The Regular Meeting of the Meridian City Council was called to order by Mayor Grant

Kingsford: Mr. Orton and I visited on the telephone last week about the possibility
of going ahead and reconsidering having the entire portion be R-8 with restrictions
that I think meet the concerns of the Council. Mr. Orton if you'd like to come forward
and make a comment.
Rick Orton: With that explanation from the Mayor and the letter that you have in front
of you I think this is pretty self explanatory. After the last meeting my client Ms.
Arnold had a meeting with her marketing representative and it occurred to me after that
meeting that they were advising her to do the same that the Council was more or less
directing her to do with the way that they had made the previous motion. That is the
development shouldn't contain any rental or attached housing and that the development
should probably have a cap in the neighborhood of .210 units and to satisfy-the market
mix as they see it in Meridian the development should have a combination of six to eight
thousand square foot lots distributed_throughout it. If the Council were to reconsider -
their motion and allow R-8 throughout the subdivision with these stipulations as Ms.
Arnold has put it in her letter I believe both of our needs could be satisfied. I'm
here to answer questions if there are any if there aren't I would ask that the Council
to vote in favor of the last motion make a motion to reconsider it.
Giesler: There was a remark on her letter saying that ACHD plans to overlay Pine Street
this summer, wasn't that just done?
Kingsford: They just did it to Linder, they plan to overlay from Linder to Ten Mile
this summer. _-
Kingsford: For your information i think that the 210 represents 4.1 units per acre
which is slightly higher than R-4 zone-would have allowed-
Tolsma: The rest of the ..project will still be the same as you originally layed out.
Orton: Yes, if you were to grant this request reconsider your motion then the whole
development would be a mixture of 6,7 & 8 thousand square foot lots with no attached
housing, no rental units and we also agreed to a stipulation that our minimum house
size would be 1100 square feet.
Kingsford: Your concept plan same as before.
Orton: Based on the concept plan that has been put in front of you about all that .would.
change of any significance in the layout. would be that.the dashed-lines which previously
denoted attached housing or rental would disappear. The mixture of lots, there would
still be some six thousand and there would be-some larger eight thousands and a.distibution - -
in between we don't think that the .road-plan would change-significantly and certainly
the green zones and up and road right of ways there is no call for that to change.

Linda Arnold property on West-.Pine as stipulated in her letter. ;,

Kingsford: Is there anyone who wishes Ordinance #549 read in it's entirety. No response.
The Motion was made by Myers and seconded by Yerrington that the rules and provisions
of 50-902 and all rules and provisions requiring that Ordinances be read on three different

ITEM #4: PUBLIC HEARING: REQUEST FOR VARIANCES MERIDIAN GREENS #2 BY GLENCO INC.:
Yerrington: I have a conflict of interest I will be stepping down.
Kingsford: I will open the Public Hearing on the variance request for Meridian Greens
#2 by Glenco Inc.. The variance includes three issues, the street lighting, the block
length of a culdesac and the irrigation. After having a discussion with the developer
we are going to stay with the irrigation as it was.
Don Hubble, Hubble Engineering, 3952 Daisy way, was sworn by the attorney.
Hubble: In regards to the culdesac length we are asking for a variance for that in
amount of approximately 70 feet. We are asking for one that is 520 to 530 and we are
willing to install the appropriate fire hydrants in order to meet the fire requirements.
In regards to the street lights, what we propose to do with this is to install street
lights at the street intersections.-- -- `
Kingsford: And you are going to xequire hat the-yard lights still--be on.- -- - -
Hubble: Yes. _- - ._
Kingsford: Anyone else to-testify-on-this tissue, hearing no response I will close the
Public Hearing. _ _
Giesler: The yard lights would be on photo cell, correct?
Kingsford: Yes. To update the Council Bob and Ron and I had a meeting with the Fullers
last week and discussed the irrigation issue. We came up with a proposal that during
the times of the year that there is not irrigation eater but yet-they want to irrigate
that we would charge that .system with City water.__ _.

DISCUSSION HELD ON ROADWAYS IN MERIDIAN GREENS, _ _._
Giesler: it would be my preference to see that highway go on through to Mesa Way.
I feel that the time to do it is right now. ACHD says that they will fix that highway
up this summer and I feel that now is the appropriate time.
Tolsma: I agree with Bob. We should let it go through.

NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND THE CITY
COUNCIL OF THE CITY OF MERIDIAN, ADA COUNTY, IDAHO:
Section 1: That the above described and referenced real
property is hereby annexed to the City of Meridian, and shall be
zoned R-8 Residential; PROVIDED, HOWEVER, that even though the
land is zoned R-8 Residential, it shall only have constructed on
the lots, single family detached dwelling units and there shall
be no duplexes, condominiums or townhouses constructed or placed
thereon; that there shall be no more than two hundred ten (210)
single family detached dwelling units constructed or placed
thereon; that there shall be no single family detached dwelling
units smaller than one thousand one hundred (1100) square feet in
size constructed or placed thereon; that thirty percent (30%) of
the single family detached dwelling units may be between 1100 and
1199 square feet in size; that forty percent (40%) of the single
family detached dwelling units may be between 1200 and 1299 square
feet in size; that at least thirty percent (30%) of the single
family detached dwelling units shall be 1300 square feet in size
or greater; and that the above square footages are determined
exclusive of the garage; that the reason for the R-8 zoning is to
allow 210 dwelling-units to be constructed on the parcel which
would be an approximate density of 4.1 dwelling units per acre

Section 2: That the property shall be subject to de-
annexation if the owner or his assigns, heirs, or successors shall
not plat the property as required above and designate on the plat
that only single family dwellings shall be allowed,. construct
water and sewer line extensions to serve the property, and
construct streets to and within the property, which conditions
subsequent shall run with land and also be personal to the owner,

Section 3: That the City Clerk Shall cause one (1) copy of
the legal description, and map, which shall plainly and clearly
designate the boundaries of said property, to be filed with the
Ada County Recorder, Ada County Assessor, and the State Tax
Commission within ten (10) days following the effective date of
this Ordinance.
Section 4: This Ordinance shall be in full force and effect
from and after its passage, approval and publication as required
by law.

I request that the Council reconsider their previous action
regarding zoning for my parcel on Pine Street. Specifically, I ask
that this entire parcel be annexed and zoned R-8.
My reasons for this request are listed below:
1. i cannot carry out my planning with both R-8 and R-4
zones on the property.
2. Market advice has led me to conclude that my concept
should not contain any attached housing or duplexes.
Additionally, I have been advised that a mixture of 6000
to 8000 sq. ft. lots is desirable in the Meridian market.
3. R-8 zoning is the only classification that will permit
the desired lot-size mixture without further delay.
4. ACHD has elected to overlay Pine Street this summer. If
I expect to complete my off-site work before the overlay,
I must act promptly.
I also recognize and share your concern for the high density that
R-8 zoning allows. Consequently, if the R-8 Zoning is allowed on
the entire parcel, I will comply with the following requirements:
1. There will be no duplexes or attached housing allowed in
the subdivision.
2. There will be a ceiling of 210 lots (and units) in the
subdivision.

Bohan: No, the utility easement. If we put up fences back there the utilities
would becoming through there I believe once or twice a year to service.
Kingsford: I have a utility easement in my back yard and I've lived there fourteen
years and they have never been there.
Bohan: Before you make a decision on this I would hope that you would look into
the letters that have been written by the other homeowners. When we first met
the Wood's the builder had never told them about the easement until they had signed
the papers. They told us that if they had known that easement was there they would
have never purchased that home. That easement is used, but there is not slot
of traffic so we feel it should stay.
Wilma John, 1545 W. Carol, was sworn by the attorney.
John: We live two houses over and behind the Woods. We've been there about three
years. That easement has never been used since I've been there. The weeds are
huge. Why don't they steralize the the ground.
Stein Wood: Something that has been left out of the public discussion but was in
my letter. On the requirements that I pave 115 x 180 feet of my back yard,
I would have to pay to have his fence taken down and put back up plus the paving
costs. My main problem is the expense, it's absurd for me to pay thousands of
dollars to pave my back yard when the easement doesn't go anywhere, it serves no
purpose.
Kingsford: Well again, the intent of that thing was that there was going to be
commercial lots in the front and it was the back access to those commercial lots.
I would like to enter into the record three letters received from homeowners which
are in opposition to this request. Any further public comm?nts, seeing none I will
close the public hearing.
The Motion was made by Tolsma and seconded by Giesler to have the attorney prepare
Findings of Fact and Conclusions of Law on this issue.

Giesler: Maybe some of these people didn't realize that they could put there fences
around that easement, but those fences can betaken out to your property line.
Kingsford: Certainly as that property develops in back of you to the east your going
to have a no-mans land there that somebody is going to be on your case on the other
side to see that that is taken care of.
ITEM #7: PUBLIC HEARING: REQUEST E'OR ANNEXATION AND ZONING BY LINDA ARNOLD:
Kingsford: I will open the Public Hearing, is there anyone to testify on this issue.
Dave Powell, from Toothman-0rton Engineering, was sworn by the attorney.
Powell: What we are proposing is a multi phase development over 50 acres of land
which currently is in the County and we are asking that to be annexed in it's
entirety and allow us to develop this in the R-8 Zone, which conforms to the

Comprehensive Plan. When I say duplex I mean that we will have, we are proposing
to develop more of a townhouse type of affect rather than a duplex affect. We are
trying to create one unit that would have a zero lot line and individual owners.
This first phase has about 47 single lots on it, if we were to go to single family
based on the minimum square footage criteria we would reduce that down to about
forty one lots. If we get approval on the annexation we may increase the square
footage of those lots in order to further take advantage of the market that exists
right now. That is 211 total lots of development. I see this as possibly a four
phase development and certainly there is a possibility for these phases to be back
to back but I think there would be more consideration to the market rather than
just push one right after the other. We are proposing a green belt buffer around the
development. Part of the green belt is by ordinance in order to create a buffer to
the railroad we're proposing the create not only a burin but also a green belt zone
along the railroad tracks. At the time of the development we may also come in to
request a variance to place a fence on top of the burin. We also have the eight
mile lateral, we are proposing at least for the initial development on this side
of the eight mile to put a green belt and connect that out with Pine. Homeowners
would maintain the green belt. Lastly one of the conditions that was put upon us
by the Planning and Zoning was to restrict access to Pine throught the public right
a ways. Lastly the end areas, it's kind of up in the air right now, but those do
work well for retention ponds for storm water. That's just one possibility.
Kingsford: How tied down has P & Z put you in terms of that concept plan?
Powell: If we went with the entire development in the duplex mode we could certainly
get alot more lots out than we have. I don't think that the market over here would
ever yield itself to a total duplex mode.
Kingsford: I feel more comfortable with a planned unit development.
Powell: I understand your concern when you've got a multi-phase development plan
like this, you need to have a concept that you are fully comfortable with. Myself
and the developer are both comfortable with the layout of the streets and the overall
layout of the lots.
Kingsford: Again, I'd like to see some stipulation that they are owner occupied and
that we have some kind of control over that development as it proceeds. I have some
real problem with just granting an R-B Zone.
Giesler: What is the proposed square footage of the homes that you have planned?
Powell: Basically for now basically the square footage will meet that that is
required for the zone. We are trying to create something other than a minimum
housing area.
Tom Geile, 2150 West Pine, was sworn by the attorney.
Geile: Where do you intend to run the wastewater out of there?
Powell: It's going to be retained on site.
Geile: I didn't see anything in regards to duplexs in the information that we received.
I think that it has already been addressed.

Bob Strosser, 3165 N. Meridian Rd., was sworn by the attorney.
Strosser: This seems to [~ like it is really crowded. I just don't particularly
like the sounds of it very well. This sounds like the type of development that
will have alot of small children, and with the railroad right there.
Kingsford: I would like to enter into the record a letter received from the
Meridian School Board. Is there anyone else to testify, hearing no response,
I will close the Public Hearing.
Crookston: The concerns are adequatly addressed.
Giesler: I have a question regarding the zoning, I feel that we need to get that
up front right now. i also feel like we need to have a little control over what
happens out there. We have so many minimum square foot lots out there right now and
we have more waiting to come in front of us. I'm getting a little concerned about
having so many of them, I wish that we'd start working towards the larger lots and
larger homes.
Kingsford: I agree with Bob's comments.

Erv Sinclair, representing Marshall Smith. We've submitted a letter of application
to the Ada County Zoning and it has been approved by them.
Kingsford: This would be one split, and your talking about building another building
and it would be on a septic system because your over 300 feet from the sewer.
Crookston: You need to make it clear that you are dealing with this specific
occassion. Every application will be met on it's own, your not setting any particular
precedence on a split of this nature.
The Motion was made by Myers and seconded by Yerrington to approve of the waiver on
this particular parcel setting no precedence and setting no particular guideline
in the future.

Dear Mr. Niemann,
This planned residential development will accelerate the
need for Joint School District No. 2 to construct additional
classrooms and/or to adjust school attendance boundaries.
Meridian Schools does not have excess capacity. Nearly every
school in the district is beyond capacity.
The Meridian School District supports economic growth for
Idaho and specifically the district's area, but such growth
produces a need for additional school construction. We ask that
planning and zoning officials assist the district in obtaining
support for a development fee statute on new home construction
to help offset the costs of building additional school
facilities. We also ask that the same support for school bond
issues be required from developers and other interests seeking
planning and zoning approval for residential projects. If this
support is lacking then we ask that additional residential
development be denied.
Sch+llol bus service may be restricted if adequate
turnarounds and loading areas are not provided.
Residents cannot be assured of attending the neighborhood
school as it may be necessary to bus students to available
classrooms across the district.
Developers are strongly encouraged to provide walkways,
bike paths and safe pedestrian access to schools.

The Special Meeting of the Meridian Planning and Zoning Commission was called to order
by Moe Alidjani at 7:10 P.M., the Chairman arrived at 7:15 P.M.:

FINDINGS OF FACT & CONCLUSIONS OF LAW: LINDA J. ARNOLD:
Dave Powell: I am an engineer for Toothman Orton Engineering, representing Linda J.
Arnold. What we have is a multi phase concept of single family and we'll call it
duplex but they are actually a proposed to be the townhome type of development.
Explained landscaping plans and layout of this project. (TAPE ON FILE)
This will not be a low income development, this layout before you has 211 lots,
the initial phase that we want to go into immediately upon approval is 47 lots in
the first development.
Alidjani: I have a question for the attorney, don't they have to have a
variance to put a fence on top of a burin.
Crookston: Yes, you would have to obtain a variance.

Crookston: You need to make sure that the lots adjacent to Pine, you need to make
sure in your covenants that you can't have fences on those lot lines that are on
the north.
Powell: What I think we are trying to do is basically do a little bit of landscaping,
we aren't proposing right now to do any significant burming, however we might do
slight burming to give -

Commission hereby adopts and approves these Findings of Fact and Conclusions as written:

Applicant designate what areas would be single family development and what would be
developed as duplexes and then appropriate zones established. A concept plan for
development should also be presented to the City Council prior to final decision.

zoning was published for two (2) consecutive weeks prior to the
said public hearing schedule for February 12, 1991, the first
publication of which was fifteen (15) days prior to said
hearing; that the matter was duly considered at the February 12,
1991, hearing; that the public was given full opportunity to
express comments and submit evidence; and that copies of all
notices were available to newspaper, radio and television
stations.
2. That the property included in the application for
annexation and zoning is described in the application, and by
this reference is incorporated herein; that the property is
approximately 50 acres in size; that it is a rectangular parcel
of land with regular boundaries; it is adjacent to and on the
south side of Pine Street and it has frontage along Pine Street;
the property is east of Linder Road but does not abutt Linder

9, That the Application requests Lhat the parcel be
annexed and zoned as set forth in paragraph 3 above and the
Applicant proposes to develop the property in the fashion
allowed in the requested zone, with some single family
dwellings and some duplex dwellings; that the Applicant did not
present a development plan.

would be obligated to provide, at a minimum, police and fire
protection services.
11. That the property can be serviced with City water and

14. That the R-4 Low Density Residential District is
described in the Zoning Ordinance, 11-2-408 B. 1. as follows:
(R-4) Low Density Residential District: The purpose
of the R-4 District is to permit the establishment of
low density single-family dwellings, and to delineate
those areas where predominately residential
development has, or is likely to occur in accord with
the Comprehensive Plan of the City, and to protect the

integrity of residential areas by prohibiting the
intrusion of incompatible non-residential uses. The
R-4 District allows for a maximum of four (4) dwelling
Municipalr Water and Sewer systems not tt~he Citytof
Meridian.
15. That the (R-8) Medium Density Residential District is
described in the Zoning Ordinance, 11-2-408 B. 2. as follows:
(R-8) Medium Density Residential District: The
purpose of the (R-8) District is to permit the
establishment of single and two (2) family dwellings
at a density not exceeding eight (8) dwellings per
acre. This district delineates those areas where such
development has or is likely to occur in accord with
the Comprehensive Plan of the City and is also
designed to permit the conversion of large homes into
two (2) family dwellings in well-established
neighborhoods of comparable land use. Connection to
the Municipal Water and Sewer of the City of Meridian
is required.
16. That the predominant residential land use in the area
is single family dwellings.
17. That proper notice was given as required by law and
all procedures before the Planning and Zoning Commission were
given and followed.
18. That there was no testimony at the hearing objecting
to the Application.

1. That all the procedural requirements of the Local
Planning Act and of the Ordinances of the City of Meridian have
been met; including the mailing of notice to owners of property
within 300 feet of the external boundaries of the Applicant's
property.
2. That the City of Meridian has authority to annex land
pursuant to 50-222, Idaho Code, and pursuant to 11-2-417 of the
Revised and Complied Ordinances of the City of Meridian; that
exercise of the City's annexation authority is a Legislative
function.
3. That the Planning and Zoning Commission has judged
this annexation and zoning use application by the standards
contained in Section 50-222, Title 67, Chapter 65, Idaho Code,
the Meridian City Ordinances, Meridian Comprehensive Plan and
the record submitted to it and things of which it can take
judicial notice.
4. That all notice and hearing requirements set forth in
Title 67, Chapter 65, Idaho Code, and the Ordinances of the City
of Meridian have been compiled with.
5. That the Commission may take judicial notice of
government ordinances, and policies, and of actual conditions
existing within the City and State.
6. That the land within the proposed annexation is
contiguous to the present City. limits of the City of Meridian,
and the annexation would not be a shoestring annexation.
7. That the annexation application has been initiated by

the Applicant and the owners, and the annexation is not upon the
initiation of the City of Meridian.
8. That since the annexation and zoning of land is a
legislative function the City has authority to place conditions
upon the annexation of land pursuant to 67-6512, Idaho Code, and
Section 11-2-418 D of the City Zoning Ordinances.
9. That the development of annexed land must meet and
comply with the Ordinances of the City of Meridian and in
particular Section 11-9-616 which pertains to development time
schedules and requirements; that the Applicant, at her own cost,
will be required to connect to Meridian water and sewer upon
development; that the property will be subject to the
requirements of the Ada County Highway District, and the
requirements of the Central District Health Department, the
Nampa and Meridian Irrigation District, and the comments of the
City Engineer.
10. That since the Applicant's property is in the Narrior
Neighborhood as designated in the Comprehensive Plan, the
annexation and zoning Application is in conformance with the
Comprehensive Plan.
11. That it is concluded that the annexation and zoning
would be in the best interests of the City of Meridian.

Ordinances of the City of Meridian, it is ultimately concluded
that the annexation of the Applicant's property is reasonable
and is in the best interests of the City of Meridian and that
Applicant's property should be annexed and zoned, the exact
zoning to be investigated and determined by the City Council;
that the conditions should be those stated above and other
conditions to be explored at the City Council level; that such
annexation would be orderly development and reasonable if the
conditions are met.

This letter is a request for a special Planning and Zoning Public
Hearing for final commission action on. the above referenced
annexation application. The owner is trying to obtain approval
from the commission and inove•on for Council approval in order to
complete development plans and still meet a reasonable
construction season this year. Your agreement for this special
hearing will allow the owner to move up this schedule by as much
as one month.
The public hearing for this project was held on Tuesday, February
12th, at which time the commission directed the City Attorney to
compile findings of fact and conclusions of law. There was no
public testimony given opposing the project. The only testimony
was my project description on behalf of my client, Linda Arnold.
The commission members had very little comment on the proposed
project. Main concern was to the type of proposed housing and to
the project layout. Since the hearing, I have discussed the
concerns with Mrs. Arnold and have the following to offer:
The proposed development will consist of a mix of single family
and duplex units. This project is not doing to be a low income
HUD development. All housing will be single ownership housing
with the duplex housing being townhouses, rather than single
family rentals. Mrs. Arnold told me that her desire was to
create a desirable living community.
I am pre~3aring a concept layout indicating lot, block and street
orientation and proposed first phase construction. This layout
will be available for commission Leview prior to this hearing or
during the hearing. Mrs. Arnold will also be in town for this
period and will be present to answer any additional questions the
commission might have regarding the development plans.

I have discussed the possibility of this special hearing with Mr.
Crookston. He informed me that he would have ample time for the
preparation of the findings of fact and conclusions of law. I
understand that special hearings are a burden oontbehalf ofsmyn
members, but respectfully request this hearing sneering
client so that we might proceed on with the project eng'
design. Your consideration of this request is greatly
appreciated.

ITEM #1: PUBLIC HEARING: REQUEST FOR ANNEXATION 6 ZONING BY LINIDA ARNJLD:
Johnson: I will now open the Public Hearing, is there someone from the Public who
would like to come forward and addess the Commission, if so please come forward and
be sworn.
Dave Powell, 1802 N. 33rd St., was sworn by the attorney.
Powell: The project is a fifty acres parcel, located on Pine a short distance
west of the intersection of Linder Road and Pine. The proposal will be to develop
the fifty acre site into multiply phase single family development. It is proposed
at this time to have the project zoned R-8 in a hope that we can have some kind
of a mix that we can have some duplex and some single family residential.
Rountree: You indicated there would be a mix of residential either duplex or:
single family dwellings do you have a concept plan?
Powell: Not at this timie. We are waiting until we find out whether or not we get
annexation before we actually do any conceptual planning. We are going the R-8 Zone
because it allows the duplex and single family developments without requiring any
of these special provisions in this ordinance, so that's the zone that we are
requesting at this time.
Rountree: With the Duplex Concept your looking at rental or owner occupied?
Powell: I don't believe that there will be any rental concept. I don't know whether
or not from a sales standpoint whether she would consider writing in special provisions
that the rental situation would be excluded.
Rountree: What kind of financing have you considered or have you considered financing
types for this?

Powell: Right now I not completely clear on what the developers mode of financing
is. Mrs. Arnold and her husband are moving to Boise to finance and see the
construction for the first phase and I don't know whether she has financing taken
care of at this time.
Rountree: Did you see the comment from the City Engineer that would indicate that
there would be no direct access from any lots on Pine Avenue?
Powell: Yes. No problem with access.
Rountree: Does the presence of the road create any grief with the way you propose
to develop?
Powell: I put a couple of concepts before the owner, one of which would be to
possibly do a slide over X on the streets and actually create an earth and burin along
the Railroad and then possibly even a wooden fence to give further sound barrier. We
have also discussed having a slight green belt around the perimeter, which would also
outline the existing eight mile lateral to give a slight buffer in that area to.
Johnson: Anyone else to testify? Hearing no response, I will close the Public Hearing.
Rountree: It would be nice to have a more concrete concept before we advance it through
the zoning.
The Notion was made by Rountree and seconded by Alidjani to have the attorney prepare
Findings of Fact and Conclusions of Law.

ITEM #2: FINDINGS OF FACT & CONCLUSIONS OF LAW ON REQUEST FOR PUD GENERAL BY GEMTONE,
INC.:
Rountree: I think the conclusions should be amended to reflect that access on
Fairview be limited to no more than #4, accesses that would jointly serve adjoining
subdivison parcels.
The Motion was made by Rountree and seconded by Shearer that the Meridian Planning
and Zoninq Commission hereby adopts and approves these Findings of Fact and Conclusions.

and Zoning Commission hereby recommends to the City Council of the City of Meridian

NOTICE OF PUBLIC HEARING
NOTICE IS HEREBY GIVEN pursuant to the Ordinances of
the City of Meridian and the laws of the State of Idaho,
that the Planning & Zoning Commission of the City of
Meridian will hold a public hearing at the Meridian City
Hall, 33 East Idaho Street, Meridian, Idaho, at the hour of
7:30 o'clock p.m., on Tuesday, February 12, 1991, for the
purpose of reviewing and considering the Application of
Linda J. Arnold a/k/a/ Guandolyn J. Arnold for annexation
and zoning of approximately fifty (50) acres in a portion of
the North 1/2 of the South 1/2 of Section 11, Township 3
North, Range 1 West, Boise Meridian, Ada County, Idaho,
generally known as 2024 West Pine, Meridian, Idaho, and is
generally located between Linder Toad and Tenmile Road and
between Pine Avenue and the railroad tracks. That the
Application requests annexation with zoning of R-8.
A more particular legal description of the above
property is on file in the City Clerk's office and is
available for inspection during regular business hours.
A copy of the full text of the Application is available
at City Hall, 33 East Idaho Street, Meridian, Idaho.
Any and all interested persons shall be heard at said
public hearing and the public is welcome and invited to
submit testimony.

16. A fee as established by the Council; (see 2-922 A)
17. A statement that the owner grants a lien against said property
for payment of all costs incurred by the City including engineer-
ing, publication and attorneys fees.
18. Tire property will be posted 1 week before hearing stating
they have applied for a Conditional Use Permit or Zoning.
There must be a signed affidavit that this has been done as
pact of the application.
PROCEDURES FOR ANNEXATION 6
1. The Applicant Shall:
a.
Give notice of the hearing, at least fifteen~15) days
prior to the hearing, by certified mail to property
owners within the land being considered and to owners
within 300 feet of the external boundaries of the land
being considered. Said notice of certified mail must
be deposited with the United States Post Office at
least 15 days prior to the hearing. Said notice shall
contain a vincinity map of the property, a brief state-
ment of the nature of the application, the name and
address of the applicant.
b. Provide the City Clerk with the names and addresses of
property owners notified, a notarized statement of
complaince and a copy of the notification.
2. The Commission Shall:
a. Conduct at least one public hearing at which interested
persons will have the opportunity to be heard. At
least 15 days prior to hearing notice of the time and
place shall be published in newspaper.
b. Within 95 days after hearing the Commission, shall
transmit its recommendation to the Council with supp-
orative reasons, the Commend shall recommend the
application be approved, approved with conditions or
denied. The Commission shall insure that any approval
is in occordance with the Comp Plan, this Ordinance
and State Law.
3. The Council:
a. The Council shall conduct one public hearing after notice
requirements as above.
b. After hearing the Council shall approve, approve with
conditions or deny, with supporative reasons.

The following information is the description of the proposed
development project as required in the application for annexation
approval and zoning.

30. The site is relatively flat and lies within the cities
proposed Warrior District which is proposed for middle density
residential living.
11. This development is in Ada County, but contiguous with the
existing Meridian City Limits. The surrounding area is primarily
agricultural with scattered residential development conforming to
the proposed land use.

13. Required copies of the 1" 300' Vicinity Map are attached.
14. A list of the property owners which are within a 300 foot
radius of the proposed development are attached.
15. The subject property is in strict conformance with the City
