well site, where we had met with Mr. Forrey and had come to an agreement to provide a well site on the north side of Ustick instead of the south side of Ustick. At that time she was in the process of preparing a development agreement, she didn't have it she had a standard form that she gave to us. At any rate we have been going right along. So all of this comes as a real shock to me. I did send Shari a 3 page letter in response to our meeting in which I went through each of those 16 items. I got a one paragraph faxed bads from her which I did not understand but it was very clear that we needed to have some meetings with Mr. Forrey before we could forv~rd on this. At any rate I would like to request if possible if nothing more that this matter be continued for 30 days to allow me to get my father here who was the original representative of the company and direct staff to meet with us so we can get to the bottom of it. Kingsford: I think certainly a table to the next to research just where we are with it. I can't believe the enormous number or amount of regulatory hoops we have jumped through in Meridian City Council August 16, 1994 Page 62 the last 4 years. We submitted our final proposal for HUD last week and they needed a clarification or confirmation from the City that the zoning still exists. I am here today to respectfully request that an extension of that zoning be continued for that project. Yen'ington: Do we need 4 more years? Holloway: I hope not, I don't think I could make another 4 more years. The file on that project now overflows a single file cabinet. Crookston: Where in the process are you? Holloway: All final plans have been reviewed we are going for a HUD insured loan. There are not a lot of lenders out there that are (inaudible) money on these kinds of projects. Particularly new projects. Crookston: I am kind of concerned the heading on our agenda is extension on annexation and zoning. Kingsford: It was annexed and zoned. Crookston: 1 am just wondering why that was on the heading of the agenda? Kingsford: I think basically what he is after is just a letter from the city saying that his projects still meets (inaudible). I think there is a (inaudible).
