The Motion was made by Tolsma and seconded by Myers to approve of Clerk Niemann and
Engineer Smith to sign the plat.

Kingsford: Mr. Wayne Forrey is present and I'd like to take a few minutes and have
him update the Council on the downtown project.
Forrey: This is a progress report that I'd like to submit to the City every week now.
Gave brief report on progress of E. 1st Project. There is one loose end to tie up tonight
and that is to incorporate the ACRD General Conditions in their contract documents as
the general conditions for the City of Meridian pertaining to the documents for the
East 1St Street Improvement Project. The City of Meridian does not have a set of general
conditions for these types of projects. The Highway District already has them and today
they gave you permission to allow you to incorporate those by reference in your contract
documents.
The Motion was made by Myers and seconded by Tolsma to approve the ACHD General Conditions
for City use in Bid Documents.

ITEM #9: DEPARTMENT REPORTS:
Kingsford: I'd like to ask the Council to approve the transfer of $10,000.00 from the
25 account to the O1 account. The purpose of this is to pay the settlement authorized
in Case #93197, Tammy Perkins Day Care issue.
The Motion was made by Yerrington and seconded by Tolsma to approve of the transfer
of funds.

Kingsford: For the record that's the on-going thing that we have with the Perkins Day
Care Center. Council approved the settlement of that in the amount of $10,000.00.
According to State Code 50-1006 we will pursue putting that on the tax levy. We'll
have to pay the 25 account 6$ as perscribed by the current daily interest rate.

FINDINGS OF FACT AND CONCLUSIONS OF LAW
A 6eazing was held before the Boazd of County Commissioners on April 4, 1991, for the purpose of
considering the above captioned planned residential development application made by Michael G.
White.
The following persons were in attendance: Chairman John Bastida, Commissioner Gary Glenn,
Commissioner Vernon Bisterfeldt; Dave Bieter, representing the Prosecuting Attorney's office; Mr.
Don Hubble, representing the applicant; and Jon Salter, representing the Development Services staff.
SUMMARY OF THE RECORD
The file documents a planned residential development request by Michael G. White.
The applicant requests appcoval of a four lot preliminary subdivision plat. Each of the lots aze at
least 5 acres in size as required in the RT zone and each lot has frontage on a public roadway.
The property frontage is located on the north side of Victory Road beginning approximately 1/4 mile
east of Ten Mile Road and runs east along Victory approximately 1/4 mile.
The record before the Boazd is comprised of:
Staff report prepazed by Jon Salter for the Boazd heazing on Apri14, 1991. The report also
reviews the applicable ordinance sections considered by the Planning and Zoning Commission
in azriving at their recommendation.
2. Preliminary plat for subdivision submitted by Michael G. White on January 22, 1991.
3. Application forms and materials submitted by the applicant.
PROCEDURAL ITEMS
1. On January 22, 1991 Development Services accepted application 91-05-PDR and scheduled it
for public heazing before the Ada County Planning and Zoning Commission on Februazy 28,
1991. The applicant proposes to subdivide the pazcel into four lots. All of the lots will have
public street frontage on Victory Road. All of the lots will meet the minimum lot size of five
acres as required in the RT zone.
2. Legal notice of the public heazing was published in the Idaho Statesman on Februazy 11,
1991. Persons owning property within 300 feet of the site were also notified of the hearing
by mail on February 11, 1991. Prior to the hearing, notice was posted on the premises.

Staff notified other agencies of this proposal. Comments received at the time the staff report
was prepazed aze incorporated into this report.
On February 28, 1991, the Ada County Planning and Zoning Commission conducted a public
heazing on this application and voted to recommend approval to the Boazd of County
Commissioners.
5. Legal notice of the heazing before the Boazd was published on Mazch 18, 1991.
6. Notification was mailed to surrounding property owners on Mazch 18, 1991.
On Apri14, 1991, the Boazd of County Commissioners conducted a public heazing on this
application.
TESTIMONY
1. Jon Salter summazized the staff report and reviewed applicable ordinance sections.
2. Mr. Don Hubble, agent for the applicant, spoke in favor of this application.
No one spoke in opposition.
FINDINGS OF FACT
1. The 39.36 acre pazcel lies with the Meridian City Impact Area and is zoned RT (Rural
Transition). The property frontage is located on the north side of Victory Road beginning
approximately 1/4 mile east of Ten Mile Road and runs east along Victory approximately t/4
mile. Thece is presently a dwelling (and out-buildings) on the property (proposed Lot 4).
2. Ada County Code, Section 9-4-3A of the Meridian Area of City Impact Agreement states that
the Meridian Comprehensive Plan shall be the applicable plan within the Meridian Area of
City Impact.
3. Ada County Code, Section 9-4-3E states that the Ada County Zoning Ordinance shall be used
to implement the plan.
4. Ada County Code, Section 9-4-3B requires that all county applications for planned
developments within Meridian's Impact Area be sent to Meridian for their comments.
Accordingly, on January 28, 1991, Development Services sent Meridian a transmittal
outlining the proposal. The City of Meridian has responded and has no objections to this
application.
5. Meridian Comprehensive Plan Policies: Rural Residential -Agricultural reads as follows:
"Rural Residential -Agricultural (outside the Urban Service Planning Area, but inside
the Area of Impact).
Single Family Housing, Farming (not more than one dwelling unit per net five
acres)."

6. Meridian's Comprehensive Plan Rural Area Policies read as follows:
DEFINITION: Land covered by this policy section has chazacteristics which generally allow
for agricultural activity due to the existence of irrigation systems, soil chazacteristics and
relative freedom from conflicting urban land use... Where community growth needs and
increased traffic at access points, creates pressure for new development, it must be recognized
that such land can no longer economically continue to be identified or used as agricultural
land to the exclusion of orderly growth and development.
POLICIES:
1. The Meridian Comprehensive Plan shall apply in the rural azeas which aze outside
Meridian s City Limits and within the Meridian Area of City Tmpact, and the Ada County
Zoning and Subdivision Ordinances shall apply in the rural azeas outside the City limits.
2. Within the rural azeas, outside of Meridian's City Limits, the City of Meridian will
- - work closely with Ada County and together establish an Area of City Impact Agreement.
This will assure that the rural azeas aze developed in accordance with all applicable provisions
of this Plan.
3. Although it is recognized that urbanized development does exist within the rural azeas
of the Area of City Impact, the rural lands should be kept in agricultural production as long
as possible until urban services (municipal sewer and water facilities and other essential
services) can be provided. In that regazd the following policies shall apply with regard to
single family dwellings on 5 acre tracts, to wit:
a. Within the Area of City Impact but outside of the Urban Service Planning Area, one
single family residential building may be constructed on a 5 acre lot without municipal sewer
and water services being provided if Central Distritt Health Department approves private
sewer and water services.
4. Residential development is allowed in the rural azeas provided that said development
does not exceed the Rural Residential Agricultural density, unless it is inside an Urban
Service Planning Area and City sewer and water is provided... All residential developments
must also comply with the other appropriate sections of this plan."
Chapter 4, Article C and Chapter 10 of the Ada County Code outlines standazds by which
subdivisions in the RT zone aze reviewed. Section 8-10-2-2 and 8-10-4-3 describe the
procedures by which the Commission reviews subdivisions. Section 8-1Cr7B outlines
procedures for action by the Commission and Section 8-18-2 outlines procedures for action by
the Boazd on recommendations from the Commission.
Ada County Code, Section 8-4C-1 defines the RT (Rural Transition) zone as follows:
"The purpose of the Article is to identify lands lying within the Areas of City Impact on the
Ada County Comprehensive Plan Map that aze not zoned residential, commercial oc
industrial. Such lands aze presently not served by urban services and urban growth should be
discouraged until urban services aze extended. At such time, it is appropriate to rezone RT
lands to applicable urban zoning classifications and to permit development that is in

accordance with the applicable City/Community Comprehensive Plan. Until such time,
appropriate use of these lands include agricultural uses and residential development of a rural
chazacter."
9. Section 8-4C-2 allows one single family dwelling or mobile home per lot as a principal
permitted use in the RT zone.
10. Ada County Code, Section 8-4C-6 outlines the design and dimensional standazds within the
zone.
Staff fmds that the preliminary plat meets the design and dimensional standazds within the RT
zone.
Section 8-10-2B states that regulations in Chapter 10 (Subdivision Regulations) shall apply to
all subdivisions of land within the unincorporated territory of Ada County.
This chapter was written in 1959 and modeled after urban subdivision designs. Its standazds
outline requirements for streets, blocks, and lot configurations found within urban
subdivisions. The adoption of Ordinance 212 allows for subdivisions of land into residential
pazcels in the RT zone, however, new standazds for these types (rural) of subdivisions have
not been adopted.
Staff finds that if the Boazd adopts the conditions of approval attached to this report and
labeled Exhibit A, the application shall meet the applicable regulations of Chapter 10.
11. The site is not within a floodway as shown on Flood Insurance Rate (FEMA) Maps.
12. Section 8-9-3C5 requires Findings of Fact and Conclusions of Law be formulated prior to
action on a planned development application. These required findings aze reviewed below:
8-9-3CSa: The site has relatively level to gently sloping topography. Exhibit A,
Conditions of Approval provide for review by the County Engineer including
drainage review.
8-9-3CSb: The Commission should weigh response to public notice and agency
comments to assess any damage, hazazd or nuisance which may result from
this proposal.
8-9-3CSc: All of the lots will have frontage on W. Victory Road. Existing services and
transportation systems in the azea should not be unduly burdened by this
proposal.
8-9-3CSd: No common space or other community facilities azea proposed as part of this
development.
8-9-3CSe: This proposal complies with the design and dimensional standazds of Section
8-4C-6.

13. Chapter 10 (Subdivision Design Standazds), Section 8-10A-1 states: "These standazds shall be
followed in all subdivisions regulated by this Title. In addition to these standazds, all
subdivisions shall meet the design standazds and findings of fact listed in Chapter 9 relating to
planned developments and shall be in accordance with the Comprehensive Plan."
14. Section 8-9A-9 states that all new utilities be placed underground unless waived by the Boazd
where physical or other problems exist on the site which preclude underground installation.
CONCLUSIONS OF LAW
1. The preliminary plat is in compliance with all of the policies, goals, and objectives of Ada
-- County's Comprehensive Plan.
2. The preliminary plat is in compliance with the requirements of the RT zone and all applicable
regulations of the Subdivision Chaptec.
3. No undue damage, hazazd or nuisance to surrounding pcopetties should occur as a result of
this subdivision.
ORDER
The Boazd heceby approves the preliminary plat for the subdivision as contained in File No. 91-05-
PDR subject to the Conditiopn~s of Approval listed in Exhibit A, attached.

?. All public rights-of-way shall be dedicated and constructed to standards
of the Ada County Highway District.
2. Provide a surface run off drainage plan to the County Engineer prior to
submitting the final plat for approval.
3. Compliance with Section 31-3805 of the Idaho Code pertaining to irrigation
waters.
~. Individual lot irrigation shall be provided. An internal irrigation and
drainage plan must be approved by the Boise-Kuna Irrigation District prior
to submitting the final plat for approval.
5. Installation of fire protection facilities as specifically required by
Meridian Fire District.
5. Install service facilities to comply with the requirements of the public
utility providing service. All utility easements shall comply with utility
recommendations and be shown on the final plat.
7. Building setbacks and dimensional standards in this subdivision shall be
in compliance with the applicable zoning regulations of Ada County. This
statement shall appear on any final platting.
8. The preliminary and final plat shall be in conformance with Section 8-10-4
and 8-10-5 as well as Section 8-10A-1 through 8-10A-6 of Ada County Code.
9. All site improvements are prohibited prior to recording the final plat.
10. Frior to approval by the Board of County Commissioners, the final plat
shall contain the following certifications and endorsements: signature of
owner, certificate of plat engineer, certificate of County Engineer,
certificate of Meridian City Clerk, endorsement of Central District Health
Department, endorsement of Ada County Highway District, certificate of
Meridian City Engineer.
11. The following statement shall appear on the face of the final plat: "Any
resubdivision of this plat shall comply with the applicable zoning
regulations in effect at the time of the resubdivision."
12. All easements and public rights-of-way shall be shown on the final plat.
13. The preliminary and final development plans and any time extension shall
be filed in compliance with Sections 8-9-3C7 and 8-9-3D4 and 5 of Ada
County Code.
1&. All lots shall be provided on site vehicle turnazound areas.
15. The subdivision name and street name are to be approved by the Ada County
Engineer prior to submitting the final plat for approval.

16. Time extensions for plats in Ada County which are inside the Meridian Area
of City Impact may also require the time extensions from the City of
Meridian.
