REQUEST FOR SUBDIVISION APPROVAL
PRELIMINARY PLAT AND/OR FINAL PLAT
PLANNING AND ZONING COMMISSION
TIME TABLE FOR SUBMISSION:
A request for preliminary plat approval must be in the City
Clerks possession no later than three days following the
regular meeting of the Planning and Zoning Commission.
The Planning and Zoning Commission will hear the request at
the monthly meeting following the month the request was
made.
After a proposal enters the process it may be acted upon at
subsequent monthly meetings provided the necessary
procedures and documentation are received before 5:00 P.M.,

FINDINGS OF FACT ANA CONCLUSIONS OF LAW
The above entitled matter saving come on for public
hearing July 6, 1993, at the. -hour of 7:30 o'clock p.m. Testi-
mony was presented in favor of request, and also in opposition
thereto. The City Council of the,City of Meridian having duly
considered the evidence and the matter makes the following
Findings of Fact and Conclusions of Law.
FINDINGS OF FACT
1. That a notice of public hearing on the Application
for Rezone was published for two (2) consecutive weeks prior to
the said public hearing scheduled for July 6, 1993, the first
publication of which was fifteen (15) days prior to said hearing;
that the public was given full opportunity to express comments
and submit evidence; and that copies of all notices were avail-
able to newspaper, radio and television --stations.
2. That this property is located within the,City of
Meridian and is owned by Applicants, HUNEMILLER and STURR, and
is described in the application which description is incorpor-
ated herein.
FINDINGS OF FACT_.AND CONCLUSIONS OF LAN -- 3.
3. That the property is zoned R-15 and the proposed
use is proper and permitted in an R-15 zone.
4. Approval of this subdivision was originally pro-
cessed by the Applicants for a Conditional Use permit providing
for private roads within,.the subdivision,. That application
was denied by the City Council. A request was made to the
City Council to reconsider the matter with the subdivision
redesigned to provide for public streets within the subdivision.
With the proposed subdivision; providing for public.streets
within, a Conditional Use Permit is no.longer necessary, and
the matter is before tike City Council at this time solely for
preliminary plat approval,.
5. Access to said property is proposed to be by
dedicated 60 foot roadway extending from Meridian Road to
the east end of the subject property. To accomplish this
60 foot dedicated access will require the joint cooperation
of the owners of the subject property, the owners of the
James Court property adjacent to the west of the subject
property, and the owners of the property to the north of
both the James Court property and the subject property.
6. That city sewer and water is already available
to the property, but the use may require additional changes
or fees.
7. That notice was given to all property owners
who are within 300 feet of the external boundaries of the land
being considered, and all property owners included within the

property being considered.
CONCLUSIONS OF LAW
1. That the procedural requirements of the Local
Planning Act and of the Ordinances of the City of Meridian
have been met including the Mailing of notice to owners of
property within 300 feet of the external boundaries of the
Applicant'_s property.
2. That the City Council has judged this applica-
tion by the guidelines, standards, criteria, and policies
contained in the Zoning and Development Ordinances and upon
the record submitted to it and the things upon which it may
take judicial notice.
3. That the Council may take judicial notice of
its own proceedings, those of the commission, governmental
statutes, ordinances, and policy, and of actual conditions
existing within the city and the state.
4. That the Preliminary Plat for Bridgewood Park
Subdivision shall not be approved until the 60 foot access
roadway has been secured and recorded dedicating said road-
way as a public street, said roadway to be constructed in
conjunction with this project.

NOTICE OF PUBLIC HEARING
NOTICE IS HEREBY GIVEN pursuant to the Ordinances of
the City of Meridian and the laws of the State of Idaho, that
the City Council of the City of Meridian will hold a public
hearing at the Meridian City Hall, 33 East Idaho Street, Meridian,
Idaho, at the hour of 7:30 o'clock p.m., on March 16, 1993, for
the purpose of reviewing and considering the Application of
Hunemiller - Stuhr, for a Conditional Use Permit and Approval
of Preliminary Plat for Bridgewood Park Subdivision. The 6
parcel acre is adjacent to east side of James Court with access
from North Meridian Road.
A more particular legal description for the parcel is on
file in the office of the City Clerk of the City of Meridian
and is available upon request.
Public comment will be taken and is welcome.

WITH PRELIMINARY PLAT BRIDGEWOOD PARK SUBDIVISION:
Kingsford: I will open the Public Hearing and invite the owner
or a representative to come forward and speak first.
Crookston: Stepping down due to a conflict of interest. Mr.
Riddlemoser will be sitting in.
Becky Bowcutt, Briggs Engineering, 1111 S. Orchard, Boise, was
sworn by the attorney.
Bowcutt: The property in question here is approximately 5.9
acres in size. It is located on the east side of Meridian Road,
which is designated as a minor arterial. The property is
currently zoned R-15, the R-15 allows for multi—family dwellings
as a permitted use. What they are proposing here is four plex
units. We have requested a conditional use permit because we
have applied for a private road along the interior, we will be
taking access off of Meridian Road through an existing private
road, E. James Court. It has 221 of pavement, it does have curb,
gutter and sidewalk along the south boundary. My client does
have a recorded 601 easement across that parcel for use of E.
James Court. We are also applying for a preliminary plat which
has 22 lots. Of 22 there are 20 that are buildable lots and we
have two open space lots which are Lot 6 and Lot 9, these will be
landscaped. We meet all the requirements on the minimum lot
sizes, which is 2400 sq. ft. per unit. Each lot exceeds 9600 sq.
feet. The proposed private street will have a 32' easement with
a 309 pavement section. Water and sewer are available to this
site. The total number of units proposed on this site is 80,
each structure will be 3480 sq. feet or roughly 870 sq. feet per
unit. Each unit will have a carport and then an additional
parking space behind that and a storage area will be located
between the carport and the dwelling. Our proposed density is
13.59 dwelling units per acre. One of the issues brought up is
the fact that we do only have a single point of ingress and
egress off of Meridian Road. (Explained on map) I sent two
letters plus drawings and information to the owners of that
particular property who reside in California, basically
requesting their permission to place a gate, which would be used
for emergency vehicles only. It would only be used in the event
that there was some type of an obstruction on James Court.

Eng. Smith: I just wanted to present a map to you that the
Highway District prepared and sent to me that shows the overall
development of the section of land in which this parcel resides.
To give you some idea of how the circulation of the roadways are
laying out there as the property does subdivide. There's been
some concern expressed by several parties and I think 1 made note
of that in my comments to you but as far as getting from the
existing developed portions of this section that would be the
Willows or Willowbrook comes in from Settlers Village and
Meridian Place Subdivision headed to the west and specifically
this 40 acre parcel that lays right in here just to the east of
the parcel that's being applied for tonight. (Explained on map -
see tape) Concerns expressed about access from Meridian Place
Subdivision, the Willows Subdivision to the west to Meridian Road
and down into Meridian business district. (See tape for further)

Raleigh Hawe, 530 Blue Heron Lane, was sworn by the attorney.
Hawe: It's my opinion that the James Court Road as a private
Street right now should be made a public road. As it is right
nog:, it's only a 22' wide access with automobiles parking from
time to time along the south side of what appears to half a
street there. The curbs are set in on the south side, the north
side of the street has just a line I guess which bounds the
property on the north. The street width is only 221. The
streets should connect in an east - west direction from
Willowbrook as your Engineer explained. (See tape for further)
Stated 22' access would not provide enough room for emergency
vehicles if needed. (Presented pictures of James Court on Fire)
Further concerns stated about street width and having only one
access available.

by the attorney.
Belnap: I am here to represent the James Court Property Owners.
Having done my own title search since the letter, I would
acknowledge that there is an easement for ingress and egress
across our property, our parcel being the burdened parcel. The

Ron Garvin, 218 James Court Lane, was sworn by the attorney.
Garvin: I am the manager of the James Court Apartments and a
considerable number of the people that live there are very
opposed to having this much additional traffic on the lane there.
There are a lot of children and senior citizens who live in there
and we are a little concerned about the additional traffic.
Riddlemoser: How long have you been connected with James Court
Apartments?
Garvin: Two years.
Riddlemoser: You weren't around at the time that it was
developed fifteen years ago.
Garvin: No I was not there.
Riddlemoser: I'm curious as to why in the development of James
Court that the 60' easement wasn't respected. I mean a row of
fire hydrants right down the middle of the 601.
Garvin: It's my understanding that there's no fire hydrants down
that easement. The fire hydrants are on the ease side of the
complex in the fire lane which is I think a 20' easement.
Riddlemoser: Are there not two or three fire hydrants right down
the south side of the lane, right in the middle there's a row of
fire hydrants that are setting in the middle of that 60'
easement.

Jeff Huber, Representing Dorado Development, 1109 Leadville Ave.,
Boise was sworn by the attorney.
Huber: We have an application pending on the Heimrich property
which is to the north of this private lane that's been discussed.
We're very .willing to work with the applicants before you and try
and iron out this entanglement that this private road is
appearing to cause here. I think everyone should participate
equally and work together on this. I think we'd be willing to
help out with some more right of way if that's what was needed.

STATEMENTS OF COMPLIANCE
1. The developer is proposing private streets within the
subivision. The Meridian City Code does not address private
road standards. Therefore, we have applied for a conditional
use permit on the private road. The private street easements
will range from 32 feet to 36 feet wide and the pavement will
be 30 feet from back of curb to back of curb. We are not
proposing sidewalks within the development.
2. The multi -family development proposed on the subject parcel is
in compliance with the Meridian zoning Ordinances under the R-
15 zoning designation and the Meridian Comprehensive Plan.
3. The subject development will connect to central water and sewer
facilities.
4. The development will have a density of 13.59 dwelling units per
acre and the existing R-15 zone allows 15 dwelling units per
acre.
The Meridian zoning Ordinance does not specigy private road
standards, so we have applied for a conditional use permit.
Lots 9 and 6 are open space or common area which will be used
by the residents of the development. The lots will be owned
and maintained by the homeowner's association. The two open
space lots have a total square footage of 13,307 and constitute
5.19% of the site. The private road will be a platted common
lot with a square footage of 49,545 or 19.32% of the total
site.
5. The final plat will reflect all necessary utility and sewer
easements.
6. The street names listed on the preliminary plat were submitted
to the Ada County Street Name Committee for review. The street
names will not conflict with the Meridian City grid system.

I have reviewed the application for Bridgewood Park
Subdivision. This planned development will accelerate the need
for Joint School District No. 2 to construct additional
classrooms and/or to adjust school attendance boundaries.
Meridian Schools do not have excess capacity. Nearly every
school in the district is beyond capacity.
The Meridian School District supports economic growth for Idaho
and specifically the district's area, but such growth produces a
need for additional school construction. We ask your support for
a development fee statute on new home construction. We ask your
support for a development fee statute on new home construction or
a real estate transfer fee to help offset the costs of building
additional school facilities. If this support is lacking then we
ask that additional residential development be denied.
Residents of the new subdivision cannot be assured of attending
the neighborhood school as it may be necessary to bus students to
available classrooms across the district.
We ask that you assure the developer will provide walkways, bike
paths and safe pedestrian access.

Court (a private street) which is located on the east side of Meridian

oped, and there is uncertainty as to access to north and east.

On January 6, 1993, the Commissioners of the Ada County Highway
District (hereafter called "District") approved the Preliminary
Plat as stated on the attached staff report.
In order that the Final Plat may be considered by the District for
acceptance, the Developer shall cause the following applicable
standard conditions to be satisfied prior to District certification
and endorsement:
1. Drainage plans shall be submitted and subject to review and
approval by the District.
2. If public street improvements are required: Prior to any
construction within the existing or proposed public right-of-
way, the following shall be submitted and subject to review
and approval by the District:
a. Three complete sets of detailed street construction
drawings prepared by an Idaho Registered Professional
Engineer, together with payment of plan review fee.
b. Execute an Inspection Agreement between the Developer and
the District together with initial payment deposit for
inspection and/or testing services.
C. Complete all street improvements to the satisfaction of
the District, or execute Surety Agreement between the
Developer and the District to guarantee the completion of
construction of all street improvements.

3. Furnish copy of Final Plat showing street names as approved by
the Local Government Agency having such authority together

Our firm represents the owners of James Court Apartments: As you are a aware, there
is a private lane running along the northern boundary of our client's property that accesses their
apartment units. It is our understanding that you propose a development on the east side of our
client's property and have proposed to the City of Meridian that you will access your property
over the James Court Lane. That will not be permitted.
The purpose of this letter is to inform you that our client has not nor will it grant to you
access easement over James Court Lane. They will have representatives at your March 16,
1993, hearing to inform the Meridian City Council of their position.
If you have any public document that shows that our client may have previously granted
such an easement, I would be interested in receiving a copy. You may want to make
arrangements with the land owner on the north of the James Court property for an access
easement.

FINDINGS OF FACT AND CONCLUSIONS OF LAW
The above entitled matter having come on for public
hearing January 12, 1993, at the hour of 7:30 o'clock p.m. Testi-
mony was presented in favor of request, and also in opposition
thereto. The Planning and Zoning Commission of the City of
Meridian having duly considered the evidence and the matter
makes the following Findings of Fact and Conclusions of Law.
FINDINGS OF FACT
1. That a notice of public hearing on the Application
for Rezone was published for two (2) consecutive weeks prior to
the said public hearing scheduled for January 12, 1993, the first
publication of which was fifteen (15) days prior to said hearing;
that tide public was given full opportunity to express comments
and submit evidence; and that copies of all notices were avail-
able to newspaper, radio and television stations.
2. That this property is located within the City of
Meridian and is owned by Petitioner, HUNFMLLER and STUHR, and
is described in the application which description is incorpor-
ated herein.
FINDINGS OF FACT AND CONCLUSIONS OF LAW - 1
a. The use of private roads, would in fact, consti-
tute a conditional use and a conditional use
permit is required by ordinance.
b. The use would be harmonious with and in accordance
with the Comprehensive Plan but the Zoning Ordin-
ance requires a conditional use permit to allow
the use of private roads.
c. The use apparently would be designed and constructed
to be harmonious in appearance with the intended
character of the general vicinity.
d. That the use would not be hazardous nor should
it be disturbing to existing or future neighboring
uses.
e. The property has sewer and water service available.
f. The use would not create excessive additional
requirements at public cost for public facilities
and services and the use would not be detrimental,
to the economic welfare of the community.
g. The use would not involve a use, activity, process,
material, equipment or conditions of operation that
would be detrimental to person, property or the
general welfare by reason of excessive production
of traffic or noise.
h. That sufficient parking for the property and the
proposed use will be required. That access to prop-
erty, while minimum, is required.
i. The development and uses will not result in the
destruction, loss or damage of a natural or scenic
feature of major importance.
S. Curbs and sidewalks should be required in the sub-
division.

The Meridian Planning and Zoning Commission hereby adopts

Meridian Planning and Zoning Commission hereby recommends to the
City Council of the City of Meridian that the City Council review
these findings and, if desired by the City Council, change, alter
or amend the conditions stated -herein, and that if the conditions

Dean Briggs, Briggs Engineering, 1111 So. Orchard, Boise, was
sworn by the attorney.
Briggs: This is a 6 acre parcel of ground currently zoned R-15.
It's approximately 1600 feet north of Cherry Lane on Meridian
Road at the end of James Court. We've had an opportunity to go
through all the comments. There seems to be one overriding
issue, that being the access. I guess the best way to put this
is it's presently zoned for apartments, it could house
approximately 88 apartments without a conditional use. The
developer seeking to maintain Meridian's high standards elects to
go into a different type of development, more of a four plex type
development on individual lots in a platted subdivision. It
seems to me that the issue of access is somewhat mute in that the
development can occur one way or the other without going through
the process of platting. I would like however to address perhaps
the fire departments issues from kind of a unique point of view.
Prepared a sketch that was passed around that shows the
orientation of the apartments directly to the west off of James
court. You will see that they have one U—shaped access and
parking lot to the north and another one that starts a little bit
to the west and the loops back and actually dead ends into this
property. Both of those are used for fire access and what we
would propose to do is along the westerly side of this plat is to
connect the fire access that comes in from the westerly side
through the apartments as a secondary access. We think this
provides an alternative for the fire and police services if they
need a secondary access. The option of widening the road I think
is best put by the Highway District's recommendation that that be
done when the property to the north develops.
Clerk Niemann: Have you done a traffic study?
Briggs: No we haven't we don't see the need for that until such
time as that northerly property develops.
Johnson: The way this is zoned now without requesting any
changes you could � in there and build low income housing right
now, correct? This is a deeded easement is it not.
Briggs: That is correct.
Johnson: It would appear to me that the time to address that
would be when that other property is annexed to the north.

Raleigh Hawe, 530 Blue Heron Lane, was sworn by the attorney.
Hawe: I own a piece of property that is east of this complex
being proposed right now and I have several reservations about
this particular unit. I don't have any objections to the type of
use that is being set forth. The problems that I have with it
are the roads and the access that serve this particular piece of
property also additional traffic. (Further explanation — see
tape)
Johnson: Thank you. This foot traffic that you mentioned, are
their other access and they just use that for convenience sake or
what's your feeling on that?
Hawe: Kids are going to be moving through these areas, they did
migrate to that corner, they did run the school buses through on
my private road, I'm not sure that they are supposed to be doing
that but they are. It is fine as far as I'm concerned because of
the safety of the kids. There are sidewalks within the units
themselves but I don't believe there's even a curb on the north
side of this particular road.
Johnson: Anyone else to testify? No response. I will close the
public hearing.

Re: Bridgewood Park Subdivision
Dear Commissioners:
I have reviewed the application for Bridgewood Park
Subdivision. This planned development will accelerate the need
for Joint School District No. 2 to construct additional
classrooms and/or to adjust school attendance boundaries.
Meridian Schools do not have excess capacity. Nearly every
school in the district is beyond capacity.
The Meridian School District supports economic growth for Idaho
and specifically the district's area, but such growth produces a
need for additional school construction. We ask your support for
a development fee statute on new home construction. We ask your
support for a development fee statute on new home construction or
a real estate transfer fee to help offset the costs of building
additional school facilities. If this support is lacking then we
ask that additional residential development be denied.
Residents of the new subdivision cannot be assured of attending
the neighborhood school as it may be necessary to bus students to
available classrooms across the district.
We ask that you assure the developer will provide walkways, bike
paths and safe pedestrian access.

the roadways shown within the plat could be private
however, consideration should be given to providing
some public roadway with a stub road into the property
to the east for future access. ACHD has required a
traffic impact study.
4. Any sewer and water lines located in a private roadway
need to be situated within a permanent recorded
easement written in favor of the City of Meridian.
5. Sewer laterals shall be located on street centerline or
south or west of centerline. Water mains shall be
located 12 feet north or east of street centerline.
6. Show street light and fire hydrant locations.
7. Any gate installed across a private street must be
accessible by City water, sewer and emergency
personnel.
8. The sewer line crossing Lot 14 — Block 1 shall be
centered within a 16 foot wide permanent easement.
9. Maintenance of any private roadway and subsurface storm
water disposal systems shall be the responsibility of
the Homeowners Association.
10. It appears from the FEMA FIRM Maps that the southwest
corner of this project could be impacted by Flood Zone
A E together with the length of James Court Lane
extending to this proposed development.
