The northerly boundary is Fairview Avenue, the westerly boundary is Eagle Road and the entire site consists of about 164 acres. The residential portion of that site is approximately 76 acres. We are proposing a subdivision consisting of 256 single family •residential lots, which would be a net density of about 3.3 lots peT^ acre. This also includes some commercial lots along the frontage of those major roadways. Tonight we are requesting approval far a subdivision plat in a PD-Genet^aI Zone. We have access into the property by three public streets, one of them off of Fairview Avenue and~two of them off of Eagle Road. In this planned development the concept of this is to provide those long linear open spaces colored in green at the rear of the lots. Crookston: Da you plan any kind of barriers between your residential lots and adjacent commercial or ind~-strial uses? Hubble: Let me refer that to Mr. Yorgason. Number one, by couenant we will have in the commercial area it will be light com®ercial and there will be screening on their side as well as we'll be putting a fence on our side. As the commercial goes in there will be shrubbery that will go between that as well. Kingsford: Any questions for Mr. Yorgason? The school has indicated that we need a school in that area. Yorgason: .We've had many discussions with the Schools and the Meridian City Staff. As we have looked at various locations, typically if an entire square mile is ga~ing to be developed into a residential area it can just about accam®adate one school. In this particular square mile area there will be large areas that will not have residential and so if they put a school in this particular square mile area then there would not be enough students to fill up a school there and either we'd have to bus students into that squat^e mile or if gee didn't have one there they would be bused out of that particular square mile. In looking at the other sites north of here where there are other schools or not other schools, it was felt by the people that we discussed with that it would probably be more appropi^i ate to have one just north of this because of the fact that it would encompass almost entire residential areas where this would have a much smaller residential configure. Kingsford: I think there really needs to be some planning done there from the standpoint that - Fairview being what it is for traffic, as well as Eagle Raad, and the district's policy is not busing students unless it's a mile. Your talking about creating a subdivision that if the students go across Fairview to school that's going to be a real hazard for those children to go across. Wayne Forney: After Mr. Yorgason and I ®et last week to discuss that very issue with this project, I met with the school district and they've identified the school site to serve this particular subdivision, not on the north side of Fairview but a school site MERIDIAN CITY CDUNCIL JUNE 15, 1993 RAGE 8 they just acquit^ed or at least have an option on, south and east of this site about a mile and a quarte-^ from Crossroads. This subdivision would be at the extreme northwest of that school site service area. Yorgason: We are on record as supporting an impact fee for the schools. We think that that's something that needs to be addressed and we think it needs to be addressed in a rapid fashion and as developers we are very supportive of that. Kingsford: Again, before final platting I'd like for you to consider a passible outlet into the south and east that might accommodate those children. Yorgason: We will certainly do that. Carrie: On the south side, what length is it between the south edge of your pt^operty and the railroad tracks? Yorgason: Around 3~1Q1' . Kingsford: Thank you. Anyone else? Tom Wright, 141 W. Our commitment to this community and to Mr.' Yorgason is that we will put covenants against all the property surrounding him that will do among other things restrict height, color,~hours of operation, landscaping separations, etc.. We have discussed three variations of separation per Say between residential and commercial, one would be fencing, one would be landscaping and one would be berming. I don't know tonight precisely in what combination, what percentage proportion of those we will use but I will assure this Council and this community that there will be sepal^ation between the t^esidential and commercial but we have to do that in tandem with Mr. Yorgason. Crookston: I know that in these other situations that this has arisen then^e is quite of bit of concern about light coming in from the commercial and sound. If you'll notice the map designates a connector generally along the mid section line, which is the south proper^t y1 line of this project which would essentially be an extension of Emerald from the east and Pine from the City of Meridian. If we construe that alignment to run along the mid section line then at least part of the right of waya would need to come out of this property. Assarming that the alignment of Emerald; Pine is relatively close to the soF~th boundary of the project, we wo-11d recommend to move his sa~tthea^n entrance to Eagle a short distance north, arod he has ag:^eed. We then had asked them to stub a street to the east property line somewhere in the nos^thez^n half of the property, that is a tentative condition pending some discussions with a church which ovans the property to the east. They have previousl;~ indicated that they want to develop their entire pt^opertj themselves for church related uses and they don't want tl-,e additional street access. I think Mr. Hubble indicated that there would be a street extension near the southeast corner of the property, I don't thinEc we' 12 da that, we'll retain that uldesac in the corridrr. I think we will require it to stub a street out to the south and connect with Emerald rather than running a street into this project. Number one, by covenant we will have in the commercial area it will be light commercial and there will be screening on their side as well as we'll be putting a fence on our side. Yorgason: .We've had many discussions with the Schools and the Meridian City Staff.. As we have looked at various locations, typically if an entire square mile- is going to be developed into a residential area it can just about accommodate one school. In this particular square Wile area there will be large areas that will not have residential and so if they put a school in this particular square mile area then there would not be enough students to fill up a school there and either we'd have to bus students into that square mile or if we didn't have one there they would be bused out of that particular square mile. In looking at the other sites north of here where there are other schools or not other schools, it was felt by the people that we discussed with that it~would probably be more appropriate to have one .just north of this because of the fact that it would encompass almost entire residential areas where this would have a much smaller residential configure. Kingsford: I think there really needs to be same planning done there from the standpoint that - Fairview being what it is for traffic, as well as Eagle Road, and the district's policy is not busing students unless it's a mile. Your talking about creating a subdivision that if the students go across Fairview to school that's going to be a real ha~ai^d for those children to ga across. Wayne Forney: After Mr. Yorgason and I met last week to discuss that very issue with this project, I met with the school district and they've identified the school site to serve this particular subdivision, not on the north side of Fairview but a school site ~ ~ MERIDIAN CITY COUNCIL JUNE lv, 1993 GAGE 9 they .,just acquired or at 1 east have an option on, south and east of this site about a mile and a quarter from Crossroads. This subdivision would be at the extreme northwest of that school site service area. Yorgason: We are on record as supporting an impact fee for the schools. We think that that's something that needs to be addressed and we think it needs to be addressed in a rapid fashion and as developers we are very supportive of that. Because was there not some question about the procedure under which the fees had been paid and the status of cross connections and de-hooks and the system in general and all those other issues? Tolsma: Then we could probably use part of the reimbursement fees probably for making a master connection to this thing to guarantee them water. Smith: Say that again Councilman? Smith: You mean deduct that amount from the reimbursement. Tolsma: I think that was the major concern of some of those people out there is they wouldn't have water in the spring or in the fall. Smith: Right Tolsma: But, if we had a master connection in there I think we could probably get rid of the other connections. I visited a couple people out there, and that was their prime concern was they didn't have any water in the spring or late fall and they would rather keep on the city water for that effect. But if they had a master connection which I had told them we had done other places that the City pushed the water in there a month early and a month late and the bill went right to Nampa Meridian Irrigation. (Inaudible) Smith: If Nampa Meridian Irrigation is maintaining the system. Tolsma: And they said they wouldn't have a problem doing that, other than that they would rather stay on the City water rather than going to a pressurized irrigation system. Smith: Well, there is two issues, one would be disconnecting all of the residents from the existing connection. And they would abandon that connection and their backflow device. The other would be the City's ability to collect fee for the water that we pump through that single point connection. Tolsma: Wouldn't' Nampa Meridian (inaudible) Smith: If it is maintained by Nampa Meridian then yes we can bill Nampa Meridian for it. If it is maintained by the homeowners association then we need a separate agreement with the homeowners association as Wayne explained to me that would be, would allow us to bill them and collect from the homeowners association. Tolsma: Well, the two people I visited with that was their prime concern was what they were going to do early and late. They said if that could be eliminated then they wouldn't have any problem with it. That is all 1 had. It is approximately 2.2 acre piece that sits on the extremity of this phase that we are now requesting annexation for. I think actually back in early September the Council passed the findings of fact, recommended annexation and asked the City Attorney to prepare annexation ordinance. This school site, it was always the developers understanding that ~ we could accommodate the Meridian School District with this school site they would be happy and this Council would be happy. As a result of that in July of this year we entered into a binding contract with the Meridian School District No. 2. The terms Meridian City Council October 3, 1995 Page 22 discovered that it may not be, if the Highway District concurs that is safe then we wouldn't need to amend those. I would suggest that we table items 5 and 6 until we get clarification of that. Morrow: Okay, it was a different issue that is in error in the findings of fact and conclusions. Morrow: I guess the question in my mind is this has been tabled several times by the request of the applicant and we were awaiting some information to Gary Smith from the applicant as to where we were at. Could Gary address, I know in our packet there was a letter from Hubble Engineering to Gary. It seems to me the issue before has been tabled repeatedly at the request of the developer and then it was tabled trying to resolve the problem with the cross connections or potential cross connections. So, where are we at with that? • • Meridian City Council November 8, 1995 Page 6 Smith: Mr. Mayor, Councilman Morrow, the Applicant did submit the map that I believe you have in your packet showing those lots that have been sold and have been built upon. Also shows a lot that was connected to the City system for sprinkler and has subsequently been disconnected. That all of the lots are being served by the pressurized irrigation system as installed by the developer. The only issue that remains from my standpoint is since this system is being provided water from an irrigation ditch is what happens to the water supply when the ditch water does not exist. The location of the pump facility is somewhat distant from the existing water line. It may be necessary for them for the developer to construct a water line from their last phase, their closest phase to that pump station so that we have a single connection, single point of connection to' provide water when ditch water is not available. Otherwise the property owners will be, it will be necessary for them to connect to the City system for their alternate source of water when the ditch water is out of the ditches. Morrow Wasn't that some point of contention between the Council and staff the last time as to how, if those cxoss connections remain how they're kept checked so on and so forth. Didn't we have a problem in that arena? Smith: Well, yes Councilman Morrow, it is a problem just from a standpoint of being able to monitor that the bads flow devices are checked on an annual basis. It is a requirement that they be checked on an annual basis, it is a problem for us to do the leg work and make sure that they are checked on an annual basis, at this point in time it is. We know that we have a lot of bads flow devices in operation that are not being tested annually. So that is why the Public Works Department is encouraging a single point connection in a subdivision from City system that could provide water through a single back flow device. Kingsford: Do we have an agreement Gary from this Homeowners Association that they will in fact pay City water on that single point? Smith: No, we don't. Kingsford: I think given some of our history that is something that we also need to have. Something in the way of a contract to that effect. Smith: Wayne Crookston has mentioned it that we do need to have an agreement with the homeowners association, con-ect. The only other system that we have in operation right now is being managed and operated by Nampa Meridian Irrigation District and the bills are being sent to Nampa Meridian for payment. Morrow. And do they pay them? Meridian City Council November 8, 1995 Page 7 Smith: I don't know that we got, this was the first fall that the system was connected to City as well as the ditch. I don't know whether, I can't answer that Councilman Morrow, I don't know I do know that they were assessed for the 4 inch meter that went into the system, they did pay that. I don't know about the water bills. Morrow. Do we have a method to guarantee collection from Nampa Meridian? Smith: I don't know that there is a separate agreement between the City and them, I am not sure. Kingsford: Maybe we can put a lien on their property and sell it after three years. To answer part of your question there Walt, the billing hasn't been out long enough for us to receive payment on that. So I am not sure whether they have or not. Well it would seem to me we'd be premature to grant any kind of a return until we have a contract with them on payment. Morrow. Well, I think that, it seems to me we need to take it from two points, one is we need to have a contract on payment from the homeowners association and two we need a commitment on the part of the developer Mr. Yorgason that we will get a single point of connection. If there is no commitment for the single point of connection if we already have a problem inspecting multiple backflow devices 1 don't think it is in the City's best interest to perpetuate the problem. Smith: I think in my September 20 memorandum to Mayor and City Council I also sent a copy of this to the developer and I state that either a shallow well needs to be built or the City needs to allow a cross connection back flow device on city water for each home being built. Reportedly the developer has entered into an ownership maintenance operation agreement with Nampa Meridian. Since an alternative water source to the ditch water is not being provided at this time it appears the property owners will still need to rely on city water for the time.period ditch water is not available. Morrow. And there has been no response on the part of the developer? Smith: The only thing we have received is the letter you have received a copy with that map. Morrow. They have mentioned that they would like to pipe it but they don't have the funds to do this. Unless some kind of a deal could be worked between Settlers and other parties that were involved in that subdivision, I don't know of any other methyl to get the pipe installed. The developer of #3 I've heard is not interested in participating in piping of the ditch, now I l~taven't talked to him specifically. He did have to give up 18 ft. of ground there fnr easement that basically is going to be a line of weeds. ' Myers: It looks to me like if we had that piped from where it goes into where ik3 is on the north side of Sandalwood all the way hack to Cherry Lane probably is where it should be done. Maybe if we could get tie folks all together maybe we could get that all tiled down as far as to where ~ folks are. Preston: That was very much in our interest. We didn't want to pay for the entire cost of that pipe. We would certainly welcome the City's participation all that you can to help us there. The thing we don't want to happen is to hold up our entire plat until someone else agrees to do something. We would very happy to work with the City or someone else to get that tiled. Tolsma: What's the plan for that drainage ditch on the west side of that property? Preston: It will remain open and fenced out. Tolsma: Is there an easement or right of wage on that? Preston: Yes the Bureau of Reclamation has a easement. Giesler: There is a number of .comments that came from the City Engineer about the number of lots. Preston: These were addressed at the Planning & Zoning Meeting and we concur with Mr. Smith's comments. We are going to drop one lot in one area to make certain that we get our 70 ft. frontage around the aaldesac. There is no other way to get back there to haul out the weeds which are large. Reading through the convnnants of our subdivision they are somewhat jumbled. Spoke about fences, walkway easements, title company. (TAPE ON FILE) We feel that we have really been violated, because it states in the covenants that you can not do that. We as a group fell that if the vacation is allowed to happen that our rights as homeowners will be violated. Giesler: Doesn't your property lines go clear to the back, even into the weed area back there? Rohan: Yes. Giesler: How-come the fences weren't put out - Rohan: There is a utility easement 10-15 ft. I believe back there. Giesler: I know in most other subdivisions the fence is taken to the property line. This is a very unusual situation. The weeds out there, you say they will be cut down, the times. I have been out there, the weeds were higher than the fence. Crossroads is a proposed 256-lot residential, 5-lot commercial subdivision on 154.5 acres of property located at the southeast corner of Fairview Avenue and Eagle Road (State Highway 55). There will be 14,810-feet of new public streets added to the system. 2. Three entry streets are proposed to provide connection to the arterials of Fairview and Eagle Roads past the large commercial lots (80-feet of right-of-way in these areas) and into the residential area (50-feet of right-of-way) in the southeast corner of the site. The right-of-way and roadway width may need to be at least 60-feet and 41-feet back-to-back of curb from the main roads to the first intersections in the residential area. This will be determined from the results of a required traffic impact study. 3. The proposed alignment of Emerald/Pine runs along the south boundary of this property, identified as a collector road by the Functional Street Classification Map. Part or all of the right-of-way should be acquired from this project if the alignment is construed to run along the mid-section line (which is the south property line of this project). Impact fee funds may be used to acquire the right-of-way for the collector. The staff has identified three options for the consideration of the Commission regarding the reservation of right-of-way for Emerald. The traffic study will aid in determining whether or not the stub streets should be required, and if so, where they should be. 8. Fairview Avenue currently has 100-feet of right-of-way and is improved with 70-feet of pavement. The 2000 Urban Street Functional Street Classification Map designates Fairview Avenue as a principal arterial roadway, which generally requires a minimum of 80-feet of right-of-way (the District is requiring 114-feet of right-of-way for this road), width sufficient for 5 traffic lanes (65-foot street section) and 5-foot sidewalks. The ultimate right-of-way should be acquired now to minimize acquisition and con- struction costs in the future. In the interim, the developer should be required to construct 5-foot sidewalk, or dedicate the cost thereof to the Public Rights-of-Way Trust Fund. 9. The ACHD Capital Improvement Plan shows Fairview as currently operating at Level of Service (LOS) E and is projected to operate at LOS F in 2010. It is not approved for use of Road Impact Fee funds to increase its capacity; therefore, Road Impact Fee offsets may not be given for construction of the roadway improvements along Fairview by the developer, but may be given for right-of-way dedication in addition to what exists now. A person seeking offsets must submit an application to the impact fee administrator prior to breaking ground, in accordance with Section 15 of ACRD Ordinance #188. 1990 traffic counts on Fairview indicate approximately 27,150 ADT east of this project. 10. Eagle Road (State Highway 55) is under the jurisdiction of Idaho Transportation Department. The applicant should coordinate his planning with that Department for requirements and comments. 11. This application is scheduled for public hearing by the Meridian Planning & Zoning Commission on May 11, 1993. Idaho Ave. Meridian, ID 83642 Re: Crossroads Subdivision Dear Gary: January 8, 1994 The developer of Crossroads Subdivision has advised me that the City has withheld authority to proceed with utility installation in the development until he has "worked out the problems" with ACRD. Please be advised that the concerns about traffic in the overall project have been resolved to the District's satisfaction. Briefly, this will require the disconnection of the northern access to Eagle Road (Congressional Drive) from the residential portion of the project. The "street" will become an entrance to the non- residential portion of the project only. Additionally, a "ring- road" type of route will be provided around or through the non- residential part of the project from the future Pine Avenue to Fairview Avenue to assure that the residential and non-residential traffic are not mixed and that non-residential traffic is not routed through the residential area. Stub street connections are being required from the residential portion of the project to the Pine Avenue corridor for future connection and to the property on the east (the church property). The developer has agreed to these revisions and is in the process of making changes to the preliminary plat for the record. As you may recall, the ACHD Commission did not give unqualified approval of the original preliminary when it was referred from the City last summer. The District required the preparation and acceptance of a Traffic Impact Study for the project prior to actual approval of the preliminary plat. This acceptance of the Traffic Impact Study and the implementation of its recommendations will complete the approval of the preliminary and with these changes, the preliminary plat meets the conditions of ACHD as determined by the Traffic Impact Study and can proceed with final platting and construction. This letter represents the District's findings and staff recommended requirements for approval of your project. These recommendations, or variations of them, will be included in a standard staff report and forwarded to the ACHD Commission for action. Because of the holidays, and to give you and your consultants time to review these findings, a revised staff recommendation will not go to the ACHD Commission before the meeting of January 12, 1994, after a staff report is finalized at a Technical Review Committee meeting on January 7, 1994. Staff concerns and suggested remedial actions are as follows: 1. As determined by the traffic analysis, the commercial component of the development represents 90 percent of the peak hour traffic volume. In addition 'to the traffic study, special notice is given the letter from Mr. Tom Wright dated December 7, 1993 in which he stated his belief that the future traffic in the area would be even greater than the traffic study report projected. 2. An alternate roadway plan that separates the commercial and residential traffic is necessary. Without a major redesign of t~.p project along the lines of one of the following alternatives or others that are developed with you and your consultants, the project is not acceptable. A. Congressional Drive should be terminated and not allowed to enter the residential area. A pedestrian/bicycle access should be provided in place of the street connection shown on the preliminary plat. The basis for this request is to minimize cut-through traffic from Congressional Drive to Reagan Drive. The Presidential Drive to Reagan Drive route will still allow some cut-through, but the route will be much more circuitous and will discourage the cut-through practice somewhat. The current layout results in too much traffic on streets that do not have potential for a future traffic signal on Eagle Road. No more than a single traffic signal on Eagle Road at Pine is appropriate. Create a ring road around the commercial area, separating the commercial and residential components of the project. Tie the residential streets into the ring road, thereby eliminating the commercial cut-through traffic. The ring road will have to intersect Pine a minimum of 600-feet (preferably 900-feet) east of Eagle Road and the additional site traffic added to Pine will most likely require a second left turn lane from Pine onto Eagle Road. The additional width needed on Pine to accommodate this additional traffic will be a site impact funded by the developer. This will also require the construction of a portion of Pine Avenue that otherwise would not be necessary. The ring road should tie into the existing Reagan Drive south of the non-residential uses, then directly to Fairview. The north- south residential street should tee into the Reagan Drive at this location also. C. An alternative to the ring road is to separate the vehicular traffic of the non-residential and the residential sites completely and access the residential component of the project from two access roads off Pine. This alternative will minimize the internal site conflicts and left-turn problems on Eagle Road but will require new access points to the undeveloped Pine. Without a ring road, a fairly direct interior routing of the non- residential traffic out to Pine will be necessary to provide safe left turn opportunities onto Eagle Road. We invite you and your engineers to meet with District staff to discuss and resolve these issues. Please call to arrange a time that we can all get together no later than January 4, 1994. Designating certain areas for business uses, as a method of guiding business expansion, is an appropriate approach to Meridian's economic future and provides for the essential difference between the City's business land market and the residential land market. The Comprehensive Plan intends to prepare for Meridian's business and employment future by reserving land for industrial, retail, commercial and office uses and so removing them from the categories of land on which residential development can be proposed. In all review areas, detailed economic analysis is essential, so that the specifics of industrial plans, designs and development will be known. Each Industrial Review Area is recognized as possessing unique physical and locational characteristics, both natural and man-made, which make it a desireable business environment. These characteristics are relatively level topography, potentially good access to rail and freeway f aci 1 ities, and being relatively free from environmental hazards. A specific set of policies has been prepared for the development of each of the Review Areas and is discussed in a later section of the plan document. 4. That the specific Eastern Industrial Review Area is • discussed at Page 19 of the Comprehensive Plan and reads as follows: EASTERN INDUSTRIAi REVIEN AREA/POLICIES: 1. It is the policy of the City of Meridian to encourage and promote the development of an interchange (egress and ingress) at the intersection of Eagle Road and Interstate I-84 by the Idaho Department of Transportation. (This policy was recently deleted from the Plan since the interchange has been constructed.) 2. It is the policy of the City. of Meridian to encourage and promote the development of an overpass, if an interchange is not feasible, at the intersection of Locust Grove and I-84 by the Idaho Department of Transportation. 3. The character, site improvements and type of industrial developments should be harmonized with the residential area to the south (on the upper bench), the contiguous residential area to~the east and north. 4. The utilization of the linear open space corridor of Five Mile Creek, which passes through the Eastern Industrial Review Area, should be maintained as natural resource for both aesthetic and environmental reasons. 5. That the City of Meridian has authority to grant conditional uses pursuant to 67-6512, Idaho Code, and, pursuant to 11-2-418 of the Revised and Complied Ordinances of the City of Meridian, Idaho; 3. Rountree: Did you see the comment from the City Engineer that would indicate that there would be no direct access from any lots on Pine Avenue? Powell: Yes. No problem with access. Rountree: Does the presence of the road create any grief with the way you propose to develop? Powell: I put a couple of concepts before the owner, one of which would be to possibly do a slide over X on the streets and actually create an earth and burin along the Railroad and then possibly even a wooden fence to give further sound barrier. We have also discussed having a slight green belt around the perimeter, which would also outline the existing eight mile lateral to give a slight buffer in that area to. Duane Gugin, 1692 Todd Way, was sworn by the attorney. Gugin: I have a few.-questions. I live in the subdivision to the west of this proposed subdivision. What are the prices ranges of these homes? Johnson: We don't have prices, we have lot sizes. Minimum footage is 1400 sq. feet, so your probably looking at around $80,000. to $90,000. price range. Gugin: Question number two, I believe that Mr. Boesiger proposed to build another subdivision on the southwest corner of Linder and Cherry Lane approximately six months ago. Did that pass may i ask? Johnson: It passed, but he dropped it. Gugin: 120 Units is not a great deal and yet I have one question, in Sunnybrook Farms at the present times, during the summer especially we have a:.water pressure situation out there where it is very low, what is this going to do to our subdivision? Johnson: That's a good question, I don't think anyone here is able to answer that. The City Engineer is the one to answer that. You could contact him concerning this water pressure problem. . Boesiger: We are looking at between $95,000. and $125,000. price range. Gugin: With only one access into this what is this going to do to the traffic pattern? Cherry Lane is already congested. Also this 120 homes is not going to help our schools. Are they going to offer help orspromote help in pursuant to their subdivision to our schools? Johnson: That's something that you need to ask the schools. Johnson:.:At this time we'd like a representative to come forward so we can ask some questions please? They asked for and received a Industrial Light Zoning for the entire property. There was a time when this City did issue the eastern portion of this property a temporary retail:. zone for a potential regional shopping center. That zoning has since expired so the entire 300 acres is zoned as Light Industrial. Presented a photo and explained to the Commission. Wright: There is roughly 160 acres on both sides of Eagle Road, and about half of that west side was platted. Rountree:"~So there wouldn't be any change in the access points. Wright: No, no changes. The property that we are trying to market are the platted lots. We have a major company that has asked for 100 acres. Rountree: You show two accesses onto Eagle Road, do you have a distance between those? Wright: They are approximately ~?0+ Ft., we have those approved. Rountree: One condition of that PUD-General is the 10~ open s~ce, can you show that in the concept, what that's going to include. Crookston: Are you talking about even re-doing some of this for interior roads coming off of Jewell Street. Wright: No. Crookston: What is your plan for coming to the City again when you have a business lined out thats ready to go, they know the property they want what is your thinking as to how that's going to be approached as far as additional improvements such as if the City required design review and things of that nature. Wright: Just that now the Conditional Use Permit that we anticipate that we need would be eliminated as a step but we still have to come in for Design Review and obviously a Building Permit.. Jensen: I was in on the original when UP wanted to develop that particular piece of property over there in Phase I, we did not object to any of it thatthey did with the exception of when they wanted. to~put in the spur line along the west side. When they were doing Phase I I requested a right of way to my property and at that time Mr. Lloyd Howell stated to the Board here it was alright if we took that up in Phase 2 and being a sucker a said yes that was fine, and they didn't put it down in the minutes and Consequently Phase 2 never come about and now I own the property on the west side of Phase I. Showed Commission where abouts the property is located. Previously we have brought our equipment down through an existing road that came down through that property from Eagle Road, well when UP took over and rebuilt that whole area, they constructed a pipe line which was to our advantage, and bring it around to the edge so we didn't have to come all that way and service that ditch, and it made it better for us for irrigation, but it did not give me access to the back piece of property. The only thing I am requesting of Mr. Wr-fight or this group is to see somehow if we can work out a way to get an access to that back 15 acres. Jensen: Yes. Mine goes to a drainage ditch which is a ditch that can be covered up in the future. The purpose of that drainage ditch was for the farms in that area which included the farms that the different properties had, .mine and the neighbors and so on for the water to drain aff the land and go down. It's all developed, there is no use for a drainage ditch. Clerk Niemann: Don't you have access off Fairview? Jensen: I have access, my home is off Fairview. If I took fifty feet off of that property for a right of way, it would put the road within about 25 ft. from my house. Also for fire purposes I think they would want a second access to that property. The only thing I'm requesting this Board anal Mr. Wright to do is see if we can work our something as a right of way for that pr~erty so it won't be an island. DRAINAGE: 1. There will be no acceptance of any increased flow in storm run-off, drainage, or any contaminated waters for which the District might be made liable by the Federal and/or State Clean Water Laws. 2. Existing or replacement of on-site drainage or run-off facilities or modification thereto must be perpetually maintained by the site owner or owners. 3. Drainage plans prepared by a registered engineer may be required where deemed necessary by the District even though on-site modifications to the District drainage system are not required in the development plans. 4. If a drainage lateral owned and maintained by the District courses the site, no alterations of the lateral nor encroachment or its right of way shall be permitted without a license agreement. No access to such drain shall be denied to the District. The water rights of this District are not the same throughout the District. Neither are these always the same on one tract of land. Often these can be simplified without changing the Court confirmed status of the rights, if arrangements are made with the Secretary of the District in the advance planning stages. 2. Any irrigation supply lateral or canal which is owned and operated by the District and which may course the site, must not be obstructed nor encroachment made on its rights of way. °1- ~ ~ C. 3. Any alteration from the original delivery point must be approved by the Water Superintendent and transfers to accomplish this alteration must be arranged with the Secretary of the District as part of the system plan acceptance by the Board of Directors. 4. If irrigation service is not to be provided to the individual properties, all property owners must be notified that the District tax is an obligation of all lands in the Irrigation District. This notification is in compliance with Idaho Law. 6. No destruction, interference, nor limitation upon water flows which are appurtenant to the property- rights of others shall be permitted. 7. If development plans include providing irrigation, operation and maintenance of the system may be undertaken by a Lateral Ditch Water User°s Association, in which case the District assumes no responsibility beyond the original point of delivery for the tract. 8. The District cannot provide permission for alteration of waterways belonging to and being a part of the property rights of individual land owners and to which waters flow from the system of the District. Permission must be granted from each of the property owners having ditch and water rights in the waterway. REVIEW AND APPROVAL PROCESS 1. Applicant shall complete and submit the attached application form to the Secretary of the District. Two (2) copies of the proposed plans shall be submitted with the application. 2. Upon approval of the original application, plans and specifications for construction, prepared by a registered engineer, shall be submitted for review to the District. Plans and specifications shall be reviewed by the District Water Superintendent and/or the District°s engineers. If acceptable, the developer will be notified. Prior to actual construction an estimate of the cost of construction shall be provided to the District. -2- 3. If the owner or his contractor fails to make required repairs or replacements promptly, the District shall make them, and the cost thereof shall be paid by the owner, his contractor or the surety. Crossroads is a proposed 256-lot residential, 5-lot commercial subdivision on 154.5 acres of property located at the southeast corner of Fairview Avenue and Eagle Road (State Highway 55). There will be 14,810-feet of new public streets added to the system. 2. Three entry streets are proposed to provide connection to the arterials of Fairview and Eagle Roads past the large commercial lots (80-feet of right-of-way in these areas) and into the residential area (50-feet of right-of-waX) in the southeast corner of the site. The right-of-way and roadway width may need to be at least 60-feet and 41-feet back-to-back of curb from the main roads to the first intersections in the residential area. This will be determined from the results of a required traffic impact study. 3. The proposed alignment of Emerald/Pine runs along the south boundary of this property, identified as a collector road by the Functional Street Classification Map. Part or all of the right-of-way should be acquired from this project if the alignment is construed to run along the mid-section line (which is the south property line of this project). Impact fee funds 'may be used to acquire the right-of-way for the collector. The staff has identified three options for the consideration of the Co~nission regarding the reservation of right-of-way for Emerald. Reserve one-half the right-of-way (45-feet) from this project and use it to construct half of a future roadway. This developer could use it as one access to Eagle Road, replacing one of the two currently proposed. B. The same right-of-way acquisition as A., but do not construct any of the roadway at this time. C. Defer the decision to reserve the right-of-way by deciding to place the alignment entirely south of this project and obtain the full 90-feet from the property to the south. The property to the south is only about 400- feet in depth (north-to-south), which may limit its use to large commercial or industrial parcels. 4. Because of an existing building on the west side of Eagle Road, the location of the intersection of Eagle and Emerald/Pine would avoid the most damage if it were centered on the mid-section line. This would place the alignment on the applicant's south property line, taking 45-feet from this project. In discussions with the applicant, the staff indicated that this is a major issue which should be resolved through the conduct of a traffic impact study, expanded to study the corridor for Emerald/Pine to determine the following: A. Should the alignment be continuous from the area of Meridian to Boise (i.e., Cole Road)? B. What alignment should the route follow? 5. It was tentatively decided with the developer that the southern entrance from Eagle Road should be. moved slightly north to be better situated with regard to intersection spacing, anticipating the location of Emerald/Pine quite near the south boundary of this project. The developer wants this entrance to be the primary entrance, constructing it with extensive landscaping and islands, etc. 6. The interior layout of the project is well done, presenting a variety of views and aspects for the access ways to the individual lots. The layout develops.a good solar orientation for the building sites and a good circulation pattern so that no lots will have large volumes of traffic past them.• The project has three sub-collector streets to carry the traffic out to the perimeter of the project and then on wider streets to Fairview and Eagle. The layout reflects careful thought and design. • PRELIMINARY PLAT - CROSSROADS SUBDIVISION May 10, 1993 Page 3 7. Assuming that a corridor for Emerald will be established in close proximity to the south boundary of the property, at least one stub street to the south should be provided. The property on the east of this property is owned by a church which has previously expressed its objection to having any stub streets extended to its property line. The traffic study will aid in determining whether or not the stub streets should be required, and if so, where they should be. 8. Fairview Avenue currently has 100-feet of right-of-way and is improved with 70-feet of pavement. The 2000 Urban Street Functional Street Classification Map designates Fairview Avenue as a principal arterial roadway, which generally requires a minimum of 80-feet of right-of-way (the District is requiring 114-feet of right-of-way for this road) , width sufficient for 5 traffic lanes (65-foot street section) and 5-foot sidewalks. The ultimate right-of-way should be acquired now to minimize acquisition and con- struction costs in the future. In the interim, the developer 5-foot sidewalk, or dedicate Rights-of-Way Trust Fund. should be required to construct the cost thereof to the Public 9. The ACRD Capital Improvement Plan shows Fairview as currently operating at Level of Service (LOS) E and is projected to operate at LOS F in 2010. It is not approved for use of Road Impact Fee funds to increase its capacity; therefore, Road Impact Fee offsets may not be given for construction of the roadway improvements along Fairview by the developer, but may be given for right-of-way dedication in addition to what exists now. A person seeking offsets must submit an application to the impact fee administrator prior to breaking ground, in accordance with Section 15 of ACHD Ordinance #188. 1990 traffic counts on Fairview indicate approximately 27,150 ADT east of this project. 10. Eagle Road (State Highway 55) is under the jurisdiction of Idaho Transportation Department. The applicant should coordinate his planning with that Department for requirements and comments. . 11. The District will retain a consultant to prepare and submit a Traffic Impact Study to examine the need and proper alignment for the extension of Emerald Street through this area and to identify a corridor for preservation. The study shall also consider the effects of this project on the transportation system; specifically, the appropriate locations and operation of the access street intersections with Fairview and Eagle Roads (and, presumably, the future Emerald Street extension). The applicant will be required to pay for that portion of the study which deals with the specific effects of the project. Additional requirements may be imposed pending the findings of the study and any design, engineering or construction accomplished prior to the District's review and approval of the study is entirely at the risk of the applicant. 2. Dedicate 57-feet of right-of-way from the centerline of Fairview abutting the parcel (7 additional feet). The owner will be compensated for this additional right-of-way from available impact fee revenues in this benefit zone. 3. Construct 5-foot wide concrete sidewalk along Fairview abutting plat, or deposit the cost thereof to the Public Rights-of-Way Trust Fund. 4. Direct lot or parcel access to Fairview is prohibited, in compliance with District policy. Lot access restrictions shall be stated on the final plat. 5. Direct lot or parcel access to Eagle is prohibited, in compliance with District policy. Lot access restrictions shall be stated on the final plat. 6. Relocate/replace the entrances to Eagle Road in. accordance with the recommendations of the traffic study and District Traffic Services staff. 7. Shift the location of southerly access road to Eagle to the north to provide better spacing on Eagle Road. 8. Provide a stub street to the south boundary of the property to connect with Emerald Street. 9. Provide a stub street to the east boundary of the property, pending more information about the future development of the adjacent church property. 10. Street and drainage improvements required in the public right- of-way shall be designed and .constructed in conformance with District standards and policies. 2. Dedicated streets and drainage systems shall be designed and constructed in conformance with District standards and policies. 3. Specifications, land surveys, reports, plats, drawings, plans, design information and calculations presented to ACRD shall be sealed, signed and dated by a Registered Professional Engineer or Professional Land Surveyor, in compliance with Idaho Code, Section 54-1215. 4. Provide written approval from the appropriate irrigation/drainage district authorizing storm runoff into their system. 5. Locate obstructions (utility facilities, irrigation and drainage appurtenances, etc.) outside of the proposed street improvements. Authorization for relocations shall be obtained from the appropriate entity. 6. Continue existing irrigation and drainage systems across parcel. 7. Submit three sets of street construction plans to the District for review and appropriate action. 8. Submit site drainage plans and calculations for review and appropriate action by ACRD. The proposed drainage system shall conform to the requirements of the City of Meridian and shall retain all storm water on-site. Public street drainage facilities shall be located in the public right-of-way or in a drainage easement set aside specifically for that use. There shall be no trees, fences, bushes, sheds, or other valuable amenities placed in said easement. Drainage easements and their use restrictions shall be noted on the plat. 9. Provide design data for proposed access to public streets for review and appropriate action by ACRD. to . Locate driveway curb cuts a minimum of 5-feet from the side lot property lines when the driveways are not being shared with the adjacent property. Install a stop sign on every unsignalized approach of a project street to an intersection involving a collector or arterial as the cross-street. The stop sign shall be installed when the project street is first accessible to the motoring public. 13. Aright-of-way permit must be obtained from ACRD for all street and utility construction within the public right-of-way. A request for modification, variance or waiver of any requirement or policy outlined herein shall be made, in writing, to the Manager of Engineering Services within 15 calendar days of the original Commission action. The request shall include a statement explaining why such a requirement would result in substantial hardship or inequity.
