Landscaping, sprinkling, screening, lighting, pavement and
striping shall be done in accordance with City Zoning

site. The plan shall be designed by a licensed engineer or
architect and approved by the City Engineer.
5. Right of Way along Meridian Rd. needs to be set aside with
ACHD for future improvements of this tt^avel way. Building

of Meridian Road.

Dear Councilmen:
I have reviewed the application for Cedar Crest Apartments. Thisi
planned development will accelerate the need for Joint School `
District No. 2 to construct additional classrooms and/or to
adjust school attendance boundaries. Meridian Schools do not
have excess capacity. Nearly every school in the district is
beyond capacity.
The Meridian School District supports economic growth for Idaho
and specifically the district's area, but such growth produces a
need for additional school construction. We ask your support for
a development fee statute on new home construction or a real
estate transfer fee to help offset the costs of building
additional school facilities. If this support is lacking then we
ask that additional residential development be denied.
Residents of the new subdivision cannot be assured of attending
the neighborhood school as it may be necessary to bus students to
available classrooms across the district.
We ask that you assure the developer will provide walkways, bike
paths and safe pedestrian access.

FACTS & FINDINGS:
1. Charles Ward is requesting conditional use approval to construct 20
apartment units on property located at the southeast corner of King
Street and Meridian Street. '
2. King Street is a local street that has 60-feet of right-of-way and im-
proved with 24-feet of paving.
3. Meridian currently has 60-feet of right-of-way and is improved with
24-feet of pavement.
The 2000 Urban Street Functional Street Classification Map designates
Meridian as a collector roadway, which generally requires a minimum of
60-feet of right-of-way (the District requires 90-feet of right-of-way on
section line roads in an urban impact area) , width sufficient for 3 traf-
fic lanes (41-foot street section) and 5-foot sidewalks. The ultimate
right-of-way should be acquired now to minimize acquisition and con-
struction costs in the future .
In the interim, the developer will be required to construct 5-foot side-
walk .
4. The City of Meridian has requested that Meridian Road be reclassified
as an arterial street, which will require greater right-of-way width.
5. The ACHD Capital Improvement Plan shows Meridian as currently operat-
ing at Level of Service (LOS) A/B and is projected to operate at LOS
A/B in 2010. It is not approved for use of Road Impact Fee funds to
increase its capacity; therefore, Road Impact Fee offsets may not be
given for construction of the roadway improvements along Meridian by

the developer, but may be given for right-of-way dedication in addition
to what exists now. A person seeking offsets must submit an applica-
tion to the impact fee administrator prior to breaking ground, in accor-
dance with Section 15 of ACHD Ordinance #188.
6. Williams Street (abutti~rg parcel) has 60-feet of right-of-way and is
unimproved from about 100-feet to the east. If the developer plans to
use the street as an access, then the street should be paved to the
nearest paved portion of the street. The street needs to be rebuilt
from subject parcel to E. 1st Street. A paved public turnaround would
be required. Staff does not recommend that Williams be extended
through the subject parcel due to the proximity to the intersection of
Meridian and Franklin .
7. No site plan has been provided with the application; therefore, staff
recommends to the City of Meridian that this application be deferred
until the applicant provides a specific site plan.
8. This application is scheduled for public hearing by the Meridian Plan-
ning & Zoning Commission on May 6, 1993.
The following requirements are provided to Meridian Planning & Zoning as
general conditions for approval. More requirements may be imposed pending
receipt of a specific site plan.
SITE SPECIFIC REQUIREMENTS:
1. Construct curb, gutter, 4-foot sidewalk and match paving on King
abutting parcel. Improvements shall be constructed to a 36-foot back-
to-back street section.
2. Dedicate 45-feet of right-of-way from the centerline of Meridian abut-
ting parcel (15 additional feet) . The owner will be compensated for
this additional right-of-way from available impact fee revenues in this
benefit zone .
3. Construct 5-foot wide concrete sidewalk (next to the new right-of-way
line) along Meridian abutting parcel . '
STANDARD REQUIREMENTS:
4. Street and drainage improvements required in the public right-of-way
shall be designed and constructed in conformance with District stan-
dards and policies .
5. Specifications, land surveys, reports, plats, drawings, plans, design
information and calculations presented to ACRD shall be sealed, signed
and dated by a Registered Professional Engineer or Professional Land
Surveyor, in compliance with Idaho Code, Section 54-1215.

6. Provide written approval from the appropriate irrigation/drainage dis-
trict authorizing storm runoff into their system.
7. Locate obstructions (utility facilities, irrigation and drainage appur-
tenances, etc.) outside of the proposed street improvements. Authoriza-
tion for relocations shall be obtained from the appropriate entity.
8. Continue existing irrigation and drainage systems across parcel.
9. Submit three sets of street construction plans to the District for review
and appropriate action.
10. Submit site drainage plans and calculations for review and appropriate
action by ACHD . The proposed drainage system shall conform to the
requirements of Meridian City and shall retain all storm water on-site.
Public street drainage facilities shall be located in the public right-of-
way or in a drainage easement set aside specifically for that use.
There shall be no trees, fences, bushes, sheds, or other valuable amen-
ities placed in said easement .
11. Provide design data for proposed access to public streets for review
and appropriate action by ACHD .
12. Locate driveway curb cuts a minimum of 5-feet from the side lot proper-
ty lines when the driveways are not being shared with the adjacent
property.
13. A right-of-way permit must be obtained from ACHD for all street and
utility construction within the public right-of-way. Contact Construc-
tion Services at 345-7667 (with zoning file number) for details.
14. A request for modification, variance or waiver of any requirement or
policy outlined herein shall be made, in writing, to the Manager of
Engineering Services within 15 calendar days of the original Commission
action. The request shall include a statement explaining why such a
requirement would result in substantial hardship or inequity.

FINDINGS OF FACT AND CONCLUSIONS
The above entitled matter having come on for public hearing
May 11, 1993, at the hour of 7:30 o'clock p.m., the Petitioner
appearing in person, the Planning and Zoning Commission of the City
of Meridian having duly considered the evidence and the matter
makes the following Finding~~ of Fact, and Conclusions:
FINDINGS OF FACT
1. That a notice of a public hearing on the Conditional Use
Permit was published for two (2) consecutive weeks prior to the
said public hearing scheduled for May 11, 1993, the first
publication of which was fifteen (15) days prior to said hearing;
that the matter was duly considered at the May 11, 1993, hearing;
that the public was given full opportunity to express comments and
submit evidence; and that copies of all notices were available to
newspaper, radio and television stations;
2. That this property is located within the City of
Meridian; the property is sufficiently described in the application
which description is incorporated herein.
3. That the property is zoned Old Town, which requires a

conditional use permit for the development of an apartment housing
unit which the application requests.
4. That the Old Town District is described in the Zoning
Ordinance, 11-2-408 H. 10. as follows:
SOT) Old Town District: The purpose of the
(OT) District is to accommodate and encourage
further expansion of the historical core of
the community; to delineate a centralized
activity center and to encourage its renewal,
revitalization and growth as the public, and
quasi-public, cultural, financial and
recreational center of the City. A variety of
these uses integrated with general business,
medium-high to high density residential, and
other related uses is encouraged in an effort
to provide the appropriate mix of activities
necessary to establish a truly urban City
Center. The District shall be served by
Municipal Water and Sewer systems of the City
of Meridian. Development in this district
must give attention to the handling of high
volumes of traffic, adequate parking, and
pedestrian movement, and provide strip
commercial develd~ment, and must be approved
as a conditional use, unless otherwise
permitted.
5. That the use proposed by Applicant is not a specific
permitted use in the Zoning Schedule of Use Control, 11-2-409.
6. That multi-family dwelling units are listed as a
conditional use in Old Town.
7. That the property to the west is used as an office and as
storage for a utility contractor; that property to the north was
used as a computer sales office and was planned for a residential
development; that property to the east is used for a grocery store
and as a used clothing and furniture store; that the property to
the south is for an office building.,

8. That sewer and water is available to the property.
9. That the City Engineer, Ada county Highway District,
Meridian School District, Meridian police and fire Departments have
submitted comments and they are incorporated herein as if set forth
in full herein; that the City Engineer's comments reflect that
there is a sewer line in the alley between King and Williams street
and it could be abandoned to the east boundary of the subject
parcel if necessary.
10. That Nampa Meridian Irrigation District and Central
District Health Department may submit comments and they shall be
incorporated herein as if set forth in full.
11. That proper notice has been given as required by law
and all procedures before the Planning and Zoning Commission have
been given and followed.
CONCLUSIONS
1. That all the procedural requirements of the Local
Planning Act and of the Ordinances of the City of Meridian have
been met including the mailing of notice to owners of property
within 300 feet of the external boundaries of the Applicant's
property.
2. That the City of Meridian has authority to grant
conditional uses pursuant to 67-6512, Idaho Code, and, pursuant to
11-2-418 of the Revised and Compiled Ordinances of the City of
Meridian;
3. That the City of Meridian has authority to place
conditions on a conditional use permit and the use of the property

pursuant to 67-6512, Idaho Code, and pursuant to 11-2-418(D) of the
Revised and Compiled Ordinances of the City of Meridian, Idaho;
4. That 11-2-418(C) of the Revised and Compiled Ordinances
of the City of Meridian sets forth the standards under which the
Planning and Zoning Commission and the City Council shall review
applications for Condition~.~l Use Permits; that upon a review of
those requirements and a review of the facts presented and the
conditions of the area, the Planning and Zoning Commission
concludes as follows:
a. The use, would in fact, constitute a
conditional use and a conditional use permit
is required by ordinance.
b. The use should be harmonious with and in
accordance with the Comprehensive Plan but the
Zoning Ordinance requires a conditional use
permit to allow the use.
c. The use apparently would be designed and
constructed, to be harmonious in appearance
with the intended character of the general
vicinity.
d. That the use, would not be hazardous nor
should it be disturbing to existing or future
neighboring uses.
e. The property has sewer and water service
available.
f. The use would not create excessive
additional requirements at public cost for
public facilities and services and the use
would not be detrimental to the economic
welfare of the community.
g. The use would not involve a use,
activity, process, material, equipment or
conditions of operation that would be
detrimental to person, property or the general
welfare by reason of excessive production of
traffic or noise.

h. That sufficient parking for the property
and the proposed use will be required and the
parking ordinance shall be met including the
preparation of a parking plan and landscaping.
i. The development and uses will not result
in the destruction, loss or damage of a
natural or scenic feature of major importance.
5. That the comments of the City Engineer must be met and
complied with and the sewer line in alley between Ring and Williams
Streets must be addressed at the City Council.
6. The requirements of the Ada County Highway District must
be met; that the requirements of the Nampa & Meridian Irrigation
District, if submitted, shall be met.
7. That all ordinances of the City of Meridian must be met,
including but not limited to, the Uniform Building Code, Uniform
Fire Code, Uniform Plumbing Code, the Fire and Life Safety Code,
all parking and landscaping requirements.

Dear Mr. Forney,
The subject property is presently bare land.
The property has enough footage to qualify for 21 living
units but we are requesting 20. These would consist of 5 -
four-plea units. Each apartment would have either a double or
single garage. The average living space would be 1000+ sq. ft.
Location makes this property very desireable as it is
close to shoping in down town Meridian. Traffic .access is
desireable for residential development.
This project lies within the Nampa Meridian Irrigation
District.
Any additional sewer, water and trash fees would be
acceptable to the project.
I have read the content of this application and it is
accurate to the best of my knowledge.

FACTS & FINDINGS:
1. Charles Ward is requesting conditional use approval to construct 20
apartment units on property located at the southeast corner of King
Street and Meridian Street.
2. King Street is a local street that has 60-feet of right-of-way and im-
proved with 24-feet of paving.
3. Meridian currently has 60-feet of right-of-way and is improved with
24-feet of pavement.
The 2000 Urban Street Functional Street Classification Map designates
Meridian as a collector roadway, which generally requires a minimum of
60-feet of right-of-way (the District requires 90-feet of right-of-way on
section line roads in an urban impact area), width sufficient for 3 traf-
fic lanes (41-foot street section) and 5-foot sidewalks. The ultimate
right-of-way should be acquired now to minimize acquisition and con-
struction costs in the future.
In the interim, the developer will be required to construct 5-foot side-
walk.
4. The City of Meridian has requested that Meridian Road be reclassified
as an arterial street, which will require greater right-of-way width.
5. The ACHD Capital Improvement Plan shows Meridian as currently operat-
ing at Level of Service (LOS) A/B and is projected to operate at LOS
A/B in 2010. It is not approved for use of Road Impact Fee funds to
increase its capacity; therefore, Road Impact Fee offsets may not be
given for construction of the roadway improvements along Meridian by

Pressure Irrigation
Dear Jim:
Nampa & Meridian Irrigation District has reviewed the pump station
details furnished for the above mentioned project. The pump
station and pumps appear to be adequate, thus if this portion of
the pressurized irrigation system is built according to the plans
that were reviewed, it will be adequate to meet the District's
requirements for this type of installation.
Nampa & Meridian Irrigation District does require a contract
between the developer or developers before the District can assume
control of the operation and maintenance of these facilities. If
this assumption is intended for the above mentioned project, please
have your client or clients contact Daren Coon, Secretary/Treasurer
of Nampa & Meridian Irrigation District, so that he can commence
with the paper work that is necessary.

City of Meridian and the laws of the State of Idaho, that the
City Council of the City of Meridian will hold a public hearing
at the Meridian City Hall, 33 East Idaho Street, Meridian,
Idaho, at the hour of 7:30 p.m., on July 20, 1993, for the
purpose of reviewing and considering the Application of Charles
Ward, for a Conditional Use Permit for the property located in
