Kingsford: Is there anyone from the church here to address the Council? Bob Maxey: I am the architect involved with the Meridian Methodist Church for this structure, it is immediately behind their existing church. If there is any questions about this project I will be very happy to answer them. Giesler: There was some concern regarding the parking could you explain a little about that. Maxey: I was in attendance at that meeting and I think the main concern was with a lady that lives accross from the church. She has a little problem with cars parking in front of her house on Sunday mornings. The members of the church did meet with her immediately after that meeting and made the committment to her that they would make every effort to see that it did not happen again. We would like to get the medical clinic property to have some additional parking, but at this time the church can not afford it. Kingsford: I really feel the major concern would be on Sundays. Motion Carried: All Yea: #2: AUTHORIZE MAYOR & CITY CLERK ~ EXECUTE LATE COMER'S AGREEMENT WITH INTERWEST DEVELOPMENT CORPORATION: The Motion was made by Tolsma and seconded by Myers to authorize the Mayor & City Clerk to execute Late Comer's Agreement with Interwest Development Corporation: Motion Carried: All Yea: #3: DISCUSSION ON NEW TYPE TRASH CONTAINERS: Kingsford: We have had no response at all at City Hall. Alidjani: I had 15 to 20 calls not recently, but the calls I receive were asking us to supply the cans. Tolsma: How many customers would that entail out there? Alidjani: Total or the ones that have called me? Tolsma: The ones that would like to have them. Alidjani: About 20 and those are ones that have seen it or have used it. Kingsford: We could try it on a voluntary basis like Mce suggested. Discussion held on putting a flyer in with the water bills. Motion Carried: All Yea: Alidjani: I want the Council to know that if there is not enough interest then I am not going to even order the equipment. Yerrington: What color are you thinking about? Pat Tealy, 479 Main Street, Boise, was sworn by the attorney. Tealy: I represent the applicant Mr. Darrell Taylor. We have reviewed the comments made and have one question. I don't know that you can answer mY question maybe Engineer Smith will have to. There has been some concern expressed about providing some services to the properties to the west when we build our sewer line in there. We feel this is a good idea, but we don't know who is going to pay for it. We would like some determination on how we are to pursue this or who to talk to. Johnson: Explained comments concerning this. Have you read all the other comments? Tealy: Yes we have. Rountree: i have a question about the extension of the street on up to Newport Street. The plat indicates some kind of a connection there is there been any coordination with the property owner in the Misty Meadows area. Tealy: We put a stub out to their property. Rountree: So that is on their plat. Tealy: Yes. Hepper: What did you say was the width of the street? Tealy: It would be 36 feet back to back. What we would be providing is the easterly, the curb gutter and sidewalk that would be on our property adjacent to the lots, half of the street width, in other words the paved portion of it and then another twelve feet of paving. Hepper: So there would be to the center line plus twelve? Tealy: That's correct. u • BEFORE THE MERIDIAN PLANNING AND ZONING COMMISSION MERIDIAN UNITED METHODIST CHURCH CONDITIONAL USE PERMIT CORNER EAST PINE AND EAST 3RD STREET MERIDIAN, IDAHO FINDINGS OF FACT AND CONCLUSIONS The above entitled matter having come on for public hearing April 9, 1991, at the hour of 7:30 o'clock p.m., the Petitioner appearing in person, the Planning and Zoning Commission of the City of Meridian having duly considered the evidence and the matter makes the following findings of Fact and Conclusions: FINDINGS OF FACT 1. That a notice of a public hearing on the Conditional Use Permit was published for two (2) consecutive weeks prior to the said public hearing scheduled for April 9, 1991, the first publication of which was fifteen (15) days prior to said hearing; that the matter was duly considered at the April 9, 1991, hearing; that the public was given full opportunity to express comments and submit evidence; and that copies of all notices were available to newspaper, radio and television stations; 2. That the property is zoned Old Town (OT), which requires a conditional use permit for the operation of a day care center; that in Old Town conditional uses are generally required for- any use where the property was not previously used for that purpose; additionally, under 11-2-407 D, uses not specifically permitted or listed in districts may be permitted under a conditional use permit. 4. That the 0-T District is described in the Zoning Ordinance, 11-2-408 B. 10 as follows: (0-T) OLD TOWN DISTRICT: The purpose of the ~Tj -~istrrct. is to accommodate and encourage fur•ther• expansion of the historical core of the community; to delineate a centralized activity center and to encourage its renewal, revitalization and growth as the public, quasi-public, cultural, financial and recreational center of the City. A variety of these uses integrated with general business, medium-high to high density residential, and other related uses is encouraged in an effort to provide the appropriate mix of activities necessary to establish a truly urban City center, The district shall be served by the Municipal Water and Sewer systems of the City of Meridian. Development in this district must give attention to the handling of high volumes of traffic, adequate parking, and pedestrian movement, and to provide strip commercial development, and must be approved as a conditional use, unless otherwise permitted. 5. That other- property in the area is used commercially and residentially; that the property to the south is used for the Applicants church; the property to the east is residential; the property to the west is commercial; the property to the north is residential. 7. That proper notice has been given as required by law and all procedures before the Planning and Zoning Commission have been given and followed. 8. That there is no present use of the property, It is a vacant lot. 9. That sewer and water is available. 10. That the Ada County Highway District may submit comments and they will be incorporated herein as if set forth in full herein. 12. That there was testimony at the public hearing objecting to present parking problems at the church itself, and objecting that additional uses at the property may increase the parking problem; that most of the parking objections related to parking on Sunday during church service. That all the procedural requirements of the local Planning Act and of the Ordinances of the City of Meridian have been met including the mailing of notice to owners of property within 300 feet of the external boundaries of the Applicant's property. 2. That the City of Meridian has authority to grant conditional uses pursuant to 67-6512, Idaho Code, and, pursuant to 11-2-418 of the Revised and Compiled Ordinances of the City of Meridian; 3. That the City of Meridian has authority to place conditions on a conditional use permit and the use of the property pursuant to 61-6512, Idaho Code, and pursuant to 11-2-418(D) of the Revised and Compiled Ordinances of the City of Meridian, Idaho; 4. •That even though one of the specific uses requested is not a listed permitted use or listed conditional use in the Old Town District, it is concluded that the family life center is analogous to an entertainment center, indoors, which is a listed permitted conditional use in the Old Town District; that also the family life center is a compatible use to those permitted in the Old Town District and to those uses presently existing. 5. That 11-2-418(C) of the Revised and Compiled Ordinances of the City of Meridian sets forth the standards under which the Planning and Zoning Commission and the City Council shall review FINDINGS OF FACT AND CONCLUSIONS OF LAW - PAGE 4 ii • • applications for• Conditional Use Permits; that upon a review of those requirements and a review of the facts presented and the conditions of the area, the Planning and Zoning Commission concludes as follows: a. The use, would in fact, constitute a conditional use and a conditional use permit is required by ordinance. b. The use would be harmonious with and in accordance with the Comprehensive Plan but the Zoning Ordinance requires a conditional use permit to allow the use. c. The use apparently would be designed and constructed, to be harmonious in appearance with the intended character of the general vicinity. d. That the use would not be hazardous nor should it be disturbing to existing or future neighboring uses but the parking problems must be resolved. e. The property has sewer and water service available. f. The use would not create excessive additional requirements at public cost for public facilities and services and the use would not be detrimental to the economic welfare of the community. g. The use would not involve a use, activity, process, material, equipment or conditions of operation that would be detrimental to person, property or the general welfare by reason of excessive production of traffic or noise. I don't see any advantage of changing it to a higher density residential as opposed to other than the immediate five residential duplex units. Hepper: Is lots 6 & 7, Block 3, are they to remain commercial? Discussion. ITEM #3: PUBLIC HEARING: REQUEST FOR CONDITIONAL USE PERMIT FUR FAMILY LIFE CENTER BY MERIDIAN UNITID METHODIST CHURCH: Johnson: At this time I will open the Public Hearing, is there anyone to testify. We have a change in Counsel. Crookston is in place and Riddlemoser is stepping down. Bob Maxie, 373 O'Cory Way, Boise, was sworn by the attorney. Maxie: I am one of the architects involved in planning the Family Life Center. What we would like to build on that vacant piece of church owned property to the north of the existing building is an approximately 8,900 sq. feet of basically the family life center consists of a multi purpose room serving many needs of the church, an activity center, a dance area, a basketball court, church social functions, dinners this kind of thing. Surrounding that with classrooms that would serve as overflow Sunday school classrooms, they would function if we are successful in handling a Day Care Center. We have it set up so that people wishing to use the Day Care could unload under cover. Our biggest problem is lack of parking. We don't feel that this is going to increase the crowding in the area. We do feel that the building would be an asset to the community. Rountree: Do you have any proposed agreements with your neighbors as far as parking arrangements? Maxie: There are members of the church here tonight that could address that point better than I could. Hepper: Going by the City requirements, how many parking spaces are required and how many do you have? Maxie: It spoke to one per bus or vehicle delivering children to the Daycare Center. The Day Care Center is not our prime motive. MERIDIAN PLANNING 6 ZONING APRIL 9, 1991 PAGE #6 Maxie: I would say we would be looking at anywhere between 10 and 30. As far as the number of parking stalls, it is shown on our site plan I would have to go back and count those. Johnson: If I interpret your site drawing correctly you have 32 parking spaces. Anyone else from the public who wishes to testify? Phyllis Musgrove, 214 East Pine, was sworn by the attorney. Musgrove: I do think that this is a nice idea but I'm worried about being blocked in. (Expressed concerns about being blocked in) They don't have enough parking. Johnson: We appreciate your comments, maybe something can be worked out with the church. Anyone else from the public to testify? Wes Hoalst, 385 Montwe Drive, was sworn by the attorney. Hoalst: I am the Administrative Chairman of the Meridian Methodist Church and our agreement has been for many years with the Masonic Lodge for usage of their parking lot on weekends. If we have a problem with blocking this lady's driveway we will certainly work on that to correct this. Most of our use is on weekends, there would be some evening use. The building itself is not built for the purpose of Day Care Center. Our purpose of this Family Life Center is to be a community service type. It would be a building that can be functional for many uses but is not a public building. Rountree: What's the time line on getting to construction? Hoalst: Our goal for ground breaking is to be the fall of 1991. Major construction to begin in spring and complete in the fall of 1992. Johnson: Anyone else to testify? Ralph Lawrence, 4192 Tattenham Way, Boise was sworn by the attorney. Johnson: I have some questions like the size of your congregation, average Sunday attendance, and how much parking that you are getting from the Masonic Lodge? Also how much parking are you sacrificing with the construction of the building? Lawrence: we expanded our parking space temporarily when we moved that old house off of there. We have all of that. i suppose you could park between 20 & 25 if you really parked them in straight lines. We would probably loose about half of that in the building process. Our Average attendance year around is 200. Johnson: You would have two or three people to a car? Lawrence: Probably two. MERIDIAN PLANNING & ZONING APRIL 10, 1991 PAGE #7 Lawrence: When there is a youth function such as a basketball game your not going to have the same numbers of cars as on a Sunday morning. The usage of the new unit is going to be a lower density parking than the peak hour on Sunday morning. Johnson: The problems with this lady that is having trouble with her company parking, would you say that that is a Sunday only occurance? Lawrence: I would suppose so. Johnson: Is the church looking at the Day Care as an income producing thing? Lawrence: Not necessarily. Johnson: Would it go beyond the scope of the church? Lawrence: Yes it probably would, it would serve the general public. Johnson: Anyone else to testify? Hearing no response I will close the Public Hearing. Meridian United Methodist Church request conditional use approval to construct a social hall with a capacity of approximately 150 people on property located at 240 East 3rd Street in Meridian. 2. Pine Avenue has 80-feet of right-of-way (which is adequate), and is improved with 45-feet of paving. 3. East 3rd Street has 80-feet of right-of-way (which is adequate), and is improved with curb and sidewalk along the west side. there is 20-feet of paving on the east side of centerline. There are several damaged panels of sidewalk which need to be removed and replaced. 4. The alley has 16-feet of right-of-way (20-feet is required), and is improved with full width paving. There is a drop-off area proposed along the alley. there is an existing building along the westerly right- of-way line preventing future widening of the alley to that side. The following requirements are provided to Meridian Planning & Zoning as conditions for approval. SITE SPECIFIC REQUIREMENTS: 1. Curb, gutter, 5-foot sidewalk and match paving shall be constructed on Pine abutting parcel. Improvements shall be constructed to a 41-foot back-to-back street section. 2. Dedicate 10-feet of right-of-way from the centerline of the alley abut- ting parcel. 3. Provide full width paving for the alley to the new right-of-way line. 4. Street and drainage improvements required in the public right-of-way shall be designed and constructed in conformance with District stan- dards and policies. 2. Specifications, land surveys, reports, plats, drawings, plans, design information and calculations presented to ACHD shall be sealed, signed and dated by a Registered Professional Engineer or Professional Land Surveyor, in compliance with Idaho Code, Section 54-1215. 3. Written approval shall be obtained from the appropriate irriga- tion/drainage district authorizing storm runoff into their system. 4. Obstructions (utility facilities, irrigation and drainage appurtenances, etc.) shall be relocated outside of the proposed street improvements. Authorization for relocations shall be obtained from the appropriate entity. 5. Existing irrigation and drainage systems shall be continued across par- cel. 6. Three sets of street construction plans shall be submitted to the Dis- trict for review and appropriate action. 7. Site drainage plans showing that storm runoff will not flow into public right-of-way shall be submitted for review and appropriate action by ACHD, in compliance with Boise City Code 11-3-54 and ACRD policy. 8. Design data for proposed access to public streets shall be provided for review and appropriate action by ACRD. 9. Driveways shall be located a minimum of 5-feet from the side lot proper- ty lines. 10. A right-of-way permit must be obtained from ACHD for all street and utility construction within the public right-of-way. Contact Quality Control at 345-7667 (with zoning file number) for details. 11. A request for modification, variance or waiver of any requirement or policy outlined herein shall be made, in writing, to the Manager of Engineering Services within 15 calendar days of the original Commission action. The request shall include a statement explaining why such a requirement would result in substantial hardship or inequity.
