1 would like to take this opportunity to offer a couple of
comments with regard to Merrywood Subdivision. Historically it
seems the real estate community and development community often
forgets to advise homeowners of surrounding property uses or if
so advised it is done verbally and glossed over. Given these
circumstances it seems to me that it would be in the City's best
interest to require both developers and realtors to disclose
verbally and in writing (perhaps via the protective covenants and
restrictions) that the properties to the south are zoned for
Industrial ~.rses as Linder Industrial Park and that the 200'
railroad right-of-way has been designated by the Meridian
~lr-ansportation Task Force as a corridor that is to remain in tact
so that it can serve the following functions:
1) Commercial passenger service i. e. Rmtrack
c') Freight service to Meridian Industrial Parks
and onto Boise Industrial Parks.
~) Rs a site for an inter-City mass transit system.
4) Rs a sight of an inter-City bike lane system.
Given these facts it seems to me that the developers of Merrywood
S~_i6division should be responsible for adequate screening on the
southern boundary of their project and that such screening be
adequate for not only present uses but the potential future uses.
Home buyer°s should be advised of present and future uses so that
the City of Meridian does not have to be involved in future
disputes such as the Hoff Lumber problem.

The Motion was made by Yerrington and seconded by Tolsma to approve Final Plat on
Chateau Med. #5&6 conditioned upon approval of the covenants, the water problem
taken care of and Gary's approval of the development plans and the fence being built.

ZTEM #3: PUBLIC HEARING: PRELIMINARY PLAT OF MERRYWOOD SUBDIVISION:
Kingsford: At this time I will open the Public Hearing and invite the developer
up to speak.
John Matzinger, 3198 Falling Brook Lane, Boise, was sworn by the attorney.
Matzinger: I am with Toothman-0rton Engineering in Boise. Have been working closely
with City Engineer and have complied with all of the requests.
Giesler: Have you seen the recommendations from Ada County Highway District?
Matzinger: Yes we have.
Giesler: Has there been any change in that street alignment across from that home
they were concerned about the lights shining into their home in the evening?
Matzinger: We presented a written response to that. We will use the tree groves
to make an attractive entrance. Our suggestion to the Highway District is that if this
really does become a problem that possibly something could be done on the other side of
the road through a small burm with dense bushes and so forth.
Tolsma: It's not directly across it's just a little bit more west. Also received
another letter from a homeowner on Franklin that he would like to make it known in
your covenants over there that the railroad tracks and anything south of the tracks
is all industrial area. We have had some noise problems in an industrial area down-
twn here. Also that is a transportation corridor where the railroad tracks are and
is future development and he would like to make that known.
Matzinger: If the Council see's fit I'm sure Mrs. Arnold would entertain that
suggestion. Explained plans for a small burm.
Kingsford: Anyone else to offer testimony on this issue? Hearing none I will
close the Public Hearing.

for Merrywood Subdivision.

Kingsford: I will now open the Public Hearing on this issue and invite the developer

Johnson: I have just one question for Jack

Tolsma: Have you seen the Engineer's comments on here and they have all been taken
care of.
Johnson: Yes, I believe so. On the Jackson stub drain, have we had any problems
on Gem Park with that 24" pipe?
Eng. Smith: Not that I know of.
Kingsford: The other question that I had is if you made contact with the other people
out there that own the additional five acres there?
Johnson: Yes.
Kingsford: They did not want to be.
Johnson: They did but they got back to me so late by the time I got to Jack with
the request we didn't have time to give the Public Notice. It is my understanding
that they intend to go ahead with that, he would like to develop it himself. The
only thing I have to do with this parcel is get the water over to the school, they are
the only ones using that irrigation system that is there.
Kingsford: Anyone else who wishes to testify? Hearing no response I will close the
Public Hearing.

Johnson: I will now open the Public Hearing, is there someone from the public who
would like to come forward and testify?
John Matzinger, Consulting Engineer with Toothman-0rton Engineering, 1802 N. 33rd,
was sworn in by the attorney.
Matzinger: We have received the comments from staff. At this point and time we
project approximately 173 lots over about a 50 acre parcel. About five or ten
acres of the property will end up in common space, it will end up as a berm. We
have relocated the entrance somewhat along West Pine. We've tried to hold the
lots at 6500 sq. ft. or better.
Johnson: Is that your minimum lot size?
Matzinger: That's about mid average.
Rountree: Clerk Niemann what is the minimum lot size?
Niemann: Six thousand.
Hepper: What's your designation for building sizes on the lots?
Matzinger: We will use the Meridian Standard.
Hepper: Meridian has got two different standards, one is either 1300 and above
or the other one is mixed square footage on a percentage.
Matzinger: We were looking at percentage wise. Are we required to use one or the
other?
Johnson: You have to fit within one or the other.

Matzinger: I think we are fitting within the mixed one.
Hepper: Did you see the comments from the City Engineer?
Matzinger: Yes, we have been working closely with the City Engineer.
Hepper: The Fire Department and emergency services on your phase over there where
it only has one access, they don't have a problem with that?
Matzinger: I don't think so, we haven't had any negative comments. We have
been working with ACRD, they rejected us but that was because we were over 100 lots.
They have a new requirement for a traffic study on any si:bdivision over 100 lots.
F~ h3ve oalvio~ them that the first phase being only 50 lots will have a minimal
impact and we agreed to provide the traffic study prior to commencing future phases.
Johnson: Have you worked out something with the developer for the street lights?
Matzinger: We still have to do that.
Johnson: With respect with the comment made by the school district, did you
discuss that at all with the developer?
Matzinger: My interpretation is that they are all in favor of the building, but
they would like some money to help them with a school site.
Matzinger: We are really not prepared to comment on the full impact of it, but
practically speaking when we do these things, we do homes, homes have families and
they do go to school, somehow that need has to be met.
Rountree: I have a question concerning the berm on the back portion of the parcel,
it shows that there is an easement for a berm, is that going to be constructed as
part of the development?
Matzinger: We've had some design problems and some practical problems with that.
One of the things that we've leared is that berms & greenway work good along front
lots or on lots that are long thorough-fairs, it serves two purposes. One you
usually generate some excavation and it's a good place to get rid of your excavation.
Two it provides a buffer between the traffic noise and three it's in an area where
we can put money into it, it pays back dividends to the City as well as the developer.
It provides nice back yards. The negative side about putting burms on the side and
back yard lot lines is, well at least one of the thoughts here was the perception that
there would be a walkway back there. We found in those walkway situations that
people generally don't like folks walking in their back yards. We've gone to the
point of fencing them and we've ended up with situations where we've had two
parellel fences. Explained further. (Tape on File)
Rountree: Is it going to be up to the homeowners or are you going to do it?
Matzinger: We will do some.

Matzinger: The perimeter fence will be a homeowner construction item. We intend
to control the size, shape and texture and uniformity through the covenants.

Crookston: Has the School District done some forcasting as to where they would
like some future school sites?
Liehe: Yes.
Crookston: Is there one in this area?
Liebe I don't know where they are. We do not come before you to oppose growth.
Hepper: If the developer did set aside some property, is there any insurance that
the school district would buy this property?
Liehe I think to long of a range might be dangerous. A three to .five year plan
we can be pretty acurate.

Dear Mr. Niemann,
This planned residential development will accelerate the need
for Joint School District No. 2 to construct additional.
classrooms and/or to adjust school attendance boundaries.
Meridian Schools does not have excess capacity. Nearly every
school in the district is beyond capacity.
The Meridian School District supports economic growth for Idaho
and specifically the district's area, but such growth produces a
need for additional school construction. We ask that planning
and zoning officials assist the district in obtaining support
for a development fee statute on new home construction to help
offset the costs of building additional school facilities. We
also ask that the same support for school bond issues be
required from developers and other interests seeking planning
and zoning approval for residential projects. If this support
is lacking then we ask that additional residential development
be denied.
School bus service may be restricted if adequate turnarounds and
loading areas are not provided.
Residents cannot be assured of attending the neighborhood school
as it may be necessary to bus students to available classrooms
across the district.
Developers are strongly encouraged to provide walkways, bike
paths and safe pedestrian access to schools.

On June 20, 1991, the Commissioners of the Ada County Highway District
(hereafter called "District") approved the Preliminary Plat as stated below:
FACTS & FINDINGS:
1. Merrywood is a 173-lot single family residential subdivision located on
50-acres on the south side of Pine Avenue, west of Linder Road;
8,510-feet of new public streets are planned.
2. Pine Avenue is a mid-section line road requiring 60-feet of right-of-
way. Pine has 50-feet of right-of-way and is improved with 24-feet of
paving. ACHD has an overlay scheduled for this street in August
1991. Any anticipated utility and sewer connections for subject project
should be completed before the overlay begins, because the District will
not allow any street cuts for five years afterwards.
3. The proposed street names "Breckenridge" and "Mineral Wells" have too
many letters and will not be accepted by the District.
4. The easterly entry street is lined up opposite an existing house on the
north side of Pine. Vehicle headlights will shine into the house at
night. Staff recommends the proposed street be realigned to alleviate
this situation.
5. The project is a significant traffic generator and a traffic study will
be required.
SITE SPECIFIC CONDITIONS:
1. Dedicate 30-feet of right-of-way from the centerline of Pine abutting
parcel .
2. Curb, gutter, 5-foot sidewalk and match paving shall be constructed on
Pine abutting parcel. Improvements shall be constructed to a 41-foot
back-to-back street section.

3. Direct lot or parcel access to Pine is prohibited, in compliance with
District policy. Lot access restrictions shall be stated on the final plat.
4. Submit a traffic evaluation study showing future traffic volumes and
circulation movements at the main intersections.
STANDARD CONDITIONS:
1. Street and drainage improvements required in the public right-of-way
shall be designed and constructed in conformance with District stan-
dards and policies.
2. Dedicated streets and drainage systems shall be designed and construct-
ed in conformance with District standards and policies.
3. Specifications, land surveys, reports, plats, drawings, plans, design
information and calculations presented to ACHD shall be sealed, signed
and dated by a Registered Professional Engineer or Professional Land
Surveyor, in compliance with Idaho Code, Section 54-1215.
4. Written approval shall be obtained from the appropriate irriga-
tion/drainage district authorizing storm runoff into their system.
5. Obstructions (utility facilities, irrigation and drainage appurtenances,
etc.) shall be relocated outside of the proposed street improvements.
Authorization for relocations shall be obtained from the appropriate
entity.
6. Existing irrigation and drainage systems shall be continued across par-
cel .
7. Three sets of street construction plans shall be submitted to the Dis-
trict for review and appropriate action.
8. Site drainage plans and calculations shall be submitted for review and
appropriate action by ACHD. The proposed drainage system shall con-
form to the requirements of Boise City Code Section 9-20-8.5 and shall
retain all storm water on-site.
9. Driveways shall be located a minimum of 5-feet from the side lot proper-
ty lines.
10. Developer shall provide the District with a copy of the recorded plat
prior to the installation of street name signs.
11. A right-of-way permit must be obtained from ACRD for all street and
utility construction within the public right-of-way. Contact Quality
Control at 345-766? (with zoning file number) for details.
12. A request for modification, variance or waiver of any requirement or

On June 20, 1991 , the Commissioners of the Ada County Highway District
(hereafter called "District") approved the Preliminary Plat as stated below:
FACTS & FINDINGS:
1. Merrywood is a 173-lot single family residential subdivision located on
50-acres on the south side of Pine Avenue, west of Linder Road;
8,510-feet of new public streets are planned.
2. Pine Avenue is a mid-section line road requiring 60-feet of right-of-
way. Pine has 50-feet of right-of-way and is improved with 24-feet of
paving. ACHD has an overlay scheduled for this street in August
1991. Any anticipated utility and sewer connections for subject project
should be completed before the overlay begins, because the District will
not allow any street cuts for five years afterwards.
3. The proposed street names "Breckenridge" and "Mineral Wells" have too
many letters and will not be accepted by the District.
4. The easterly entry street is lined up opposite an ekisting house on the
north side of Pine. Vehicle headlights will shine into the house at
night. Staff recommends the proposed street be realigned to alleviate
this situation.
S. The project is a significant traffic generator and a traffic study will
be required.
SITE SPECIFIC CONDITIONS:
1. Dedicate 30-feet of right-of-way from the centerline of Pine abutting
parcel .
2. Curb, gutter, 5-foot sidewalk and match paving shall be constructed on
Pine abutting parcel. Improvements shall be constructed to a 41-foot
back-to-back street section.

3. Direct lot or parcel access to Pine is prohibited, in compliance with
District policy. Lot access restrictions shall be stated on the final plat.
9. Submit a traffic evaluation study showing future traffic volumes and
circulation movements at the main intersections.
STANDARD CONDITIONS:
1. Street and drainage improvements required in the public right-of-way
shall be designed and constructed in conformance with District stan-
dards and policies.
2. Dedicated streets and drainage systems shall be designed and construct-
ed in conformance with District standards and policies.
3. Specifications, land surveys, reports, plats, drawings, plans, design
information and calculations presented to ACHD shall be sealed, signed
and dated by a Registered Professional Engineer or Professional Land
Surveyor, in compliance with Idaho Code, Section 54-1215.
4. Written approval shall be obtained from the appropriate irriga-
tion/drainage district authorizing storm runoff into their system.
5. Obstructions (utility facilities, irrigation and drainage appurtenances,
etc.) shall be relocated outside of the proposed street improvements.
Authorization for relocations shall be obtained from the appropriate
entity.
6. Existing irrigation and drainage systems shall be continued across par-
cel
7. Three sets of street construction plans shall be submitted to the Dis-
trict for review and appropriate action.
8. Site drainage plans and calculations shall be submitted for review and
appropriate action by ACRD. The proposed drainage system shall con-
form to the requirements of Boise City Code Section 9-20-8.5 and shall
retain all storm water on-site.
9. Driveways shall be located a minimum of 5-feet from the side lot proper-
ty lines.
10. Developer shall provide the District with a copy of the recorded plat
prior to the installation of street name signs.
11. A right-of-way permit must be obtained from ACRD for all street and
utility construction within the public right-of-way. Contact Quality
Control at 345-7667 (with zoning file number) for details.
12. A request for modification, variance or waiver of any requirement or
policy outlined herein shall be made, in writing, to the Manager of

Dear Members of the Commission:
We are submitting herewith for your review and approval, our
Application and support documents covering the Merrywood
Preliminary Plat and Merrywood Phase I.
We would ask that your review and approval of these items be
approached concurrently since a good deal of the preliminary layout
and design was accomplished during the recent rezone of the
property.
The Preliminary Plat considers 173 single family lots with an
additional 9 parcels to be dedicated for open space or right-of-way
uses. Phase I will take advantage of the existing grove of trees
and preserve them as part of the project entrance. This entrance
area will be held in common ownership and maintained by the
property owners association. Additional phases will continue this
open space along West Pine Avenue, providing it with earth berming,
landscaping and a meandering walkway/jogging path.
It is anticipated that construction on Phase I will commence
in July of this year, readying 50 lots for a late summer/early fall
marketing program. Early construction is also necessary to allow
underground improvements to occur on Pine Street prior to the ACHD
overlay program scheduled for this summer.
The following Statements of Compliance are offered in
accordance with the Ordinance Requirements:
1. All street improvements are to be constructed in
accordance with the Standards of the Ada County Highway
District and the City of Meridian Ordinances. All
sidewalks in the public right-of-way will be 5 feet in
width.

2. The uses as set forth in the Merrywood Subdivision are in
compliance with the City of Meridian Comprehensive Plan.
3. Existing utility services will be extended to the
Merrywood Subdivision which will, in turn, connect to
Meridian City public water supply and sanitary sewer
systems.
4. The design of the development will be in compliance with
Meridian City Ordinances.
Easements will be shown on the Preliminary Plat where
known. One of the purposes of routing the Preliminary
Plat will be to gain input from utility providers and
others which may require right-of-way or easements in
which to place their facilities. All easements will be
made a part of the Subdivision plats.
Street names shown have been selected by the
Owner/Developer. However, it is understood that any
conflict with the Meridian City Grid System will require
an appropriate alteration of these names. Please make
changes known to us as soon as possible such that all
documents will have the correct name.
The development features will include the following:
a. A land plan which is in harmony with the
surrounding neighborhood, the site itself, the
Meridian Comprehensive Plan and ordinances, the Ada
County Highway District Standards and good
engineering and design practice.
b. All utilities will be installed in accordance with
the Standards of the City of Meridian and the
utility providers. Easements will be provided
where necessary.
c. The drainage system for the development will
generally follow the current lay of the land and
runoff, if any, will exit the property in a
controlled manner at the current general locations.
Through site irrigation systems will be preserved,
major canals will be fenced.

d. The south boundary of the development lying
adjacent to the Union Pacific Railroad right-of-way
will be bermed using onsite earth materials. CC&Rs
will promote a uniform type and height of fencing
on all exterior lines of the development.
e. Landscape and open space is being provided at the
entrance and along the frontage of West Pine
Avenue, as well as the western end of the
development adjacent to Pine Avenue. These areas
will be attractively bermed using onsite earth
material and planted in trees, shrubs, ground cover
and grasses. These improvements are planned to
enhance the attractiveness of the Pine Avenue
frontage, provide a buffer to the housing units and
provide an attractive linear park like atmosphere
equipped with a 5 foot wide meandering sidewalk for
walking or jogging. Landscape areas will be fitted
with an underground sprinkler system and will be
maintained by the Homeowner's Association.
f. In addition to the public water supply, the lots
will be furnished with an irrigation water supply
through an underground pipe network and pumping
system deriving its source from either an onsite
well or existing irrigation facilities.
