Re: Reconsideration and Re-opening of Public Hearing for the Clearbrook Estates Subdivision

This letter is in reference to the Council's decision on July 22, 2003 to deny PP 03-007 and VAR 03-012,
Clearbrook Estates Subdivision.
By this letter Briggs Engineering, Inc., on behalf of RK Development, LLC is requesting that the Meridian City
Council reconsider their decision to deny the preliminary plat with a variance for the Cleazbrook Estates Subdivision,
and reopen the public hearing.
As the representative for the applicant, I believe that there maghave been some miscommunication between the
Council and myself. I understand that one or more members of the Council believed that Briggs Engineering had
done all it could do to comply with the Council's direction from their July 15th hearing and was not willing to try
anything different. Further, we believed that the modified plan submitted to the Council on July 22na was in keeping
with Council member Tammy de Weerd's direction from the July 15`h hearing. I believed the choker street design we
submitted was what she had in mind, but I was incorrect. Also, I understood [hat once the public hearing had been
closed, I was not permitted to address the Council any further regarding this issue.
The primary issue in question is that of the lack of traffic control or cahning devices on Indian Rocks Street that
would effectively slow down traffic. We have modified the preliminary plat to include two additional islands in the
center of Indian Rocks Street. One island will be located east of the intersection with NW 3'd Avenue and a second
island will be located west of the intersection. Both of the islands will be landscaped. I believe this modification
represents the solution the Council may have been looking for and will receive a favorable review at another public
heazing.
We understand that there maybe additional fees associated with re-noticing the public hearing and we aze willing to
pay those fees in addition to waiting for the next available hearing date.
