Dear Mayor Kingsford:
Attached you will find a copy of the draft letter that is proposed to be mailed to the property
owners and renters residing within the one square mile area of the Meridian Area of City
Impact that will be surveyed to ask whether they wish to remain in the Area of City Impact
or be removed from it. As was discussed when you met with the Board of County
Commissioners on April 28, 1993, the survey will be limited to two choices:
• The area should remain within the Meridian Area of City Impact;
• The area should be removed from the Meridian Area of City Impact.
The Board has informed Don Smitchger, Mike Caven, and Chris Korte that the property
owners that are proposing the change will be responsible for the costs associated with this
survey. The Board also requests that you review the letter and survey before it is mailed out,
so please look it over and let me know if you have comments or suggestions for changes to
the text.
The Board is proposing to allow property owners that are listed on the Assessor's records be
eligible to respond to the survey. Thus a husband and wife that jointly own a parcel will be
entitled to two surveys. Should they own more than one parcel, they will be still be limited
to two responses (for example, if they own three parcels, they are allowed to send back two
survey responses, NOT six). The Board is also interested in hearing from renters, with the
responses being limited to the individuals that signed the lease or otherwise arranged to rent
the property.

Dear Property Owner or Resident:
This letter is being sent to ask you to complete the enclosed
survey regarding property that you either own or rent within a
portion of the Meridian Area of City Impact. For your information,
an "Area of City Impact" is unincorporated land surrounding a
municipality that has ties with that city due to its trade area,
geographic factors, and reasonable likelihood of being annexed into
the city some time in the future. Each "Area of City Impact"
boundary is established through negotiations between incorporated
cities and the County.
The area being surveyed is located 4 mile west of Cloverdale Road
to 4 mile south of Ustick Road, to 4 mile west of Eagle Road to
mile south of McMillan Road (see enclosed map). Several property
owners within this area are interested in having their land removed
from the Meridian Area of City Impact, with the hope that their
properties will later be placed within the Boise City Area of
Impact. They believe that their properties are likely to be served
by Boise City in a more timely manner than would be the case if
they remained within the Meridian Area of City Impact.
At this point, the City of Meridian and Board of Ada County
Commissioners are interested in learning the opinions of all
property owners and residents within this square mile area, through
the use of an informational, nonbinding survey. The survey asks
you to pick between two options: should the area remain within the
Meridian Area of City Impact, or should be area be removed.
If the City of Meridian and Board agree that the area should be
removed from the Meridian Area of City Impact, then it will be
scheduled for public hearings before the City and County Planning
and Zoning Commissions, Meridian City Council, and Board of County
Commissioners. In addition, should the area be proposed for
removal from the Meridian Impact Area, and if property owners wish
to proceed with placing the land in the Boise Area of City Impact,
that request will also go through the public hearing process.

Idaho State Code 67-6526(a) requires that Ada County and each of the cities in
the county adopt an Area of City Impact by ordinance. If an Area of City Impact
was not adopted by 1978, Idaho State Law provides for the formation of an Area
Of City Impact Committee which must recommend an Area of City Impact to both the
city and the county.
On August 29, 1983, a nine -member Meridian Area of City Impact Committee was
formed in accordance with Idaho Code 67-6526(b). This committee was composed
of:.

On September 6, 1984, the Meridian Area of City Impact Committee recommended a
package of two ordinances and two resolutions as the Meridian Area of City
Impact.
The Area of City Impact is defined in Idaho Code 67-6526(a) as two ordinances.
The first ordinance is "a map identifying an Area of City Impact within an unin-
corporated area of the county." The second ordinance provides for "application
of plans and ordinances for the Area of City Impact." This second ordinance .may
provide for three different strategies for plan and ordinance applications in
the Area of City Impact:
I. City plan and ordinances,
2. County plan and ordinances, or
3. Any mutually agreed upon plan and ordinance requirements.
The recommendation of the Meridian Area of City Impact Committee is that
the county's plan and ordinances apply in the unincorporated area of the county
that comprises the Meridian Area of City Impact.

There are two Area of City.lmpact Ordinances and two related Area of City Impact
Resolutions. The first ordinance designates a Meridian Area of City Impact
boundary using the one-quarter mile section lines as the boundaries. A map is
attached to this ordinance identifying the Area of City Impact. The map also
shows related Referral Areas, which are discussed in the second resolution and
are addressed later in this report. Also contained within this ordinance are
provisions for the treatment of property which is split by the Area of City
Impact boundary, for a renegotiation process of the Area of City Impact, and for
a severance clause.
The second ordinance applies the County Comprehensive Plan Rural Area Policies
and the Ada County Zoning Ordinance to the unincorporated area within the
Meridian Ares of City Impact. In addition, this second ordinance states that:
- Meridian may not annex outside of this Area of City Impact Boundary.
- City and county amendments to their respective comprehensive plans and
zoning ordinances that apply within the Meridian Area of City Impact shall
be referred to the other for comments.
- There is renegotiation process.
- There is a severance clause and an effective date.
In reference to the before mentioned two Area of City Impact Ordinances, it
should be emphasized that the county rural area policies do not apply to land
within the city limits or to any future annexed lands to Meridian. The Meridian
City Council has exclusive jurisdiction within the city limits. The only
restriction to the city's jurisdiction is that annexation not'occur outside of
the adopted Area of City Impact boundary.
The first resolution, which is called the Meridian Area of City Impact Referral
Process, establishes the specific time periods and procedures for Meridian and
Ada County to refer each other's plan and ordinance amendments to the other.
Specifically covered are all amendments to comprehensive plans, the Zoning Ordi-
nance, and zoning applications. These items cannot be considered at a public
hearing unless and until the referral has been sent to the other jurisdiction
within the specified time period. The contents of this resolution could have
been put within the Area of City Impact Ordinance; however, they were placed in'
the resolution so that they could be changed if the time periods or process
proved to be unreasonable.
The second Area of City Impact Ordinance requires that the referral process take
place, but the resolution identifies the specific time periods and to whom the
referrals should be sent. If the time periods need to be lengthened or shor-
tened, for whatever reason, a change in the resolution can be accomplished
without renegotiating the Area of City Impact Ordinances. Such a renegotiation
would be more time-consuming and needlessly bureaucratic.
The second resolution, called the Meridian/Ada County Referral Areas, describes
two areas that were originally considered to be included in the Meridian Area of

City Impact boundary, but were rejected because they could not meet State Code
criteria.for inclusion within the Meridian Area of City Impact. These areas are
still of concern to Meridian, however. Specifically, the City of Meridian
wants to be officially informed of any effort to amend the County Comprehensive
Plan policies that would apply to these referral areas or of any effort to
include these areas in another city's Area of City Impact. Consequently, this
resolution would require that Ada County notify Meridian of any County
Comprehensive Plan amendment or any county negotiated Area of City Impact
Ordinance affecting the Referral Areas.
Idaho Code 67-6526(b) states that the recommendations of the Meridian Area of
City Impact Committee "shall be acted upon by the governing boards within sixty
(60) days of receipt." Since the Meridian Area of City Impact Committee made
its recommendation on September 6, 1984, the Meridian City Council and the Board
of Ada County Commissioners will have to "act upon" the Committee's recommen-
dation by November 5, 1984.
Idaho Code 67-6526(b) also states that "in defining an Area of City Impact, the
following factors shall be considered:
1. "Trade area;
2. Geographic factors;
3. Areas that can reasonably be expected to be annexed to the city in the
future."
TRADE AREA
The intersection of Cherry Lane, Fairview Avenue and East 1st Street serves as
the commercial hub of Meridian. Adjacent to and extending from this intersec-
tion are the Cherry Plaza Shopping Center, the Smith's Shopping Center, the Old
Town Meridian area, and adjacent commercial sites to these three centers. Taken
together, these commercial areas could be defined as a large community -sized
shopping center. Normally a community -sized shopping.center comprises between
100,000 to 300,000 square feet of floor area. Cherry Plaza includes approxima-
tely 135,000 square feet of gross floor area and the Smith's Shopping Center
Includes approximately 64,000 square feet of floor area.
At a density of three dwelling units per acre (DU/A), a community -sized shopping
center can be expected to have a service radius of two to three miles (De
Chiara, Joseph and Lee Koppelman, Urban Planning and Design Criteria [New York:
Van Nostrader Reinhold Company, 19751, p. 428.). The vast majority of the City
of Meridian is zoned R-4 (8,000 square foot lots), which is equiva.lent to
approximately three DU/A. From the intersection of Fairview Avenue, Cherry
Lane, and East 1st Street to the proposed Meridian Area of City Impact boun-
daries, the,distance In.each direction is approximately as follows:
North - 1 3/4 miles.
East - 2 3/4 miles (abuts the adopted Boise Area of City Impact boundary).

South - 3 1/4 miles.
West - 3 3/4 miles.
This intersection may not be the exact center of the described three major
shoppi.ng areas, but it is necessary to pick a specific location for analysis
purposes. Also, these shopping center standards are general and must be applied
and balanced against other factors such as existing land use, public service
capabilities, geographic factors, and ability to annex. Based on this infor-
mation -the Meridian Area of City Impact boundary can be considered as the pri-
mary trade area of the existing Meridian shopping centers.
GEOGRAPHIC FACTORS
The Meridian area has a generally flat to rolling terrain which is devoid of
major geographic factors which would divide or unite the City of Meridian.
There are no major rivers except for the Boise River, which is to the north of
the proposed Area of City Impact. There are no major elevation changes, with
the possible exception of the benches or rims which do not seem to pose any
major barrier to city development or expansion.
Roads are a major man-made feature of the geography of the Meridian Area of City
Impact. However, only Interstate 84 -could be considered as a barrier.- This
1-84 barrier will become.less of a factor -in the future as the Eagle Road
Interchange is developed. In addition., transportation plans (Ada Planning
Association, Transportation Plan for_Northern Ada County, [October, 19821, p.
34.) call for the construction of aLocust Grove Road Overpass in the long-term
future. This will also lessen the barrier of 1-84.
The Southwest Community Wastewater'Management Study (1980) indicates that the
general flow of ground water from Southwest Boise/Southeast Meridian is toward
the City of Meridian. This northwest -flow of the groundwater applies to all the
land which is generally north of Amity Road. At Amity Road the ground water
flows directly west, and south of Amity Road the ground water flows in a south
to southwesterly direction. Based on this technical report, there is no ground
water related geographic factor to justify the inclusion of land around Amity
Road and south of Amity Road within the Meridian Area of City impact.
AREAS THAT CAN REASONABLY BE EXPECTED TO BE ANNEXED TO THE CITY IN THE FUTURE
The Meridian Comprehensive Plan, adopted in 1978 and as amended in 1984, iden-
tifies an Urban Service Planning Area (USPA) for the City of Meridian (see
attached two maps). Meridian Is expected,to grow to approximately 20,500 people
by the year 2000 ('Ada Planning Association, Demographic Report, Ada County,
Idaho, [July, 19841 p. 3.). Within the 1978 and the 1984 USPA boundaries indi-
cated in the Meridian Comprehensive Plan, a population of approximately 50,000
can easily be accommodated at the densities identified in the Meridian
Comprehensive Plan. In other words, the USPA for Meridian could be considered
as an ultimate plan or fifty-year growth pattern. Normally comprehensive plans
cover a growth period of twenty years. Consequently, a fifty-year planning
period can be considered as more futuristic and as an ultimate design for the
City of Meridian.

The proposed Meridian Area.of City Impact includes all of this ultimate fifty-
year USPA for the City of Meridian as identified in the adopted Meridian
Comprehensive Plan. In fact, the proposed Meridian Area of City Impact is
larger than the.USPA. It is unlikely that Meridian will need to annex outside
of the proposed Area of City Impact in the foreseeable future.
The USPA boundaries indicated in the Meridian Comprehensive Plan are generalized
sketch boundaries and are not drawn to fit any legal description of property.
Consequently, the USPA may be larger or smaller in given.areas based upon the
ability of Meridian to provide urban services to those areas as determined by
Meridian when these lands are annexed.
Two major factors affecting public service capabilities were used to refine the
boundary of the proposed Area of City Impact so that all of the Urban Service
Planning Area would be included within it. These factors may affect the cityts
ability to provide services and to annex these areas in the future. These two
factors include:
1. It is desirable to maintain gravity -flow sewer lines for collecting
wastewater at the Meridian Wastewater Treatment Plant because new
sewage pumping stations are not required. The Meridian Wastewater
Treatment Plant is located northwest of the intersection of Ustick and
Ten Mile Roads. The southern part of Black Cat Road and the northern
part of Eagle Road were not included in the proposed Meridian Area of
City Impact because they could not be serviced by gravity -flow sewer
collection lines.
2. Major roads such as section line roads were considered as poor ultimate
boundaries between the Meridian city limits and eith6r the Ada County's
rural lands or the Boise city limits. This is the major reason why the
Cities of Boise and Meridian agreed in 1982 to a common Area.of City
Impact boundary dividing the jurisdictions at a line one-quarter mile
west of and parallel to Cloverdale Road. It is simply more practical
and cost effective for one city to provide services on both sides of a
major street.
If Cloverdale Road, for example, was used as the ultimate boundary bet-
ween the city limits of Boise and Meridian, two cities would run major
underground utilities (sewer, water, etc.) and emergency vehicles
(police, fire, ambulance, etc.) along and down the same street but only
serve one side of the street. In fact, an accident which occurred on
Cloverdale Road might actually occur in both cities and involve respon-
ses from two police departments, fire departments and ambulance ser-
vices.
Consequently, quarter -mile section lines would be�used as boundaries
rather than roads.
These three factors of trade area, geography and future annexation justify the
proposed Meridian Area of City Impact boundary.

COUNTY ORDINANCE NUMBER
AN ORDINANCE ESTABLISHING THE BOUNDARY OF THE MERIDIAN AREA OF CITY IMPACT
BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF ADA COUNTY, IDAHO, pur-
suant to the authority under Section 67-6526, Idaho Code, that the following
ordinance be adopted:
SECTION 1.0
The Meridian Area of City Impact is the area designated on the attached map and
incorporated herein by reference.
SECTION 2.0
In case a property under single ownership is divided by the boundary line of the
Meridian Area.of City Impact and the line divides the property so that one or
both of the parts has a depth of 300 feet or less, such part may be included in
the jurisdiction within which the remainder and larger portion of the property
is located.
SECTION 3.0 RENEGOTIATION
3.1 In accordance with Idaho Code 67-6526(d), the Meridian City Council or
the Board of Ada County Commissioners may request, in writing, to renego-
tiate any provision of this ordinance at any time. Withim 30 days of
receipt of such written request by either party, a meeting between the two
jurisdictions shall occur.
3.2 While renegotiation is occurring, all provisions of th.is ordinance
shall remain in effect until this ordinance is amended or a substitute ordi-
nance is adopted by Meridian and Ada County, in accordance with the notice
and hearing procedures provided in Title 67, Chapter 65 of Idaho Code, or
until a declaratory judgment from the district court is final. Provided,
however, that this ordinance or stipulated portions thereof shall be of no
further force and effect if both jurisdictions so agree by mutually adopted
resolution.

SECTION 4.0 SEVERANCE
Should any section, clause or a provision of this ordinance be declared invalid
by a court of competent jurisdiction, the same shall not affect the validity of
this ordinance as a whole or any part thereof, other than the part, so declared
to be invalid, each section, clause and provision hereof being declared
severable.

APPLYING THE ADA COUNTY ZONING ORDINANCE WITHIN THE MERIDIAN AREA OF CITY
IMPACT; PROVIDING FOR THE AMENDMENT OF THE MERIDIAN AND ADA COUNTY COMPREHENSIVE
PLANS TO BE CONSISTENT WITH THIS AGREEMENT; PROVIDING FOR THE COORDINATION OF
PLAN AMENDMENTS, ORDINANCE AMENDMENTS AND OF ZONING APPLICATIONS; PROVIDING FOR
RENEGOTIATION OF THE PROVISIONS OF THIS ORDINANCE AND PROVIDING FOR A SEVERANCE

BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF ADA COUNTY, IDAHO, pur-
suant to the authority under Section 67-6526, Idaho Code, that the following be
adopted:
1.0 MERIDIAN AREA OF CITY IMPACT BOUNDARY
The Meridian Area of City Impact boundary is as adopted in County Ordinance
Number (City ordinance Number ). Upon annexation of any portion
of the Area of City Impact in Meridian, the provisions of this ordinance shall
no longer apply to such annexed areas.
2.0 ANNEXATION TO OCCUR ONLY IN AREAS OF CITY IMPACT
Meridian shall limit its annexation to those lands within its Area of City
Impact. If Meridian wishes to annex lands outside of its Area of City Impact,
it shall renegotiate its Area of City Impact boundary with Ada County in accor-
dance with Idaho Code 67-6526(d).
3.0 PLAN POLICIES AND ORDIANCES TO APPLY TO THE MERIDIAN AREA OF CITY IMPACT
3.1 The Ada County Comprehensive Plan - Rural Area Section adopted by Ada
County as of May 18, 1983, shall apply to the Rural Area as identified on
the Area of City Impact boundary map in County Ordinance Number (City
Ordinance Number ), which is the land area outside the Meridian City
limits but within the Area of City Impact.boundary.
3.2 Both Meridian and Ada County shall amend their Comprehensive Plans to
be consistent with this ordinance.
3.3 The Ada County Zoning Ordinance shall be used to implement this
ordinance.

4.0 COORDINATION OF PLAN AMENDMENTS, ORDIANCE AMENDMENTS, AND ZONING
APPLICATIONS
4.1 All applications for county and city amendments to their respective
comprehensive plans and implementing ordinances which apply within the
Meridian,Area of City Impact shall be sent by the entity considering such
amendment to the other entity. A separate Referral Process (County
Resolution Number ,City Resolution Number ) shall be adopted,
by resolution, by each entity regarding procedures and time periods for, and
the effect of, sending such amendments.
4.2 All county applications for Planned

AT A MEETING OF THE BOARD OF ADA COUNTY COMMISSIONERS, STATE OF IDAHO, ON THE
DAY OF , 1984, THE FOLLOWING RESOLUTION WAS ADOPTED, TO WIT:
WHEREAS, the 1975 Local Planning Act requires that Ada County and each of
its cities establish Area of Impact Boundaries for each city and designate the
plans and ordinances to apply within such Areas of Impact; and
WHEREAS, Idaho Code, Section 67-6526(a), establishes procedures and deadlines
for establishing such Area of Impact Ordinances; and
WHEREAS, Idaho Code, Section 67-6526(b), requires that if the provisions of
67 -6526(a) -are not met by the deadline of January 1, 1978, the County
Commissioners together with three elected officials from the city concerned and
three city or county residents shall, by majority vote, recommend to the city
and county governing boards an area of city impact, together with plan and ordi-
nance requirements; and
WHEREAS, such a nine -member committee was formed by Ada County and Meridian
on August 29, 1983,consensus; and
WHEREAS, said committee has recomended adoption of an ordinance establishing
the boundary of the Meridian Area of City Impact and an ordinance providing for
the application of plans and ordinance for the Meridian Area of City Impact; and
WHEREAS, the committee has also recomended that a referral process agreement
establishing procedures for amending plan policies and ordinances and the pro-
cessing of zoning applications be adopted;
THEREFORE, BE IT RESOLVED that the Board of Ada County Commissioners hereby
adopt the Meridian Area of Impact Referral Process, attached hereto and incor-
porated herein.

MERIDIAN AREA OF CITY IMPACT REFERRAL PROCESS
SECTION 1.0 AMENDMENT OF COMPREHENSIVE PLANS FOR LAND SOLELY WITHIN OR TO BE
INCLUDED IN THE CITY LIMITS
1.1 Applications to amend the Meridian Comprehensive Plan or zoning ordi-
nances, which application pertains to land already in the city 1-imits or
land which will be annexed into the City of Meridian coincident with adop-
tion of the Comprehensive Plan Amendment, shall not be governed or
controlled by this referral process or the Area of City Impact Ordinance.
The City of Meridian shall, however, provide Ada County with copies of such
applications 15 days prior to the initial public hearing on said application
and the County, if it desires, may provide comment and input on the applica-
tion. Such input shall in no way be binding or.controlling on the City of
Meridian but shall be treated as documentary evidence. Upon approval, if
approved, the amendment or the admendment and the annexation, if annexation
is a part of the application, shall be effective and the Meridian City
Council shall within fifteen (15) days of approval of said amendment or
amendment and annexation, as the.case may be, notify the Ada County Zoning
Commission of said approval and the effective date thereof.
SECTION 2.0 AMENDMENT OF COMPREHENSIVE PLANS AND ORDINANCES FOR THE MERIDIAN
•AREA OF CITY IMPACT
2.1 Any application to amend the Meridian Comprehensive Plan as it may
effect the unincorporated areas shall be reviewed and approved or denied by
the Meridian City Council before the Ada County Planning Commission shall
schedule such amendments for public hearing.
2.2 All applications for such amendments to the Meridian Comprehensive Plan
and to the text of Meridian's implementing ordinances shall be forwarded to
the Ada County Planning Commission by the Meridian Planning and Zoning
Commission at least 15 days prior to any public hearing on such proposed
amendment(s). The Ada County Planning Commission shall determine whether or
not such an amendment is in conflict with one or more of the goals, objec-
tives or policies of the Ada County Comprehensive Plan. The Ada County
Planning Commission shall notify the Meridian Planning and Zoning.Commission
of such determination in writing prior -to or at such public hearing. Such
input from the County shall not be binding or controlling on the City of
Meridian but shall be treated as documentary evidence.
2.3 Once an amendment to the Meridian Comprehensive Plan is adopted by the
Meridian City Council, the Meridian City Council shall forward a copy of the
final document to the Ada County Planning Commission within 15 days after
its adoption, along with notice as to when the amendment will take effect.
Any such amendment made by the Meridian City Council to the Meridian
Comprehensive Plan, in accord with Idaho Code, shall not take effect in the
unincorporated Meridian Area of City Impact unless and until.such amendment
is adopted by the Board of Ada County Commissioners as an amendment to the
Ada County Comprehensive Plan.

2.4 All proposed amendments to the Ada County Comprehensive Plan Rural Area
Section.shall be forwarded by the Ada County Planning Commission to the

SECTION 3.0 PROCESSING OF ZONING APPLICATIONS IN THE MERIDIAN AREA OF CITY
IMPACT
3.1 The Ada County Zoning Commission shall send to the Meridian Planning
and Zoning Commission all County applications for Planned Developments, sub-
divisions, rezones, conditional use permits and private roads, located
within the Meridian Area of City Impact 30 days prior to any county public
hearing on such applications. The Meridian Planning and Zoning Commission
shall make recommendations to the Ada County Zoning Commission on such
applications in writing and shall cite the County Comprehensive Plan Rural
Area policies or other policies supporting such recommendation. Such recom-
mendations shall be received by the Ada County Zoning Division no later that
24 days after Meridian has received such application.
3.2 The Meridian City Council shall make written recommendations to the
Board of County Commissioners, and to the County Zoning Commission where
appropriate, on any of the applications cited in Section 3.1 above. The
recommendation must be received by the County Zoning Division no later than
24 days after Meridian has received such application. The council shall
cite the County Comprehensive Plan Rural Area policies that support their
recommendation. The recommendation from the Meridian City Council shall not
be binding or controlling on Ada County but shall be treated as documentary
evidence.
3.3 Neither the Board of Ada County Commissioners nor the Ada County Zoning
Commission shall hold a public hearing on such application until the recom-
mendation of the Meridian City Council or Meridian City Planning and Zoning
Commission has been received, or the date the County should have received
the said Council's or Commission's recommendation, specified above, has
passed.
3.4 The Ada County Zoning Division will notify the Meridian City Council in
writing of the County's action on applications within the Meridian Area of
City Impact but outside the Meridian City limits within 15 days following a
final decision by the appropriate Ada County agency on such matter.

1.1 The northern referral area is the land within the following boundaries:

thence east for 2 3/4 miles to a point V4 mile west of Eagle Road; thence

RE: Area of City Impact Committee Meeting
On May 7, 1984, the Meridian Area of City Impact Committe recommended
approval of a package of Meridian Area of Impact Ordinances/Resolutions. At
that time, the Committee directed the planning and legal staff to work out some
minor wording changes.
The Prosecuting Attorney's Office has completed review of the
Ordinance/Resolutions and has proposed a number of changes. The Prosecutor,
Wayne Crookston and myself all agree that these changes are minor in natural
even though they are extensive in length. However, because the changes are
lengthy we are recommending that the Committee review the redrafted
Ordinances/Resolutions and make another recommendation. Thi's will insure that
the exact recommendation of the Committee is considered at hearings by the
Meridian City Council and the Board of Ada County Commissioners.

BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF ADA COUNTY, IDAHO, pur-
suant to the authority under Section 67-6526, Idaho Code, that the followi.ng
ordinance be adopted:
SECTION 1.0
The Meridian Area of City Impact'is the area designated on the attached map and
incorporated herein by reference.
SECTION 2.0
In case a property under single ownership is divided by the boundary line of the
Meridian Area of City Impact and the line divides the property so that one or
both of the parts has a depth of 300 feet or less, such part may be. included in
the jurisdiction within which the remainder and larger portion of the property
is located.
SECTION 3.0 RENEGOTIATION
3.1 In accordance with Idaho Code 67-6526(d),`the''Meridian City Council or
the Board of Ada County Commissioner's may request, in writing, to renego-
tiate any provision of this ordinance at any time. Within 30 days of
receipt of such written request by either party, a meeting between the two
jurisdictions shall occur.
3.2 While renegotiation is occurring, all provisions of this ordinance
shall remain in effect until this ordinance is amended or a substitute ordi-
nance is adopted by Meridian and Ada County, in accordance with the notice
and hearing procedures provided in Title 67, Chapter 65 of Idaho Code, or
until a declaratory judgment from the district court is final. Provided,
however, th.at this ordinance or stipulated portions thereof shall be of no

no longer apply to such annexed areas.
2.0 ANNEXATION TO OCCUR ONLY IN AREAS OF CITY IMPACT
Meridian shall limit its annexation to those lands within its Area of City
Impact. If Meridian.wishes to annex lands outside of its Area of City Impact,
it shall renegotiate its Area of City Impact boundary with Ada County in accor-
dance with Idaho Code 67-6526(d).
3.0 PLAN POLICIES AND ORDIANCES TO APPLY TO THE MERIDIAN AREA OF -CITY IMPACT
3.1 The Ada County Comprehensive Plan - Rural Area Section adopted by Ada
County as of May 18, 1983, shall apply to the Rural Area as identified on
the Area of City Impact boundary map in County Ordinance Number (City
Ordinance Number ), which is the land area outside the Meridian City
limits but within the Area of City Impact boundary.
3.2 Both Meridian and Ada County shall amend their Comprehensive Plans to
be consistent with this ordinance.
3.3 The Ada County Zoning Ordinance shall be used to implement this
ordinance.

4.0 COORDINATION OF PLAN AMENDMENTS, ORDIANCE AMENDMENTS, AND ZONING
APPLICATIONS
4.1 All applications for county and city amendments to their respective

amendment to the other entity. A separate Referral Process (County

by resolution, by each entity regarding procedures and time periods for, and

of such determination in writing prior to or at such public hearing. Such
input from the County shall not be binding or controlling on the City of
Meridian but shall be treated as documentary evidence.
2.3 Once an amendment to the Meridian Comprehensive Plan is adopted by the
Meridian City Council, the Meridian City Council shall forward a copy of the
final document to the Ada County Planning Commission within 15 days after
its adoption, along with notice as to when the amendment will take effect.
Any such amendment made by the'Meridian City Council to. the Meridian
Comprehensive Pian, in accord with Idaho Code, shalt not take effect in the
unincorporated Meridian Area of City Impact unless and until such amendment
Is adopted by the Board of Ada County Commissioners as an amendment to the
Ada County Comprehensive Plan.

2.4 All proposed amendments to the Ada County Comprehensive Plan Rural Area

SECTION 3.0 PROCESSING OF ZONING APPLICATIONS IN THE MERIDIAN AREA OF CITY
IMPACT
3.1 The Ada County Zoning Commission shall send to the Meridian Planning
and Zoning Commission -all County applications for Planned Developments, sub-
divisions,
ubdivisions, rezones, conditional use _permits and private.roads, located
within the'Meridian Area of City Impact?30 days prior to any county public
hearing on such appl-ications. The Meridian Planning and Zoning Commission
shall make recommendations to the,�Ada County Zoning Commission on such
applications in writing and shall cite the County Comprehensive Plan Rural
Area policies or other policies supporting such recommendation. Such recom-
mendations shall be received by the'Ada County Zoning Division no later that
24 days after Meridian has received such application.
3.2 The Meridian City Council shall make written recommendations to the
Board of County Commissioners, and to the County Zoning Commission where
appropriate, on any of the applications cited in Section 3.1 above. The
.recommendation must be received by the County Zoning Division no later than
24 days after Meridian has received such application. The council shall
cite the County Comprehensive Plan Rural Area policies that support their
recommendation. The recommendation from -the Meridian City Council shall not
be binding or controlling on Ada County but shall be treated as documentary
evidence.
3.3 Neither the Board of Ada County Commissioners nor the Ada County Zoning
Commission shall hold a public hearing on such application until the recom-
mendation of the Meridian City Council or Meridian City Planning and Zoning;,
Commission`:has been recetved,.or the date the County should have received
the said Council's or Commission's recommendation, specified above, has
passed.
3.4 The''Ada County Zoning Division will notify the,Meridian City Council) in
writing of the County's action on applications within the Meridian Area of
City Impact but outside the Meridian City limits within 15 days following a
final decision by the appropriate Ada County,agency on such matter.

SECTION 1.0 - REFERRAL AREAS
The northern referral area is the land within the following boundaries:
Beginning at the intersection of Chinden Boulevard and Linder Road; south

thence east for 2 3/4 miles to a point 1/4 mile west of Eagle Road; 'thence

Meeting was called to order at approximately 4:20 P.M. with six members present.
OLD BUSINESS:
1. MERIDIAN AREA OF CITY IMPACT ORDINANCE
Mr. Gross indicated to the committee that he has given to the Meridian City
Clerk a copy of the legal notice and Area of City Impact Boundary Map that
the County will be using as part of its hearing notification requirements.
He advised Meridian to review these documents with their legal counsel and
revise It accordingly to meet Meridlants public hearing notification
requirements.
Mr. Gross also advised the committee that the County's Prosecuting
Attorney's representative, Ted Argyle, had suggested changes to the Area of
City Impact Ordinances/Resolutions. The document which was forwarded to the
committee indicates in yellow the changes that are suggested. Mr. Gross
mentioned that Wayne Crookston suggested that this meeting be held so that
the revised Area of City Impact•Ordinances/Resolutions could be formally
acted on by the committee and used as the final public hearing document.
This will insure that the exact recommendation of the committee is con-
sidered at the hearings held by the Meridian City Council and the Board of
Ada County Commissioners.
MOTION: MAYOR KINGSFORD MOVED THAT THE
COMMITTEE RECOMMEND APPROVAL OF THE
REVISED ORDINANCES AND RESOLUTIONS.
VERN EMERY SECONDED THE MOTION AND
IT PASSED FOUR VOTES TO TWO WITH
TERRY SMITH AND BOB SPENCER OPPOSING
THE MOTION.
Mayor Kingsford indicated that with the committee approval both the City of
Meridian and Ada County can now schedule public hearings on the Impact Area
Ordinances/Resolutions. Ted Argyle indicated that such hearings would have to
be held separately since each governmental entity will have to eventually amend
its own Comprehensive Plan by virtue of adopting this document.
Mayor Kingsford asked City Attorney Crookston if he had any further comments to
make now that the ordinances had been recommended. Mr. Crookston indicated that
he thought the document was fine before, and the changes that were made were
only semantical. He did not see any problem with it.

Mayor Kingsford asked Mr. Spencer and Mr. Smith to make some kind of statement
concerning their negative vote on this document. Mr. Smith indicated that he had
difficulty with the area where the county policies are going to be used between
the city limits and the Area of Impact boundary. It is not consistent with
other communities and it provides some difficulty in encouraging future growth
and the expedient bringing in of new business. Mr. Spencer agreed with Mr.
Smith's assessment and added that the city was giving up some of i;ts flexibility
and ability to do things that maybe could be done if the city's plan applied
within the Urban Service Planning Area.
Mayor Kingsford indicated that Meridian could move much more rapidly with this
type of agreement than some other cities can since all we have to do to have our
plans and ordinances apply within the Area of City Impact is to annex.. We don't
have near the constraint that is typical in the other communities. The thing we..
have protected, in my judgement, is that their Rural Plan applies outside of our
city limits. Nothing can be approved out there by the county unless it meets
their Rural Plan. If it is anything that is creditable and a real asset to the
city then they would want annexation and as a result of annexation could be
approved for development quite rapidly.
Mr. Emery suggested that the City of Meridian schedule its public hearing first
and the county would follow suit shortly thereafter. Mr Argyle indicated to
the committee that Meridian and Ada County have sixty (60) days in which to take
action on the proposed Area of City Impact Ordinances/Resolutions.

development. Enclosure 3 was prepared by Mr. Crookston and showed modifi—
cations to the text in Enclosure 2.
The Area of City Impact Boundary Ordinance was not modified by Mr.
Crookston. There were some minor modifications to the Area of City Impact
Policy Ordinance.
Several minor additions and one major addition were proposed to the Meridian
Area of City.lmpact Referral Process Resolution. A new section was proposed
at the beginning called, Section 1.0 Amendment to Comprehensive Plans for
Land Solely Within or To Be Included In The City Limits. Mr. Gerber
suggested that the phrase "but shall be treated as documentary evidence", be
added to the end of the second sentence in the paragraph, in reference to
County comments on Meridian's proposed annexations and comprehensive plan
amendments.

Committee to prepare a letter to the Meridian City Council. and to the Board

" Committee. According to Idaho Code the City Council and the Board of County
Commissioners would have to act upon the recommendation within 60 days of
receipt. Mr. Crookston thought that "act upon the recommendation" meant
approve or deny the recommendation.
Mr. Gerber explained that he would redraft the ordinance to reflect the
changes approved by the Committee and ,draft a notice of public hearing. The
�. ordinance, resolutions, map and hearing notice would be submitted to the
Prosecuting Attorney's Office for review before the notice of hearing would
be published in the paper. Mr. Gerber stated that he would forward a copy
of all of the above mentioned documents to Meridian as soon as he had
completed them.

There was discussion on whether the proposed Meridian Area of City impact
Ordinances/Resolutions would be acceptable to the general public in
Meridian. Commissioner Emery was particularly concerned that the Meridian
Chamber of Commerce as represented by Terry Smith and the Meridian Planning
and Zoning Commission as represented by Bob Spencer would oppose adoption of
the Area of City Impact. He stated that if there was a strong possibility
that the ordinance would not be adopted he was prepared to scrap the recom-
mendation of the Area of City.Impact Committee and start over again at.

After some additional discussion Mr. Gerber was directed as Secretary of the
Committee to prepare a letter to the Meridian City Council and to the Board
of County Commissioners notifying them of the recommendation of the
Committee. According to Idaho Code. the City Council and the Board of County
Commissioners would have to act upon the recommendation within 60 days of
receipt. Mr. Crookston thought that "act upon the recommendation" meant
approve or deny the recommendation.
Mr. Gerber explained that he would redraft the ordinance to reflect the
changes approved by the Committee and draft a notice of public hearing. The
ordinance, resolutions, map and hearing notice would-be submitted to the
Prosecuting Attorney's Office for review before the notice of hearing would
be published in the paper. Mr. Gerber stated that he would forward a copy.
of all of the above mentioned documents to Meridian as soon as he had
completed them.

Meeting was called to order at approximately 3:45 p.m. with eight members pre-
sent.

MOTION: Commissioner Bill Gratton moved that the
minutes of November 28, 1983, be
approved. Terry Smith seconded the
motion and it passed unanimously.
OLD BUSINESS
1. Meridian Area of City Impact Map
Mr. Gerber described the two maps that were mailed to the committee.
The first was orginally prepared by the committee in October 1983. The
second map showed the additional area that Meridian was now considering as
an amendment to it's Urban Service Planning Area. (The amendment area can
generally be described as lying between the old Urban Service Planning Area
boundry of Meridian, and the Boise Area of Impact, a line one quarter mile
west of Cloverdale Rd.)
Mr -Crookston pointed out that the new Urban Service Planning Area boundry on
the north was not the South Slough but was a line one quarter mile south of
Ustick Rd.
Mayor Grant Kingsford, Mr. Gerber, and Mr. Gross, described the meeting that
they had had in February to discuss Meridians proposed new Urban Service
Planning Area. As a result of that discussion, Mayor Kingsford has
suggested that Meridian's Comprehensive Plan would only apply in the city
limits of Meridian, and that all of the unincorporated area in Meridian's
Area of City Impact should be governed by the County's Rural Area policies.

Bill Brewer entered the meeting at 3:50 p.m.
There was a great deal of discussion about the advantages and disadvantages
of the County using the new larger Urban Service Planning Area. Even though
the County would be using Meridian's Plan, it still would make the final
decision on whether an application was or was not in compliance with the
Meridian Comprehensive Plan. Any decision by the County Commissioners may
or may not be consistant with Meridians interpretation of it's Comprehensive
Plan.
Mr. Gerber indicated that the idea of Meridian using the larger Urban
Service Planning Area and the County applying Rural Area policies to all of
the Area of City Impact, would have to be explored more fully by legal coun-
cil. Wayne Crookston indicated that he did not see any problem with the
City using one set of policies and the County using another set of policies.
He knew of nothing in the Local Planning Act nor of any case law which would
prohibit such an agreement.
The committee discussed how Industry could be encouraged to come in to the
Meridian area. Mayor Kingsford stated that good industries would want to be
annexed and become part of the city. On the other hand the County may be
asked to approve fly-by-night development which Meridian might not want
to locate within it's Area of City Impact.
Terry Smith and Bob Spencer stated that industry might be discouraged from
coming to Meridian, if all new development had annex to the City. This
would be especially true if the property could not be annexed to Meridian
and the County could only review the development.under the County's Rural
Area policies.
The County Commissioners asked the Mayor and members of the City Council
what they wanted for the City.
MOTION: Mayor Kingsford moved that the Committee
approve the new Meridian Urban Service
Planning Area to apply within the City of
Meridian and the County Comprehensive Plan
Rural Area policies to apply to the unin-
corporated parts of the Meridian Area of
City Impact. David Davenport seconded
the motion and it passed with Terry Smith
and Bob Spencer opposing it.
MOTION: Councilman Brewer moved that the
Committee approve the Meridian Area of
City Impact Map including the referal
areas. Mayor Kingsford seconded the
motion and it passed unanimously.

The Committee directed Sheldon Gerber and Wayne Crookston to redraft the written
part of the Area of City Impact Ordinances reflecting the map that as approved
by the Committee. The Committee would meet again after the ordinances had been
redrafted.

AN ORDINANCE ESTABLISHING THE BOUNDARY OF THE MERIDIAN AREA OF CITY IMPACT
BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF ADA COUNTY, IDAHO, pur-
suant to the authority under Section 67-6526, Idaho Code, that the following
ordinance be adopted:
SECTION 1.0
The Meridian Area of City Impact is the area designated on the attached map and
Incorporated herein by reference.
SECTION 2.0
In case a property under single ownership is divided by the boundary line of the
Meridian Area of City Impact and the line divides the property so that one or
both of the parts has a depth of 300 feet or less, such part may be included in
the jurisdiction within which the remainder and larger portion of the property
Is located.
SECTION 3.0 RENEGOTIATION
3.1 In accordance with Idaho Code 67-6526(d), Meridian or Ada County may
request, in writing, to renegotiate any provision of this ordinance at any
time. Within 30 days of receipt of such written request by either party, a
meeting between the two jurisdictions shall occur.
3.2 While renegotiation is occurring, all provisions of this ordinance
shall remain in effect until this ordinance is amended or a substitute ordi-
nance is adopted by Meridian and Ada County, in accordance with the notice
and hearing procedures provided in Title 67, Chapter 65 of Idaho Code, or
until a declaratory judgment from the district court is final. Provided,
however, that this ordinance or stipulated portions thereof shall be of no
further force and effect if both jurisdictions so agree in writing.

IMPACT; PROVIDING FOR THE AMENDMENT OF THE MERIDIAN AND ADA COUNTY COMPREHENSIVE
PLANS TO BE CONSISTENT WITH THIS AGREEMENT; PROVIDING FOR THE COORDINATION OF
PLAN AMENDMENTS, ORDINANCE AMENDMENTS AND OF ZONING APPLICATIONS; PROVIDING FOR
RENEGOTIATION OF THE PROVISIONS OF THIS ORDINANCE AND PROVIDING FOR A SEVERANCE

BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF ADA COUNTY, IDAHO, pur-
suant to the authority under Section 67-6526, Idaho Code, that the following be
adopted:
1.0 MERIDIAN AREA OF CITY IMPACT BOUNDARY
The Meridian Area of City Impact boundary is as adopted in County Ordinance
Number (City ordinance Number ). Upon annexation of any portion
of the Area of City impact in Meridian, the provisions of this ordinance shall
no longer apply to such annexed areas.
2.0 ANNEXATION TO OCCUR ONLY IN AREAS OF CITY IMPACT
Meridian shall limit its annexation to those lands within its Area of City
Impact. If Meridian wishes to.annex lands outside of its Area of City Impact,
It shall renegotiate its Area of City Impact boundary with Ada County in accor-
dance with Idaho Code 67-6526(d).
3.0 PLAN POLICIES AND ORDIANCES TO APPLY TO THE MERIDIAN AREA OF CITY IMPACT
3.1 The Ada County Comprehensive Plan - Rural Area Section adopted by Ada
County as of May 18, 1983, shall apply to the Rural Area as identified on
the Area of City Impact boundary map in County Ordinance Number (City
Ordinance Number ).
3.2 Both Meridian and Ada County shall amend their Comprehensive Plans to
be consistent with this ordinance.
3.3 The Ada County Zoning Ordinance shall be used to implement this
ordinance.

4.0 COORDINATION OF PLAN AMENDMENTS, ORDIANCE AMENDMENTS, AND ZONING
APPLICATIONS
4.1 All county and city amendments to their respective comprehensive pians
and implementing ordinances which apply within the Meridian Area of City
Impact shall be sent by the entity considering such amendment to the other
entity. A separate Referral Process (County Resolution Number
,City Resolution Number ) shall be adopted, by resolution, by
each entity regarding procedures and time periods for sending such amend-
ments.
4.2 All county applications for Planned Developments, subdivisions, rezo-
nes, conditional use permits, and private roads within the Meridian Area of
City Impact shall be sent to Meridian, in accordance with the Referral
Process Agreement cited in Section 4.1 above.
5.0 RENEGOTIATION
5.1 In accordance with Idaho Code 67-6526(d), Meridian or Ada County may

RESOLUTION NUMBER
AT A MEETING OF THE BOARD OF ADA COUNTY COMMISSIONERS, STATE OF IDAHO, ON THE
DAY OF , 1984, THE FOLLOWING RESOLUTION WAS ADOPTED, TO WIT:
WHEREAS, the 1975 Local Planning Act requires that Ada County and each of
its cities establish Area of Impact Boundaries for each city and designate the
plans and ordinances to apply within such Areas of Impact; and
WHEREAS, Idaho Code, Section 67-6526(a), establishes procedures and deadline
for establishing such Area of Impact Agreements; and
WHEREAS, Idaho Code, Section 67-6526(b), requires that if the provisions of
67-6526(a) are not met by the deadline of January 1, 1978, the County
Commissioners together with three elected officials from the city concerned and
three city or county residents shall, by majority vote, recommend to the city
and county governing boards an area of city impact, together with plan and ordi-
nance requirements; and
WHEREAS, such a nine -member committee was formed by Ada County and Meridian
on , 198 , and has since negotiated on this matter and has reached
consensus; and
WHEREAS, said committee has recomended adoption of an ordinance establishing
the boundary of the Meridian Area of City Impact and an ordinance providing for
the application of plans and ordinance for the Meridian Area of City Impact; and
WHEREAS, the committee has also recomended that a referral process agreement
establishing procedures for amending plan policies and ordinances and the pro-
cessing of zoning applications be adopted;
THEREFORE, BE IT RESOLVED that the Board of Ada County Commissioners hereby
adopt the Meridian Area of Impact Referral Process, attached hereto and incor-
porated herein.

SECTION 1.0 AMENDMENT OF COMPREHENSIVE PLANS AND ORDINANCES FOR THE MERIDIAN
AREA OF CITY IMPACT
1.1 Any application to amend the Meridian Comprehensive Plan as it may
apply to unincorporated areas shall be reviewed and approved or denied by
Meridian before Ada County shall schedule such amendments for public
hearing.
1.2 Al amendments to the Meridian Comprehensive Plan and to the text of
Meridian's Implementing ordinances shall be received by Ada County at least
15 days prior to any public hearing on such proposed amendment(s). Ada
County shall determine whether or not such an amendment is in conflict with
one or more of the goals, objectives or policies of the Ada County
Comprehensive Plan. The County shall notify Meridian of such determination
In writing prior to or at such public hearing.
1.3 Once an amendment to the Meridian Comprehensive Plan is adopted by
Meridian, a copy of the final document shall be received by Ada County
within 15 days after its adoption, along with notice as to when the amend-
ment will take effect. Any such amendment made by Meridian to the Meridian
Comprehensive Plan, in accord with Idaho Code, shall not take effect In the
unincorporated Meridian Area of City Impact unless and until approved by Ada
County.
1.4 All amendments to the Ada County Comprehensive Pian Rural Area Section
and to the text of the Ada County Zoning Ordinance shall be received by
Meridian for comment at least 15 days prior to any public hearing on such
proposed amendments. Any comment by Meridian on such amendments shall be
made to the county in writing prior to or at such public hearing. Ada
County shall notify Meridian, in writing, of the county's action on such
amendments within the Meridian Area of City Impact within 15 days following
a final decision on such matter.
SECTION 2.0 PROCESSING OF ZONING APPLICATIONS IN THE MERIDIAN AREA OF CITY
IMPACT
2.1 All County applications sent to Meridian under the provisions of the
Area of City Impact Ordinance for Planned Developments, subdivisions, rezo-
nes, conditional use permits and private roads shall be received by Meridian
30 days prior to any county public hearing on such applications. The
Meridian Planning and Zoning Commission shall make recommendations to Ada
County on such applications in writing and shall cite the County
Comprehensive Plan Rural Area policies supporting such recommendation. Such
recommendations shall be received by the Ada County Zoning Division no later
that 24 days after Meridian has received such application.

2.2 The Meridian City Council shall make written recommendations to the
Board of County Commissioners, and to the County Zoning Commission where
appropriate, on any of the applications cited in Section 2.2 above. The
recommendation must be received by the County Zoning Division no later than
24 days after Meridian has received such application. The council shall
cite the County Comprehensive Plan Rural Area policies that support their
recommendation. Neither the Board of County Commissioners nor the County
Zoning Commission shall hold a public hearing on such application until the
recommendation of the Council has been received, or the date of County
receipt of the Council's recommendation, specified above, has passed.
2.3 Ada County will notify Meridian in writing of the County's action on
applications within the Meridian Area of City Impact within 15 days
following a final decision by Ada Couty on such matter.

1.1 The northern referral area is the land within the following boundaries:
Beginning at McMillan Road and Linder Road south along Linder Road for 11/4
mile to a point 1/4 mile south of McMillan Road, then east for 2 3/4 miles to
a point 1/4 mile west of Eagle Road, then south for one mile to a point 1/4 mile
west of Cloverdale Road, then north for 21/4 miles to Chinden Boulevard, then
west for 3 3/4 miles to Linder Road.
1.2 The southern referral area is the land within the following boundaries:
Beginning on Kuna-Meridian Road at a point 1/4 mile south of Victory Road
south for 2 3/4 miles along Kuna-Meridian Road to the intersection of
Columbia Road, then east for 2 3/4 miles to a point 1/4 mile west of
Cloverdale road, then north for 2 3/4 miles to a pont 1/4 mile south of

1. Meridian Area of City Impact Map
Chairman Spencer asked if there were any comments about the map.
Commissioner Gratton stated that with the addition of the referral area to
the northeast of Meridian, the map appeared to be okay.
2. Meridian Area of Impact Ordinance Text
Wayne Crookston indicated that he had met with Scott Campbell and Sheldon
Gerber to discuss Meridian's proposal to remove the Urban Service Planning
Area boundary from the Comprehensive Plan and adopt a separate Urban Service
Planning Area ordinance which would be cross-referenced within the
Comprehensive Plan and within the Area of City Impact ordinance. Mr.
Crookston stated that there did not appear to be any requirements in state
law about either including or excluding references to an Urban Service
Planning Area. However, it was the County's Intent to have some type of
line drawn In the Area of Impact Agreement which identified where Meridian's
Comprehensive Plan policies would be applied and where the County's Rural
Area Policies would be applied. It was not necessary this line be called "an
Urban Service Planning Area boundary. It could, for example, be called an
"Immediate Area of City Impact".

Mr. Crookston also suggested the possibility of defining Meridian's Urban
Service Planning Area as only Including the city limits. For the land
surrounding the city limits but inside the Immediate Area of City Impact,
the County would use Meridian's Comprehensive Plan policies.
Commissioner Riddle entered the meeting at 3:52 p.m.
Meridian believed that use of the term Urban Service Planning Area implied
that the City had an obligation to provide services to an area upon request.
Since Meridian only had intentions of .providing services to its immediate
corporated limits, it would then seem appropriate to limit the Urban Service
Planning Area boundary to the city limits.
Scott Campbell agreed that there was no prohibition in the Local Planning
Act from doing what was suggested by Meridian. However, the County would be
establishing a new precedent in adopting such an Area of City Impact
agreement. All the previous Area of Impact Agreements had identified an
Urban Service Planning Area where the City's Comprehensive Plan policies
would apply. If the County departed from past policy, the other cities
could also request various alternative boundaries to an Urban Service
Planning area to be included within their Area of City Impact ordinances.
Commissioner Gratton indicated that it would be a burden upon the County
Zoning staff to have to implement different sets of ordinances for each of
the five cities of Ada County.
Mr. Gerber quoted Section 67-6526 (Paragraph d) of the Local Planning Act
"Areas of City Impact Plan and ordinance requirements shall remain fixed
until both governing boards agree to renegotiate". In other words, an Urban
Service Planning Area (USPA) ordinance cross-referenced in an Area of Impact
ordinance remains fixed until the Area of Impact Ordinance is changed. Even
though the USPA Ordinance may be amended, this is not recognized automati-
cally in the Area of City Impact Ordinance.
Councilman Kingsford stated that it was Meridian's intent to have a smaller
USPA boundary, maybe even as small as the city limits. On the other hand,
there would be a larger Immediate Area of Impact where Meridian's
Comprehensive Plan applied. If this Immediate Area of Impact boundary is
large enough, it will not have to be amended within the Area of Impact
Ordinance every time Meridian decides to extend services to new industry.
Since the Urban Service Planning Area would be small, then Meridian would
not be making an commitment to provide services to new development upon
demand.
Scott Campbell indicated that if the City changes its USPA boundary or any
of the terms of the Area of Impact Ordinance, the Area of Impact Ordinance
has to be renegotiated. The County can only implement Meridian's policies
If they are recognized in the Area of Impact Ordinance and the City cannot
change the rules of the game without renegotiating the Area of Impact
Ordinance as is required in State Code.

Chairman Spencer emphasized Meridian's concern that designating a large
Urban Service Planning Area on a map would obligate the City to provide
services to any and all development. Meridian did not want to mislead
individuals and promise services which they may not be able to deliver
now. Someday in the future Meridian may want to provide services to these
areas, however.
Scott Campbell asked how long it would take developers to see that the City
and County were only changing the name of the Urban Service. Planning Area
but that the game was the same since Meridian's Comprehensive Plan policies
still applied. As long as Meridian's Comprehensive Plan policies apply,
there was some sort of commitment.to providing services at some point in the
future. It is not possible for the County to allow one use because it is a
desirable development and deny another use because it is an undesirable
development if both developments areas are within the same service area and
are being looked at under the same policies.
Commissioner Gratton indicated that he could not support adopting an Area of
Impact Ordinance which encouraged the County to make arbitrary and capri-
cious decisions. He also stated that he could not support an Area of Impact
Ordinance which put an unreasonable administrative burden on the County
Zoning staff. He felt very strongly that the County must follow the con-
cepts of an Urban Service Planning Area and that the County's rural area
ordinances apply outside of the Urban Service Planning Area.
Bill Brewer stated that it might be unreasonable for the City to ask the
County to do away with Urban Service Planning Area policies. This would be
breaking past County policy with the other cities and may not be practical
for the County to implement.
David Davenport stated that if the Area of Impact policies were too
flexible, then it may only encourage marginal development to occur which
can't afford to extend services. These marginal industries might prosper in
good times and go bankrupt in bad economic times, leaving the City holding
the bag for the cost of services.
Bill Brewer indicated that he thought most large desirable industries did a
lot of advance research and gave advance notice to City officials before
they made their decisions to locate in a given area.
Terry Smith stated that he did not want to discourage growth that may want
to locate outside of an Urban Service Planning area. It may be desirable to
have a larger Urban Service Planning Area and instead rely upon the policies
of the Meridian Comprehensive Plan to give Meridian and the County control
over the situation.
Commissioner Gratton stated that it was still possible to amend the City
Comprehensive Plan every six months to take into consideration new develop-
ments as they might occur.

Councilman Brewer stated that the City Council and Planning and Zoning
Commission members would have to meet to see where they wanted to put their
Urban Service Planning Area boundaries. He thought it was desirable for the
City to stick to using the Urban Service Planning area concept in the
Comprehensive Plan and within the Area of City Impact Ordinance.
Wayne Crookston indicated that the City would have to readvertise for the
public hearing to amend the Comprehensive Plan to enlarge the USPA boundary
to include the Upland Annexation. Originally, the December 5, 1983 hearing
was advertised to remove the USPA designation from the Comprehensive Plan.

AN ORDINANCE ESTABLISHING THE BOUNDARY OF THE MERIDIAN AREA OF CITY IMPACT
BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF ADA COUNTY, IDAHO, pur-
suant to the authority under Section 67-6526, Idaho Code, that the following
ordinance be adopted:
SECTION 1.0
The Meridian Area of City Impact is the area designated on the attached map and
incorporated herein by reference.
SECTION 2.0
In case a property under single ownership is divided by the boundary line of the
Meridian Area of City Impact and the Line divides the property so that one or
both of the parts has a depth of 300 feet or less, such part may be included in
the jurisdiction within which the remainder and larger portion of the property
Is located.
SECTION 3.0 RENEGOTIATION
3.1 In accordance with Idaho Code 67-6526(d), Meridian or Ada County may
request, in writing, to renegotiate any provision of this ordinance at any
time. Within 30 days of receipt of such written request by either party, a
meeting between the two jurisdictions shall occur.
3.2 While renegotiation is occurring, all provisions of this ordinance
shall remain in effect until this ordinance is amended or a substitute ordi-
nance is adopted by Meridian and Ada County, in accordance with the notice
and hearing procedures provided in Title 67, Chapter 65 of Idaho Code, or
until a declaratory judgment from the district court is final. Provided,
however, that this ordinance or stipulated portions thereof shall be of no

BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF ADA COUNTY, IDAHO, pur-
suant to the authority under Section 67-6526, Idaho Code, that the following be
adopted:
1.0 MERIDIAN AREA OF CITY IMPACT BOUNDARY
The Meridian Area of City Impact boundary is as adopted in County Ordinance
Number (City ordinance'Number ). Upon annexation of any portion
of the Area of City impact in Meridian, the provisions of this ordinance shall
no longer apply to such annexed areas.
2.0 ANNEXATION TO OCCUR ONLY IN AREAS OF CITY IMPACT
Meridian shall limit its annexation to those lands within its Area of City
Impact.. If Meridian wishes to annex lands outside of its Area of City Impact,
it shall renegotiate its Area of City Impact boundary with Ada County in accor-
dance with I daho Code 67-6526( d) .
3.0 PLAN POLICIES AND ORDIANCES TO APPLY TO THE MERIDIAN AREA OF CITY IMPACT
3.1 The Meridian Comprehensive Plan adopted and amended by Meridian as of
, is hereby adopted by Ada County to apply within the
Meridian Urban Service Planning Area as identified on the Area of City
Impact boundary map in County Ordinance Number (City Ordinance Number

3.2 The Ada County Comprehensive Plan - Rural Area Section adopted by Ada
County as of May 18, 1983, shall apply to the Rural Area as identified on
the Area of City Impact boundary map in County Ordinance Number (City
Ordinance Number ).
3.3 Both Meridian and Ada County shall amend their Comprehensive Plans to
be consistent with this ordinance.
3.4 The Ada County Zoning Ordinance shall be used to implement this
ordinance.
4.0 COORDINATION OF PLAN AMENDMENTS, ORDIANCE AMENDMENTS, AND ZONING
APPLICATIONS
4.1 All county and city amendments to their respective comprehensive plans
and implementing ordinances which apply within the Meridian Area of City
Impact shall be sent by the entity considering such amendment to the other
entity. A.separate Referral Process Agreement (County Resolution Number
,City Resolution Number ) shall be adopted, by resolution, by
each entity regarding procedures and time periods for sending such amend-
ments.
4.2 All county applications for Planned Developments, subdivisions, rezo-
nes, conditional use permits, and private roads within the Meridian Area of
City Impact shall be sent to Meridian, in accordance with the Referral
Process Agreement cited in Section 4.1 above.
4.3 Applications for Planned Developments, subdivisions and rezones within
the Meridian Urban Service Planning Area should occur as a result of annexa-
tion to Meridian; however, Ada County may consider such applications in
those exceptions where annexation is denied by Meridian or where the parcel
on which such application is filed is not contiguous to Meridian and there-
fore cannot be annexed.
5.0 CONSISTENCY OF ZONING WITH THE MERIDIAN COMPREHENSIVE PLAN IN THE MERIDIAN
AREA OF CITY IMPACT
Those lands with the Meridian Area of City Impact, to which the Meridian
Comprehensive Plan applies, which are presently zoned inconsistently with the
Meridian Comprehensive Plan, shall be considered for rezoning by the County to a
zone in the Ada County Zoning Ordinance which is consistent with the designation
and policies of the Meridian Comprehensive Plan. Rezoning of these lands shall
be coordinated with Meridian as provided within the Referral Process Agreement
(County Resolution Number , City Resolution Number ).

6.0 RENEGOTIATION

AT A MEETING OF THE BOARD -OF ADA COUNTY COMMISSIONERS, STATE OF IDAHO, ON THE
DAY OF , 198_, THE FOLLOWING RESOLUTION WAS ADOPTED, TO WIT:
WHEREAS, THE 1975 Local Planning Act requires that Ada County and each of
its cities establish Area of Impact Boundaries for each city and designate the
plans and ordinances to apply within such Areas of Impact; and
WHEREAS, Idaho Code, Section 67-6526(a), establishes procedures and deadline
for establishing such Area of Impact Agreements; and
WHEREAS, Idaho Code, Section 67-6526(b), requires that if the provisions of
67-6526(a) are not met by the deadline of January 1, 1978, the County
Commissioners together with three elected officials from the city concerned and
three city or county residents shall, by majority vote, recommend to the city
and county governing boards an areaof city impact, together with plan and ordi-
nance requirements; and
WHEREAS, such a nine -member committee was formed by Ada County and Meridian
on , 198, and has since negotiated on this matter and has reached
consensus; and
WHEREAS, said committee has recomended adoption of an ordinance establishing
the boundary of the Meridian Area of City Impact and an ordinance providing for
the application of plans and ordinance for the Meridian Area of City Impact; and
WHEREAS, the committee has also recomended that a referral process agreement
establishing procedures for amending plan policies and ordinances and the pro-
cessing of zoning applications be adopted;
THEREFORE, BE IT RESOLVED that the Board of Ada County Commissioners hereby
adopt the Meridian/Ada County Referral Process Agreement, attached hereto and
incorporated herein.

MERIDIAN/ADA COUNTY REFERRAL PROCESS AGREEMENT
SECTION 1.0 AMENDMENT OF COMPREHENSIVE PLANS AND ORDINANCES FOR THE MERIDIAN
AREA OF CITY IMPACT
1.1 Any application to amend the Meridian Comprehensive Plan shall be
reviewed and approved or denied by Meridian before Ada County shall schedule
such amendments for public hearing.
1.2 All amendments to the Meridian Comprehensive Plan and to the text of
Meridian's implementing ordinances shall be received by Ada County at least
15 days prior to any public hearing on such proposed amendment(s). Ada
County shall determine whether or not such an amendment is in conflict with
one or more of the goals, objectives or policies of the Ada County
Comprehensive Plan. The County shall notify Meridian of such determination
in writing prior to or at such public hearing.
1.3 Once an amendment to the Meridian Comprehensive Plan is adopted by
Meridian, a copy of the final document shall be received by Ada County
within 15 days after its adoption, along with notice as to when the amend-
ment will take effect. Any such amendment made by Meridian to the Meridian
Comprehensive Plan, in accord with Idaho Code, shall be considered by Ada
County as a proposed amendment to the Meridian Comprehensive Plan, as
adopted by Ada County, and shall not take effect in the unincorporated
Meridian Area of City Impact until approved by Ada County.
1.4 All amendments to the Ada County Comprehensive Plan and to the text of
the Ada County Zoning Ordinance shall be received by Meridian for comment at
least 15 days prior to any public hearing on such proposed amendments. Any
comment by Meridian on such amendments shall be made to the county in
writing prior to or at such public hearing. Ada County shall notify
Meridian, in writing, of the county's action on such amendments within the
Meridian Area of City Impact within 15 days following a final decision on
such matter. .
SECTION 2.0 PROCESSING OF ZONING APPLICATIONS IN THE MERIDIAN AREA OF CITY
IMPACT
2.1 The County Zoning Administrator shall coordinate implementation of the
ordinance with Meridian so that the Meridian Comprehensive Plan•is admi-
nistrated as consistently as possible within the two jurisdictions.

2.2 All County applications sent to Meridian under the provisions of the
Ordinance for Planned Developments, subdivisions, rezones, conditional use
permits and private roads shall be received by Meridian 30 days prior to any
county public hearing on such applications. The Meridian Planning and
Zoning Commission shall make recommendations to Ada County on such applica-
tions in writing and shall cite those Meridian Comprehensive Plan policies
supporting such recommendation. Such recommendations shall be received by
the Ada County Zoning Division no later that 24 days after Meridian has
received such application.
2.3 The Meridian City Council shall make written recommendations to the
Board of County Commissioners, and to the County Zoning Commission where
appropriate, on any of the applications cited in Section 2.2 above. The
recommendation must be received by the County Zoning Division no later than
24 days after Meridian has received such application. The council shall
cite those Meridian Comprehensive Plan policies that support their recommen-
dation. Neither the Board of County Commissioners nor the County Zoning
Commission shall hold a public hearing on such application until the recom-
mendation of the Council has been received, or the date of County receipt of
the Council's recommendation, specified above, has passed.
2.4 Ada County will notify Meridian in writing of the County's action on
applications within the Meridian Area of City Impact within 1.5 days
following a final decision by Ada Couty on such matter.

SECTION 1.0 - Ada County Development Application Referral Area
The following area shall be referred to as the County Development Application
Referral Area for the City of Meridian: a line 1/4 mile west of Kuna/Meridian
Road shall be the western boundary, a line 1/4 mile north of Columbia Road shall
be the southern boundary, a line 1/4 mile west of Cloverdale Road shall be the
eastern boundary and 1/4 mile south of Victory Road shall be the northern boun-
dary.
SECTION 2.0 - Amendment of County Comprehensive Plan Ada County Zoning Ordinance
All amendments to the Ada County Comprehensive Plan and to the Ada County Zoning
Ordinance shall be referred to and received by Meridian for comment at least 15

The members of the City Council and the Planning & Zoning
Commission recently had a joint meeting to discuss several issues
that have come up, including the Meridian/Boise Area of Impact
Boundary. The members of the Council and Commission feel
strongly that the Boise Area of Impact should not extend West of
Eagle Road. It was their consensus that a state highway such as
Eagle Road would provide an excellent place to end a Area of
Impact Boundary. The State Highway Department would not allow
the sewer and water lines to go down the center of the road,
therefore it would be very expensive to serve both sides of the
state highway. When we met back in November, your staff talked
about the building of a additional Fire Station out in the
Centennial Area and advised this would serve a circular area, it
seems by going across Eagle Road this defeats that theory.
1 would have to agree with the members of the Council and the
Planning and Zoning Commission that the Boise City Area of Impact
should end at Eagle Road.

RE: Boise Meridian Area of Impact Boundary

I have reviewed your concern with the proposed Boise City Area of ���®
Impact boundary and discussed it with several city and county /
representatives. We are all surprised that you were surprised.
As you recall, several of us from Boise City met with you and other
City of Meridian representatives on November 13, 1990 to discuss
impact area boundaries in the subject area. It was clear to the
City contingent that you wanted the Meridian boundary extended
northward to the quarter section line south of McMillan Road. I do
not recall that you had any concern with Boise City extending the
impact area westward as long as it was north of Meridian's east/
west boundary along the quarter section line south of McMillan.
The developer of the Boise Research Center has acquired property
from the west boundary of that development all the way to Eagle
Road. This developer has requested that the Boise City Area of
Impact be extended to Eagle Road to allow the expansion of the
Research Center to occur within Boise City. It is my understanding
that the Boise Research Center plans on submitting an annexation
request for this expansion as soon as the Area of Impact boundary
changes are resolved.
Our experience indicates it is not very efficient or even feasible
to place Area of Impact boundaries along major roadways. As the
area develops, the west side of Eagle Road will also request
services. It is difficult to justify the installation of sewer
lines and other utilities if services are limited to one side of
the street.

Following our November meeting at Meridian City Hall, Boise City
representatives had a series of meetings with the Ada County
Commissioners and staff regarding the City Area of Impact bound-
aries. All participants in those meetings felt the Boise City
boundary west of Eagle Road was appropriate and acceptable to the
City of Meridian.
