We are in the process of getting together funds for a building project. We did sell our building that was at Carlton and 2 1/2 Street. We are now renting the Methodist Church and they have given us the use of that facility for one year. In the meantime we are trying to get the funds together and we are having an architect draw up some plans. We've got Briggs Engineering doing our site work and one of the things we discover^ed as we got into this project which we were not aware of is the fact that we would be required to do curb, gutter and sidewalk and extend the asphalt out to the existing road. That was something that when we purchased the property we were nat aware of. That this property is located within the City of Meridian and. the Applicant has an agreement to purchase the property; the property is described in the application which description is incorporated herein. FINDINGS OF FACT AND CONCLUSIONS OF LAW -- PAGF, 1 3. That the property is zoned Old Town, which requires a conditional use permit for the operation of plumbing office and warehouse which the application requests. 4. That the Old Town District is described in the Zoning .Ordinance, 11-2-408 B. 10. as follows: (OT) Old Town District: The purpose of the (OT Distr ct is to accommodate and encourage further expansion of the historical core of the community; to delineate a centralized activity center and to encourage its renewal, revitalization and growth as the public, and quasi-public, cultural, financial and recreational center of the City. A variety of these uses integrated with general business, medium-high to high density residential, and other related uses is encouraged in an effort to provide the appropriate mix of activities necessary to establish a truly urban City Center. The District shall be served by Municipal Water and Sewer systems of the City of Meridian. Development in this district must give attention to the handling of high volumes of traffic, adequate parking, and pedestrian movement, and provide strip commercial development, and must be approved as a conditional use, unless otherwise permitted. 5. That the use proposed by Applicant is not a specific allowed use in the Zoning Schedule of Use Control, 11-2-409; however 11-2-407 D. 1. provides as follows: "When a use is not specifically listed as a permitted use, such use shall be hereby expressly prohibited unless by application and authorization (as provided for under Conditional Use) it is determined that said use is similar to an compatible with listed permitted uses. That electronic equipment and supplies, lumber yards, cabinet and door shops, and other similar business are allowed as conditional uses in the Old Town District. 7. That the property to the west is used as an office and as storage for a gas utility contractor; that property to the north was used as a computer sales office and is planned for a residential development; that property to the east is used for a grocery store and as a used clothing and furniture store; that the property to the south is for an office building. 8. That proper notice has been given as required by law and all procedures before the Planning and Zoning Commission have been given and followed. 9. That sewer and water is available to the property. 10. That the City Engineer has submitted comments and they are incorporated herein as if set forth in full herein. 11. CONCLUSIONS 1. That all the procedural requirements of the Local Planning Act and of the Ordinances of the City of Meridian have been met including the mailing of notice to owners of property within 300 feet of the external boundaries of the Applicant's property. 2. That the City of Meridian has authority to grant conditional uses pursuant to 67-6512, Idaho Code, and, pursuant to 11-2-418 of the Revised and Compiled Ordinances of the City of Meridian; 3. That the City of Meridian has authority to place conditions on a conditional use permit and the use of the property pursuant to 67-6512, Idaho Code, and pursuant to 11-2-418(D) of the Revised and Compiled Ordinances of the City of Meridian, Idaho; 4. The use, would in fact, constitute a conditional use and a conditional use permit is required by ordinance. b. The use apparently would be designed and constructed, to be harmonious in appearance with the intended character of the general vicinity. d. That the use would not be hazardous nor should it be disturbing to existing or future neighboring uses. e. The property has sewer and water service available. f. The use would not create excessive additional requirements at public cost for public facilities and services and the use would not be detrimental to the economic welfare of the community. g. The use would not involve a use, activity, process, material, equipment or conditions of operation that would be detrimental to person,. property or the general welfare by reason of excessive production of traffic or noise. h. That sufficient parking for the property and the proposed use will be required. i. The development and uses will not result in the destruction, loss or damage of a natural or scenic feature of major importance. 5. That the comments of the. We have ernest of the property just south of Franklin on Meridian Street and King. Rountree: You made the statement in your application that the proposed buildings and grounds are to be of such size that all trucks and materials can be housed inside, and in the plot plan you show a proposed building on lot 12 of block 4 but you didn't have anything identified on lot 12 of block 3. Will that be set up for storage or future development? Butterfield: That's for future use. We don't know if we will keep it or sell it. Johnson: Have you read the Ada County Highway District's recommendations? Butterfield: I scanned it the other day but I could not find it today. I don't think there is anything our of the ordinary there. They are asking us if we wanted to use that access on Williams Street to have part of it paved. Parking area shall be paved. Butterfield: I didn't really plan to pave parking for all the employees. My thought was to pave it for the customers. Johnson: You will probably be required to pave that. Dennis and Janet Butterfield are requesting conditional use approval to construct an office and warehouse for a plumbing business on property located on the east side of Meridian Street, south of King Street. Only the southerly portion of the site is being developed at this time. 2. Meridian Street has 60-feet of right-of-way (which is adequate), and is improved with 24-feet of paving. 3. King Street has 60-feet of right-of-way (which is adequate), and is improved with 24-feet of paving. 4. Williams Street has 60-feet of right-of-way (which is adequate), and is unimproved from about 100-feet to the east. It appears from the site plan that a dumpster will be placed at the end of Williams Street right- of-way. If the developer plans to use Williams Street as an access, then the street should be paved to the nearest paved portion of the street. Staff does not recommend that Williams be extended through the property due to the proximity to intersection of Meridian and Frank- lin. The following requirements are provided to Meridian Planning & Zoning as conditions for approval. SITE SPECIFIC REG~UIREMENTS: 1. Curb, gutter, 5-foot sidewalk and match paving shall be constructed on Meridian abutting parcel. Improvements shall be constructed to a 41- foot back-to-back street section. 2. Any utility cuts on Meridian Street must be approved by the .District Commission. STANDARD REQUIREMENTS: 1. Street and drainage improvements required in the public right-of-way shall be designed and constructed in conformance with District stan- dards and policies. 2. Specifications, land surveys, reports, plats, drawings, plans, design information and calculations presented to ACRD shall be sealed,. signed and dated by a Registered Professional Engineer or Professional Land Surveyor, in compliance with Idaho Code, Section 54-1215. 3. Written approval shall be obtained from the appropriate irriga- tion/drainage district authorizing storm runoff into their system. 4. Obstructions (utility facilities, irrigation and drainage appurtenances, etc.) shall be relocated outside of the proposed street improvements. Authorization for relocations shall be obtained from the appropriate entity . 5. Existing irrigation and drainage systems shall be continued across par- cel. 6. Three sets of street construction plans shall be submitted to the Dis- trict for review and appropriate action. 7. Site drainage plans and calculations shall be submitted for review and appropriate action by ACHD. The proposed drainage system shall re- tain all storm water on-site. 8. Design data for proposed access to public streets shall be provided for review and appropriate action by ACHD. 9. Driveways shall be located a minimum of 5-feet from the side lot proper- ty lines. 10. A request for modification, variance or waiver of any requirement or policy outlined herein shall be made, in writing, to the Manager of Engineering Services within 15 calendar days of the original Commission action.
