We have reviewed the above referenced submittals and offer the following comments, as
conditions of approval. These conditions shall be considered in full, unless expressly
roodi6ed or deleted by motion of the Meridian City Council:
APPLICATIONS cUMNraRv
The applicant, the City of Meridian, acting on behalf of twenty-two home-owners, has applied
for annexation and zoning approval of 24.004 acres of land located in the Carol Subdivision,
west of Eagle Road and south of East Ustick Road. The requested zoning designation for the
subject property, R-2, is in conformance with the Comprehensive Plan Future Land Use Map.
The annexation of Carol Subdivision was originally proposed to Carol Subdivision residents by
the City of Meridian in 2002. The construction of the South Slough sewer and water project has
made it possible for residents of Carol Subdivision, which is currently located in Ada County and
not connected to City services, to hook up to City services. In 2002 the City of Meridian sent
letters to residents of Carol Subdivision informing residents of their option to apply for
annexation into the City of Meridian. The Carol Subdivision annexation application includes
only those residents who have chosen to participate in the annexation application.
The subject property currently is made up of 22 residential subdivision lots which are a part of
the Carol Subdivision. The subject property will continue to be used as a residential subdivision.
The legal description for annexation and zoning appears to describe the subject property, and
complies with the requirements of the State Tax Commission and City of Meridian.
Staff has reviewed the ditch piping requirements of the Subdivision and Development
Ordinance, and felt such improvements were inappropriate for this annexation.

The property is located at the southwest intersection of Eagle Road and Ustick Road.
SURROUNDING PROPERTIES
North: Rural residential/agricultural properties, zoned RUT (Ada County)
West: Packard Subdivision, zoned R-4 and rural residential properly zoned RUT (Ada County.)
East: Rural residential/agricultural property, zoned RUT (Ada County.)
South: Packard Subdivision, zoned R-4 and rural residential property zoned RUT (Ada County.)
OWNER OF RECORD
There aze twenty-two owners of record for the properties applying for annexation through the
City of Meridian. All property owners have provided notarized consent for submission of this
application.
ANNEXATION & ZONING ANALYSIS
According to Ordinance 11-15-11, General Standards Applicable to Zoning Amendments, both
the P&Z Commission and Couttcil are required "to review the particular facts and circumstances
of each proposed zoning amendment in terms of the following standazds and shall find adequate
evidence answering the following questions about the proposed zoning amendment."
The following is the list of standards found in 11-15-11 and analysis by staff:
A. Will the new zoning be harmonious with and in accordance with the
Comprehensive Plan and, if not, has there been an application for a
Comprehensive Plan amendment;
The Comprehensive Pian Future land Use Map depicts the subject property as
"Low Density Residential" which complies with the requested zoning designation
of R-2.
Staff finds that the requested zone of R-2 will be harmonious with and in
accordance with the Comprehensive Plan.
B. Is the area included in the zoning amendment intended to be rezoned in the
future;
Staff does not anticipate that the applicant intends to rezone the subject property
again in the future.

C. Is the area included in the zoning amendment intended to be developed in the
fashion that would be allowed under the new zoning -for example, a
residential area turning into a commercial area by means of conditional use
permits;
Staff finds that the existing residential subdivision is a permitted use within the
requested R-2 zone.
D. Has there been a change in the area or adjacent areas which may dictate that
the area should be rezoned. For example, have the streets been widened, new
railroad access been developed or planned or adjacent area being developed
in a fashion similar to the proposed rezone area;
City services have become available to the residents of Cazol Subdivision since
the subdivision was originally created.
E. Will the proposed uses be designed, constructed, operated-and maintained to
be harmonioua and appropriate in appearance with the existing or intended
character of the general vicinity and that such use will not change the
essential character of the same area;
Staff finds that there are no new proposed uses and that the existing uses aze
harmonious with the character of the general vicinity.
F. Will the proposed uses not be hazardous or disturbing to existing or future
neighboring uses;
The Commission and Council should rely on public testimony to determine
whether or not the existing use is disturbing or hazardous to the existing or future
neighboring uses.
G. Will the area be served adequately by essential public facilities and services
such as highways, streets, police and fire protection, drainage structures,
refuse disposal, water, sewer or that the person responsible for the
establishment of proposed zoning amendment shall be able to provide
adequately any of such services;
Staff finds that the property to be annexed can be served adequately by all
essential public facilities and services.
The Commission and Council should review ACRD, and Fire Department's
comments concerning this annexation for further information regarding
availability of necessary public services.

H. Wilt not create excessive additional requirements at public cost for public
facilities and services and will not be detrimental to the economic welfare of
the community;
Staff finds that there will not be excessive additional requirements at public cost
and that the annexation and zoning will not be detrimental to the community's
economic welfare.
L Will the proposed uses oot involve uses, activities, processes, materials,
equipment and conditions of operation that will be detrimental to any
persons, properly or the general welfare by reason of excessive production of
traffic, noise, smoke, fumes, glare or odors;
Staff finds that the proposed annexation will not create additional traffic and noise
that may be detrimental to the general welfare of the surrounding residential area.
J. Will the area have vehicular approaches to the property which shall be so
designed as not to create an interference with traffic on surrounding public
streets;
Staff finds that no new vehicular approaches have been created.
K Will not result in the destruction, loss or damage of a natural or scenic
feature of major importance; and
Staff finds that no natural or scenic features of major importance will be lost or
damaged by approving the annexation and re-zone. Any existing trees larger than
4" caliper that are removed shall be mitigated for, per the Landscape Ordinance.
L. Is the proposed zoning amendment in the best interest of the City of
Meridian. (Ord. 592,11-17-1992)?
The annexation will create county enclave lots. While it would be preferred from
a public services perspective to perform a single annexation of the entire
subdivision, Staff finds that the annexation of the subject 22 lots is in the best
interest of the City.
ANNEXATION AND ZONING CONDITIONS OF APPROVAL
Any existing domestic wells and/or septic systems within this project will have to be
removed from their domestic service, per City Ordinance Section 5-7-517, with the exception
that the property owners are allowed 12-months from the date of this annexation approval to
make the physical connection to the City of Meridian's sanitary sewer and water systems.
Wells may be used for non-domestic purposes such as landscape irrigation.

2. All future development of the subject property shall be constructed in accordance with City
of Meridian ordinances in effect at the time of development.
3. Each property owner within this annexation shall be subject to the current sanitary sewer and
water assessment fees, and service line construction reimbursement costs at the time of
connection. Property owners will also have to obtain all necessary permits and inspections.
Staff recommends annexation and zoning of the subject property to a R-2 zone, with the
aforementioned conditions of approval.

Please be aware that at the initial meeting of the neighborhood to discuss the installation
of water and sewer to Leslie Way/Dr. the group attending was told that we weren't
wanted as customers unless our septic systems failed and that the project was really for
making said utilities available to Ustick Road and to the east side of Eagle Road. I hope
these were not the general run of letting the `peons out there' hear what they came to
hear.
I appreciate that about half of the Carol Subdivision residents have petitioned to be
annexed into the City of Meridian and more power to you and them - but I want you to
know that the remaining residents are not interested in the slightest in becoming members
of the City of Meridian. Annexation will come, eventually, but until you just can't make
up that budget shortfall, please leave the rest of us in the county.
I know this letter is late and was not meant to be discussed at the up coming meeting but I
do hope, at least a few of you read my thoughts on the matter.
May I applaud the choice of dates on which to hold this particular meeting, the eve before
a three day-weekend, how extremely thoughtful.
