Dear Mr. Forrey:
Per the attached Notice of Hearing please accept this letter from
Meridian Meat Packers as input to your upcoming meeting which we
will be unable to attend due to prior out-of-town commitments.
As a second (and soon to be third) generation business operating in
Meridian, we would like to add our comments for your consideration.
First, from a philosophical standpoint we do not have any overall
problems with the proposed annexation and zoning request. However,
we do have some relevant concerns as how they would relate to our
uninterrupted and continued business operations.
1. If granted, what is the commissioners and
developers position of locating residential
dwelling adjacent to a "Meat Packing" company.
Will there later be a move to re -zone our
property as residential without our willing
consent and force a relocation of this
business?
2. What is the proposal for the development of
Blue Heron Ln.. Will this lane be paved with
curbs and sidewalks? Who will pay for these
improvements?
3. As a business, Meridian Meat Packers has for
over 30 years maintained a business sign on
the northwest corner of Blue Heron Ln.. What
is the proposal for maintaining our sign at
this location?
4. If in fact this lane will be improved what is

In short, we hope and would respectfully expect that any proposed

Johnson: I'll now open the Public Hearing. Is there someone
representing the applicant that would like to come forward and
address the Commission, please do so at this time.
Jerrie Wolfe, 410 S Orchard, was sworn by the Attorney.
Wolfe: Jerrie Wolfe, architect, representing Gary Ballew and Don
Taylor. We're requesting an Annexation and Rezone to R-40 piece of
property that due to the shape of the property is hard to work with
for, with anything else but what we're proposing. And if I could
display it, I can explain it a little better. The property is
situated on off of Meridian Road, here, through Heron Lane. what
or proposal is to satisfy fire protection what have you having two
accesses, one of them coming off the right lane here and off here
by the circle drive here. This is ideal for a multi -family use, we
can situate the units 8-plexes, 10-plexes etc. along here, create
a landscaping area with various amenities(gazebos, barbecue areas
etc..) garbage collection areas and we have an area here that is a
ditch that were hoping to create a greenbelt bike path situation
that would continue on with other portions in the overall city
plan. I think that can be better explained. That basically covers
it, the units are a continuation there are some variations in
height and materials, a continuation of what is, will blend in
with the neighborhood as shown these diagrams here. We've gone to
the extent of showing proposed floor plans in exterior elevations
that we hope will blend in with the neighborhood, accenting with

a lot of landscaping berms and variations of height. Are there any
questions, I'll sure try to answer them.
Johnson: Well, I'm sure we'll have a few. Commissioners,
questions? Well I'll start, with respect to the comment by Gary
Smith the City Engineer specifically item #3 are you familiar with
these, have you had a chance to look at them, they're dated October
10? From Gary Smith there are just 3 comments.
Wolfe: Yes I have reviewed that.
Johnson: That last sentence there, a question there,"does the
property.have access rights to Blue Heron Lane, and if so should
the lane become a public road?", did you have an opportunity to
discuss that at all with Gary Smith?
Wolfe: I haven't discussed it with Gary Smith, I've discussed it
with owner of the property, and at this time I'm not tying to
sidestep I don't know how to answer to tell you the truth.
Johnson: Well you can just tell me the truth
Wolfe: We're asking for an annexation and a rezone and what we
would like to do is work these details out with the proper
authorities ACHD and those people who are actually going to tell us
what we have to do, but if we have to give that all off to Bell
road, and who splits the cost, we like to work that about at that
time, it's hard for me to make a commitment at this time. Our
other accesses here and if we're required to as an alternate fire
lane we've got access here that depending on what ACHD is going to
tell us what we have to do, these maybe the only two that we have
if we can use this one that would be ideal, so these are things we
still need to work out.
Johnson: So what do you see as the total number of units there?
my copy is so small I can't read it.
Wolfe: Sixty-six, 3.94 acres and that includes the center line of
the right of way on the ditch, 3.19 acres to the easement portion.
Number of units would be 66, which correlates to 20 units per acre.
Johnson: And we're looking at 2 story units, is that what we were
talking about, approximately 10 buildings, 8 buildings, so some of
those are 10 and some are S.

Wolfe: I've got one 10 and the rest are 81s.
Johnson: Yea, that would be 66, okay. Anybody have ny questions
of Jerrie Wolfe?
Alidjani: Yes, out of the designated 66 units, how many are two
bedroom, one bedroom, three bedroom, it's a combination?
Wolfe: Twenty-six one bedroom units, which includes the
handicapped units, 40 two bedroom units. The parking ratio we're
proposing is 1.63 to 1 parking ratio which normally 1.5 is
acceptable I like to bump that up a little bit, a little extra
parking. And then a portion of those of course are going to be in
covered parking.
Alidjani: How many parking is designated all together?
Wolfe: 108 parking, car parks
Alidjani: Any other area designated area for extra parking or is
that it?
Wolfe: That's it, handicapped parking dispersed among them but
that is included in the 1.63. The one thing that I would like to
point out is we are proposing a lot of irregular and variation in
the landscaping a lot of bermsand that type of thing. Plus the
greenbelt access.
Alidjani: On sketch that you have what is the dimension of the
opening to Blue Heron and also Meridian road?
Wolfe: Thirty feet
Johnson: Any more questions? Anybody else have any questions,
Charlie?
Rountree: Do you have any proposals for any playgrounds or
recreation on site type of facilities?
Wolfe: Our central area would be landscaped and a play area and
then we have various gazebos/barbecue areas we've got 3 of those,
one here, one here, one here and then a picnic playground area
right here, trying to get them centrally located as much as we can.

Johnson: Anything else Charlie?
Rountree: No, I have nothing at this time
Johnson: Jim Shearer?

Shearer: No, looks like it's pretty well covered between the plans
we have here and what Jerrie has put forth.
Johnson: Wayne you had a couple of comments, did you respond to
Mr. Montoya's letter?
Forrey: Mr. Chairman, members of the Planning and Zoning
Commission and Mr. Wolfe, I just got Mr. Montoya's letter about
lunch time today. Mr. Montoya is a business manager at Meridian
Meat Packers, raises some issues, one of which is the compatibility
of land use. Certainly, the city would not approach any business
like this and ask them to relocate,and that's one question he
raised in his letter, what is the position of the city. Our
approach here in Planning function is to make sure that these two
uses are compatible, in the Comprehensive plan it addresses this
area as the mixed planned use development area. With that comes a
lot of responsibility to make sure that these two uses an industry,
in this case a packing plant, and where people live, the project
proposed by Mr. Wolfe, can be compatible, and the key thing here is
we know about it in advance. You know there is meat packing plant,
we know it, you know that you have a use that by some definitions
may be compatible, but our challenge here is to make it work.
Screening, buffering landscaping adequate setbacks, good site
design, this request is annexation and zoning only so I really
don't have anything to apr- a as far as site design, but as we
work with Mr. Wolfe and vidian Meat Packers, we'll make sure
that both uses can-' r without driving one or the other
out of business ® in coexist.

on the South side then we've got a really nice premier pathway
along that section of Jackson drain, good development on both
sides.
Johnson: Have you talked to Mr. Wolfe about anything like that.
Forrey: Yes, you might want to address that.
Wolfe: I thought I did, the Ewing Company is building a bike path
along this side and after talking with you and my client we don't
have any problem continuing that on this side we've left plenty of
room for doing that, it coincides with what you've already got, a
continuation on both ends.
Johnson: Thank you very much Wayne, Wayne Crookston do you have
anything?
Crookston: No
Johnson: Jerrie thank you very much, we may call you back. This
is a public hearing is there someone from the public who'd like to
come forward. Raleigh, you need to be sworn please.
Raleigh Hawe, 530 Blue Heron Lane, was sworn by the Attorney.
Hawe: I have several questions on that project. Number 1 is the
continuation of Blue Heron Lane in an east -west direction from
Meridian road to, I don't recall the subdivision that is to the
east of me, but does Blue Heron continue, a continuation to the
east of my property on that, and the question I had with this, as
this road is developed or is it is developed the bike path and the
Blue Heron Lane will be intersecting each other and that's one of
the questions, since that bike path will be continued through a
piece of my property how that will be handled for that
intersection, I get foot traffic and automobile or in the case of
Meridian Meat Packers commercial semis etc. through that particular
area. I suppose this would be addressed in part from the ACHD unit
if they proceed with this thing. Now as this Blue Heron Lane is
presently a private lane and the ownership of the road is the
property owners. The location of the Blue Heron Lane is entirely
owned by property south of the east -west property boundary off of
Meridian road and to the north side of Blue Heron lane which I
might show you at this time. And this brings up the question of
setbacks who's going to contribute what to the road I noticed that

everything is based on the center line of the road, shows and
automobile in left hand corner of the print that I'm looking at.
Blue Heron Lane at this time can't be much over 20 feet wide, maybe
a little bit more than that. At this time I'll show where the
property points are, I don't know if this was a question with Mr.
Wolfe or not, but I certainly know where they are. This is the
center line of Meridian road right here and the end of the center
line is located somewhat at the center. This is the north side of
Meridian Road right, or excuse me Blue Heron Lane right here, this
then goes on straight through to this point over here which is
northwest corner which is on the north side of Blue Heron Lane. At
this intersection right here, this Jackson drain goes not quite but
almost perpendicular to the Blue Heron and then crosses here and
comes back over, goes over this way a little ways and diagonals
about 45 degrees lengthwise. At this juncture right here there is
a road proposed to come through Ewings place somewhere I think in
here, and there is another one over in here, I don't have that
drawing of Ewings but there is another over here. Anyway this
intersection right here poses the problem. One of the questions I
have on this particular thing is the people to the north side and
taking a look at some setbacks here, it appears to be a 20 foot six
setback from their property on into the edge of the apartment
complex, as Blue Heron Lane is widened and since it will affect a
partial of the property that I have on the east side of this
particular thing who's going to give up the property or who's going
to dedicate the property to ACRD or to this particular project to
widen that road? As an example, Mr. Wolfe has explained that will
be a fire access going through this particular thing, now that's a
fairly good access going into presently a gravel road and 20 foot,
so something will have to take place in that particular are, but
that's one of the major questions that I have, what will become of
Blue Heron Lane? The other questions I have stated before is Blue
Heron Lane going to be continued through as a through street on
that? That's all I have at this time.
Johnson: Okay Raleigh, thank you very much. Any questions of Mr.
Hawe?
Rountree: Do you have a particular presence on what happens to
Blue Heron in terms of through access or being culdesaced?
Hawe: Well there's a, excuse me Mr. Wolfe how many units are going
to be in that particular area?

Wolfe: 66

Hawe: 66, Well you'll have one access off of that into Meridian
road and the other will have to go onto Blue Heron Lane, and come
down Blue Heron Lane and back onto Meridian road. The other thing
is that they might come down Blue Heron Lane and pick up a lane
that, I know Mr. Ewing has two roads coming into that particular
Blue Heron Lane right now, that are proposed. So quite conceivably
Blue Heron Lane would carry a considerable amount of traffic. So,
as would I have a preference as to Blue Heron Lane continuing into
existence you mean or as pertained as a private road, all of the
above. Well, if it stays as a, I would want to see Blue Heron Lane
because of it going into a through street type of thing, the reason
is that there the property south of Blue Heron Lane, I'm will be
developed at some time, most of those properties are in a five year
state of being in change at some place in 5 years it will change
from the existing use to some other, either multiple use or some
other single family use. Therefore, I see the road getting a lot
of use, a lot of traffic from that. There would be traffic coming
up from that from, as an example conceivably, from my place as it
develops and from Ewings properties to the north and to the east of
this property as those streets are designed, and I have a, I
believe I have the Ewings map right here. It's a culdesac that
comes of the north part of that property, that street does not come
through on that corner, but there is a street called North Eureka
that comes off of Ewings place onto Blue Heron Lane, if you want to
take a look at this, unless you have a copy yourself. If I may
I'll just pass this down.
Johnson: Wayne Forrey, did you specifically look at that or talk
to anyone at ACRD? Anything to add Raleigh?
Hawe: No I don't, except that that's a 30 foot street as I recall
coming off of it in the Eureka area, total service area of that
plus the commercial services going down Blue Heron Lane at this
particular time, there's a fairly good amount for the size of the
businesses a fair amount of semis traffic in that particular area
a lot of 18 wheeler traffic that goes down in there, we have farm
equipment and that sort of thing that goes through that thing
frequently it isn't significant number of units as compared with
the Meridian Meat Packing plant at this time. Also, at this time
there are two either presently used or temporarily used or
whatever, I don't know what they're called on the Meridian Meat
Packing property at this time, and there is no fences or guards or

whatever for people falling into them or people getting into them
or whatever. Some people just use them to shoot ducks or whatever.
Well anyway that's basically the use of Blue Heron Lane I see is
increasing traffic area and I hope that I've answered the questions
on that particular thing.
Crookston: Raleigh, Blue Heron is that on a quarter section line?
Hawe: Yes, it's on a half, I don't know it's a quarter section but
it's exactly a half a mile from Cherry Lane to that particular
point and from that point I'm talking about the east -west point
it's a half a mile to Ustick, so I don't if whether you'd call it
the quarter section line or half section mile line, I'm not sure
where that section falls in that particular thing, Wayne.
Johnson: Any comments Wayne Forrey? Apparently we didn't get any
response from ACHD on the application.
Forrey: That's what I was going to say Mr. Chairman. That they
were given an opportunity to comment, perhaps they need more time.
I think it would be important to get their comments and then
address specific items of Mr. Wolfe and Mr. Hawe brought up as well
as the counselors comment about the location of that easement. And
the long term with Ewing and the other developing properties there
it would affect on Blue Heron.
Johnson: What procedure can we use to get those comments, quickly?
Forrey: Well tomorrow we can make a phone call and follow up with
a written request of the Highway district to answer specific
questions, also the City Council will not take action on any of
these things on the agenda tonight unless the comprehensive plan is
adopted in early November or mid-November, and so that again would
give us time to get the bugs worked out with the Highway District.
Johnson: Well I think we ought to look into why we don't have any
comments on any of these applications. I don't think we have
anything from ACHD on any of these. That would certainly help us.
Anybody else from the public want to address the commission at this
time, yes sir.

Fuller: Just a simple question, I drive trucks down that Blue

Heron Lane, and I didn't know it was going to be discussed tonight,
but just input, is the city requiring the Highway departments to
put in curb and gutter in all these types of situations, because
from the semi standpoint that really is, if you're going to have
people living there we got to have sidewalks for them to walk on.
I just wondered if it was a standard policy or not.
Johnson: Well that's not exactly the way we would phrase it, the
city doesn't require those things, the Highway District does
because they have jurisdiction over all streets and roads. And
then the city would normally adopt the ACHD's requirements but not
necessarily in each and every instance, is that basically our
procedure?
Fuller: And then the city takes jurisdiction over that?
Johnson: No, the city has no jurisdiction.
Shearer: ACHD won't have any jurisdiction either if it's a
private road and stays a private road.
Fuller: I see that's all I have.
Johnson: Anyone else? Anyone else on this application on hearing
none and seeing none I'll close the public hearing. What is your
pleasure gentlemen? What would like to do? Would you like to do
anything?
Rountree: Mr. Chairman I make a motion that we have Findings of

Rountree: I have none.

Johnson: No specific changes, I've had a discussion with Will
regarding some of the typos and things we need to do a better job
on. When we've got two Johnson's testifying maybe we should
designate who is speaking it's kind of hard to reconstruct some of
this. In any event, we have a motion and a second for approval,

specifically required to tile all ditches, canals, waterways as a
condition of annexation, and that the applicant meet all the
Ordinances of the City of Meridian, specifically including the
development time requirements, and the requirements, and require a
development agreement and the conditions of these Findings and
Conclusions of Law, and that if the conditions are not met, that
the property be annexed.

Re: Heron Cove Subdivision
Dear Councilmen:
I have reviewed the application for Heron Cove Subdivision. This
planned development will accelerate the need for Joint School
District No. 2 to construct additional classrooms and/or to
adjust school attendance boundaries. Meridian Schools do not
have excess capacity. Nearly every school in the district is
beyond capacity.
The Meridian School District supports economic growth for Idaho
and specifically the district's area, but such growth produces a
need for additional school construction. We ask your support for
a development fee statute on new home construction or a real
estate transfer fee to help offset the costs of building
additional school facilities. If this support is lacking then we
ask that additional residential development be denied.
Residents of the new subdivision cannot be assured of attending
the neighborhood school as it may be necessary to bus students to
available classrooms across the district.
We ask that you assure the developer will provide walkways, bike
paths and safe pedestrian access.

FACTS & FINDINGS:
1. Jerrie Wolfe & Associates, Architects are requesting annexa-
tion into the City of Meridian of 3.9 acres of property locat-
ed at the northeast corner of Meridian Road and Blue Heron
Lane. The requested zoning designation of R-40 would allow
construction of 66 apartment units as shown on the attached
site plan. This would add approximately 400 vehicle trips per
day to traffic on Meridian Road.
2. Meridian Road currently has 60 -feet of right-of-way and is
fully improved with a 41 -foot street section. There is an
existing curb cut that will be used in the proposed layout as
an emergency access. The street was reconstructed in 1992 and
no pavement cuts will be allowed without Commission approval.
The 2000 Urban Functional Street Classification Map designates
Meridian as a minor arterial roadway. The District requires a
minimum of 90 -feet of right-of-way on arterials in an urban
area, width sufficient for 5 traffic lanes, 5 -foot sidewalks,
and bicycle pathways. The ultimate right-of-way will be ac-
quired when a specific development plan is submitted.
3. The proposed main access into the project is offset approxi-
mately 50 -feet to the south of Waterbury Drive. District
policy requires the access to be aligned directly across from
the existing Waterbury Drive, and also offset no less than
125 -feet from another street intersection, on an arterial
roadway. As the vicinity map indicates, the already construct-
ed Waterbury Drive, Woodbury Drive, and Blue Heron Lane pose a

is hereby annexed to the City of Meridian, and is zoned R-40
Residential; that the R-40 Residential zone would allow
construction of 66 apartment units; that the annexation and zoning
is subject to the conditions referenced in the Findings of Fact and
Conclusions of Law as adopted by the Meridian Council on the
request for annexation and zoning; that Applicant pay any
development fee or transfer fee if adopted by the City of Meridian;
that Applicant shall pay any development fee or transfer fee

adopted by the City of Meridian as a condition of annexation and if
not paid the land shall be de -annexed.
Section 2. That the property shall be subject to de -
annexation if the owner shall not meet the following requirements:
1. Dedicate 45 -feet of right-of-way from the centerline of
Meridian abutting parcel (15 additional feet). The owner
will be compensated for this additional right-of-way from
available impact fee revenues in this benefit zone.
2. Redesign the access to Meridian Road, in accordance with
District policy. If this is not possible, coordinate
with the City of Meridian and adjacent properties to
redesign the project limiting the access to only Blue
Heron Lane.
3. Utility street cuts in the new pavement on Meridian will
not be allowed unless approved by the District
Commission.
4. Replace unused curb cuts on Meridian with standard curb,
gutter and sidewalk.
5. Coordinate with the City of Meridian and the affected
property owners with access to the street regarding the
paving of Blue Heron Lane.
6. Coordinate. with the City of Meridian and the Ada Planning
Association regarding the pathway along the Jackson
Drain.
7. Pay any development fee or transfer fee adopted by the
City of Meridian.
8. Enter into a development agreement as authorized by 11-2-
416 L and 11-2-417 D; that the development agreement
shall address, but not be limited to, the inclusion into
the subdivision of the requirements of 11-9-605 C., G.,
H. 2, R., L. and the comments of the Planning Director,
Wayne Forrey, relating to the lack of adequate recreation
facilities, a school site or fees in lieu thereof, and
that land be set a side for a future park and relating to
development of greenbelts along any canals or drainages
within the subdivision.
9. Meet the requirements and conditions of the Findings of
Fact and Conclusions of Law and meet the Ordinances of
the City of Meridian.
Section 3. That if Applicant shall fail to meet the above
conditions the property shall be subject to de -annexation, which
conditions subsequent shall run with land and also be personal to
the owner and Applicant.

ANNEXATION AND ZONING
A PORTION OF SECTION 6, T.U., R.1E, B.M ADA COUNTY,
MERIDIAN, IDAHO
FINDINGS OF FACT AND CONCLUSIONS OF LAW
The above entitled annexation and zoning application having
come on for consideration on October 9, 1993, at the hour of 7:30
o'clock p.m. on said date, at the Meridian City Hall, 33 East Idaho
Street, Meridian, Idaho, and the Commission having heard and taken
oral and written testimony and the Applicant not appearing but
through Jerry Wolfe, and having duly considered the matter, the
Planning and Zoning Commission makes the following:
FINDINGS OF FACT
1. That notice of public hearing on the annexation and
zoning was published for two ( 2 ) consecutive weeks prior to the
said public hearing scheduled for October 9, 1993, the first
publication of which was fifteen (15) days prior to said hearing;
that the matter was duly considered at the October 9, 1993,
hearing; that the public was given full opportunity to express
comments and submit evidence; and that copies of all notices were
available to newspaper, radio and television stations.
2. That the property included in the application for
annexation and zoning is described in the application, and by this

reference is incorporated herein; that the property is
approximately 3.94 acres in size; it is on the east side of
Meridian Road north of Blue Heron Lane and between Cherry Lane Road
and Ustick Road.
3. That Jerrie Wolfe stated at the hearing that the
development would blend in with the neighborhood; that they need to
work out the access to Blue Heron Lane; that the land is planned
for eight apartment buildings which would contain sixty-six housing
units, 26 one bedroom units and 40 two bedroom units; that there
would be 108 parking spaces, a lot of berms for landscaping, a
greenbelt, 30 feet of access, and a landscaped play area 'in the
center; he stated that they desired a zoning of R-40 but would
develop to an R-20 standard.
4. That the property is presently zoned by Ada County
as RT and the proposed use would be for residential type
development as above stated.
5. The general area surrounding the property is used
agriculturally but there have recently been a substantial amount of
subdivision requests in the area which are single family
developments.
6. That the property is adjacent and abutting to the
present City limits.
7. The Applicant is not the owner of record of the
property, but the applicant has submitted the consent of the titled
owners, Dallan Taylor and Gary Belew.
8. That the property included in the annexation and

zoning application is within the Area of Impact of the City of
Meridian.
9. That the parcel of ground is included within the
Meridian Urban Service Planning Area as the Urban Service Planning
Area is designated in the Meridian Comprehensive Plan and the
proposed Comprehensive Plan.
10. There were two people testifying; one was concerned
about the access because Blue Heron Lane is a private lane; he
wondered whether Blue Heron was going to become a public road and
if it would continue to his property; he also was concerned about
a bike path intersecting with Blue Heron Lane; the other person
testifying was concerned about the heavy truck traffic that now
travels Blue Heron Lane.
11. That the property is in the CAIRNS Neighborhood as
set forth in Policy Diagram in the current Meridian Comprehensive
Plan; that the property is in the Linder District as designated in
the proposed Comprehensive Plan; that the proposed Comprehensive
Plan designates the area where the land in the application is
located to be a mixed planned use development area; that under
Housing Development on page 25 and 26 of the Current Comprehensive
Plan, property inside the Urban Service Planning Area may be
developed at greater densities than one dwelling unit per acre and
it is the policy that a density of greater than 1 dwelling unit per
5 acres may not be exceeded outside of the Urban Service Planning
Area.
12. That in the Rural Area section of the current
FINDINGS OF FACT & CONCLUSIONS OF LAW Page - 3
Comprehensive Plan it does state that land in agricultural activity
should so remain in agricultural activity until it is no longer
economical to exclude orderly growth and development to maintain
agricultural pursuits.
13. That the proposed Meridian Comprehensive Plan, under
Land Use, Residential Policies, 2.1U states as follows:
"Support a variety of residential categories (urban,
rural, single-family, multi -family, townhouses,
apartments, condominiums, etc.) for the purpose of
providing the City with a range of affordable
housing opportunities."
14. That the proposed Meridian Comprehensive Plan, under
Land Use, Mixed -Planned Use Development, Mixed -Use Area at Locust
Grove Road and Fairview Avenue Plus Areas North of Fairview Avenue,
at page 28, 5.16U, it states as follows:
"All Development requests will be subject to
development review and conditional use permit
processing to ensure neighborhood compatibility."
15. That the proposed Meridian Comprehensive Plan, under
Population, Housing Policies, at page 66 and 67, it states as
follows:
111.1 The City of Meridian intends to provide for
wide diversity of housing types (single-family,
modular, mobile homes, multi -family, townhouses,
apartments, condominiums."
"1.3 An open housing market for all persons,
regardless of race, sex, age, religion or ethnic
background."
"1.4 The development of housing for all income
groups close to employment and shopping centers
should be encouraged."
"1.14 Design and performance standards should be
applied to infilling development in order to reduce

adverse impacts upon existing adjacent development."
"1.17 The City of Meridian intends to consider the
implementation of Planned Development (PD) methods
and the use of performance standards through
revisions of the City's land use control
ordinances."
"1.19 ( High -Density development, where possible,
should be located near open space corridors or other
permanent major open space and park facilities, and
near major access thoroughfares."
16. That the proposed Meridian Comprehensive Plan, under
Community Design, Entryway Corridors, Meridian Road is designated
as an entryway corridor.
17. That the proposed Meridian Comprehensive Plan, under
Community Design, Entrance Corridors Goal Statement, it states as
follows:
"Promote, encourage, develop and maintain
aesthetically pleasing approaches to the City of
Meridian."
"4.4U Encourage 35 -foot landscaped setbacks for new
development on entrance corridors. The City shall
require, as a condition of development approval,
landscaping along all entrance corridors."
18. That there is a population influx into the City of
Meridian at the present time which has been going on for some time
and is likely to continue; that the land is relatively close to
Meridian and economic conditions are making it difficult to
continue farming in the area.
19. That the property can be serviced with City water
and sewer at this time.
20. Meridian Police Department, Nampa -Meridian
Irrigation District, Settlers Irrigation District, Ada County

Highway District and Bureau of Reclamation may submit comments and
such shall be incorporated herein as if set forth in full; that the
Meridian City Engineer, Central District Health Department,
Meridian Fire Department, and the Meridian School District
submitted comments and they are incorporated herein as if set forth
in full.
21. That the comments from the City Engineer regarding
Blue Heron Lane were whether the Applicant has access rights to
Blue Heron Lane and should the Lane become a public Road?
22. That the comments form the Meridian Fire Chief were
that roads need to be in and water hydrants in place before any
building is stated and that no paring on the roadway should be
allowed.
23. That the R-40 Residential District is described in
the Zoning Ordinance, 11-2-408 B. 6. as follows:
(R-40) High Density Residential District: The
purpose of the (R-40) District is to permit the
establishment of high density residential uses at
density not exceeding forty (40) dwelling units per
acre. Connection to the Municipal Water and Sewer
Systems of the City of Meridian is required.
24. That the Applicant has requested a zoning of R-40
but indicated that development would be at an R-20 standard.
25. The Meridian School District submitted comment and
such is incorporated herein as if set forth in full; its comment
was that there is no excess capacity in the schools of the District
and that residents of the new subdivision could not be assured of
attending the neighborhood schools; the School District asked for

support for a development fee or a transfer fee to help offset the
costs of building additional schools.
26. That in 1992 the Idaho State Legislature passed
amendments to the Local Planning Act, which in 67-6513 Idaho Code,
relating to subdivision ordinances, stated as follows:
"Each such ordinance may provide for mitigation of the
effects of subdivision development on the ability of
political subdivisions of the state, including school
districts, to deliver services without compromising
quality of service delivery to current residents or
imposing substantial additional costs upon current
residents to accommodate the proposed subdivision.";
that the City of Meridian is concerned with the increase in
population that is occurring and with its impact on the City being
able to provide fire, police, emergency health care, water, sewer,
parks and recreation services to its current residents and to those
moving into the City; the City is also concerned that the increase
in population is burdening the schools of the Meridian School
District which provide school service to current and future
residents of the City; that the City knows that the increase in
population does not sufficiently increase the tax base to offset
the cost of providing fire, police, emergency health care, water,
sewer, parks and recreation services; and the City knows that the
increase in population does not provide sufficient tax base to
provide for school services to current and future students.
27. That pursuant to the instruction, guidance, and
direction of the Idaho State Legislature, the City may impose
either a development fee or a transfer fee on residential property,
which if possible would be retroactive and apply to all residential

lots in the City, because of the imperilment to the health,
welfare, and safety of the citizens of the City of Meridian.
28. That Section 11-9-605 C states as follows:
"Right-of-way for pedestrian walkways in the middle of long
blocks may be required where necessary to obtain convenient
pedestrian circulation to schools, parks or shopping areas;
the pedestrian easement shall be at least ten feet (101)
wide."
29. That Section 11-9-605 G 1. states as follows:
"Planting strips shall be required to be placed next to
incompatible features such as highways, railroads, commercial
or industrial uses to screen the view from residential
properties. such screening shall be a minimum of twenty feet
(201) wide, and shall not be a part of the normal street right
of way or utility easement;"
30. That Section 11-9-605 H 2. states as follows:
"Existing natural features which add value to residential
development and enhance the attractiveness of the
community (such as trees, watercourses, historic spots
and similar irreplaceable amenities) shall be preserved
in the design of the subdivision;"
31. That Section 11-9-605 R states as follows:
"The extent and location of lands designed for linear
open space corridors should be determined by natural
features and, to lesser extent, by man-made features such
as utility easements, transportation rights of way or
water rights of way. Landscaping, screening or lineal
open space corridors may be required for the protection
of residential properties from adjacent arterial streets,
waterways, railroad rights of way or other features. As
improved areas (landscaped), semi -improved areas (a
landscaped pathway only), or unimproved areas (left in a
natural state), linear open space corridors serve:
1. To preserve openness;
2. To interconnect park and open space systems within
rights of way for trails, walkways, bicycle ways;
3. To play a major role in conserving area scenic and
natural value, especially waterways, drainages and
natural habitat;

4. To buffer more intensive adjacent urban land uses;
5. To enhance local identification within the area due
to the internal; linkages; and
6. To link residential neighborhoods, park areas and
recreation facilities."
32. That Section 11-9-605 L states as follows:
Bicycle and pedestrian pathways shall be encouraged within new
developments as part of the public right of way or as separate
easements so that an alternate transportation system (which is
distinct and separate from the automobile) can be provided
throughout the City Urban Service Planning Area. The
Commission and Council shall consider the Bicycle -Pedestrian
Design Manual for Ada County (as prepared by Ada County
Highway District) when reviewing bicycle and pedestrian
pathway provisions within developments.
CONCLUSIONS
1. That all the procedural requirements of the Local
Planning Act and of the Ordinances of the City of Meridian have
been met, including the mailing of notice to owners of property
within 300 feet of the external boundaries of the Applicant's
property.
2. That the City of Meridian has authority to annex
land pursuant to 50-222, Idaho Code, and Section 11-2-417 of the
Revised and Compiled Ordinances of the City of Meridian; that
exercise of the City's annexation authority is a Legislative
function.
3. That the Planning and Zoning Commission has judged
this annexation and zoning application under Section 50-222, Idaho
Code, Title 67, Chapter 65, Idaho Code, the Meridian City
Ordinances, the Meridian Comprehensive Plan, as amended, and the
FINDINGS OF FACT & CONCLUSIONS OF LAW Page - 9
record submitted to it and things of which it can take judicial
notice.
4. That all notice and hearing requirements set forth
in Title 67, Chapter 65, Idaho Code, and the Ordinances of the City
of Meridian have been complied with.
5. That the Commission may take judicial notice of
government ordinances, and policies, and of actual conditions
existing within the City and State.
6. That the land within the proposed annexation is
contiguous to the present City limits of the City of Meridian, and
the annexation would not be a shoestring annexation.
7. That the annexation application has been initiated
by the Applicant with the consent of the titled owners and the
annexation is not upon the initiation of the City of Meridian.
8. That since the annexation and zoning of land is a
legislative function, the City has authority to place conditions
upon the annexation of land.
9. That the development of annexed land must meet and
comply with the Ordinances of the City of Meridian and in
particular Section 11-9-616 which pertains to development time
schedules and requirements.
10. That this Application has been submitted prior to
the adoption of the proposed amendment to the Meridian
Comprehensive Plan; that as a condition of annexation the
Applicant, and titled owners, must agree that the proposed Meridian
Comprehensive Plan, once adopted, shall apply to the land and any

development.
11. That since the proposed Meridian Comprehensive Plan
says that in mixed use planned development areas all development
requests will be subject to planned development methods and
conditional use permit processing, the development of the parcel
will be subject to the planned development process under the
conditional use process.
12. That under the planned development review and
conditional use processing, standards shall be .required so that
that portion of Meridian Road which is included in the development
shall be aesthetically maintained with a 35 -foot setback for
landscaping.
13. That proper and adequate access to the property has
not been shown and any development plans will have to show adequate
access and will have to meet City requirements and those of the Ada
County Highway District; that Blue Heron Lane will have to become
a public road to provide adequate access.
14. That since the Applicant's property is in the CAIRNS
NEIGHBORHOOD of the Comprehensive Plan, the annexation and zoning
Application are in conformance with the current Comprehensive Plan
and do not conflict with the Rural Areas policies; it further is in
compliance with the proposed Meridian Comprehensive Plan.
15. That the requirements of the Meridian City Engineer,
Central District Health Department and Meridian Fire Department,
and of the Ada County Highway District, Settlers and Nampa &
Meridian Irrigation District, if submitted, shall be met.

16. That all ditches, canals, and waterways shall be
tiled as a condition of annexation and if not so tiled the property
shall be subject to de -annexation.
17. With compliance of the conditions contained herein,
the annexation and zoning of R-40 Residential would be in the best
interest of the City of Meridian. However, the Applicant shall be
limited to development of the property to an R-20 standard; this is
because that is what the applicant stated.
18. That the Applicant will be required to connect to
Meridian water and sewer and resolve how the water and sewer mains
will serve the land; that the development of the property shall be
subject to and controlled by the Subdivision and Development
Ordinance; that, as a condition of annexation, the Applicant shall
be required to enter into a development agreement as authorized by
11-2-416 L and 11-2-417 D; that the development agreement shall
address the inclusion into the subdivision of the requirements of
11-9-605 C, G., H 2, K, L and the comments of the Planning
Director, Wayne Forrey; that the development agreement shall, as a
condition of annexation, require that the Applicant, or if
required, any assigns, heirs, executors or personal
representatives, pay, when required, any development fee or
transfer fee adopted by the City; that there shall be no annexation
until the requirements of this paragraph are met or, if necessary,
the property shall be subject to de -annexation and loss of City
services, if the requirements of this paragraph are not met.
19. That proper and adequate access to the property is

available and will have to be maintained.
20. That these conditions shall run with the land and
bind the applicant, the titled owners, and their assigns.
21. That if these conditions of approval are not met the
property shall be subject to de -annexation.

The Meridian Planning and Zoning Commission hereby adopts and
approves these Findings of Fact and Conclusions.

the annexation and zoning is subject to the conditions referenced
in the Findings of Fact and Conclusions of Law as adopted by the
Meridian Council on the request for annexation and zoning; that
Applicant shall pay any impact development fee or transfer fee
adopted by the City of Meridian as a condition of annexation and if
not paid the land shall be de -annexed.
Section 2. That the property shall be subject to de -
annexation if the owner shall not meet the following requirements:

Meridian water and sewer and resolve how the water and
sewer mains will serve the land.
b. That the development of the property shall be subject to
and controlled by the Subdivision and Development
Ordinance and the Meridian Comprehensive Plan adopted
January 4, 1994.
C. That all development requests will be subject to planned
development methods and conditional use permit processing
and the development of the parcel will be subject to the
planned development process under the conditional use
process and a density of 20 dwelling units per acre shall
no be exceeded.
d. That under the planned development review and conditional
use processing, standards shall be required so that that
portion of Meridian Road which is included in the
development shall be aesthetically maintained with a 35 -
foot setback for landscaping.
e. That proper and adequate access to the property has not
been shown and any development plans will have to show
adequate access and will have to meet City requirements
and those of the Ada County Highway District; that Blue
Heron Lane will have to become a public road to provide
adequate access.
f. That, as a condition of annexation, the Applicant shall
be required to enter into a development agreement as
authorized by 11-2-416 L and 11-2-417 D; that the
development agreement shall address the following, among
other items:
1. Inclusion into the subdivision of the requirements
of 11-9-605 C, G., H 2, R, L of the Revised and
Compiled Ordinances of the City of Meridian.
2. The comments of the Planning Director, Wayne
Forrey, submitted as part of the annexation and
zoning process.
3. The Applicant and owners of the property, and if
required, any assigns, heirs, executors or personal
representatives, pay, when required, any impact
development fee or transfer fee adopted by the
City.
g. That the development of annexed land must meet and comply
with the Ordinances of the City of Meridian and in
particular Section 11-9-616, which pertains to
development time schedules and requirements, and 11-9-605
M. which pertains to the tiling of ditches and waterways.
h. That these conditions shall run with the land and bind
the applicant, the titled owners, and their assigns.
i. That if these conditions of approval are not met the
property shall be subject to de -annexation.
j. Meet the requirements and conditions of the Findings of
Fact and Conclusions of Law and meet the Ordinances of

Section 3. That if Applicant shall fail to meet the above
conditions the property shall be subject to de -annexation, which
conditions subsequent shall run with land and also be personal to

the legal description, and map, which shall plainly and clearly
designate the boundaries of said property, to be filed with the Ada
County Recorder, Ada County Assessor, and the State Tax Commission
within ten (10) days following the effective date of this
Ordinance.
Section 5. EFFECTIVE DATE: There being an emergency,
which emergency is hereby declared to exist, this Ordinance shall
be in full force and effect from and after its passage and approval
as required by law.

RT TO R-40 FOR JERRIE WOLFE AND ASSOCIATES:
Kingsford: At this time I will open the public hearing and invite
the owner or his representative to begin. Would you state your
name, address and be sworn.
Jerrie Wolfe, 410 South Orchard, was sworn by the Attorney.
Wolfe: I'm representing Gary Ballew and Dallen Taylor, this is a
request for Annexation and a rezone. I don't know where I should
start, but I can do a presentation and show you what we are asking
for. Can I use the easel, this represents 3.19 acres triangle
shape on Meridian Road and there is a private lane here, Blue Heron
Lane, we are proposing a rezone to R-40 and asking for a little bit
less than that. Actually it is 66 units on the 3.19 acres which
represents 20 per acre. We've got 108 car parks which gives us
1.68 parking ratio 1.68 to 1. I'm going through this as fast as I
can. Our landscaping, our building coverage far exceeds any
requirement. We've been in contact with the Planning and Zoning as
far as providing public access along the right of way, the ditch
right of way here. The highway department has a concern on the
access alignment with the alignment across the street, we've got no
problem there, just a little bit of shifting here and we can do
that. It appears to be we don't even need Blue Heron Lane as an
access, as long as we've got our Fire turn around. Those are the
type of items I'd like to work out with the Highway District, I
don't think we are going to have any kind of problem there at all.

Raleigh Hawe, 530 Blue Heron Lane, was sworn by the Attorney.
Hawe: The only question that I had, as I previously discussed at
the Planning and Zoning portion of this is that if they were going
to use Blue Heron Lane they type of public access for that
particular lane I question the width of it in as much of the
development that is going on just north of that and to the east of
it has a lane coming down I believe its called Eureka Lane from Mr.
Ewings subdivision, it comes in a couple of hundred feet from the
corner of that property corner and (End of Tape). North Eureka
Avenue on the Ewing property plat, I don't have a number here that
I can see right away, anyway if I may I will show you what is going
on. (Inaudible) I don't know whether Blue Heron Lane is going to
be used as a public access or what it is that is going to take
place with that particular area. But you see the amount of traffic
that will be coming down into this particular area, there is a lot
of traffic in commercial enterprise right here. Right now there is
little room for two vehicles two cars can pass, if there is a truck
there you have to wait. The lane should be some type of a public
access, it goes to that it should go to a 30 - 40 foot width but
that would be subject to ACHD's discretion whatever goes on with
that. There will be this walkway that comes down a pathway I
believe is proposed to come down through here. There is an
irrigation lateral that comes from the, it goes northwest direction
and that pathway comes across the street and across it may
intersect this North Eureka Lane it comes down in through this area
here. So at that particular point why there is a need for
additional traffic movement both foot and vehicular traffic. Right
now any kids that are, there are only 2 kids on this lane right now
but with the apartment complex and the 185 units to the north there
is going be a lot of use or any of these lanes going into Meridian
Road in a westerly direction. Right now this area is pretty much
blocked off for any easterly travel except for this lane that is up
here it goes into John Barnes' development. The access then comes
down in through here the collector coming in from Meridian Road on
that James Court area and coming down through there and coming out
that way. This is the only other westerly flow of access that
there is. From the standpoint of traffic planning that is the only
question that I had. Are there any other questions?
Kingsford: Are there any questions for Raleigh? Thank you
Raleigh. Mr. Wolfe, I might ask you, should it be ACHD's desire

do you have a problem what does it do to your configuration,
density if you would have to give up half a street on Blue Heron?
Wolfe: As I previously said we don't really have to have that
access here unless ACHD requires us to, and the last that I
understood talking with Mr. Sale, their biggest concern was the
alignment with across the street we don't have any problem with at
all. It would probably, we would just assume not to have to make
any improvements here or connect to it or whatever as we proceeded.
It would be the simplest for us to just realign this with across
the street and eliminate this access and whatever Ewing's
(inaudible).
Kingsford: We, though in the Highway District might have some
concerns about land locking.
Wolfe: But, no we are not land locking.
Kingsford: We would have some problems with traffic.
Wolfe: We will do whatever they tell us to do, but then I would
like to know what are supposed to do?
Kingsford: Well, that is a group that you will have to meet down
in Garden city with.
Wolfe: We've met and I'm telling you what the Findings were from
those meetings. Their are not necessarily concerned with whether
we hook onto here their concern was whether we line up here. I
don't have a problem with doing that at all and then just eliminate
this access and we've got our fire turn around and we are fine.

Ted Johnson, 5330 Farrel Street, Boise, was sworn by the Attorney.
Johnson: Mayor and members of the commission we are asking for an
Annexation of 10 acres of ground that are outlined in the package
you received on pages 7 and 8. Its a 10 acre piece that adjoins
the Mallard Landing Subdivision on the west and a little bit on the
south. Its an expensive piece of ground and the only reason I try
to build is to get another access in there as has been requested
previously. The Annexation has been requested by both myself and
the land owner who intends to retain ownership of about 2.5 acres
of land on the northwest corner of the parcel. I read the
conclusions that have been prepared and I only have 2 questions.
I haven't seen any agreements, any development agreements nor have
I in the 27 years of developing have entered into one so I don't
know what that contains but I'm sure it can be worked out. I do
have a question having to do with the tiling of the ditch and to
that effect I have filed an application for variance. On a portion
of the ditch the Kennedy Lateral will bisect this parcel in the
easterly third of the piece. And through that portion we would
propose to tile it no matter what the size was, but the other part
