NOTICE IS HEREBY GIVEN pursuant to the Ordinances of the
City of Meridian and the laws of the State of Idaho. that the
City Council of the City of Meridian will hold a public gearing
at Meridian City Hall, 33 East Idaho Street, Meridian, Idaho at
the hour of 7:30 o'clock p.m., on July 6, 1993, for the purpose
of reviewing and considering the Application of HUNEMILLER-WURTZ
ENTERPRISES, for a preliminary plat of the property located

FACTS & FINDINGS:
1. Bridgewood Park is a 20 -lot multi -family (20 fourplex buildings = 80
living units) residential subdivision located at the east end of James
Court (a private street) which is located on the east side of Meridian
Road approximately 1,600 -feet north of Cherry Lane. All the proposed
internal streets will be private. No new public streets are planned.
2. Meridian Road has recently been reconstructed so no pavement cuts will
be allowed without Commission approval.
3. James Court is a private street that is improved with a curb along the
south side and 20 -feet of paving. The approach at Meridian Road is
24 -feet wide and is quite narrow to handle the potential traffic from
subject development along with the existing apartment complex (50 -
living units access James Court) for a total of 130 -units and also what-
ever may be built to the north of the proposed development. This
should be widened when the adjoining property to the north is devel-
oped, and there is uncertainty as to access to north and east.
4. This application is scheduled for public hearing by the Meridian Plan-
ning & Zoning Commission on January 12, 1993.
SITE SPECIFIC REQUIREMENTS:
1. Utility street cuts in the new pavement on Meridian must be approved
by the District Commission.

2. Submit a traffic impact study to the District in accordance with District
Policy. Coordinate required information with the Traffic Services De-
partment prior to commencing the study.
3. Staff recommends to Meridian Planning and Zoning that this application.
be deferred until a traffic impact study has been reviewed.
STANDARD REQUIREMENTS:
1. A right-of-way permit must be obtained from ACHD for any street or
utility construction within the public right-of-way. Utility cuts should
be combined where practical to limit pavement damage. Contact Con-
struction Services at 345-7667 (with zoning file number) for details.
2. A request for modification, variance or waiver of any requirement or
policy outlined herein shall be made, in writing, to the Manager of
Engineering Services within 15 calendar days of the original Commission
action. The request shall include a statement explaining why such a
requirement would result in substantial hardship or inequity.

Re: Bridgewood Park Subdivision
Dear Commissioners:
I have reviewed the application for Bridgewood Park
Subdivision. This planned development will accelerate the need
for Joint School District No. 2 to construct additional
classrooms and/or to adjust school attendance boundaries.
Meridian Schools do not have excess capacity. Nearly every
school in the district is beyond capacity.
The Meridian School District supports economic growth for Idaho
and specifically the district's area, but such growth produces a
need for additional school construction. We ask your support for
a development fee statute on new home construction. We ask your
support for a development fee statute on new home construction or
a real estate transfer fee to help offset the costs of building
additional school facilities. If this support is lacking then we
ask that additional residential development be denied.
Residents of the new subdivision cannot be assured of attending
the neighborhood school as it may be necessary to bus students to
available classrooms across the district.
We ask that you assure the developer will provide walkways, bike
paths and safe pedestrian access.

Cherry Larne and could be considered a location for a

the roadways shown within the plat could be private
however, consideration should be given to providing
some public roadway with a stub road into the property
to the east for future access. ACHD has required a
traffic impact study.
4. Any sewer and water lines located in a private roadway
need to be situated within a permanent recorded
easement written in favor of the City of Meridian.
5. Sewer laterals shall be located on street centerline or
south or west of centerline. Water mains shall be
located 12 feet north or east of street centerline.
6. Show street light and fire hydrant locations.
7. Any gate installed across a private street must be
accessible by City water, sewer and emergency
personnel.
e. The sewer line crossing Lot 14 — Block 1 shall be
centered within a 16 foot wide permanent easement.
9. Maintenance of any private roadway and subsurface storm
water disposal systems shall be the responsibility of
the Homeowners Association.
10. It appears from the FEMA FIRM Maps that the southwest
corner of this project could be impacted by Flood Zone
A E together with the length of James Court Lane
extending to this proposed development.

FINDINGS OF FACT AND CONCLUSIONS OF LAW
The above entitled matter having come on for public
hearing January 12, 1993, at the hour of 7:30 o'clock p.m. Testi-
mony was presented in favor of request, and also in opposition
thereto. The Planning and Zoning Commission of the City of
Meridian having duly considered the evidence and the matter
makes the following Findings of Fact and Conclusions of Law.
FINDINGS OF FACT
1. That a notice of public hearing on the Application
for Rezone was published for two (2) consecutive weeks prior to
the said public hearing scheduled for January 12, 1993, the first
publication of which was fifteen (15) days prior to said hearing;
that the public was given full opportunity to express comments
and submit evidence; and that copies of all notices were avail-
able to newspaper, radio and television stations.
2. That this property is located within the City of
Meridian and is owned by Petitioner, RUNEMILLER and STUHR, and
is described in the application which description is incorpor-
ated herein.
FINDINGS OF FACT AND CONCLUSIONS OF LAW - 1
3. That the property is zoned R-15 and the proposed
use is proper and permitted in an R-15 zone.
4. That the applicants desire a conditional use Permit
for said subdivision so as to allow for private streets within
the subdivision, since the access to said subdivision is by
private road.
5. That access to the subject property is by James Court
Drive, a private road, an asphalt roadway 22 feet wide, aid is a
private road.
6. That an apartment complex, known as James Court, borders
the subject property on the west. That included in the Deed to
the subject property, a 60 foot wide easement is reserved along
the north side of the James Court property. However, an examination
of the James Court premises clearly shows that the James Court
property has been developed and constructed clear up to the south
edge of the 22 foot roadway. Therefore, as a practical matter,
any access to the subject property over and above the 22 foot
roadway is not available.
7. That the development plan proposed by applicants does
not provide for curbs and sidewalks within the subdivision.
8. That city sewer and water is already available to
the property, but the use may require additional charges or
f ees .
9. That notice was given to all property owners who
are within 300 feet of the external boundaries of the land

being considered, and all property owners included within the
property being considered.
CONCLUSIONS OF LAW
1. That all the procedural requirements of the Local
Planning Act and of the Ordinances of the City of Meridian have
been met including the mailing of notice to owners of property
within 300 feet of the external boundaries of the applicant's
property; including obtaining the consent of 75% of the owners
of property within 300 feet of the external boundaries of the
applicant's property.
2. That the City of Meridian has authority to grant
conditional uses pursuant to 67-6512, Idaho Code, and, pursuant
to 11-2-418 of the Revised and Compiled Ordinances of the City
of Meridian; and
3. That the City of Meridian has authority to place con-
ditions on a conditional use permit and the use of property pur-
suant to 67-6512, Idaho Code, and pursuant to 11-2-418(D) of
the Revised and Compiled Ordinances of the City of Meridian,
Idaho;

4. That 11-2-418(C) of

of the City of Meridian
sets forth
the standards
under
which
the Planning and Zoning
Commission
and the City Council
shall
review applications for
Conditional
Use Permits;
that
upon a
review of those requirements and a
review of the facts
presented and the conditions of
the area,
the Planning
and
Zoning
Commission concludes as
follows:
FINDINGS OF FACT AND CONCLUSIONS OF LAW - 3
a. The use of private roads, would in fact, consti-
tute a conditional use and a conditional use
permit is required by ordinance.
b. The use would be harmonious with and in accordance
with the Comprehensive Plan but the Zoning Ordin-
ance requires a conditional use permit to allow
the use of private roads.
c. The use apparently would be designed and constructed
to be harmonious in appearance with the intended
character of the general vicinity.
d. That the use would not be hazardous nor should
it be disturbing to existing or future neighboring
uses.
e. The property has sewer and water service available.
f. The use would not create excessive additional
requirements at public cost for public facilities
and services and the use would not be detrimental,
to the economic welfare of the community.
g. The use would not involve a use, activity, process,
material, equipment or conditions of operation that
would be detrimental to person, property or the
general welfare by reason of excessive production
of traffic or noise.
h. That sufficient parking for the property and the
proposed use will be required. That access to prop-
erty, while minimum, is required.
i. The development and uses will not result in the
destruction, loss or damage ofa natural or scenic
feature of major importance.
5. Curbs and sidewalks should be required in the sub-
division.

and approves these Findings of Fact and Conclusions.

DECISION AND RECOMMEENDATION `
The Meridian Planning and Zoning Commission hereby
recommends to the City Council of the City of Meridian that they
approve the Conditional Use Permit requested by the Applicant
for the property described in the application with.the condi-
tions set forth in the Findings of Fact and Conclusions of Law
and that the property be required to meet the water and sewer
requirements, the fire and life safety codes, and the Uniform
Building Code, and other Ordinances of the City of Meridian.

Conditional Use Permit/Bridgewood Park Subdivision
Our firm represents the owners of James Court Apartments: As you are a aware, there
is a private lane running along the northern boundary of our client's property that accesses their
apartment units. It is our understanding that you propose a development on the east side of our
client's property and have proposed to the City of Meridian that you will access your property
over the James Court Lane. That will not be permitted.
The purpose of this letter is to inform you that our client has not nor will it grant to you
access easement over James Court Lane. They will have representatives at your March 16,
1993, hearing to inform the Meridian City Council of their position.
If you have any public document that shows that our client may have previously granted
such an easement, I would be interested in receiving a copy. You may want to make
arrangements with the land owner on the north of the James Court property for an access
easement.

response. Any questions of staff?
Tolsma: . Is now when we have to have that .joint road entry
document? Do we have to have that first?
Kingsford: That is on James Court.
Eng. Smith: I haven't received any other correspondence from
that other owner at all.
Tolsma: I know they said they had an agreement there but I've
not come across anything in these files here.
Eng. Smith: It seems like they were going to go twelve foot on
the other side of the center line of half of a street to the
north so that we would have two lanes going back to the
subdivision.
Tolsma: But Dorado Development was going to put part of that
road in. I .just wondered if we ever had a letter stating the
fact that they were actually going to do that.
Kingsford: You could make that a condition for approval to make
sure it has been deeded to the Highway District.
The Motion was made by•Tolsma and seconded by Yerrington to
approve the Final Plat on Bridgewood Subdivision conditioned upon
receiving confirmation of deeded land from Dorado/James Court
north to south to accommodate a full street.

Re: Bridgewood Park Subdivision
Dear Commissioners:
I have reviewed the application for Bridgewood Park
Subdivision. This planned development will accelerate the need
for Joint School District No. 2 to construct additional
classrooms and/or to adjust school attendance boundaries.
Meridian Schools do not have excess capacity. Nearly every
school in the district is beyond capacity.
The Meridian School District supports economic growth for Idaho
and specifically the district's area, but such growth produces a
need for additional school construction. We ask your support for
a development fee statute on new home construction or a real
estate transfer fee to help offset the costs of building
additional school facilities. If this support is lacking then we
ask that additional residential development be denied.
Residents of the new subdivision cannot be assured of attending
the neighborhood school as it may be necessary to bus students to
available classrooms across the district.
We ask that you assure the developer will provide walkways, bike
paths and safe pedestrian access.

Dear Wayne:
The subdivision plat of Bridgewood park is in accordance with the approved
preliminary plat and conforms to the requirements of the Meridian City Subdivision
and Zoning Ordinances and Comprehensive Plan in affect at the time of the
approval. The engineering designs and plat were prepared in accordance with
generally accepted engineering and surveying practices. The development will be
connecting to a central water and sewer systems.. All necessary easements are
delineated on the final plat. Street names have been approved by the Ada County
Street Name Committee.
Please schedule the final plat for hearing before the City Council.

Dear Stan:
I have reviewed the proposed subdivision plans for Bridgewood Park
Subdivision.
The plans indicate that all drainage will remain on site and that
there are no Nampa & Meridian Irrigation District facilities on
site. Because of this, we will be returning $500.00 of the fees
you submitted for the Land Use Change Application.
All laterals and wasteways must be protected. Nampa & Meridian
Irrigation District recommends that the developer supply irrigation
water to each lot.
If the subdivision is constructed according to the plans we have
received, it will not impact Nampa & Meridian Irrigation District's
operation.

document? Do we have to have that first?
Kingsford: That is on James Court.
Eng. Smith: I haven't received any other correspondence from
that other owner at all.
Tolsma: I know they said they had an agreement there but I've
not come across anything in these files here.
Eng. Smith: It seems like they were going to go twelve foot on
the other side of the center line of half of a street to the
north so that we would have two lanes going back to the
subdivision.
Tolsma: But Dorado Development was going to put part of that
road in. I ,just wondered if we ever had a letter stating the
fact that they were actually going to do that.
Kingsford: You could make that a condition for approval to make
sure it has been deeded to the Highway District.
The Motion was made by Tolsma and seconded by Yerrington to
approve the Final Plat on Bridgewood Subdivision conditioned upon
receiving confirmation of deeded land from Dorado/James Court

NOTICE IS HEREBY GIVEN pursuant to the Ordinances of the City
of Meridian and the laws of the State of Idaho, that the City
Council of the City of Meridian will hold a public hearing at the
Meridian City Hall, 33 East Idaho Street, Meridian, Idaho, at the
hour of 7:30 o'clock p.m., on June 15, 1993, for the purpose of
reviewing and considering the Application of HUNEMILLER-WURTZ

Dear Wayne:
The subdivision plat of Bridgewood park is in accordance with the approved
preliminary plat and conforms to the requirements of the Meridian City Subdivision
and Zoning Ordinances and Comprehensive Plan in affect at the time of the
approval. The engineering designs and plat were prepared in accordance with
generally accepted engineering and surveying practices. The development will be
connecting to a central water and sewer systems.. All necessary easements are
delineated on the final plat. Street names have been approved by the Ada County
Street Name Committee.

On August 18, 1993, the Commissioners of the Ada County Highway
District (hereafter called "District") approved the Preliminary
Plat as stated on the attached staff report.
In order that the Final Plat may be considered by the District for
acceptance, the Developer shall cause the following applicable
standard conditions to be satisfied prior to District certification
and endorsement:
1. Drainage plans shall be submitted and subject to review and
approval by the District.
2. If public street improvements are required: Prior to any
construction within the existing or proposed public right-of-
way, the following shall be submitted and subject to review
and approval by the District:
a. Three complete sets of detailed street construction
drawings prepared by an Idaho Registered Professional
Engineer, together with payment of plan review fee.
b. Execute an Inspection Agreement between the Developer and
the District together with initial payment deposit for
inspection and/or testing services.
C. Complete all street improvements to the satisfaction of
the District, or execute Surety Agreement between the
Developer and the District to guarantee the completion of
construction of all street improvements.

3. Furnish copy of Final Plat showing street names as approved by
the Local Government Agency having such authority together
with payment of fee charged for the manufacturing and
installation of all street signs, as required.
4. If Public Rights -of -Way Trust Fund deposit is required, make
deposit to the District in the form of cash or cashier's check
for the amount specified by the District.
5. Furnish easements, agreements, and all other datum or
documents as required by the District.
6. Furnish Final Plat draw-ings for District acceptance,
certifications, and endorsement. The final plat must contain
the signed endorsement of the Owner's and Land Surveyor's
certification.
7. Approval of the plat is valid for one year. An extension of
one year will be considered by the Commission if requested
within 15 -days prior to the expiration date.

FACTS & FINDINGS:
1. Bridgewood Park is a 18 -lot multi -family (18 fourplex buildings = 72
living units) residential subdivision located at the east end of James
Court (a private street) which is located on the east side of Meridian
Road approximately 1,600 -feet north of Cherry Lane.
The District reviewed this project on January 6, 1993 with private
streets proposed. A Traffic Impact Study was required as one of the
conditions of the previous application because of the amount of vacant
land around the subject parcel and the potential need for a future
collector street to serve that undeveloped area. The developer has
redesigned the layout to propose public streets (including James
Drive), and in the process has reduced the proposed number of dwell-
ing units from 80 to 72. There will be 1,920 -feet of new public streets
added to the system including the conversion of existing James Court
(private) to public from this project out to Meridian Road.
This project (72 -units) and the existing complex total 122 dwellings -
about 900 trips per day. James Court will be rebuilt to sufficient
width to handle this traffic safely. The next project to be approved
which uses James Court will be required to complete the widening of
James Court to collector standard. A Traffic Study will not be re-
quired for this project.
2. Meridian Road currently has 60 -feet of right-of-way and is fully im-
proved with a 41 -foot street section and 5 -foot sidewalks. Meridian
Road has recently been reconstructed so no pavement cuts will be al-
lowed without Commission approval.
