Stiles: I did ask for that but since I was the one that put it on the agenda basically I guess
the request has been verbally withdrawn.
Morrow: So there is no discussion and it is off the agenda.
Corrie: Thank you Shari.
ITEM #7: LATE COMERS AGREEMEM' FOR CANDLELIGHT SUBDIVISION BY MCBEE
CORPORATION:
Corrie: Bruce, do we have that? We don't have it with our in our packet.
Freckleton: You don't have copies of it in your packet?
Corrie: No
Morrow: We don't have any information concerning it.
Freckleton: Mr. Mayor and members of the Council I will give you a brief synopsis here of
what has transpired. In 1983 or 1993 excuse me a late comers agreement was drafted for
Candlelight Subdivision. The agreement was signed by the developer this was during the
time when Jack was going through his treatments and this sort of thing. We lost Jack and
we had Wayne Forrey involved, the agreement never did get executed by the City and
never was recorded. The ball kind of got dropped and in 1994 the developers built phase
3 of Candlelight Subdivision and installed an additional bunch of 12 inch water main. in Ten
Mile Road and Ustick Road. At that point in time they wrote us and requested that the
additional expense be added to the late comers agreement. They recently contacted me
to find out where things were and in my research I found that nothing had been done on
this agreement since the original draft of 1993. I got together with Wayne Crookston we
went through, we recalculated it because of the ir*;;reased service area and the increased
costs. We have drafted a new agreement, we have sent it down to California to the
developers for their review, they have reviewed it, they have signed it, they sent a faxed
copy of the signature portion back to us for tonight's meeting. I do ,have that, I thought that
you guys had it too. They are in total agreement to it we just need to move forward and
approve that agreement if possible and get the Mayor's and City Clerk's signatures.
Corrie: You say the City Attorney has looked at this and approved it?
Freckleton: Yes
Corrie: My suggestion to the Council would be that we make sure that he has.

Morrow: I am prepared to make a motion that the Council approve the late comers
agreement for Candlelight subdivision by McBee Corporation subject to the City Attomey
sign off and approval having obtained that we would authorize the Mayor to sign and the
Clerk to attest that late comers agreement. .

agreement subject to the Attomey sign off and if it is done so that the Mayor would sign

ITEM #8: BILL SIMONS, 675 S. CINDER ROAD: REQUEST HOOK UP TO CITY SEWER:
Cowie: Bruce?
Freckleton: Mr. Mayor, members of the Council, Mr. Simons came into our office I believe
it was last week, Tuesday. He lives out on Llnder Road across from the Landing
Subdivision. His property fronts Llnder Road, fronts the sewer and water mains that were
installed by Skyline for the Landing Subdivision. Mr. Simons has been experiencing some
problems with his septic drain field has failed and he requested connection to the sewer.
Last week we explained to him the situation with his property being situated in the County
that it would require a City Council approval and also the situation that exists with having
to pay double assessments for that connection. Mr. Simons did come and he paid the
double assessments, he took care of all of the fees and we got him moving ahead on that.
I think he had some comments that he wanted to raise tonight.
Simons: I don't know what comments I want to make but other than the fact, the double
fee kind of bothers me because, I have to pay it I will pay it. That street has been tom up
so much so long we have had to alter our way of getting in there on many occasions I had
to park vehicles down the road. I couldn't' get into my own driveway for I don't know how
many times. Then when they built the bridge now they have ,diverted us around the
subdivision across a lot, I don't even know whose lot is was but it was a vacant lot with
ruts and holes and it was horrendous. I have broken windshield from it. The inconvenience
it was just unbelievable. I anticipate more because they approved a subdivision down the
street anal they went halfway back. Now. they are going to go down around to Waltman
Lane and then they are going to come back around. So I anticipate one of these days and
I don't even mind being part of the (inaudible) of the City we are sun'ounded anyway. But
my biggest thing I was wondering if there was any chance of getting a reduced rate.

This letter is in response to your correspondence of January 31, 1995 concerning the installation
of street name signs in new Meridian subdivisions.
Piedmont Subdivision was designed by Roylance Associates. The signs were not ordered
because ACRD was not notified that the final plat was approved. We have contacted Roylance
for a copy of the signed plat and we will order the necessary signs.
Merrywood Subdivision Number 2 was designed by~ Johnson Engineering. The signs were not
ordered because ACRD was not notified that the final plat was approved. We have contacted
Johnson Engineering for a copy of the signed plat and we will order the necessary signs.
Cherry Lane Village Number 5 was designed by Paul White Development. The signs were not
ordered because ACHD was not notified that the final plat was approved. Paul White has
indicated that he expects to fmalize the plat within the next ten days. We will order the
necessary signs when the plat is finalized and we receive a signed copy.
ACHD has received the final plat for Meridian Greens Subdivision Number 3 -Phase 2A. The
signs nave peen ordered and Glenco Development has been notified that they are ready for
installation.
Hunts Bluff Subdivision Number 2 was designed by Far West Development. The signs were
not ordered because ACHD was not notified that the fmal plat was approved. We have
contacted Far West Development for a copy of the signed plat and we will order the necessary
signs.
As we discussed, the needed signs for the Tall Pine Place/Pine Street intersection of the Conifer
Subdivision were ordered and installed on September 29, 1994. The stub street to the east of
tall Pine Place was not named in the plat as therefore was not signed. I suspect that the roadway
will be named once the adjacent parcel redevelops and the stub street is extended.

Candlelight Subdivision Number 3 was designed by Tealey's. The signs were not ordered
because ACHD was not notified that the final plat was approved. We have contacted Tealey's
for a copy of the signed plat and we will order the necessary signs.
Our site review process also showed that there were no signs for the Lanesbury Lane
Subdivision on Meridian Road. I contacted the developer to get a final plat of his site and the
signs have now been ordered.
As we discussed over lunch the other day, the Ada County Higiaway District realizes the
importance of adequate signing for both the drivers' convenience and traffic safety. We have
revised out internal procedures to ensure that future signing requests are completed in a timely
and efficient manner. Also, our weekly field trips with ACHD's Development Services
Department now includes a site check of recent subdivisions to ensure that the necessary signs
are installed at the proper time.

Moore: We're finding that to accommodate the type of employer
and new business that we're observing as seeking to come into
Boise, that there are a lot of small users as opposed to a lot of
lat^ge users and that's the reason for so many half acre lots here
so we can accommodate the smaller user to create some employment
in Meridian and we can also by combining the lots then we have
the flexibility to provide an acre lot, an acre and half lot and
so on. It's very unlikely that this will be deweloped lot by lot
like a residential subdivision.

Re: Candlelight Subdivision #3
Dear Councilmen:
I have reviewed the application for Candlelight Subdivision #3.
This planned development will accelerate the need for Joint
School District No. 2 to construct additional classrooms and/or
to adjust school attendance boundaries. Meridian Schools do not
have excess capacity. Nearly every school in the district is
beyond capacity.
The Meridian School District supports economic growth for Idaho
and specifically the district's area, but such growth produces a
need for additional school construction. We ask your support for
a development fee statute on new home construction or a real
estate transfer fee to help offset the costs of building
additional school facilities. If this support is lacking then we
ask that additional residential development be denied.
Residents of the new subdivision cannot be assured of attending
the neighborhood school as it may be necessary to bus students to
available classrooms across the district.
We ask that you assure the developer will provide walkways, bike
paths and safe pedestrian access.
