We are in the process of getting together funds for a building project. We did sell our building that was at Carlton and 2 1/2 Street. We are now renting the Methodist Church and they have given us the use of that facility for one year. In the meantime we are trying to get the funds together and we are having an architect draw up some plans. We've got Briggs Engineering doing our site work and one of the things we discovered as we got into this project which we were not aware of is the fact that we would be required to do curbs gutter and sidewalk and extend the asphalt out to the existing road. That was something that when we purchased the property we were not aware of. This is going to put a financial burden on us that's MERIDIAN CITY COUNCIL NOV. 6, 1991 PAGE 25 going to be quite difficult to bear. The options that we see is either we will have to delay construction for possibly one or two years and face the rising construction costs when we do begin building. Or perhaps we will have to borrow more money which will take our monthly expenditure ^uch higher than we can reasonably afford. We are willing to work with the City. What we would like to do is give you a number of options, of course you can tell us none of them and we will just have to bite the bullet. What we would like to do is ask that you not require us to do curb, gutter and sidewalk along either the Cherry or along the Ten Mile, that's our first request. The second request would he that perhaps if you do require us to do it along Cherry you wouldn't require us to do it along Ten Mile. If you do require us to put it along both we'd ask that perhaps you give us maybe two years or sore period of grace so that we could continue our construction plans and get into our facility. Along with that which we think would he very helpful is if you would •aybe give us that same two year period of grace on the required parking lot. Kingsford: I want to state publicly that we appreciate your portion in donation of the well site to the City. It's a real asset to the City and we do appreciate that. I think it would be my opinion that we do require that. I think that I'd have no problem with a time period. Discussion. I am pastor of the Meridian Seventh-day Adventist church, and the issue that I would like to address deals with the property we purchased through Mr. Rich Allison nearly 3 years ago. This property was purchased for a new church facility. Evidently Mr. Allison did not know at that time that this parcel would be incorporated into the city of Meridian, and that when it was, we would be required to make certain improvements in order to use the site. Of course I am referring to moving the existing irrigation canal, which we have done at a cost of X10,600.00 and curb, gutter, and sidewalk, plus extending the asphalt roadway from our curb to the existing street. If he would have known that, and could have told us that, perhaps we would have looked elsewhere for a piece ofi property that we could have build upon more economically, or perhaps we would have gotten on the ball and built earlier as the Church of Christ did so that these requirements would not have been made upon us. At any rate, we have tried to cooperate with these additional requirements in every way. And it has been our policy to cooperate as much as we can. It was our pleasure to work with the city of Meridian in deeding a part of our property to the city so that a well could be dug which would result in water fior hundreds ofi Meridian residents. And we are benefiitting already from that cooperation in having a water hookup ready to go, and a fire hydrant at no cost to us. We think that this sort of working together is what makes a city strong. ~ That is why we feel comfortable asking the city council to consider a plan whereby we can better afford to build our church in the near future. We have been scraping the bottom personally and corporately in order to raise the necessary monies to build the structure itself. And gratefully we are nearing that goal. If our members continue to sacrifice as they have been, we will have all the money we need for the structure by next April when we are planning for work to begin. In the past few weeks that because of the required to make ~~~`~~.. ~`7?~ we have learned for the very first time incorporation/annexation process, we are these expensive improvements. That ..- i~_ approximately $40,000.00 represents the giving of our church members to the building Rind over about 3 years.. We have many generous members, but none of us are wealthy. And this is either going to force us to delay our building plans for quite some time, and of course face higher building costs when we do begin building, or to borrow more money increasing our monthly budget by an additiory~800.00. The danger of having an open ditch and little ones around convinced us right off that the ditch needed to be moved and exchanged for underground piping. Hut the curb, gutter, and sidewalk, and asphalt are the items that we want to address at this time. We are asking the city of Meridian to help us by not requiring us to put it around our property. This will save us nearly $30,000.00, and relieve our dilemma. We are aware that Mr. Hunemiller is being required to do this around Sunburst, but he no doubt knew about this when he purchased the property which makes a difference. We hope that you will make this concession for us. But if not, please consider two additional alternatives'(ki~~A' 0 ~o~ 1. rather than requiring the curb/Zjutter/sidewalk to be constructed along both Cherry and 10 Mile, permit that we -eei~s construct it only along Cherry. This would save us nearly 50% of the total cost. 2. rather than requiring that we construct it immediately, give us 2 or more years of grace to raise the money to build it. An especially helpful option would be to give us grace on both the curb/gutter/and sidewalk, and on the required parking lot paving for 2 or more years. Then when we had the money we could have both major items constructed at the same time. And until that time, gravel driveways and parking lot would get us by. Mayor Kingsford: We will take up at this time an item that was not on the agenda. Giesler: Presented a placque to Roy Porter for the time he spent with the City and wished him good luck. Porter: The past four years have been a pleasure. Mayor Kingsford: Item #1: Request for split of parcel by Rich Allison & Dedication of well site for the City of Meridian: Rich do you want to address that issue. Allison: Originally Jack Niemann asked me about working with the City and providing a well site out on the property that was acquired by myself and the Seventh Day Adventist Church. Since that time I went ahead and with an Engineer drafted the lot with a legal easement as well as the legal parcels themselves it would be two specific parcels which would be well lot north and well lot south with two 25' easements on the north and south and would be described as separate parcels because they belong to separate parties, myself and Seventh Day Adventist Church. They would be offering half and I would be offering half. In addition to that based on the water and soforth being put in I have also requested a lot split of the 1.6 acres that I aquired which would be a 25' easement going into parcel B as well as parcel B. Kingsford: Any questions of the Council for Rich? There were none. We appreciate your willingness and the church's willingness to proceed xith this, it's going to be a great help to us. I do have one question that the attorney brought up today with regard to what kind of a deed are we looking at? Allison: Either a warranty deed or a quick claim deed, it's immaterial to us. The legal's I provided Jack, if you haven't seen them. Ccookston: I'd like to get a warranty deed but do you have a recent title report on it7 Allison: I have one that's from October of last year, but that wouldn't be, that would be for my property and for the church, it would be a separate policy of title insurance for my property and then one for the church. Is the 50' going to be wide enough for a private road? Allison: The 50' is sufficient certainly for a private road but it's also wide enough to dedicate at some point in the future. The only reason I really did it was that if the church wants to later subdivide the property when sewer is put in as far as that back portion which would allow them to build a house for their minister and so forth. Kingsford: I would entertain a motion be made. The Motion was made by Tolsma and seconded by Morrow to approve of this lot split and dedication by Rich Allison. Motion Carried: All Yea: Item #2: Pre-termination Hearing: Water/Sewer/Trash Delinquencies: Mayor Kingsford: You have been informed in writing, if your choose to, you have the right to a pre-termination hearing before the Mayor & Council, to appear in person to be judged on facts and defend the claim made by the City that your water, sewer & trash - bill is delinquent. You may retain Coungel. Is there anyone in the audience who wishes a pre-termination hearing? Would you please come forward and state your name. Linda Owsley, I moved into my house in November, and my water bills were like $20.80 every month, and then my bill for March was $128.20 for one month. They've come out and done all sorts of checks and there is no leak but they still say I have to pay the $128.20. Gary Smith: Since Linda was not there in January & February of 1988 they used the average or the usage over that month of the previous owner. They billed her for 5,000 gallons in January and 4100 gallons in February, the meter was read in March, we have done leak checks and checked the meter and there is no explanation for the usage. Giesler: How can it differ that much? Myers: Have we had any others in that area that have had that problem? Mayor Kingsford: We have had four or five of these that we have no explanation for. With the approval of the Council i would like to ask you to allow Gary and i to review this situation at a convenient time that you could come in and strike an agreement. Myers made a motion to do this. Kingsford: is there anyone else who wishes a hearing? There was no response. Due to their failure to pay their water bill or present any valid readon why the bill has not been paid, their water shall be turned off on May 10, 1989. In order to have their water turned back on, there will bean additional fee of $10.00: They are hereby informed that they may appeal or have the decision of the City reviewed by the Fourth Judicial Apirl 28, 1989 Meridian City Council Mr. President: we are requisting a lot division of our property on Ten Mile Road just north of Cherry Lane. It seen to me here that maybe sane of the energies are a little misdirected and being fran that building connnu~ity, one of the reasons we keep things simple here in Meridian is so we do ~t have the horrendous bureaucracies like they have in Boise. Those bureacracies are created by these kirxl of situations with everybody wanting to fudge a little bit. So it seems to me that the pceple with young families are entitled to have wood fences or any kind of fence to keep those children off of Franklin Road and with that in mind it sears the proper thing to do here for the builders and developers to put the buxm where it belongs, put the fencing where it belongs so it protects the residents children and so that it protects Mrs. Schlekeway's rights and that we ought to press on fran that standpoint. Everybody is free to ask for a Variance but I think in teams of me personally, I would be inclined to vote against it. Mayor Kingsford: Any other caiments, if not I would entertain a Notion. That the Planning and Zoning Commission has judged this annexation, zoning and conditional use application by the guidelines, standards, criteria, and policies contained in Section 50-222; Title 67, Chapter 65, Idaho Code, the Meridian City Ordinances, Meridian Comprehensive Plan as amended February 19, 1965, and the record submitted to it and things of which it can take judicial notice. 3. That all notice and hearing requirements set forth in Title 67, Chapter 65, Idaho Code, and the Ordinances of the City of Meridian have been complied with. 4. That the Commission may take judicial notice of government ordinances, and policies, and of actual conditions existing within the City and State. 5. That the land within the proposed annexation is contiguous to the present City limits of the City of Meridian, and the annexation would not be a shoestring annexation. 6. That the annexation application has been initiated by the Applicant, with consent of the owner, and the annexation is not upon the initiation of the City of Meridian. 7. That since the annexation and zoning of land is a legislative function the City has authority to place conditions upon the annexation of land and that the City of Meridian has authority to place conditions on a conditional use permit and the use of the property pursuant to 67-6512, Idaho Code, and Section 11-2-418(D) of the City Zoning Ordinances. 8. That 11-2-418(C) of the Revised and Compiled Ordinances of the City of Meridian sets forth the standards under which the Planning and Zoning Commission and the City Council shall review applications for Conditional Use Permits; that upon a review of those requirement's and a review of the facts presented and the conditions of the area, the Planning and Zoning Commission preliminarily concludes as follows: a. Sewer and Water: The attached maps show the property location with respect to existing water and sewer lines. Water: In accordance with City policyy when the property develops the water line shall be installed in Ten Mile Road, from Cherry Lane Road North to this property's north- west corner. Sewer: This property was intended to be served by a gravity line to be installed in Ten Mile Rd. This line was to extend from a point in Ten Mile Rd., just north of Eight Mile Lateral, to a connection in Woodmont Drive of the Cherry Lane Village Subdivision. (See attached sewer map). It seems to me, rather than having a series of individual subsurface disposal units, the sewage, disposal should-be handled by an extension of the gravity sanitary. sewer line as shown by our City wide Facility Plan. Perhaps a consortium could be put together consisting of Benj-Fran (and Paul White - Cherry Lane Village Subdivision); LDS Church; Stone mouse Church and the Seventh Day Adventist Church to construct this line extension. Off-Street Parking: The design of the parking area shall be in accordance with Sec. 2-414(D) of the Meridian Zoning and Development Ordinance. Provide 1 parking space for each 5 church seats. 4.
