The City Council of the,City of Meridian having duly considered the evidence and the matter makes the following Findings of Fact and Conclusions of Law. FINDINGS OF FACT 1. That a notice of public hearing on the Application for Rezone was published for two (2) consecutive weeks prior to the said public hearing scheduled for July 6, 1993, the first publication of which was fifteen (15) days prior to said hearing; that the public was given full opportunity to express comments and submit evidence; and that copies of all notices were avail- able to newspaper, radio and television --stations. 2. That this property is located within the,City of Meridian and is owned by Applicants, HUNEMILLER and STURR, and is described in the application which description is incorpor- ated herein. FINDINGS OF FACT_.AND CONCLUSIONS OF LAN -- 3. 3. That the property is zoned R-15 and the proposed use is proper and permitted in an R-15 zone. 4. Approval of this subdivision was originally pro- cessed by the Applicants for a Conditional Use permit providing for private roads within,.the subdivision,. That application was denied by the City Council. A request was made to the City Council to reconsider the matter with the subdivision redesigned to provide for public streets within the subdivision. With the proposed subdivision; providing for public.streets within, a Conditional Use Permit is no.longer necessary, and the matter is before tike City Council at this time solely for preliminary plat approval,. 5. Access to said property is proposed to be by dedicated 60 foot roadway extending from Meridian Road to the east end of the subject property. To accomplish this 60 foot dedicated access will require the joint cooperation of the owners of the subject property, the owners of the James Court property adjacent to the west of the subject property, and the owners of the property to the north of both the James Court property and the subject property. 6. That city sewer and water is already available to the property, but the use may require additional changes or fees. 7. That notice was given to all property owners who are within 300 feet of the external boundaries of the land being considered, and all property owners included within the FINDINGS OF FACT AND CONCLUSIONS OF LAW - 2 property being considered. CONCLUSIONS OF LAW 1. That the procedural requirements of the Local Planning Act and of the Ordinances of the City of Meridian have been met including the Mailing of notice to owners of property within 300 feet of the external boundaries of the Applicant'_s property. 2. That the City Council has judged this applica- tion by the guidelines, standards, criteria, and policies contained in the Zoning and Development Ordinances and upon the record submitted to it and the things upon which it may take judicial notice. 3. That the Council may take judicial notice of its own proceedings, those of the commission, governmental statutes, ordinances, and policy, and of actual conditions existing within the city and the state. 4. That the Preliminary Plat for Bridgewood Park Subdivision shall not be approved until the 60 foot access roadway has been secured and recorded dedicating said road- way as a public street, said roadway to be constructed in conjunction with this project. Crookston: Stepping down due to a conflict of interest. Mr. Riddlemoser will be sitting in. Becky Bowcutt, Briggs Engineering, 1111 S. Orchard, Boise, was sworn by the attorney. Bowcutt: The property in question here is approximately 5.9 acres in size. It is located on the east side of Meridian Road, which is designated as a minor arterial. The property is currently zoned R-15, the R-15 allows for multi—family dwellings as a permitted use. What they are proposing here is four plex units. We have requested a conditional use permit because we have applied for a private road along the interior, we will be taking access off of Meridian Road through an existing private road, E. James Court. It has 221 of pavement, it does have curb, gutter and sidewalk along the south boundary. My client does have a recorded 601 easement across that parcel for use of E. James Court. We are also applying for a preliminary plat which has 22 lots. Of 22 there are 20 that are buildable lots and we have two open space lots which are Lot 6 and Lot 9, these will be landscaped. We meet all the requirements on the minimum lot sizes, which is 2400 sq. ft. per unit. Each lot exceeds 9600 sq. feet. The proposed private street will have a 32' easement with a 309 pavement section. Water and sewer are available to this site. The total number of units proposed on this site is 80, each structure will be 3480 sq. feet or roughly 870 sq. feet per unit. Each unit will have a carport and then an additional parking space behind that and a storage area will be located between the carport and the dwelling. Our proposed density is 13.59 dwelling units per acre. One of the issues brought up is the fact that we do only have a single point of ingress and egress off of Meridian Road. (Explained on map) I sent two letters plus drawings and information to the owners of that particular property who reside in California, basically requesting their permission to place a gate, which would be used for emergency vehicles only. It would only be used in the event that there was some type of an obstruction on James Court. MERIDIAN CITY COUNCIL MARCH 16, 1993 PAGE 10 Eng. Smith: I just wanted to present a map to you that the Highway District prepared and sent to me that shows the overall development of the section of land in which this parcel resides. To give you some idea of how the circulation of the roadways are laying out there as the property does subdivide. There's been some concern expressed by several parties and I think 1 made note of that in my comments to you but as far as getting from the existing developed portions of this section that would be the Willows or Willowbrook comes in from Settlers Village and Meridian Place Subdivision headed to the west and specifically this 40 acre parcel that lays right in here just to the east of the parcel that's being applied for tonight. (Explained on map - see tape) Concerns expressed about access from Meridian Place Subdivision, the Willows Subdivision to the west to Meridian Road and down into Meridian business district. (See tape for further) Kingsford: Thank you. Anyone else to testify? Raleigh Hawe, 530 Blue Heron Lane, was sworn by the attorney. Hawe: It's my opinion that the James Court Road as a private Street right now should be made a public road. As it is right nog:, it's only a 22' wide access with automobiles parking from time to time along the south side of what appears to half a street there. The curbs are set in on the south side, the north side of the street has just a line I guess which bounds the property on the north. The street width is only 221. The streets should connect in an east - west direction from Willowbrook as your Engineer explained. (See tape for further) Stated 22' access would not provide enough room for emergency vehicles if needed. Limon Belnap, Attorney for James Court property owners, was sworn by the attorney. Belnap: I am here to represent the James Court Property Owners. Having done my own title search since the letter, I would acknowledge that there is an easement for ingress and egress across our property, our parcel being the burdened parcel. The MERIDIAN CITY COUNCIL MARCH 16, 1993 PAGE 12 Ron Garvin, 218 James Court Lane, was sworn by the attorney. Garvin: I am the manager of the James Court Apartments and a considerable number of the people that live there are very opposed to having this much additional traffic on the lane there. There are a lot of children and senior citizens who live in there and we are a little concerned about the additional traffic. Riddlemoser: How long have you been connected with James Court Apartments? Garvin: Two years. Riddlemoser: You weren't around at the time that it was developed fifteen years ago. Garvin: No I was not there. Riddlemoser: I'm curious as to why in the development of James Court that the 60' easement wasn't respected. I mean a row of fire hydrants right down the middle of the 601. Garvin: It's my understanding that there's no fire hydrants down that easement. The fire hydrants are on the ease side of the complex in the fire lane which is I think a 20' easement. Riddlemoser: Are there not two or three fire hydrants right down the south side of the lane, right in the middle there's a row of fire hydrants that are setting in the middle of that 60' easement. Huber: We have an application pending on the Heimrich property which is to the north of this private lane that's been discussed. We're very .willing to work with the applicants before you and try and iron out this entanglement that this private road is appearing to cause here. I think everyone should participate equally and work together on this. STATEMENTS OF COMPLIANCE 1. The developer is proposing private streets within the subivision. The Meridian City Code does not address private road standards. Therefore, we have applied for a conditional use permit on the private road. The private street easements will range from 32 feet to 36 feet wide and the pavement will be 30 feet from back of curb to back of curb. We are not proposing sidewalks within the development. 2. The multi -family development proposed on the subject parcel is in compliance with the Meridian zoning Ordinances under the R- 15 zoning designation and the Meridian Comprehensive Plan. 3. The subject development will connect to central water and sewer facilities. 4. The development will have a density of 13.59 dwelling units per acre and the existing R-15 zone allows 15 dwelling units per acre. Orchard, Boise, was sworn by the attorney. Briggs: This is a 6 acre parcel of ground currently zoned R-15. It's approximately 1600 feet north of Cherry Lane on Meridian Road at the end of James Court. We've had an opportunity to go through all the comments. There seems to be one overriding issue, that being the access. I guess the best way to put this is it's presently zoned for apartments, it could house approximately 88 apartments without a conditional use. The developer seeking to maintain Meridian's high standards elects to go into a different type of development, more of a four plex type development on individual lots in a platted subdivision. It seems to me that the issue of access is somewhat mute in that the development can occur one way or the other without going through the process of platting. I would like however to address perhaps the fire departments issues from kind of a unique point of view. Prepared a sketch that was passed around that shows the orientation of the apartments directly to the west off of James court. You will see that they have one U—shaped access and parking lot to the north and another one that starts a little bit to the west and the loops back and actually dead ends into this property. Both of those are used for fire access and what we would propose to do is along the westerly side of this plat is to connect the fire access that comes in from the westerly side through the apartments as a secondary access. We think this provides an alternative for the fire and police services if they need a secondary access. The option of widening the road I think is best put by the Highway District's recommendation that that be done when the property to the north develops. Clerk Niemann: Have you done a traffic study? Briggs: No we haven't we don't see the need for that until such time as that northerly property develops. Johnson: The way this is zoned now without requesting any changes you could � in there and build low income housing right now, correct? This is a deeded easement is it not. Briggs: That is correct. Johnson: It would appear to me that the time to address that would be when that other property is annexed to the north. r MERIDIAN PLANNING & ZONING JANUARY 12, 1993 PAGE 22 M Raleigh Hawe, 530 Blue Heron Lane, was sworn by the attorney. Hawe: I own a piece of property that is east of this complex being proposed right now and I have several reservations about this particular unit. I don't have any objections to the type of use that is being set forth. The problems that I have with it are the roads and the access that serve this particular piece of property also additional traffic. (Further explanation — see tape) Johnson: Thank you. This foot traffic that you mentioned, are their other access and they just use that for convenience sake or what's your feeling on that? Hawe: Kids are going to be moving through these areas, they did migrate to that corner, they did run the school buses through on my private road, I'm not sure that they are supposed to be doing that but they are. It is fine as far as I'm concerned because of the safety of the kids. There are sidewalks within the units themselves but I don't believe there's even a curb on the north side of this particular road. Johnson: Anyone else to testify? No response.
