This planned development will accelerate the need for Joint School District No. 2 to construct additional classrooms and/or to adjust school attendance boundaries. Meridian Schools do not have excess capacity. Nearly every school in the district is beyond capacity. The Meridian School District supports economic growth for Idaho and specifically the district's area, but such growth produces a need for additional school construction. We ask your support for a development fee statute on new home construction. We ask your support for a development fee statute on new home construction or a real estate transfer fee to help offset the costs of building additional school facilities. If this support is lacking then we ask that additional residential development be denied. Residents of the new subdivision cannot be assured of attending the neighborhood school as it may be necessary to bus students to available classrooms across the district. An application form may be obtained at the District office which will provide necessary preliminary information for District review. General Information A. DRAINAGE: 1. There will be no acceptance of any increased flow in storm run-off, drainage, or any contaminated waters for which the District might be made liable by the Federal and/or State Clean Water Laws. 2. Existing or replacement of on-site drainage or run-off facilities or modification thereto must be perpetually maintained by the site owner or owners. 3. Drainage plans prepared by a registered engineer may be required where deemed necessary by the District even though on-site modifications to the District drainage system are not required in the development plans. 4. If a drainage lateral owned and maintained by the District courses the site, no alterations of the lateral nor encroachment or its right of way shall be permitted without a license agreement. No access to such drain shall be denied to the District. B. IRRIGATION 1. The water rights of this District are not the same throughout the District. Neither are these always the same on one tract of land. Often these can be simplified without changing the Court confirmed status of the rights, if arrangements are made with the Secretary of the District in the advance planning stages. 2. Any irrigation supply lateral or canal which is owned and operated by the District and which may course the site, must not be obstructed nor encroachment made on its rights of way. -1- 0- C. 3. Any alteration from the original delivery point must be approved by the Water Superintendent and transfers to accomplish this alteration must be arranged with the Secretary of the District as part of the system plan acceptance by the Board of Directors. 4. No alteration or enclosure of an irrigation canal or lateral shall be permitted without a license agreement. No access to such canals or laterals shall be denied to the District. 5. If irrigation service is not to be provided to the individual properties, all property owners must be notified that the District tax is an obligation of all lands in the Irrigation District. This notification is in compliance with Idaho Law. 6. No destruction, interference, nor limitation upon water flows which are appurtenant to the property rights of others shall be permitted. 7. If development plans include providing irrigation, operation and maintenance of the system may be undertaken by a Lateral Ditch Water User's Association, in which case the District assumes no responsibility beyond the original point of delivery for the tract. 8. The District cannot provide permission for alteration of waterways belonging to and being a part of the property rights of individual land owners and to which waters f low from the system of the District. Permission must be granted from each of the property owners having ditch and water rights in the waterway. REVIEW AND APPROVAL PROCESS 1. Applicant shall complete and submit the attached application form to the Secretary of the District. Two (2) copies of the proposed plans shall be submitted with the application. 2. Upon approval of the original application, plans and specifications for construction, prepared by a registered engineer, shall be submitted for review to the District. Plans and specifications shall be reviewed by the District Water Superintendent and/or the District's engineers. If acceptable, the developer will be notified. Prior to actual construction an estimate of the cost of construction shall be provided to the District. -2- 0 • 3. If a license agreement is required to conform to specifications of the District and/or recommendations of its engineers, the Secretary of the District will then make arrangements for an appropriate license agreement for which the licensee shall be liable for payment of attorney fees. 4. The District shall be notified prior to commencement of construction. Inspection by representatives of the District or its engineers will not constitute approval of all or any part of the system and shall in no way relieve the developer or his contractor of the responsibility for providing a sound, workable system. 5. Within ten (10) days after completion of construction the developer's engineer must certify to the District that the system was installed in accordance with plans and specifications, and furnish as -built drawings to the District. 6. The developer and/or his contractor shall be responsible for the repair of all defects, leaks or failures occurring in the installation for a period of three (3) years after completion of construction. A maintenance and warranty bond in the amount of 10$ of the estimated or actual construction cost, whichever is greater, shall be furnished to the District within thirty (30) days after completion of construction. If the owner or his contractor fails to make required repairs or replacements promptly, the District shall make them, and the cost thereof shall be paid by the owner, his contractor or the surety. The fees required will be: $650.00 7. Attorney fees will be required only where a license agreement is required and these will be payable directly to the law firm of the District's attorney. and, BE IT FURTHER RESOLVED, that the Secretary of the District is hereby ordered to send copies of this resolution to all planning and approval agencies in Ada and Canyon Counties and in the Cities of Boise, Meridian, and Nampa, to the County Commissioners of Ada and Canyon Counties and to the Mayors of Boise, Meridian and Nampa to provide sufficient copies of the policy and application form for the continual administration and use thereof by all interested parties. -3- STATE OF IDAHO ) ) ss. This property consists of 31.82 acres and is intended to be the fourth phase of the subdivision commonly known as Rod's Parkside Creek. This phase of the subdivision will have 106 lots. 8. This ordinance requires the tiling of irrigation ditches, laterals, or canals. All irrigation ditches, lateral or canals, exclusive of natural waterways, intersecting, crossing or laying adjacent and contiguous or which canals, ditches or laterals tough either or both sides of the area being subdivided, shall be cover, and enclosed with tiling, or other covering equivalent in ability to detour access to said ditch, lateral or canal. 14. The Eight Mile Lateral runs along the Easterly edge of phase four (4) of the Parkside Creek Subdivision project. The dimensions of the water flow in the lateral are 18 feet wide a the surface, 4 1/2 feet deep as an average and 16 feet wide a the bottom and 1000 feet long. Due to the size of this ditch, the considerable cost would be well beyond what is considered standard or reasonable development cost. 15 & 16 The Eight Mile Lateral is on the far eastern side of the affected property, the proposed development does not cross over to opposite side of the canal. Also the canal bank adjoining the affected property is approximately eight feet above the level of the proposed development. Both of these factors create a situations where the detouring of access is easily achieved by the installation of a fence along the full length of the property. There are other subdivision in the area; Parkside Creek #1 & 2, The Vineyards, Parkwood, that because their boundaries do not encompass the Eight Mile Lateral, have incurred overall development costs much lower than that of Parkside Creek Subdivision will, if strict code enforcement is required. There may be instances where a development may have properties on both sides of the canal, and in order to effectively restrict access to the canal it may be necessary to tile the canal. We believe the circumstances involving Parkside Creek, the canal isolated to only one side, make fencing for the purpose of restricting access a much more viable solution. 17. Surrounding residential subdivision have in the past fenced the Eight Mile Lateral, or other large laterals, as our clients are proposing to do. Cherry Lane Village, One Subdivision, Sunny Brook, etc.. 18. The Eight Mile Lateral was constructed in 1906, the current land owner was not available to provide comment as to the location of the canal. 19. Same as 17. 20. The Meridian City Ordinance states that "any canal, ditch or lateral, exclusive of natural waterway, intersecting, crossing or laying adjacent and contiguous to, or which canals, ditches, or laterals touch either or both sides of the area being subdivided shall be covered, and enclosed with tiling or other covering equivalent in ability to detour access to said ditch lateral or canal". Our client is proposing to construct a six (6) foot high site obscuring fence, with no gates provided for access to the public, as an alternate cover equivalent to the ordinance. The fence shall be constructed along the entire length of the Eight Mile Lateral that is within the boundaries of the proposed Rod's Parkside Creek Subdivision No. 4. By proposing this alternative to the tiling of the Eight Mile Lateral our client will still be able to effectively detour access to the Eight Mile Lateral and a substantially lower cost. November 2, 1993, at approximately 7:30 o'clock p.m. on said date, at the Meridian City Hall, 33 East Idaho Street, Meridian, Idaho and the City Council having heard and taken oral and written testimony, the City Council of the City of Meridian makes the following: FINDINGS OF FACT 1. That notice of the public hearing on the variance was published for two consecutive weeks prior to the scheduled hearing for November 2, 1993, the first publication of which was fifteen (15) days prior to said hearing; that the matter was duly considered at the.November 2, 1993, hearing; that copies of all notices were available to newspaper, radio and television stations. 2. That notice of.public hearing is required to be sent to property owners.w�thin'300 feet of the external boundaries of the land being considered pursuant to 11-2-416 E., 11-2-419 D., and 11-9-612 B. l.b. of the Revised and Compiled Ordinances of the City of Meridian; that this requirement has been met. The entire property in question is described in the variance application and is incorporated herein as if set forth in full. 6. That the property in the area where the.variance is requested is zoned R-4 Residential and is proposed to be used in that fashion. 7. That the Applicant stated at the hearing that the ditch is quite large to be tiled and such would be cost prohibitive and cause economic.hardship. Due to the size of the Eight Mile Lateral and the amount of water flowing through it, it would be cost prohibitive to install a pipeline of sufficient size to meet the needs of the irrigation district. 8. That the Applicant owns the property. 9. That no people appeared at the hearing objecting to the variance application. CONCLUSIONS • 1. That all the procedural requirements of the Local Planning Act and of the Ordinances of the City of Meridian have been met including the mailing of notice to owners of property within 300 feet of the external boundaries of the Applicant's property - 2. That the.Casty has authority to grant.variances pursuant to.Section 11-2-419 of the Zoning Ordinance and pur- suant to Section 11-9-612 of the Development Ordinances and under 11-9-605 M the City may waive the requirement of piping ditches if the City Council finds that the public purpose requiring such will not be served in the individual case. 3. That the City Council has judged this application by the guidelines, standards, criteria, and policies contained in the Subdivision and Development Ordinance and upon the record submitted to it and.the things upon which it may take judicial notice. 4. That the -Council may take judicial notice of its own proceedings, those of.the Commission-,_ governmental statutes, ordinances, and policies, and of.actual, conditions existing within the City.and the State. 5. That the following provisions of Section 11-9--605 M PIPING OF DITCHES, of the Subdivision and Development Ordinance are noted which is pertinent to the Application: All irrigation ditches,,laterals or canals, exclusive of natural waterways, intersecting, crossing or lying 0 adjacent and contiguous, or which canals, ditches or laterals touch either or both sides of the area being subdivided, shall be covered and enclosed with tiling or other covering equivalent in ability to detour access to said ditch, lateral or canal. The City may waive this requirement for covering such ditch, .lateral or canal, if it finds that the public purpose requiring such will not be served in the individual case.' Any covering program involving the distribution system of any irrigation district shall have the prior approval of that affected district. 6. That the specific requirements regarding a variance that must be evidenced and found by the City Council are as follows: 11-9-612 A. 2.1 FINDINGS No variance shall be favorably acted upon by the Council unless there is a finding, as a result of a public hearing, that all of the following exist: a. That there are such special circumstances or conditions affecting the property that the strict application of the provisions of this Ordinance would be clearly impracticable or unreasonable; in such cases, the subdivider shall first state his reasons in writing as to the specific provision or requirement involved; b. That strict compliance with the requirements of this Ordinance would result in extraordinany hardship to the subdivider because of unusual topography, the nature of condition of adjacent development, other physical conditions or other conditions that make strict compliance with this Ordinance unreasonable under the circumstances, or that the conditions and requirements of this Ordinance will result in inhibiting the achievement or objectives of this Ordinance. c. That the granting of the specified. variance will be be detrimental to the public welfare or injurious to other property in the area in which the property is situated; d. That such variance will notviolate the provisions of the Idaho Code; and 0 e. That such variance will not have the effect of nullifying the interest and purpose of.this Ordinance and the Compre- hensive Development plan. 7. That there does appear to be a specific benefit or profit, economic gain or convenience to the Applicant if this variance is granted; however, to require tiling of the ditch would cause extreme hardship to applicant. 8. That the requirement of tiling ditches is a health and safety requirement; that by reason of the size of this ditch, it appears that to require tiling of this ditch would not achieve the, safety purpose for which tiling is required in the Ordinance. 9. That the irrigation district::, affected herein is not demanding that ditch be tiled. 10. That regarding Section. 11-9-612 A. 2., regarding the tiling of ditches, it is specifically concluded as follows: a. That there are.special circum tances or conditions affecting the property that the strict application of the provisions of the ditch tiling Ordinance would clearly be unreasonable. b. That strict compliance with the requirements of the ditch tiling Ordinance would result in extra- ordinary hardship to the applicant. c. That the granting of a variance would not be detrimental to the public's welfare and possibly injurious to the public. d. That the variance would not have the effect of altering the interests and purposes of the ditch tiling Ordinance which is included in the Sub- division and Development Ordinance for safety purposes. 11. That it is concluded that the Application for a 0 variance from the 11-9-605 M PIPING OF DITCHES should be granted and the ditch right of way be fenced with a sic foot chain link fence. Corrie: What culdesacs are you talking about as far as the school if it goes in? Would you have all four culdesacs go into that area or one? Hubble: Probably just the one, it's their choice. Corrie: So in other words we have one access into that school ` through a culdesac area. Hubble: If they purchase the site they are negotiating with there's another piece of property that lays between the proposed school site and Ten Mile so that the only way that they could get to this property right now would be through this culdesac through this subdivision down one of those culdesacs. Yerrington: Do you plan on tiling the ditch on the northeast corner? Hubble: Plans are now to leave that as an open ditch and fence it. Corrie: Have you seen the Engineer's comments? On the culdesac length variance request,.he mentioned that Pine Creek possibly would connect to Fur Creek to eliminate one of those long culdesacs. Has then been thought of? Hubble: We wanted to provide as many lots on a culdesac street as possible. That would discourage through traffic so even though it appears as a natural connection there and what actually increased the number of lots it wouldn't provide the same affect as the culdesac lots. Goldsmith: I'm representing a 23 lot subdivision, that is zoned R- 4 and it has increased in size due to some changes we have made as per ACHD's recommendations and such. I have a couple different drawings based on which interpretation of the Ordinance that we should go by as far as culdesac lot frontages and I have those both available to us it does not change the number of lots and I would open this hearing for questions at this time. Goldsmith: Yes, the lots that were indicated on the Preliminary that back up to Meridian Greens would have larger square footages and shake roofs. Giesler: Could you give the square footages of those homes? Goldsmith: Those homes will be 1600 square foot minimums and the remaining lots in the subdivision would be 1500 square foot minimums. Goldsmith: Yes • 0 Meridian City Council November 3, 1993 Page 6 ITEM #5: PUBLIC HEARING: VARIANCE APPLICATION FOR ROD'S PARKSIDE CREEK SUBDIVISION #4 BY L & R SALES: Crookston: Mr. Mayor, I have a conflict in this matter I need to step down, Mr. Ridlemoser is here to handle that. Kingsford: Acknowledge that the Attorney has a conflict Mr. Ridlemoser will be sitting in on this issue. At this I will open the Public Hearing on that variance which is a variance asking to not tile the canal through that portion. Entertain public hearing first inviting the applicant or his representative to speak first. Come forward state your name, address, and be sworn please. Gary Lasher, P.O. Box 967 Caldwell, was sworn by the Attorney. Lasher: Could I hand out something here, I found this at 4:30 this afternoon if I had it before hand, this is just one page. What I have just given you is a copy from July 7th 1992 of the minutes of that meeting. At that time the Preliminary Plat in July was approved with fencing of that ditch rather than tiling of the ditch. We had forgotten about it we had put it back in the back corner and of course Wayne just came on board here probably a year ago and Jack would have known this was done that way, but we just uncovered it this afternoon. After you read it if you have any questions I don't think we ought to even ask for a variance because we didn't need a variance to start with. Kingsford: Mr. Crookston, indifference to your conflict when was the Ordinance requiring ditches be tiled? This is dated July 7th 1992. Crookston: The initial Ordinance was passed October 1, 1991 it was then amended on November 2, 1992. Kingsford: What was the amendment? Crookston: The amendment spoke to the requirement related to whether the ditch was on the property line or abutting the property line where there were some requirements for requesting an abutting owner to participate in the tiling. Kingsford: So basically it was enforced though that all ditches had to be tiled prior to this meeting? Crookston: As of October 1991 Kingsford: Regardless of the preliminary plat approval it still was our ordinance at that time that they had to be tiled. Meridian City Council November 3, 1993 Page 7 Lasher: Okay, let me get you some cost sheets on the ditch here to tile it. I'm not sure in the ordinance what sized ditch is required to be tiled, we wouldn't have any problem if this was a 3 foot tile or so on, this is a 6 foot 72 inch tile for 1240 at a cost of $201,000 that is without engineering. We only control one side of that property, we have purchased the property on the let's see it would be the southeast side or southwest side of the road, but we don't control that little triangular piece in there. This would really be excessive to take and spend maybe $225,000 to tile that ditch we can fence it for about $7, 000 and safety wise, if you tile a 72 inch ditch and put a grate in there you have an awful lot of water going through that thing and far as safety wise unless that's tiled clear through town I'm not sure how safe it's going to be. Kingsford: Any questions of Mr. Lasher? Giesler: Mr. Mayor, does anyone recall the size of that tile that was put in south of town? Kingsford: Would you remember on, what was that Elk Run, isn't that the same ditch? Smith: That's a different ditch Lasher: We checked the tile where it crosses the road and it's all 72 inch tile and that's what makes it so excessive in price. Yerrington: Gary what's the size of the pipe in Tulley park? Smith: 36 inch tile Yerrington: Thank you Kingsford: Any other questions? Giesler: Mr. Mayor I guess I'd ask this gentleman when did you purchase this property? Lasher: About June of 1991 Kingsford: Thank You Lasher: One thing I might comment on Wayne has said in his letter to the City here dated September 30, 1993 that if the City would give us another 30 months it would probably help in defrain some of the cost of tiling the ditch it would not help it to delay it I • 0 Meridian City Council November 3, 1993 Page 8 don't want to do it but it wouldn't help to delay it 30 months because the cost of everything keeps going up so what we're really asking for is a variance to put in a chain link non -climbable fence. Goldsmith: Mr. Mayor and Councilmen, I'm a developer here in Meridian and I have civil projects that would be affected by this tiling of the 8 mile Lateral and I come forth and would like to tell you people that it would make development prohibitive on several of my projects and that I would like to see the 8 mile Lateral and some of the other large canals like the Ridenbaugh excluded from this ordinance. That's all I have to say. Kingsford: Anyone else? Rod Trumbul, P.O. Box 36 Caldwell, was sworn by the Attorney. Trumbul: One major difference when you get into a big ditch and a little ditch that goes through a subdivision like Glennfield had a 3 foot pipe that went through it it's hard for the ditch company to get in and maintain the ditch once it goes through a development and maintain the weeds and keep the ditch cleaned out. When you get into a major canal the right of way has a full road along the side of it for maintenance at this time. It does get extremely expensive, with a ditch there that would never get obstructed in any way it looks to me like these major canals are too expensive to tile. Kingsford: Anyone else from the public? Seeing none I'll close the public hearing. Mr. Tolsma Tolsma: You put a comment sheet in here about on this variance, basically what you're saying if they get a 30 month stay will coincide with the Cherry Lane project, would that be they would tile everything all at once. Forrey: Mr. Mayor Councilman Tolsma, the Ada County Highway District is planning to do some work in that area and they are going to be tiling laterals in that area, so I felt that in fairness to the developers here maybe if the Council gave them some time to work out a deal with the Highway District maybe they could use the same contractor, shipping of pipe could be reduced those r � l Meridian City Council November 3, 1993 Page 9 kinds of things, they can all shave some money off. I understand there is a lot of money involved here and I thought that might be something we can do to help the developer and still comply with the intent of the ordinance. Kingsford: Any other questions for the staff? Ridlemoser: May I ask one, Mr. Forrey do you take the position that this is a true variance under the ordinance? Forrey: Mr. Mayor, Mr. Ridlemoser I was unaware of the preliminary plat question about the fence and the applicants statement that he was going to fence until just out here in the hall just before the Council meeting. Jack Niemann probably would have known I was just unaware of that, but my opinion is this would have to be a variance and that's the reason for this public hearing tonight because the Ordinance does in fact state that laterals including the 8 mile Lateral must be tiled, it does not set a size criteria so just taking a strict reading and interpretation of the Ordinance would mean it has to be tiled in this case the developer is seeking a variance from that requirement and asking to not tile but rather to fence so yes. Ridlemoser: May I put it this way Mr. Forrey, is he asking for a variance or is he asking for special treatment under the Ordinance? Forrey: A variance Ridlemoser: That's what they're asking for but what is it a true variance? Forrey: As I understand it, it is. Asking for Kingsford: I'm not sure what you're driving at Counselor, is it the hardship issue. Ridlemoser: Is it that? Because we also have a provision there that profit isn't the only motive for asking for it. Tolsma: Well, the question if ACHD is going to tile this on the opposite side of the road why are we getting an objection to tile through a subdivision? Evidently access and clean out is not a draw back to ACHD on the other side of the road. Forrey: Well certainly there are canals this size and larger that are tiled and the intent of our ordinance is safety it doesn't address economics at all, which is really an issue here, the cost Meridian City Council November 3, 1993 Page 10 and size, it's a very expensive proposition, but the ordinance is oriented to safety it does not consider cost. Kingsford: Well certainly there are trade offs you know, as I look at this and $225,000 by the same token, I think Mr. Lasher made a sound point that velocity of water is going to pull a person against the screen and I don't profess to know which is the best trade off, I do know for example that the Ridenbaugh and the New York canals both go full stretch through Boise and they move of course more water than this. I think probably some investigation is appropriate to try and determine what might be the best as you say safety is the issue and safety is the major motivator of putting this in our Ordinance. Forrey: Mr. Mayor, taking the opportunity of updating this very ordinance, the entire Subdivision and Zoning Ordinance and this keeps coming up maybe it would be appropriate to look at design criteria and sizing of laterals, maybe we need a little more specifics in the Ordinance section itself. I'd be happy to do that if the Council directs. Kingsford: Well of course having closed the public hearing the requirements of the Land Use Planning Act is Findings of Fact and Conclusions of law I would hope that some of those kinds of investigations could be included in those. entertain a motion to have those prepared.
