Boise, Idaho Owners: Sara L. and John R. Ewing, Individuals Developer: John R. Ewing I. DEVELOPMENT LOCATION The Ewing property is located in a portion of the NW 1/4 of Section 6, Township 3 North, Range 1 East, B.M., Ada County, Idaho. More particularly, the project lies east of Meridian Road, south of the South Slough and North of Blue Heron Lane. Tract Subdivision is located along the easterly boundary and Meridian Place No. 3 lies to the southeast. II. SITE DESCRIPTION Currently, the site is comprised of approximately 50.26 acres of irrigated pasture with one single-family home known as the Fothergill Life Estate. The land is generally flat with a small irrigation ditch flowing east to west through the site. The land is being irrigated and producing alfalfa hay and pasture. At this time, the property is adjacent to the City of Meridian corporate limits to the east and west. The present zoning of the site is RT within Ada County. N. Meridian Road provides access to the parcel along the westerly boundary of the property and Blue Heron Lane (a private lane) provides access to the south boundary. A planned development known as Tract Subdivision is situated along the easterly boundary line. It is anticipated that a street connection will be made at the northeast corner of this site. III. PROPOSED DEVELOPMENT The developer plans to request a re-zone of the property to residential R-8. The project will consist of approximately 180 to 190 single-family residential lots resulting in a gross density of 3.7 lots per acre. The lots sizes will conform to the City of Meridian Zoning Ordinance for residential developments. ~' i • rJ-U B , Engineers Surveyors Planners Ewing Annexation Narrative April 20, 1993 Page 2 This development and zoning (R-8) are desirable at this location. The property is situated next to R-8 zoning to the east, west and southeast. There are other residential developments in the area that make an R-8 zone desirable. This zoning request and annexation will comply with the Meridian Comprehensive Plan. IV. PROPOSED IMPROVEMENTS A. Sanitary .Sewer System: There is an existing public sanitary sewer system on N. Meridian Road known as the South Slough sewer trunk extension that will traverse through this property to provide sewer service to this and other sites in need of sewer service. This system is operated and maintained by the City of Meridian. This development will extend the existing sanitary sewer service into this site, as well as proposed developments to the east and northeast. B. Domestic Water System: It is anticipated that domestic water and fire flows will be supplied by the City of Meridian through the extension of an existing water system located at N. Meridian Road and E. Hawk Street when Tract Subdivision No. 4 is developed in the near future . A new water distribution system will be constructed within the planned development, which will include the necessary fire hydrants, valves, blow-offs and appurtenances as required by the State of Idaho Drinking Water Standards. C. Public Utilities: This subdivision will include public utilities, such as electrical power from Idaho Power Company; natural gas from Intermountain Gas Company; telephone service from U.S. West Communications; and TV service from United Artists Cable Network. Utility easements will be provided upon each lot to accommodate these public utilities as required. D. Public Streets: All streets will be constructed to Ada County Highway District Standards and Specifications. Disposal of storm water into the natural drainage will consist of only flows equal to the pre-development storm water discharge of the property (i.e., the amount of storm water discharged into this drainage. will not exceed what is currently flowing into said drainage ditch in its present condition). E. Irrigation and Drainage: An existing irrigation ditch that traverses this site-from the east boundary to a point lying 1,320 feet easterly of N. Meridian Road, which will be tiled to continue delivery of irrigation water to neighboring properties. Other smaller irrigation and drainage ditches that deliver water to this parcel only will be abandoned. V. FIRE PROTECTION As mentioned earlier, the domestic water system will be maintained and operated by the City of Meridian. Part of their service will include the delivery of adequate fire protection. Lee: We had hoped it would be but is not ready yet. We hope to have that within the next ten days to submit to the City far review. The plan with that open space bike path is to traverse along the Jackson Drain and cross Woodbury Drive to the north and tie into what would be the South Slough bike path which would be the main artery. I'd be glad to answer any questions. Giesler: The Jackson Drain will be tiled or left open? Lee: Well at this point and time we're working with the concept of leaving it open and the architect is going to come up with some plans far landscaping it along those lines. That the Application requests that the parcel be annexed and zoned R-8 Residential; that the applicant indicated that the intended development of the property is for single family residential development with improvements as above stated. 10. There was one person testifying and he was concerned with the lot size. 11. That the property-is in the CAIRNS Neighborhood as set forth in Policy Diagram in the Meridian Comprehensive Plan; that under Housing Development on page 25 and 26 of the Comprehensive Plan property inside the Urban Service Planning Area may be developed at greater densities than one dwelling unit per acre and it is the policy that a density of greater than 1 dwelling unit per 5 acres may not be exceeded outside of the Urban Service Planning Area. 12. That in the Rural Area section of the Comprehensive Plan it does state that land in agricultural activity should so remain in agricultural activity until it is no longer economical to exclude orderly growth and;develop~ent to maintain agricultural pursuits. 13. That there is a population influx into the City of Meridian at the present time which has been going on for some time and is likely to continue; that the land is relatively close to Meridian and economic conditions are making it difficult to continue farming in the area. The Central District Health Department, Settlers Irrigation District, and Bureau of Reclamation may submit comments and such shall be incorporated herein as if set forth in full; that the Meridian City Engineer, Nampa-Meridian Irrigation District, Meridian Police Department, Ada County Highway District, the Meridian School District and the Meridian Fire Chief submitted comments and they are incorporated herein as if set forth in full. 16. That the R-8 Residential District is described in the Zoning Ordinance, 11-2-408 B. as follows: (R-8) Medium Density Residential District: The purpose of the (R-8) Districts is to permit the establishment of single and two (2) family dwellings at a density not exceeding eight (8) dwelling units per acre. This district delineates those areas where such development has or is likely to occur in accord with the Comprehensive Plan of the City and is also designed to permit the conversion of large homes into two (2) family dwellings in well-established neighborhoods of comparable land use. Connection to the Municipal Water and Sewer systems of the City of Meridian is required. 16. That the Applicant has requested a zoning of R-8 and has submitted a concept plan of the parcel. 17. That proper notice was given as required by law and all procedures before the Planning and Zoning Commission were followed and have been met. CONCLUSIONS 1. That the Planning and Zoning Commission has judged this annexation and zoning application under Section 50-222, Idaho Code, Title 67, Chapter 65, Idaho Code, the Meridian City Ordinances, the Meridian Comprehensive Plan, as amended, and the record submitted to it and things of which it can take judicial notice. 4. That all notice and hearing requirements set forth in Title 67, Chapter 65, Idaho Code, and the Ordinances of the City of Meridian have been complied with. 5. That the Commission may take judicial notice of government ordinances, and policies, and of actual conditions existing within the City and State. 6. That the land within the proposed annexation is contiguous to the present City limits of the City of Meridian, and the annexation would not be a shoestring annexation. 7. That the annexation application has been initiated by the Applicant with the consent of the titled owners and the annexation is not upon the initiation of the City of Meridian. 8. That the requirements of the City Engineer, Ada County Highway District, and Nampa-Meridian'Irrigation District shall be met. 13. That all ditches, canals, and waterways shall be tiled as a condition of annexation and if not so tiled the property shall be subject to de-annexation. 14.
